Public Statement
On February 26, 2016 the Town of Morristown held an emergency meeting to
address the issue of the incorrect appointments of Supervisor Frank Putman and
Councilman Howard Warren in 2015. Due to the recent issue of another oath of
office that was not filed in a timely manner it was discovered that the same error
also occurred with these appointments. The Town Board wishes to rectify these
errors quickly and in compliance with the law.
In July of 2015 Supervisor Frank Putman tendered his resignation effective
07/18/2015. On 07/21/215 the Town Board appointed him for the balance of his
term. This was done to allow Mr. Putman to go off the payroll for 24 hours so he
could draw his retirement. He did not file an oath upon this appointment. As this
vacancy occurred before September 20", the Town Board should have appointed
him for the remainder of 2015, not for the entire term ending 12/31/2017. The
Clerk did not report the vacancy. The Supervisors position should have been on
the ballot in fall of 2015. Mr. Putman will have to run for a one year term of office
this year which will run 01/01/2017 - 12/31/2017.
In November of 2015 Councilman Howard Warren tendered his resignation
effective 11/03/2015. On 11/10/15 the Town Board appointed Mr. Warren for the
remainder of his term ending 12/31/2017. He also did not file an oath of office. Mr.
Warren resigned for the same reasons as Mr. Putman. The Clerk did not report
the vacancy. Because Mr. Warren’s vacancy occurred after September 20, 2015,
he will need to run for a one year term of office this year which will run 01/01/2017
= 12/31/2017.
The following steps need to be taken to remediate these errors.
1. The Town Board will appoint Mr. Putman and Mr. Warren for the remainder of
2016. Both will need to take and file their oath of office.
2. The Clerk will notify the Board and the Supervisor of the vacancies in writing.
3. The Clerk will notify the Board of Elections in writing of the vacancies, the
reason for them, and the length of the term. Both Mr. Putman and Mr. Warren ran
in 2013 for office. Their term is 01/01/2014 -12/31/2017. Thus they will run for a
‘one year term of office in 2016. This will preserve the staggered terms for Town
Board elective offices.
4. The Town Board will ratify all motions and resolutions from July 21, 2015
through February 26, 2016.
