1 PLEASE TAKE NOTICE that, by submission to the Honorable Florence-Marie


2 Cooper of the United States District Court for the Central District of California,
3 Western Division, located at 255 East Temple Street, Los Angeles, California,
4 Defendants Donald C. Winter, et al., by and through their undersigned counsel, hereby
5 apply ex parte for a stay pending appeal of the Court’s January 3, 2008 Order Issuing
6 Preliminary Injunction (docket no. 91) (“January 3 Order”). Defendants’ respectfully
7 request a determination on this ex parte Application as soon as practicable and no later
8 than January 14, 2008 so that they may pursue an appeal of the Court’s January 3
9 Order prior to the start of the next scheduled exercise.
10 Notice of Application to Counsel. On January 4, 2008, in accordance with L.R.
11 7-19, Defendants gave notice to Plaintiffs’ counsel by electronic mail of Defendants’
12 intention to file this Application on January 7, 2008, between approximately 5:00 p.m.
13 and 12:00 a.m. Plaintiffs have indicated that they oppose this Application.1/
14 Defendants also provided notice to counsel on January 8, 2008, of Defendants’
15 intention to file this Application on January 9, 2008.
16 This Application is made pursuant to Fed. R. Civ. P. 62(c) and 62(e) and Fed.
17 R. App. P. 8(a)(1) and is based upon the accompanying Memorandum of Points and
18 Authorities; the accompanying classified evidence for which Defendants have
19 concurrently sought leave to submit for ex parte and in camera review; the
20 accompanying Declaration of Michael R. Eitel; the pleadings and other documents on
21 file in this action; and such other matters that the Court may consider or of which the
22 Court may take judicial notice.

Although the California Coastal Commission’s (“CCC”) status in this case is
unclear, see Defendants’ Response to the CCC’s Brief on Proposed Mitigation
27 Measures for Preliminary Injunction at 1 n. 1 (docket no. 78) (filed Dec. 21, 2007),
Defendants provided the CCC with notice of Defendants’ intent to file the instant
28 Application, and the CCC indicated that it would oppose this Application.
