    3.1 - Introduction:

    As an attorney on the sidelines, I have watched the drama unfold regarding Mark Owen’s (pseudonym name) decision to release a book entitled No Easy Day: The Firsthand Account of the Mission that Killed Osama Bin Laden.[1]

    His decision has brought with it a cauldron of firestorm and controversy. Yet, it is surprising how misinformed the general public is concerning the legal implications and broader public policy ramifications of that decision.

    It is within this context that I aim to quell the misinformation and analyze this controversy from a lawyer’s perspective.

    In this brief treatment, which I promise to keep as simple and short as possible, I will discuss the facts to date, review the relevant laws, review an exact replica of the Non-Disclosure Agreement that Mark Owen signed and outline the arguments that are most likely to be proffered by the US Government and Mr. Owen’s defense team in the, more-likely-than-not, impending show down of a Mark Owen’s criminal trial.     My story is unlike Mark Owen in that mine is a lot shorter, to the point, and is purely fiction published on May 09, 2011, a mere 7 days after the raid on Bin Laden’s Haveli Compound.

    It is interesting when you read it and compare some foreshadowing that in my apparent attempt at fiction appeared to be more non-fiction like the issue that has come to light that maybe Bin Laden was not buried at sea as we were lead to believe.[6]

    In any event, let’s get down to the heart of the matter. This analysis will focus on three issues. First, the pre-clearance debate analyzing all aspects of that debate, Second the issue of whether Mr. Owen divulged military secrets and Third, demarcating the battle lines in a possible criminal trial that if occurring would be heralded as the greatest trial of the 21st Century.

    3.2 - The Facts:

    Any proper legal analysis must focus on the facts because the facts drive the law, not the reverse.

    Law school professors drill this mantra into first year law students from the moment they enter the corridors of law school. Bear in mind that my analysis is what has been discovered and verified as facts up to the date of my penning this analysis.

    On January 24, 2007 Matt B. (initial used) signed two Non-Disclosure Agreements with the Department of Navy. [7]

    Matt B. was one of the Navy Seals on Operation Geronimo that killed Osama Bin Laden. [8]

    On or about April 20, 2012, Matt B. departed from active duty with the military. [9]

    He used the pen name Mark Owen to co-author along with Kevin Maurer, a book entitled No Easy Day: A Firsthand Account of the Mission that Killed Osama Bin Laden. [10]

    He submitted it to internal sources for vetting regarding whether it divulged military secrets. [11]

    On or about August 2012, Penguin publishing offered the book for pre-release ordering. [12]

    The book, originally scheduled for a September 11, 2012 release, was released on September 4, 2012. [13]

    The book has since skyrocketed to the top of Amazon’s Top 100 Ebooks list arguably fueled by the controversies. [14]
