After losing consciousness from hypothermia, the guards thought Bardes was dead. So, Bardes was shot to feign a reason for death being other than from hypothermia. But by beating 1 in 1,000 odds of survival from hypothermic coma, Bardes lived to teach himself the law, and litigate three Federal lawsuits over ten years to bring an end to hypothermic torture.
