Re: Unauthorized Use of JOHN ADAMS Trademark

Lam writing to Jon Adams High School ("JAHS") dtectly because as far as T know
JAHS is not represented by counsel in the above matter. ITJAHS is represented by
‘counsel, please forward my letter to him or her for review and response.
(On behalf of my client, John Adams Academy, Inc. ("JAA"), Lam writing regarding
JAHS’ website located at johnadamshs.org and Facebook page,
facebook.com/JohnAdamsHS. According to these sites, JAHS is planning to open &
charter igh school under the name “John Adams High School.”
Please be aware that JAA has operated a K-12 charter school in Roseville, California
since 2010 and owns two federal trademark registrations for the mark JOHN ADAMS
ACADEMY, US. Registration Nos. 4,596,882 and 4,596,884. While JAA appreciates
‘and encourages other charter schools such as JAHS' planned one, it must ake steps to
protect its intellectual property. JAHS” use of “John Adams” runs the risk of eonfusing
students and parents interested in either schools and damaging JAA's “John Adams
“Academy” trademark. In fact, this is already occurring as JAA has received inquiries
‘fom parents mistakenly thinking that JAA is JAHS. While JAA is willing to work with
JAHS on a reasonable period for JAHS to transition to a new name JAA must insist that
JAHS adopt a new name that does not include “John Adams”, or any confusingly similar
znames, and cease use ofthe “Fohn Adams” mark
Please provide me, by May 27, 2015, written confirmation that JAHS will comply with
the above demands. While JAA looks forward to an amicable resolution ofthis matter,
itreserves its right to sec injunctive relief, damages and al other available relief if such
‘resolution is not forthcoming. Thank you for your prompt attention to this matter.
