KELSEN S PARADOX
Summary
Antinomical character of Kelsens Pure theory of law is best described with a syntagm consistent idealistic eclectism. This qualification
encompasses a rich philosophical and scientific background of Kelsens
normativism, but also the controversy of Kelsens work which deserves to
be regarded as paradoxical. This paper researches deeper into these controversies, i.e. Kelsens wondering and intellectual split between science
and philosophy, through a more complex insight into the socio-historical
context and the ideological climate that influenced his creative work.
