COMES NOW, making a special appearance, Daniel Riley, acting in a sovereign
capacity, Sui Juris, not Pro Se repeat not Pro Se representing the fiction DANIEL,
RILEY, and files this notice of appeal. In no way can this notice be construed to grant
jurisdiction over the defendant, because the defendant's counsel still contends no
jurisdiction exist. In no way should this notice be construed to be considered a contract,
and ali rights are reserved at the common law UCC 1-308 and 1-103.6 without prejudice.
1. The defendant DANIEL RILEY files this notice of appeal through his
counsel Daniel Riley according to F.R.A.P. rule 3, 4(c) and 28 U.S.C. § 1292 to the First
Circuit Court of Appeals.
2. The defendant appeals the following two orders dated 01/24/08 and the
defendant was served on 01/26/08:
a Docket # 207 Denial of motion to dismiss for lack of
Jurisdiction, without any findings of fact, conclusions of law, no hearing, and no
‘opposition,
b Docket # 197 Denial of a constitutional challenge, without
any findings of fact, conclusions of faw, no hearing, and no opposition.
3. This appeal is taken from the U.S. district court for New Hampshire.
4, The defendant (appelfant) is an indigent inmate at the Strafford County
Jail, Therefore the defendant requests all filing fees to be waived.
