Ciristine Cummings (1RT016-27-LO}) had questions in reference to the


& desist letter that the Selectmen had sent to them, SelJctmen Garland explained

that the septic wasn't the problem but that the minimum land
area required was.
Selectmen Garland explained that when you combine both commercial
and residential
together that a lot size of 70,000 square feet would be needed, Chairman
Chandler made
mention that the Selectmen had gotten the opinion of the town's attorney
on this issue.
Lyons would like to have a person live on siie and have his cleaners coming
and going

from that location' Chairman Chandler explained that Lyons could run the
business but
couldn't have someone living there or he can have it be i residence, but can,t run
the
business out of there. Chairman Chandler also advised Lyons that he could go
to the
Zonng Board of Adjustment to see if they would grant a variance. Cumminis inquired if
was difficult to get a variance, Lynn Jones, AA, explained that a public

have to be held, abutters notified and that one problem would be that
the lot was
established after zoning went into effect, Lynn Jones, AA, will mail Lyons
the necessary
paper work and instructions on applying for a variance, Cummings
explained that the
business was conducted over the internet and that they have lock boxes for the people
to
pick up the keys' Lyons stated that it would not be thi customers but
the cleaners that
wouldcome and go. Cummings also stated that they have about 50 homes that they take
care of. Chairman Chandler suggested that they get the paper work for the zoning
board
of adjustment and to let the Selectmen think about what can be done, Chairman Chandler
inquired about a shed permit for Lyons that he had submitted, Lynn Jones, AA,
stated the
shed was there and that it does meet the set back requirements, Lyons mentioned
that he
could move the shed if it was a problem. A permit will be issued for the shed.

TerT Miller, White Mountain National Forest Service, stopped by to keep the Selectmen
updated about the timber sale activity on Jericho Road as biing about halidone.

also said that there was a small-scale timber operation going on in the Experimental
Forest up offBear Notch Road. Miller also informed the Selectmen that Robert

Forestry Enforcement Officer, has retired and that position is being advertising right
now.
Chairman Chandler inquired if Mr. E. Furlong, Lil;Man Snow
-aihine, had p-ermission
to use the Forestry land to conduct his business. Miller stated that this ir u gruy area and
that notices have been served, as he does need a permit. Miller informed the
Setectmen
that they are working on these issues, Selectmen Garland asked if peter Gagne, Northern
Extremes, has a permit. Miller stated that Gagne gives guided tours and that he
does
have a permit. Miller informed the Selectmen thai theyLe aware of the problems with
the snow machines and are working on these issues. ielectman Tanguayinquired if it
would be possible for the emergency rescue department to have a key to the ^for.rtry
service gate at the entrance to Bear Notch as right now they have no access without
cutting the locks when they have to respond to an emergency. Miller will take care of

police offtcers for the Bartlett Police Department. Leslie Mallett, town cierk, performed
the ceremony while family and friends looked on.

Selectman Garland made a motion at 09:30 AM to enter nonpubiic session to discuss a


request for aid according to RSA 91-A:3 (c). Selectman Tanguay seconded the motion.
Motion canied unanimously. chairman chandler made u *oiioo at 10:00 AM to end the
nonpublic session. Selectman Garland seconded the motion. Motion carried unanimously.

Terry Miller, U. S. Forestry Service, stopped by to see if the selectmen had any questions
or concerns. Chairman Chandler mentioned that he was surprised that they were logging
in the East Branch area in the summer. Chairman Chandler had thought it was only
allowed in the winter months and wanted to know if the selectmen had put any
restrictions on the permit. Miller stated that there were no restrictions and they were
allowed to log the area year round. Miller informed the board that they were atout to
round up the timber sales in Bartlett as there was only one sale left and that they would be
moving on to Jackson. The forestry is encountering problems in the Carter Notch area in
Jackson with the Sierra Club objecting to the logging and will probably end up going to
court. Lynn Jones, AA" inquired if he was aware of the intent to cut on the West Side
Road. Miller stated that he was. Chairman Chandler replied that it was his understanding
that it was to gain access to a land locked parcel. Miller confirmed that that was correct.
Miller also mentioned that they are working on relocating a snowmobile trail in the
Slippery Brook area that will be an alternate route to Chatham, etc. Miller also mentioned
that they are still working on the issues of snow machines on cross country ski trails on
the Bear Notch road as snow machines on sharp curvos with the skiers is a real problem.
Chairman Chandler inquired if Lil'Man Snd* Machine in Bartlett village had ever
obtained his permit for the use of the nation{l forest. Miller stated that he had not. Miller
informed the board that the forestry service has hired a new law enforcement offrcer,
Mark Magelise (sp), who would be starting in September and he will bring him around to
meet the selectmen. Miller also mentioned that Mr. Chrenko is appealinglhe Diana,s
Bath expansion. Chairman Chandler was pleased to hear this. There was a brief
discussion about the parking problems at Diana's Bath and about the fact that if they have
a toilet facility and trash receptacles then they have to charge a fee, but if they
have one
or the other there is no fee. Selectman Garland is surprised that there ur. not *or.
studies done as to how many people use an area.
Chairman Chandler made a motion at 70'.45 AM to enter nonpublic session to discuss a
personnel issue according to RSA 91-A:3 (b). Selectman Garland seconded the motion.
Motion carried unanimously. Selectman Tanguay made a motion at 11:30 AM to end

replied not that he knows of and if they were upp.ou.h.d they would
be
open to a cooperative agreement with the State. Selectman Garland
will let
them know that there are options and that they should get rn touch with
Mrller. Chairman Chandler also reminded Miller that the scemc turn outs
on
Bear Notch road need to be cieared. Mrller will check into this. It
was also
agreed that Miller and Chairman Chandler will take a look at some possible
other turn out sites on Bear Notch road as well as the Kanc.
Police Chref Timothy Connifey informed the Selectmen that he would
not be
at the annual Christmas Tree Lighting rn Bartlett on December l"
as he had
a pnor hockey cornmitment, however, officer Ed conley and
officer
Suzanne Scott would be there.

Lynn Jones, AA, and the Selectmen discussed putting tax information
on the
town website, but they aren't sure how to do this as some information
on the
tax bills is not public information. Chairman Chandler requested that
Jones
check with otirer towns to see how they do it.
George Howard (2RT302-60-R01) inquired when he would be hea'ng
from
Ellis Withington of Patriot Properties who was suppose to get back to him

reference to the v.aluation on his property. Lynn Jones,
explained that
Withington travels around a lot and is not in the office much and that it is
only because he started with us and knows the town so well that he
contmues working with us. Howard would like a date when he would hear
from withington and suggested that the Selectmen light a fue under
Withington Howard also mentioned that the current use on his fields

Chairman Chandler stated that he hadn't talked to NH DOT about cabins


and if Wilczek has questions that involve something he has said he needs to
come directly to him and ask the question. Chainnan Chandler stated that
according to the ruling from the Zonine Board of Adjustment that the snow
machines can't be driven off the site. Wilczek stated that the cabins have
always operated in the winter. Selectman Tanguay stated that the point is
that he is changing from summer storage to day to day operation which is a
different issue. Wilczek replied that it has always been used as commercial.
Chairman Chandler stated that atthe time of enactment of the Bartlen
Zoning Ordinance that the building in question was vacant. Wilczek inquired
how Bear Notch Ski Touring could rent skis and have a warming hut and
where was Selectman Garland. Chairman Chandler explained that Selectman
Garland had a prior commitment and had to leave the meeting early.
Chairman Chandler also stated that he hadn't said he couldn't have it but
that he needed a permit to have it. Selectman Tanguay replied that if the
building is going to be used as a winter office that they need to go to the
zoning Board of Adjustment. Wilczek stated it is a storage building.
Chairman Chandler stated that you can't store helmets, etc. that are
associated with the second business. Selectman Tanguay replied that he just
needs to go to the Zonrng Board of Adjustment. Wilczek stated that people
are watching him daily and he is using one building for the rentals where the
paper work is completed and the other building is for storage and to do
minor repairs as fixing tail lights, etc. on the snow machines and in his
opinion he is not breaking any laws as the Selectmen are defining what he
can put in a building and they can't do that and he guesses he will have to
take this to court.

Fire Chief L. Pat Roberts inquired about the decision the Selectmen had
made on the leffer he had received in reference to the Blueberry
Village/Attitash Mountain Village inspections of the buildings. Chairman
Chandler replied that nothing had been done yet. Lynn Jones, AA, stated that
Shawn Bergeron is doing inspections of the dormers at Attitash Mountain
Village now. Roberts inquired as to what his reply should be in reference to
the letter he had received about their phase in plans. It was agreed that
Roberts would instruct them to move forward with the phase in plans.
Roberts gave the Selectmen a report from Lakes Region Fire Apparatus on
the ladder truck inspection on the hydraulic leak as well as other problems

Meeting opened at 08:35 AM.
Annette Libby, Recreation Director, discussed the following with the
Selectmen: l.) The Rothen family has offered to donate a Christmas tree for
the Bartlett Village Park and Libby wanted to know what the Selectmen's
wishes were. She had thought about decorating one of the existing trees with
colored lights and the rest of the trees with white lights. Chairman Chandler
stated that he liked the tree to be in the center with colored lights and the
surrounding trees to have white lights. The Selectmen agreed that if a tree
has been donated that we should accept this donation. Libby also mentioned
that there is some discussion that the Bartlett Pre-school would like to sell
lights in memory of a loved one and the recreation department would get one
half of the money. 2.) Libby discussed a surveying letter she had received
from Thorne Surveys. Thorne Surveys will survey the Bartlett Blackfly ball
field for S1200.00 and one of the members of the Bartlett Water Precinct
agreed to pay this cost but one refused to sign and claims he can get it
surveyed for $300.00. Libby doesn't want to wait more than a week to get
going on this survey so she can start clearing brush and get ready to put the
dug outs in. 3.) Libby has seeked out several proposals for a shed and Lowes
offered a discount and she can get a precut shed for $3000.00. The shed will
need to be assembled. She has requested prices for garages and has not
received them yet. Selectman Tanguay suggested that she may want to move
the building and the shed could be moved where a garage would be on a
cement foundation. Chairman Chandler mentioned that a land swap with the
government may happen in the future which could affect the location of the
shed. Chairman Chandler suggested that she buy the shed and hire someone
to put it together. Selectman Tanguay would like to see an old fashion barn
raising happen to put the shed together. Selectman Tanguay also cautioned
Libby that not all kits would be made for the type of winters we have and
that she should check out the snow load capacity. 4.) Selectman Tanguay
inquired if the recreation department still had items stored at the Bartleff
Village fire station. Libby stated that she has just two large crates of baseball

Lyons stated that he would send a letter of the continuation of the project
and that one of the next projects is the tank and pump house at Karwendal
Strasse and the piping project that will go up Route l6 past Kringles Store,
to Nordic Village and Partridge Woods. The boring will be offthe pavement
on the left side of the road. Selectman Garland stated that this is the fype of
information that will help. Glines replied that January 1u they will get the
information to the Selectmen. Glines stated that he now has a better
understanding of what the Selectmen need and he doesn't feel it is
unreasonable. Glines inquired if the Selectmen had received any
misinformation from the current precinct board. Selectman Garland stated
not from the current board but they have had problems from the precinct not
being truthful about putting in pipe sleeves. Selectman Tanguay suggested
that they meet in December.
Selectman Garland made a motion at 10:00 AM to enter nonpublic session
to discuss a legal issue according to RSA 91-A: 3 (e). Selectman Tanguay
seconded the motion. Motion carried unanimously. Chairman Chandler
made a motion at lA:25 AM to end the nonpublic session and to seal the
minutes. Selectman Garland seconded the motion. Motion carried
unanirnously.
Chairman Chandler made a motion at 10:30 AM to enter nonpublic session
to discuss a personnel issue with the Bartlett Recreation Director according
to RSA 91-A: 3 II (a). Selectman Tanguay seconded the motion. Motion
carried unanimously. Selectman Tanguay made a motion at l0: 40 AM to
end the nonpublic session and to seal the minutes. Selectman Garland
seconded the motion. Motion carried unanimously.

Anneffe Libby, Bartlett Recreation Director, discussed that she would like to
keep the momentum going in reference to Thorne Surueys going ahead with
the surveying of the Blackfly ball field as she needs to have the pin set
before she can go ahead with the electrical setup. Libby had one Bartlett
Water Commissioner (Bob Blake) who was in favor of them paying for the
survey and one (Matt Howard) who claimed $1200.00 to do the sur-vey was
too much money. Chairman Chandler placed a telephone call to Matt
Howard and he was willing to commit to pay for half the survey and the
Bartlett Recreation Department will pay for the otherhalf.

Richard Wilczek (5VILLG-MAI-150) of Better Life Cabins would like to
resoive the situation of the use of a buiiding on his property. Selectman
Tanguay inquired as to which building he was referring to. Wilczek stated
that it is the one that is most westerly on his properb/. Selectman Tanguay
asked what Wilczek's interpretation was as to what the building's usage is.
Wilczek repiied that it is for storage but he would like to use it for his
snowmobile business. Wilczek also stated that the Town tax card has it at a
residential two bedroom home. Selectman Garland stated that he doesn't
know about that and u,ill have to check it out. Lyn r Jones, AA. explained
that it was only an assessing category and may not be the legal use for the
building but it was the closest assessing category to what it was at the time.
Wilczek stated that when he purchased the properf,v the building was used
for storage and he also had used it for storage of the snowmobile equipment.
Seiectman Tanguay replied that from what he has observed when he has
driven by is that he personally has gotten the impression that it appears to be
used not just for storage. Selectman Tanguay believes that Wilczek is
conducting a portion of the snowmobile business out of the building as it
appears it was used as a warming hut as well as for the sizing of snowmobile
heimets. Wilczek confirmed that he had been fitting people for helmets at
that location and that now he wouid like to resolve the use of the building
issue. Selectman Tanguay stated there are procedures that everyone has to
go thru. First of all you need to file a change of use of permit from storage to
a business which would be denied as it is not a permitted use according to
the Bartlett Zontng Ordinance and at that point he would go to the Bartlett
Zontng Board of Adjustment. Selecft{ran Garland further explained that the
snow machine business is a special exception and it is very limited.
Selectman Tanguay suggested that he re-evaluate his business to see exactly
what he would like to do at the property, Wilczek stated he would make out
the application for the change of use as he would like to use that building
independentiy. Seiectman Tanguay mentioned that Wilczek may want to
revierv just rihat the BartlettZomng Board of Adjustment had granted when
he received the first special exception from them. Ly.m Jones, AA,
explained that when the use of a building is changed it can change things

Ed Furlong of Lil'Man snowmobile Rentals (5RT302- 23lz6lLo0) was


served a cease and desist order from the Seiectmen in reference to
work he is
doing on the cabins on his property without a building permit, having
an off
premise sign, and parking snowmobiles, etc. in the green area
of his
business property because he ignored a prior letter on these
issues. Furlong
stated that he didn't add to the footprint of the building
and has only been
refurbishing the cabin for renting. Selectman Garland replied that
the last
time he knew that this unit was a storage shed. chairman chandler
instructed Furlong not to do any more work until he obtained a building

Police Chief Tirnothy Connifey met with the Selectmen to discuss a proposal
to upgrade the officers'dufy weapons through a trade program at Riley's
gun shop in Hooksett, NH. Riley's will take the current dufy pistol, the
Glock 9mrn which are approximately 9 years old and replace them with a
new Glock .40 caliber for $160.00 per gun provided our guns pass their
inspection process. We have six guns to upgrade and the cost to the
department would be $960.00 and the upgrade would not require any change
to our current ieather gear as the guns are the same size. Chairman Chandler
inquired as to how many guns the Town owns. Connifey replied that we own
five guns and that four other guns are owned by the offrcers as they don't
feel comfortable using ours. Chairrnan Chandler stated that he would prefer
that they carry our guns. Selectman Garland stated that he has no issue with
us purchasing the guns. Selectman Tanguay inquired if we purchase the guns
will the officers still carry their own guns. Chief Connifey replied that he
would prefer that they not do that. Chairman Chandler remarked that they
need to carry the proper gun and he would like the Chief to write a policy
that they tnust use town owned guns. Chief Connifey will take care of that.
Chief Connifey also stated that they are having problems with one of the
printers and the fypewriter in his office. The Selectmen agreed that it was ok
to purchase a new printer as it would be costly to repair the old printer and to
have the typewriter fixed.

Bartlett Recreation Director, Annette Libby, met with the Selecfmen to


discuss the following issues:
1.) She attended the Bartlett Village Water Precinct meeting when they were
discussing the Blackfly ball field She also requested that the Selectmen take
a real hard look at the documents that her husband; Steve, had found.sn the
Blbckfty ball field. The Seleotmen agreed to do that.
2.) Libby is having problems with some sfudents (both grarnmar and high
school) that are riding their bicycles on the new ice rink and may have
caused damage to the liner of the rink. These students have been spoken to
by both her and Vance Pickering, Athletic Director for Josiah Bartlett
Elementary School. One student in particular curses and swears at Libby

Terry Miller, US Forest Service, and Rick Garland (3RT302-176-R00)
met with the Selectmen in reference to Ricks Road where there is a beaver
pond and wetlands which are causing problems for Garland to gain access to
his property. Garland is applying to the State of NH Wetlands Board to
replace the culverts and regrade the road. He is working with the Department
of Environmental Services and wants to comply with all local and state laws.
Miller stated that the Birchview Homeowners Association is one of the land
abutters and thought they were on board with this project; however, they
have run into an obstacle as they have received threatening letters. They
have been threatened of being sued so they couldn't get a unanimous vote
from the association so it is all back in our laps due to a small group of
unreasonable people. Miller explained that at this point Garland is applying
for a waiver and he needs statements from the US Forest Service and from
the Town of Bartlett that states this is a class VI road. Selectman Tanguay
inquired if it was just the culverts that were being replaced. Miller replied
that it is the culverts and there would be some grading of the road done. The
beaver pipe would remain as is. Chairnan Chandler doesn't know if this is a
class VI road or a public highway and he would like the wording to coincide
with the prior court ruling. The Selectmen will write a letter of support and
attach the court decision.
Chairman Chandler made a motion at 09:35 AM to enter nonpublic session
to discuss a legal issue according to RSA 91-A: 3 (e). Selectman Tanguay

Attomey Rob Upton and Aaron Colaiuca met with the Selectmen to discuss
what Colaluca plans to do with the lot that is for sale that is adjacent to
observatory way. colaiuca went over some plans that he had brought with
him. colaluca has fwo concepts that he is looking at. The first one is to
build a business structure and have five tenants or so. Lynn Jones, AA,
infonned him that to do that he will need a special exception as fwo or more
business in one building is considered a shopping center. Colaluca replied
that it would not be retail business but wholesale. Chainnan Chandler
clarified that it is retail if someone goes in to buy something. The second
option is to build an indoor sports facility which would be a benefit to the
town. Chairman Chandler informed him that he would have to meet all the
state life and safety codes. Selectman Garland stated that he would also have
to go before the zoning board of adjushnent as he would need a site plan
review done. Selectman Garland also mentioned that he would need green
space area and that there is a limited access driveway. He would need to go
to the planning board to get them to grant permission to go thru the green
space.

Chris Marchioni of Storyland inquired if he needs to reapply for a permit


each year for the circus tent at Storyiand since they take it down in the
winter. The tent will be in the same space and nothing changes. The
Selectrnen agreed that he does not need to reapply each year, but it does
need to be inspected.

Annette Libby, Recreation Director, telephoned the Selectmen in reference


to a situation with a concert held in the park. She has received threatening
phone calls from M. Haber, Swingtones Music, as he claims that she agreed
io puy him $300.00 and he received a check for $225.00 and he is planning
oniui.ing her to small claims court if she doesn't pay him the balance due.
Selectman Garland inquired as to how much she pays everyone else' Libby
replied that they pay different amounts and that Haber had originally wanted
that he was
S4OO.OO but agreed to do it for $225.00. Libby also stated
contracted to fhy for the chicken barbecue and didn't show up. Libby will
be checking hir io.r.rpondence further but feels that if he accepted and
cashed the check that he has accepted payment.
Selecbnan Garland mentioned that the new fence at the Blackfly ball field
looks good and much beffer that the rocks that were there. Libby stated that
she wi]l take pictures of the fence and that the US Forest Service has
reblaz,edthe boundary line and has put the boulder back across the access.
Libby also rnentioned that she is planning on seffing up days in either september or october for tree planting and to get the field ready for FallThe Selectmen reviewed colrespondence, building permits, signed letters
and checks prior to and throughout the meeting.

more that wouid be going on. Lucy replied yes. and it starts next week.
Selecfrnan Garland inquired if the State was ok with his enfrance. Luc-"replied that at the time they are and if he has to put lights in in the furure he
will coincide with the tou.n since Toqn Hail road is there too.
3.) Seiecrman Gariand inquired from Lucy if he had fiiled out the State A-9
and A-12 form for nonprofit starus which has to be done annua111'and fi1ed
with the to$'n. Selecrrnan Tanguay stated that it makes a big dift-erence on
his taxes. Luc,v replied that he hadn't but he rvould. Lvnn Jones. AA.. gave
Lucy the A-9 and A- 12 form.
Annette Libby. Bartlen Recreation Director. met w'ith the Selectmen to go
over the following:
1 ) The Christmas tree lightrng is scheduled for Decernber,5" Selecnnan
Garland will get the ffee and Libb,"" will take care of decorating it.
r ) Libby would like to put the skanng nnk up in N4onument Park
provided there is room for it as it rvould be more visible. there is a fir-e
hydrant there as *'e1i as lighting. Libb,v u'ii1 also check rvrth the road
agent to make sure it is not an issue wrth pior,i'ing. Selectman Tangual'
inquired if she has issues of dead grass hke North Conrva.u- is
experiencing. Libb,v replied it wasn't a problem last vear. Selectman
Tanguay aiso inquired *'h,v the rink is not put up on school propeq,'.
Libb.v" didn't know. ChainTian Chandler inquired if rve could add on to
the skating nnk and make it bigger, Libbv stated that she u'ould need
more rnonev as she would have to purchase a ne\\' irner as it is one
solid unit and that would be the biggest expense

Mitigation Plan Development grant form. The Selectmen reviewed the form

Route 302 crossing we have nothing on and that Albany Avenue is our
problem. Gagne replied that if he can't cross he will have to trailer the
machines both ways. Selectman Garland stated that that doesn't stop you
from running your business and until January 15m he can't use the railroad
tracks anyways.
5.) Gagne inquired about the requirement to have Shawn Bergeron do an
inspection of the property. Chairman Chandler explained that a commercial
business has to have an inspection and that Gagne needs to fill out the
agreement form and return it to the offrce.
Chairman Chandler also explained that when Gagne receives his permit that
it will have conditions on it.
Gagne left the meeting and then reappeared inquiring why Better Life
Cabins wasn't required to have a green area. Chairrnan Chandler explained
that they did meet it and had put in a berm out front. Gagne than proceeded
to ask about the Rogerson lot in the middle of the village. He was informed
that they have already been sent letters addressing this issue.
Selecnnan Garland informed the others that Lil'Man Snowmobile Rentals is
plowing snow up in front of the gate to Blacldly field. It was agreed that
iince this is a State road that a leffer would be written to the State
concerning this issue.

Chief Connifey had obtained prices for a new computer as the one in his
office was not repairable. The Selectmen reviewed the prices and decided it
was okay for Connifey to order the computer from Computer Port.
The Selectmen reviewed colrespondence, building permits, signed letters
and checks prior to and throughout the meeting-

decided that until further notice that the Selectmen will prohibit
snowmobiles, all terrain vehicles, etc. from using Albany Avenue or the
sidewalks. Letters will be mailed to concerned parties.

Lynn Jones, AA, informed the Selectmen that she had met with the health
insurance representative from Local Government Center to obtain more
information about possible changes to our health plan.
The Selectmen requested Brenda Medeiros to contact the Jackson Selectmen
to see if they could meet on January 15t at 08:30 AM at Bartlett town hall
for a solid waste committee meeting.

Motion was made by Chandler, seconded by Garland to carry over all funds
from any 2009 warrant articles. Vote: approved.
The Selectmen reviewed cotrcspondence, building permits, signed letters
and checks prior to and throughout the meeting.

Town of Bartlett Office of Selectmen


Meeting Minutes: December 31,2009
Attendance: Chairrnan Gene Chandler, Douglas Garland, Jon Tanguay

Meeting opened at 08:00 AM.

Kathy Longnecker of the 2010 census bureau met with the Selectmen to give
them an overview as to what will be happening when they start taking the
census in April. At the present time they are having a diffrcult time getting
people to work and are looking for some guidance. Longnecker isn't sure
why but they have said they need782 people to canvas Bartlett, Jackson,
and Intervale as they did a general canvas of the area last year and this is
what the report suggested. Lynn Jones, AA, explained that when they
canvassed ihe urei ihey probably didn't realize that 75Yo of the homes are 2d
homeowners. SelectmanGarland stated that he would assurne they would be
taking the information from the primary residence and not the secondary
residence. Longnecker explained that they will mail out a form that will have
ten questions to answer and if they don't return the form they will have to
check to find out why they didn't return it. Chairman Chandler inquired if
they mail the forms and how they know if Mr. Smith who lives in Boston,
buf owns property in Bartlett if he makes out forms for both places how do
they know this. Longnecker explained that it is place specific and they
would go by a person's social security number and choose which one is the
residenie. Chairman Chandler stated that that could be a big problem for us
as the information may not be accurate. Longnecker inquired as to how she
should let people know about the test sites for employment. They pay S15.00
per
hour pius mileuge reimbursement. They need both full time and part time
-help.
They have to be l8 or older and need a vehicle. They will be training
in March and April 1't is the actual start date. The Selectmen suggested that
she put an ad in the local paper as well as in the Bartlett town column'
Selectman Tanguay had a prior commitment and had to leave the meeting at
09:05 AM.
Selectman Garland mentioned that the snowmobile corridor needs to be
discussed as snowmobiles, groomerso etc. are driving up Albany Avenue.
The road is the State's concem however the sidewalks are the towns and
people need to get permission from both the State and the Town to use the
corridor. A telephone call was placed to Selectman Tanguay and it was

Michael Weeks, District Supervisor-Bureau of Trails-DRED, David
Ainsworth, White Mountain Trail Club, Peter Gagne, Northern Extremes,
Gagne's attorney Peter Malia and Steven and Kimberly Ryan, Bear Notch
Deli met with the Selectmen in reference to the Selectmen closing the
Albany Avenue snowmobile corridor until a public meeting could be held.
Selectman Garland had received a letter from Gagne regarding Bear Notch
Ski Touring crossing the properly and step'ped down from the meeting.
Chairman Chandler apologized to the Ryan's that he had made out the list of
who should receive letters about the closure and he thought he had put them
on the list, but when checking further discovered he had not. S. Ryan stated
that he was shocked to hear that the Selectmen had arbitrarily closed the trail
without a discussion. Chairman Chandler stated that in our previous
discussions with Gagne that he had been told that the Selectmen's position
was to have a public rneeting. S. Ryan inquired why it was closed at this
point and time. Chairman Chandler explained that it was different
iircumstances now as the use had been intensified. Gagne stated that he was
the reason it was closed. Chairman Chandler reminded Gagne that the
Selectmen have let him operate his business and he has no permit to do so as
he has not met the conditions that the Zoning Board of Adjustment issuedGagne stated that he callecl the Bureau of Trails and they clairned the trail
*ui optn and they had no contact from the Selectmen. He had 12 people on
Sunday and 6 on Monday that used the corridor. They parked their snow
machines and either walked to Bart's Deli or he shuttled them there. Atty.
Malia inquired as to what ZoningBoard of Adjustment conditions weren't
being foliowed. Chairman Chandler stated that there were a few but the
primary ones were that Gagne must be the owner of the properfy and that he
have Town and State permission for the crossing. S. Ryan stated you just
arbitrarily took the trail away. Atty. Malia stated that the people who come to
the meeting would have more information if the trail was kept open till the
meeting sothey could see what type of use the trail gets. D. Ainsworth read
RSA 215-4: 6 title 9. Pursuant to RSA 215-A:15 city or town councils and
boards of selectmen rnay authorize the use of sidewalks and class IV,
