(11) When in possession of dangerous drugs, penalty of life imprisonment and a ne of ve


hundred thousand pesos to ten million pesos regardless of the degree of purity.
(15) Usage of dangerous drugs shall be determined through drug tests (is positive or negative in
drugs) and penalty of six month rehabilitation in a government centre for the rst offence. If
apprehended for the second time penalty of imprisonment ranging from six years and one day to
twelve years and a ne of fty thousand pesos to two hundred thousand pesos.
(54) Drug dependents may apply to the Board in order to be subject to rehabilitation but must pass
through examinations made by a DOH accredited physician. If tests show he or she is drug
dependent, the court orders rehabilitation for the drug dependent in a rehabilitation centre which
isnt near the dependents residence.
(55) Drug dependent is exempted in from the criminal liability of section 15 if he/she complies to
rules and regulations, no charges under the Act, no attempts of escape and poses no serious danger
to himself.
