The General Investigation and Ethics Board requested assistance from the Texas Rangers after a complaint concerning the validity of names on the list were brought forward by Transportation Committee Chairman Representative Joe PICKETT. DETAILS: 4.1 On 04-30-2015, during the 84th Legislative Session Transportation Committee Chairman Representative Joe PICKETT noted discrepancies related to the witness affirmation report. This report contained the names of witnesses who intended to make their opposition, support, or neutrality of House Bill 142. This witness list also contained information for those witnesses whom intended to testify as it relates to HB 142. Representative PICKETT found some of the persons whose names appeared on the list had not been present at the Capital on 04-30-2015. Representative PICKETT alleged Representative Jonathan STICKLAND may have tampered with the witness affirmation list by adding witness names without their presence in the Capital. The General Investigation and Ethics Board requested assistance from the Texas Rangers with this investigation. STATE OF TEXAS 0490/2015 ( Thursday) FREEMAN was assigned to the investigation. 1.2 On 07-24-2015, Texas Ranger Ike UPSHAW was assigned to assist Ranger FREEMAN in this investigation by Company "B" Headquarters. Ranger UPSHAW was provided a list of names and was tasked with locating individuals who resided in the Tarrant County area whose name appeared on the witness affirmation list. Ranger UPSHAW was instructed to ask the named individuals the following questions as needed: 1.* Did you register on the witness list? 2. sHow did you register, were you in Austin or did you register remotely? 3. *If you did not register, were you aware your name had been added to the witness list and how it might have been added? 4, *If you did not register, do you have any objections to your name being placed on the witness list? 4.3 On 07-24-2015, at approximately 11:11 AM, Ranger UPSHAW located Matthew James CHRISTENSEN (a white male, date of birth (MMMM) at his residence located at 7236 Cross Keys Drive in North Richland Hills. CHRISTENSEN was identified on the list as a legislative staffer. While preparing to interview CHRISTENSEN, he received a phone call from his attorney, Trey TRAINOR. CHRISTENSEN put Mr. TRAINOR on speakerphone and Ranger UPSHAW was allowed to listen to the conversation. CHRISTENSEN was advised not to speak to the Texas Rangers regarding this investigation and that all questions needed to be referred to him. Mr. TRAINOR provided Ranger UPSHAW phone number 512-623-6700. 1.4 After completing the conversation with his attorney, CHRISTENSEN asked Ranger UPSHAW what questions he would be asked concerning the investigation. When told he would only be asked if he signed his name to the witness affirmation list and if so where did he sign up, CHRISTENSEN agreed to answer both questions. Ranger UPSHAW advised CHRISTENSEN the questioning would be audio recorded. CHRISTENSEN advised that he did sign his name to the witness affirmation list in Austin where he works as a legislative staffer. On 07-27-2015, at approximately 11:50 AM, Ranger UPSHAW located Roberta Evelyn VALDERAS (a white female, date of birth MMMM) at her residence located at 612 Jacob in Keller. VALDERAS was made aware of the reason for Ranger UPSHAW'S presence at her residence. VALDERAS agreed to be audio recorded while answering questions regarding her name being placed on the witness affirmation list. VALDERAS confirmed she did sign her name to the witness affirmation list, which she stated she did through a conservative website. Ranger UPSHAW'S interaction with VALDERAS was cordial. On 07-28-2015, at approximately 6:00 PM, Ranger UPSHAW located Philip Aaron HARRIS (a white male, date of birth jm MMMM) 2 his residence located at 3609 Charles Street in North Richland Hills. Ranger UPSHAW approached HARRIS as he was getting out of his vehicle in the driveway. HARRIS appeared agitated from the onset. Prior to HARRIS arriving home, Ranger UPSHAW made contact with a white female who identified herself as HARRIS’S wife and a second white female who identified herself as HARRIS’S mother. Ranger UPSHAW was told that HARRIS was not home, but would arrive shortly. As Ranger UPSHAW approached HARRIS, Ranger UPSHAW observed that HARRIS appeared to be video recording Ranger UPSHAW with his cell phone. Ranger UPSHAW identified himself to which HARRIS replied, "Good for you." Ranger UPSHAW informed HARRIS he was there to speak to him concerning his name being on the witness affirmation list for HB 142. HARRIS declined to answer any questions and stated his belief that it was insanity for the government to send officers to harass citizens who petition their government. When Ranger UPSHAW told HARRIS the purpose of the questioning was to insure no one had signed his name without his knowledge, he responded the only person who had made such allegations was "Joe Pickett." Jason, who answered the door, was made aware that Ranger UPSHAW Was there to ask questions concerning the witness affirmation list for HB 142. Jason and Ali were questioned by Ranger UPSHAW concerning their name being on the affirmation list for HB 142. Jason and Ali both confirmed they did sign their name to the affirmation list in Austin, No further questions were asked of Jason and Ali. Ranger UPSHAW'S interaction with the BORENS was cordial. At approximately 7:10 PM, Ranger UPSHAW located Leah Elena MARCHAND (a white female, date of birth J) at her residence located at 1308 Stonehollow Court in Keller. Leah was made aware that Ranger UPSHAW was at the residence to ask questions concerning the witness affirmation list for HB 142. Leah could not recall if she personally signed her name to the witness list, but was aware that her name was on the list and had no issue with her name being on the list. Leah stated that she may have signed her name to the list while in Austin with her daughter, Lauren Elena MARCHAND (a white female, date of birth NNN), who is a legislative staffer. Ranger UPSHAW'S interaction with Leah was cordial. At approximately 7:34 PM, Ranger UPSHAW located Mark Dwayne CHRISTENSEN (a white male, date of birth MN) at his residence located at 7236 Cross Keys Drive in North Richland Hills. Mark is the father of Matthew CHRISTENSEN. Mark was made aware of the purpose of Ranger UPSHAW’S presence at his residence. Mark stated that his son Matthew signed his name to the witness affirmation list, he was aware of his name being on the list, and he had no issue with his name being on the list. No further questions were asked of Mark. Ranger UPSHAW'S interaction with both Mark and Matthew was cordial. Ranger UPSHAW made and retained audio recordings of all witness interviews on a compact disk (Exhibit #1.1).
