John Doe Order


Placeholder namesare words that can refer
to objects or people whose names are
temporarily forgotten, irrelevant, or unknown in
the context in which they are being discussed.
When an infringement is done by a person or
class of persons whose identity is unknown, a
John Doe order is issued to avoid delay and
render justice until such identity is known.

It is a form of an extraordinary equitable remedy
permitting the plaintiff to search and seize the
premises of the infringer with the intention of
preserving the evidence that may be destroyed.
Three step test laid out by Omrod LJ:
Extremely strong prima facie case against the
respondent
Potential or actual damage of extremely serious
nature
Clear evidence of possession of documents with the
respondent and a possibility of its destruction.

Mareva Injunction
Also known as a Freezing Order.
It is a temporary injunction that freezes the
assets of a party to an action pending further
order or final resolution by the court.
It prevents the dissipation of said assets
beyond the jurisdiction of the court in order
not to frustrate a potential judgment.
It is usually made only where the claimant can
show that there was at least a good arguable
case that they would succeed at trial.

Norwich Order
ANorwichorder is a pre-action discovery mechanism
that compels a third party to provide certain
information in its possession.
It is usedto obtain information which is in the
possession of a third party before
the
commencement of litigation.
Factors considered before a Norwich order is issue:
Bona fide or reasonable claim.
Establishment of a relationship with the third party and that
of its involvement.
The third party being the only source of the information
Whether the third party can be indemnified for costs to
which it may be exposed because of such a disclosure.
The interests of justice should be favoured by the
disclosure.
