Pursuant to Local Rule 34(b) and the Courts Informal Briefing Order of
April 21, 2015, Breitbart.com submits the following in response to PlaintiffAppellant Brett Kimberlins Informal Opening Brief to clarify that this appeal of
the dismissal of Kimberlins federal claims against certain defendants does not
concern Breitbart.com.
Kimberlin has not asserted any federal claims against Breitbart.com, and his
four state-law claims against this defendant were dismissed without prejudice in
the District Courts March 17, 2015 order (the Order). Kimberlin has not asked
this Court to reverse the dismissal of the state claims (and in fact, he already has
refiled those claims in Maryland state court). This appeal focuses solely on the
dismissal of the federal claims, and to the extent this Court entertains Kimberlins
arguments seeking reversal of the Order as to those claims, Breitbart.com concurs
with the arguments advanced by other defendant-appellees and the reasoning of
Judge Hazels 37-page opinion. The District Courts Order should be summarily
affirmed.
