Selectmen Garland explained that when you combine both commercial
and residential
together that a lot size of 70,000 square feet would be needed, Chairman
Chandler made
mention that the Selectmen had gotten the opinion of the town's attorney
on this issue.
Lyons would like to have a person live on siie and have his cleaners coming
and going
from that location' Chairman Chandler explained that Lyons could run the
business but
couldn't have someone living there or he can have it be i residence, but can,t run
the
business out of there. Chairman Chandler also advised Lyons that he could go
to the
Zonng Board of Adjustment to see if they would grant a variance. Cumminis inquired if
was difficult to get a variance, Lynn Jones, AA, explained that a public

have to be held, abutters notified and that one problem would be that
the lot was
established after zoning went into effect, Lynn Jones, AA, will mail Lyons
the necessary
paper work and instructions on applying for a variance, Cummings
explained that the
business was conducted over the internet and that they have lock boxes for the people
to
pick up the keys' Lyons stated that it would not be thi customers but
the cleaners that
wouldcome and go. Cummings also stated that they have about 50 homes that they take
care of. Chairman Chandler suggested that they get the paper work for the zoning
board
of adjustment and to let the Selectmen think about what can be done, Chairman Chandler
inquired about a shed permit for Lyons that he had submitted, Lynn Jones, AA,
stated the
shed was there and that it does meet the set back requirements, Lyons mentioned
that he
could move the shed if it was a problem. A permit will be issued for the shed.
TerT Miller, White Mountain National Forest Service, stopped by to keep the Selectmen
updated about the timber sale activity on Jericho Road as biing about halidone.
Miller
also said that there was a small-scale timber operation going on in the Experimental
Forest up offBear Notch Road. Miller also informed the Selectmen that Robert
Smitb
Forestry Enforcement Officer, has retired and that position is being advertising right
now.
Chairman Chandler inquired if Mr. E. Furlong, Lil;Man Snow
-aihine, had p-ermission
to use the Forestry land to conduct his business. Miller stated that this ir u gruy area and
that notices have been served, as he does need a permit. Miller informed the
Setectmen
that they are working on these issues, Selectmen Garland asked if peter Gagne, Northern
Extremes, has a permit. Miller stated that Gagne gives guided tours and that he
does
have a permit. Miller informed the Selectmen thai theyLe aware of the problems with
the snow machines and are working on these issues. ielectman Tanguayinquired if it
would be possible for the emergency rescue department to have a key to the ^for.rtry
service gate at the entrance to Bear Notch as right now they have no access without
cutting the locks when they have to respond to an emergency. Miller will take care of
Terry Miller, U. S. Forestry Service, stopped by to see if the selectmen had any questions
or concerns. Chairman Chandler mentioned that he was surprised that they were logging
in the East Branch area in the summer. Chairman Chandler had thought it was only
allowed in the winter months and wanted to know if the selectmen had put any
restrictions on the permit. Miller stated that there were no restrictions and they were
allowed to log the area year round. Miller informed the board that they were atout to
round up the timber sales in Bartlett as there was only one sale left and that they would be
moving on to Jackson. The forestry is encountering problems in the Carter Notch area in
Jackson with the Sierra Club objecting to the logging and will probably end up going to
court. Lynn Jones, AA" inquired if he was aware of the intent to cut on the West Side
Road. Miller stated that he was. Chairman Chandler replied that it was his understanding
that it was to gain access to a land locked parcel. Miller confirmed that that was correct.
Miller also mentioned that they are working on relocating a snowmobile trail in the
Slippery Brook area that will be an alternate route to Chatham, etc. Miller also mentioned
that they are still working on the issues of snow machines on cross country ski trails on
the Bear Notch road as snow machines on sharp curvos with the skiers is a real problem.
Chairman Chandler inquired if Lil'Man Snd* Machine in Bartlett village had ever
obtained his permit for the use of the nation{l forest. Miller stated that he had not. Miller
informed the board that the forestry service has hired a new law enforcement offrcer,
Mark Magelise (sp), who would be starting in September and he will bring him around to
meet the selectmen. Miller also mentioned that Mr. Chrenko is appealinglhe Diana,s
Bath expansion. Chairman Chandler was pleased to hear this. There was a brief
discussion about the parking problems at Diana's Bath and about the fact that if they have
a toilet facility and trash receptacles then they have to charge a fee, but if they
have one
or the other there is no fee. Selectman Garland is surprised that there ur. not *or.
studies done as to how many people use an area.
Chairman Chandler made a motion at 70'.45 AM to enter nonpublic session to discuss a
personnel issue according to RSA 91-A:3 (b). Selectman Garland seconded the motion.

rephed that it might have been the State's groomer. The groomer

grooms Bear Notch road is looking for a place to park and didn't
know if it
would be an issue if they park up by where the Stite parked thers. IMrller
replied not that he knows of and if they were upp.ou.h.d they would
be
open to a cooperative agreement with the State. Selectman Garland
will let
them know that there are options and that they should get rn touch with
Mrller. Chairman Chandler also reminded Miller that the scemc turn outs
on
Bear Notch road need to be cieared. Mrller will check into this. It
was also
agreed that Miller and Chairman Chandler will take a look at some possible
other turn out sites on Bear Notch road as well as the Kanc.
Police Chref Timothy Connifey informed the Selectmen that he would
not be
at the annual Christmas Tree Lighting rn Bartlett on December l"
as he had
a pnor hockey cornmitment, however, officer Ed conley and
officer
Suzanne Scott would be there.
Lynn Jones, AA, and the Selectmen discussed putting tax information
on the
town website, but they aren't sure how to do this as some information
on the
tax bills is not public information. Chairman Chandler requested that
Jones
check with otirer towns to see how they do it.
George Howard (2RT302-60-R01) inquired when he would be hea'ng
from
Ellis Withington of Patriot Properties who was suppose to get back to him

reference to the v.aluation on his property. Lynn Jones,
explained that
Withington travels around a lot and is not in the office much and that it is
only because he started with us and knows the town so well that he
contmues working with us. Howard would like a date when he would hear
from withington and suggested that the Selectmen light a fue under
Withington Howard also mentioned that the current use on his fields

Fire Chief L. Pat Roberts inquired about the decision the Selectmen had
made on the leffer he had received in reference to the Blueberry
Village/Attitash Mountain Village inspections of the buildings. Chairman
Chandler replied that nothing had been done yet. Lynn Jones, AA, stated that
Shawn Bergeron is doing inspections of the dormers at Attitash Mountain
Village now. Roberts inquired as to what his reply should be in reference to
the letter he had received about their phase in plans. It was agreed that
Roberts would instruct them to move forward with the phase in plans.
Roberts gave the Selectmen a report from Lakes Region Fire Apparatus on
the ladder truck inspection on the hydraulic leak as well as other problems

Lyons stated that he would send a letter of the continuation of the project
and that one of the next projects is the tank and pump house at Karwendal
Strasse and the piping project that will go up Route l6 past Kringles Store,
to Nordic Village and Partridge Woods. The boring will be offthe pavement
on the left side of the road. Selectman Garland stated that this is the fype of
information that will help. Glines replied that January 1u they will get the
information to the Selectmen. Glines stated that he now has a better
understanding of what the Selectmen need and he doesn't feel it is
unreasonable. Glines inquired if the Selectmen had received any
misinformation from the current precinct board. Selectman Garland stated
not from the current board but they have had problems from the precinct not
being truthful about putting in pipe sleeves. Selectman Tanguay suggested
that they meet in December.
Selectman Garland made a motion at 10:00 AM to enter nonpublic session
to discuss a legal issue according to RSA 91-A: 3 (e). Selectman Tanguay
seconded the motion. Motion carried unanimously. Chairman Chandler
made a motion at lA:25 AM to end the nonpublic session and to seal the

Chairman Chandler made a motion at 10:30 AM to enter nonpublic session
to discuss a personnel issue with the Bartlett Recreation Director according
to RSA 91-A: 3 II (a). Selectman Tanguay seconded the motion. Motion
carried unanimously. Selectman Tanguay made a motion at l0: 40 AM to
end the nonpublic session and to seal the minutes. Selectman Garland
seconded the motion. Motion carried unanimously.
Anneffe Libby, Bartlett Recreation Director, discussed that she would like to
keep the momentum going in reference to Thorne Surueys going ahead with
the surveying of the Blackfly ball field as she needs to have the pin set
before she can go ahead with the electrical setup. Libby had one Bartlett
Water Commissioner (Bob Blake) who was in favor of them paying for the
survey and one (Matt Howard) who claimed $1200.00 to do the sur-vey was
too much money. Chairman Chandler placed a telephone call to Matt
Howard and he was willing to commit to pay for half the survey and the
Bartlett Recreation Department will pay for the otherhalf.

Bernard inquired about signage. Selectrnan Garland stated that the sign out
front would be grandfathered. Lynn Jones, AA, stated that she doesn't know
about the signage on the building as this has never come up before.
Attomey Rob Upton and Aaron Colaiuca met with the Selectmen to discuss
what Colaluca plans to do with the lot that is for sale that is adjacent to
observatory way. colaiuca went over some plans that he had brought with
him. colaluca has fwo concepts that he is looking at. The first one is to
build a business structure and have five tenants or so. Lynn Jones, AA,
infonned him that to do that he will need a special exception as fwo or more
business in one building is considered a shopping center. Colaluca replied
that it would not be retail business but wholesale. Chainnan Chandler
clarified that it is retail if someone goes in to buy something. The second
option is to build an indoor sports facility which would be a benefit to the
town. Chairman Chandler informed him that he would have to meet all the
state life and safety codes. Selectman Garland stated that he would also have
to go before the zoning board of adjushnent as he would need a site plan
review done. Selectman Garland also mentioned that he would need green
space area and that there is a limited access driveway. He would need to go
to the planning board to get them to grant permission to go thru the green
space.

Bartlett Recreation Director. Annette Libb,v. met u'ith the Selectmen and
gat'e them an update on the recreation golf tournament that il'as held on May
29''. Libbl'doesn't have all the figures rn yet but rt appears that the figures
riill be about the same as last year and be around $10.000.00. They did have

Libby aiso requested that the Selectmen set a date to hold a meeting with the
Bartlett Water Precinct and henelf to discuss the BartlettBlackfly,ball.field.
Libby would like to know where she stands with the snow machine iszues as
well as the plowing of snow onto the field before another winter arrives.
Selectman Garland stated that hopefully they will have the fence put up
before next year which should end'some of the,problems.rSelectman
Tanguay is concerned that they could still go around'the-fence. Libby
inquired if she needed a permit for fhe fence. It was explainedthat,'as.longas
the fence is not over 6'6" she didn't need a permit. Libby is planning on
purchasing the t-ence up tiont and then to seek a grant for reirnbursement of
the money. Selectman Garland,would like,to see'the rocks removed. to.,allow
for more parking as right now cars are parking on the roadside and this is
very dangerous. The rock issue will be looked at further. The Selectmen
agreed on a date of June l6'r'at 09:30 AN{ as a rneeting date rvith the Bartlett
Water Precinct commissioners and Libb,v who is anending their next regular
precinct rneeting rvill inquire from thern if this date is acceptable to them.

Mitigation Plan Development grant form. The Selectmen reviewed the form

Route 302 crossing we have nothing on and that Albany Avenue is our
problem. Gagne replied that if he can't cross he will have to trailer the
machines both ways. Selectman Garland stated that that doesn't stop you
from running your business and until January 15m he can't use the railroad
tracks anyways.
5.) Gagne inquired about the requirement to have Shawn Bergeron do an
inspection of the property. Chairman Chandler explained that a commercial
business has to have an inspection and that Gagne needs to fill out the
agreement form and return it to the offrce.
Chairman Chandler also explained that when Gagne receives his permit that
it will have conditions on it.
Gagne left the meeting and then reappeared inquiring why Better Life
Cabins wasn't required to have a green area. Chairrnan Chandler explained
that they did meet it and had put in a berm out front. Gagne than proceeded
to ask about the Rogerson lot in the middle of the village. He was informed
that they have already been sent letters addressing this issue.
Selecnnan Garland informed the others that Lil'Man Snowmobile Rentals is
plowing snow up in front of the gate to Blacldly field. It was agreed that
iince this is a State road that a leffer would be written to the State
concerning this issue.
Chief Connifey had obtained prices for a new computer as the one in his
office was not repairable. The Selectmen reviewed the prices and decided it
was okay for Connifey to order the computer from Computer Port.
The Selectmen reviewed colrespondence, building permits, signed letters
and checks prior to and throughout the meeting-
decided that until further notice that the Selectmen will prohibit
snowmobiles, all terrain vehicles, etc. from using Albany Avenue or the
sidewalks. Letters will be mailed to concerned parties.
Lynn Jones, AA, informed the Selectmen that she had met with the health
insurance representative from Local Government Center to obtain more
information about possible changes to our health plan.
The Selectmen requested Brenda Medeiros to contact the Jackson Selectmen
to see if they could meet on January 15t at 08:30 AM at Bartlett town hall
for a solid waste committee meeting.
Motion was made by Chandler, seconded by Garland to carry over all funds
from any 2009 warrant articles. Vote: approved.
The Selectmen reviewed cotrcspondence, building permits, signed letters
and checks prior to and throughout the meeting.

Kathy Longnecker of the 2010 census bureau met with the Selectmen to give
them an overview as to what will be happening when they start taking the
census in April. At the present time they are having a diffrcult time getting
people to work and are looking for some guidance. Longnecker isn't sure
why but they have said they need782 people to canvas Bartlett, Jackson,
and Intervale as they did a general canvas of the area last year and this is
what the report suggested. Lynn Jones, AA, explained that when they
canvassed ihe urei ihey probably didn't realize that 75Yo of the homes are 2d
homeowners. SelectmanGarland stated that he would assurne they would be
taking the information from the primary residence and not the secondary
residence. Longnecker explained that they will mail out a form that will have
ten questions to answer and if they don't return the form they will have to
check to find out why they didn't return it. Chairman Chandler inquired if
they mail the forms and how they know if Mr. Smith who lives in Boston,
buf owns property in Bartlett if he makes out forms for both places how do
they know this. Longnecker explained that it is place specific and they
would go by a person's social security number and choose which one is the
residenie. Chairman Chandler stated that that could be a big problem for us
as the information may not be accurate. Longnecker inquired as to how she
should let people know about the test sites for employment. They pay S15.00
per
hour pius mileuge reimbursement. They need both full time and part time
-help.
They have to be l8 or older and need a vehicle. They will be training
in March and April 1't is the actual start date. The Selectmen suggested that
she put an ad in the local paper as well as in the Bartlett town column'
Selectman Tanguay had a prior commitment and had to leave the meeting at
09:05 AM.
Selectman Garland mentioned that the snowmobile corridor needs to be
discussed as snowmobiles, groomerso etc. are driving up Albany Avenue.
The road is the State's concem however the sidewalks are the towns and
people need to get permission from both the State and the Town to use the
