With refer to Contractors letter Ref.LJOTTMC1-14-084-CP3B dated 17th April 2014, we

would like to give following comments:

1. The Engineer has reviewed and satisfied with the technical data submitted by the
contractor, such satisfaction was mentioned in letter Ref.RPMU/CP3B/140412
dated 12th April 2014 and letter Ref.RPMU/CP3B/14018 dated 18th April 2014.
However, head hardened rail can only be applied with prior approval of Employer
on modification of Technical Specification related to Rail and Rail Connection. In
addition and for your information, recommendation on modification of Technical
Specification has been issued by the Engineer by letter Ref.RPMU/CP3A/140327
dated 27th March 2014.

2. If head hardened rail is approved by the Employer refers to technical aspect, the
Contractor shall be requested to prepare and submit proposal to apply head
hardened rail in term of additional cost and time extension for Engineers review
and acceptance.

3. The Contractor should note that any works performed by the Contractor before
specifications are approved shall be the Contractors risk.

Copies of all materials and production test results: these documents can be ontained from the
Company since it already carried these test as part of its QA/QC in accordance with ISO 9000
