Mareva Injunction
Also known as a Freezing Order.
It is a temporary injunction that freezes the
assets of a party to an action pending further
order or final resolution by the court.
It prevents the dissipation of said assets
beyond the jurisdiction of the court in order
not to frustrate a potential judgment.
It is usually made only where the claimant can
show that there was at least a good arguable
case that they would succeed at trial.
Norwich Order
ANorwichorder is a pre-action discovery mechanism
that compels a third party to provide certain
information in its possession.
It is usedto obtain information which is in the
possession of a third party before
the
commencement of litigation.
Factors considered before a Norwich order is issue:
Bona fide or reasonable claim.
Establishment of a relationship with the third party and that
of its involvement.
The third party being the only source of the information
Whether the third party can be indemnified for costs to
which it may be exposed because of such a disclosure.
The interests of justice should be favoured by the
disclosure.
