On 10-22-2015, a Parker County Grand Jury reviewed this case and returned a ruling of no criminal responsibility on the part of WPD Officer Chris BROWN in the death of Randall WADDEL. File closed. On 06-23-2015, Texas Ranger Anthony BRADFORD began investigating an Officer Involved Shooting at the request of the Weatherford Police Department. Further details will be reported in subsequent reports in this file. On 06-23-2015, at approximately 11:10 AM, Texas Ranger Anthony BRADFORD was notified by Parker County Sheriff's Office (PCSO) Chief Deputy Russ AUTHIER that radio traffic indicated an Officer Involved Shooting (OIS) had just taken place at David's Western Wear on South Main Street in Weatherford. Ranger BRADFORD contacted Weatherford Police Department Chief Mike MANNING by cell phone. Chief MANNING had just arrived on the scene and confirmed an OIS had occurred, and that one male subject had been transported to Harris Hospital in Fort Worth with gunshot wounds. The involved Officer was identified as Christopher Lynn BROWN Officer MANNING stated the preliminary information was that the male subject had been armed with a knife and came at Officer BROWN while he was attempting to arrest him. Officer BROWN was being removed from the scene and would be taken to the WED station. Ranger BRADFORD was at the Palo Pinto County Sheriff's Office at the time of the notification, and responded to the WED, arriving at approximately 12:00 PM. Ranger BRADFORD met with Officer BROWN in a conference room. This would allow Officer BROWN to have the opportunity for two full sleep cycles before giving his statement, which allows for the most accurate recall of a stressful event according to Ranger BRADFORD'S training. Ranger BRADFORD provided Officer BROWN with his phone number in the event Officer BROWN elected to have an attorney represent him. 2.3 Ranger BRADFORD obtained Officer BROWN'S duty pistol, a Glock 22 .40 caliber, S/N# PXB559 (Exhibit #2.1), from Officer BROWN'S holster. The weapon slide had locked back during the shooting, and it was still in this condition in the holster, with no round in the chamber. (from Ranger BRADFORD'S experience and training, this was likely the result of Officer BROWN accidentally activating or pushing up on the slide release lever during the shooting, causing the slide release lever to catch the slide and stopping it from going forward) The weapon contained a magazine, which contained 14 rounds of live Speer Gold Dot ammunition (Sxhibit #2.2) The magazine holds 15 rounds, and Officer BROWN stated that he carries the weapon with one round in the chamber and the magazine full, for a total of 16 rounds. The weapon, magazine and ammunition were photographed (Exhibit #2.3), and was released to WPD Evidence Technician Tina MAXWELL, who placed the items in WeD evidence storage. 24 Ranger BRADFORD left WPD and went to the scene of the shooting at David's Western Wear. Ranger BRADFORD met with WED Detective Troy LURCKE, who provided the following briefing to Ranger BRADFORD: EMS and Weatherford Fire Department (WFD) were dispatched to a medical call at the Jiffy Lube, adjacent to David's Western Wear. A subject identified as Randall Tabor WADDELL, W/M, DOB 04-13-1966, had fallen in the parking lot and appeared to be in distress. EMS personnel arrived and WADDELL became uncooperative. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) 25 2.6 WADDELL'S breath, and suspecting he was intoxicated, requested WPD to the scene. WADDELL became more agitated and pulled out a knife and began walking toward David's Western Wear. WADDELL entered the store with the knife in plain view, causing the employees who saw him to run out of the back of the business. Officer BROWN arrived shortly afterward and gave commands for WADDELL to put the knife down. WADDELL ignored the commands and continued coming toward Officer BROWN with the knife in his hand. Officer BROWN was just inside the front door when he shot WADDELL. EMS was already on scene, and immediately began aid to WADDELL and transported him to Harris Hospital. Detective LUECKE informed Ranger BRADFORD that he and Detectives Jason GOFF, Chris BENIAK and Mark WOLFENBURGER had identified and taken either written or audio recorded statements from all of the witnesses known to be in the area at the time of the incident. Detective WOLFENBURGER was currently working with store management to obtain surveillance video from inside the store during the incident. (These witness statements and the surveillance video will be summarized in later details in this report) Ranger BRADFORD was approached by WED Officer / Crime Scene Investigator Angela MCCRORY, who was processing the crime scene. Officer MCCRORY advised she was at the point of beginning to collect evidence, and wanted to provide Ranger BRADFORD an opportunity to walk through the crime scene before removing any of the items. Ranger BRADFORD made a walk through of the scene and made the following observations: Crime scene tape was erected in front of the store and around the parking lot closest to the entrance to David's Western Wear. A lock blade knife (Exhibit #2.4) with a black handle, with the blade open and in the locked position, was in the parking lot, directly in front of the entrance. (Officer MCCRORY explained that one of the WFD Firefighters stated he kicked the knife away from WADDELL'S (030172016 10:32:50 AM TR (Rev. 02108) DPS SENSITIVE REPORT OF INVESTIGATION Page sof 28 ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) vicinity after he was shot, with the knife ending up in this position) Coagulated blood was observed on the outer sidewalk. Two WPD units were parked inside the taped off area. (Officer BROWN'S unit and a his shift Sergeant's unit) Just inside the door of the entrance, two .40 caliber shell casings (Exhibit #2.5) were observed on the deck of the show window to the right of the entrance as viewed from the inside. A large pool of blood was observed on the floor mat covering the tile floor just inside the entrance. After Ranger BRADFORD'S walk through, Officer MCCRORY began collecting and packaging the evidence from the scene, which included a back pack (Exhibit #2.6) left by WADDELL at the Jiffy Lube parking lot. Officer MCCRORY related that there were cans of Reds Apple Ale in the backpack, along with prescription medication. See Officer MCCRORY'S supplement to WED Incident Report # 1500022553 for details 2.7 Ranger BRADFORD made contact with Detective WOLFENBURGER, who was coordinating with David's management to obtain in store video surveillance of the incident. During this process, Ranger BRADFORD was advised that the two paramedics that originally encountered WADDELL and transported him to the hospital in Fort Worth, were back at the scene and had not been interviewed yet. Ranger BRADFORD identified the paramedics as Jonathan MARTIN, W/M, DOB JM, and Jon MOSHER, W/M, DOB (NNN. Ranger BRADFORD obtained audio recorded statements from both MARTIN (Exhibit #2.7) and MOSHER. (Exhibit #2.8) In the statements, both paramedics stated they were called to the Jiffy Iube due to a person fainting. They encountered WADDELL in the parking lot and detected an odor of alcohol on his breath. WADDELL fell while they were talking to him, and they asked him to stay on the ground while they assessed him. WADDELL did not want to go to the hospital. Both paramedics believed WADDELL was intoxicated, and they did not want to leave him to walk in public in that condition. When WADDELL heard them call for WED to come to the scene, WADDELL pulled a knife (unopened) (030172016 10:32:50 AM TRA (Rev. 02108) DPS SENSITIVE REPORT OF INVESTIGATION Page 6 of 28 ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. The paramedics and fire personnel stepped back at this time, and WADDELL turned and walked toward David's, opening the knife in his hand as he went. The paramedics followed WADDELL at a safe distance to keep him in visual sight for WPD. When the Officer (BROWN: arrived, WADDELL was at the back of the store. Officer BROWN told WADDELL to put the knife down and to stop WADDELL continued around the store and appeared he was going toward the front door. Both paramedics went out the front door of the store to avoid WADDELL. They then heard shots being fired and saw WADDELL fall to the ground just inside the front door. ‘They began treating WADDELL immediately and transported him to Harris Hospital in Fort Worth. For details, see Exhibits #2.7 and 2.8 28 While at the scene, Ranger BRADFORD was contacted by John SNIDER, an attorney obtained by Officer BROWN. Ranger BRADFORD went to WED and met with SNIDER and Officer BROWN. SNIDER agreed to make Officer BROWN available for the taking of a written statement on the morning of the 25th. SNIDER requested to go to the scene and view it in person. Ranger BRADFORD met SNIDER and Officer BROWN at David's Western Wear. By this point, the scene had been cleared and was no longer secured. SNIDER viewed the scene, and Ranger BRADFORD went to the back to check with David's management, about the in store video. (there were initial problems with getting the video downloaded, although it could be watched on the monitor) The General Manager from David's in Decatur, David CRADDOCK, W/M, DOB 08-28-1963, had arrived by this point and was in the process of downloading it for recording, although it was unknown if it would play correctly on computers available to law enforcement. In light of this, Ranger BRADFORD allowed SNIDER and Officer BROWN to view the incident on the monitor at David's. Ranger BRADFORD watched the video with SNIDBR and Officer BROWN. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) 29 210 Summary of David's surveillance video: WADDELL can be seen coming into the store, and David's employees can be seen running behind the counter and out the back entrance to the store. WADDELL follows and an object can be seen in WADDELL'S hand as he walks with his hands behind his back. WADDELL stops behind the counter and just stands looking forward for a few moments. EMS and fire personnel are seen coming into the store and staying at the front area of the store, away from WADDELL. A David's employee steps out of an adjoining room and is right behind WADDELL when he notices WADDELL and quickly moves away toward the front of the store. WADDELL begins to go to the back of the store, and Officer BROWN is seen coming in the front entrance. WADDELL begins to run / walk at a fast pace around the back of the store as Officer BROWN appears to begin addressing him. (no audio is available on the video Officer BROWN moves to the area of the front door as WADDEL makes his way to the front corner of the store and is coming down the aisle toward the entrance. As WADDELL is approaching Officer BROWN, Officer BROWN is obviously speaking to WADDELL with his pistol in a tactical low ready position. Officer BROWN fires two rounds as WADDELL comes to within approximately a few feet of Officer BROWN WADDELL goes to the ground and out of the camera angle at this point in the video. EMS and fire personnel then begin rendering aid to WADDELL. At the conclusion of observing the video, CRADDOCK provided Ranger BRADFORD with a USB thumb drive (Exhibit #2.9) containing the download of the in store video. Ranger BRADFORD left David's Western Wear and returned to WED, where the thumb drive was given to Detective BENIAK. Detective BENIAK confirmed the surveillance video would play on his computer, and provided Ranger BRADFORD a DVD copy (Sxhibit #2.10) of the recording. Ranger BRADFORD then met with WPD Sergeant Jason HAYES, who provided Ranger BRADFORD (030172016 10:82:50 AM TR (Rev. 02108) DPS SENSITIVE REPORT OF INVESTIGATION Page 6 ot 28 ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) with 2 CD'S containing radio transmissions (Exhibit #2.11) related to the call. 2.11 While at WPD, Ranger BRADFORD was advised by Detective GOFF that he received information WADDELL had been pronounced deceased at Harris Hospital. WPD Corporal John WRIGHT, who followed the ambulance to Harris Hospital and stayed with WADDELL, collected WADDELL'S personal items and one projectile (Exhibit #2.12) removed from WADDELL'S body. These items were transported to WED by Corporal WRIGHT and placed in WPD Evidence on 06-23-2015. 2.12 Ranger BRADFORD was advised by Detective LUECKE that he was at Harris Hospital, and was going to meet with family members of WADDELL at the hospital. Detective LUECKE advised he would audio record the interview. (this interview will be summarized in later details in this report) 213 On 06-24-2015, Detective LUECKE and Ranger BRADFORD attended the autopsy of WADDELL at the TCME. Chief Medical Examiner Dr. Nizam PEERWANI performed the autopsy. Dr. PEERWANI confirmed WADDELL sustained two gunshot wounds, one to the upper right chest, the other to the right flank. (side) The autopsy revealed serious damage to WADDELL'S spleen, pancreas and liver. Dr. PEERWANI was of the opinion that the projectile removed at the hospital was the one that entered WADDELL'S right flank. The remaining projectile (Exhibit #2.13) was removed from WADDELL'S body and placed in evidence by TCME. 244 on 06-25-2015, Ranger BRADFORD met with SNIDER and Officer BROWN at Ranger BRADFORD'S office in Weatherford. Ranger BRADFORD obtained a written statement (Exhibit #2.14) from Officer BROWN related to the incident. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) medical call involving a possibly intoxicated person in the 1800 block of South Main St. While enroute to the call, Officer BROWN was advised the subject had pulled a knife and became combative with the paramedics. Officer BROWN stepped up his response to include lights and siren, and arrived in the parking lot to observe a subject (WADDELL) walking toward David's Western Wear with something in his hand. WADDELL entered the store, and Officer BROWN entered with his pistol drawn and located WADDELL at the back of the store. Officer BROWN began ordering WADDELL to drop the knife. WADDELL ignored these commands and began to move rapidly across the store. Officer BROWN began to try to contain WADDELL as he awaited other officers to arrive, continuing to give WADDELL commands to drop the knife. Officer BROWN attempted to keep a safe distance from WADDELL while trying to contain him, due to the fact his previous training had instructed him that a person with a knife can be lethal even to an armed officer at a distance of less than 21 feet. Officer BROWN moved parallel with WADDELL, and ended up near the front door. At this point, WADDELL began coming toward Officer BROWN, and still ignored commands to put the knife down. As WADDELL continued to approach Officer BROWN, Officer BROWN recognized that WADDELL was no longer a safe distance from him, and believed WADDELL would cut or stab him if he did not stop him. Officer BROWN fired his weapon in self defense at WADDELL, and believed that he fired two times at him. For details, see Exhibit #2.14. 2.15 On 06-29-2015, Ranger BRADFORD served a Grand Jury Subpoena (Exhibit #2.15) to Harris Hospital, requesting medical records for WADDELL from the incident. Ranger BRADFORD also obtained the following items from TCME: Gunshot residue stubs from the autopsy (Exhibit #2.16); Forensic Evidence (Sxhibit #2.17); Pulled facial, pubic and scalp hair from the autopsy (Exhibit #2.18); Blood Card (Exhibit #2.19); and (030172016 10:32:50 AM TR (Rev. 02108) DPS SENSITIVE REPORT OF INVESTIGATION Page 1001 28 ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. These items were transported from TCME to WED and placed into evidence by Ranger BRADFORD on 06-29-2015. 2.16 on 07-01-2015, Ranger BRADFORD served a Grand Jury Subpoena Exhibit #2.20) for medical records for WADDELL for the day previous to and the day of the shooting incident. This was done after Detective GOFF related to Ranger BRADFORD that he had interviewed a witness at Goodwill (which was coordinating WADDELL'S employment and assisting him through their resource center) that WADDELL had been hospitalized the previous day for "dehydration." Detective GOFF also provided information to Ranger BRADFORD that WADDELL had a criminal history in Texas, Hawaii, Alaska, Oregon and California for offenses ranging from Assault, Dangerous Drugs, Resisting Arrest, Unlawful Carrying of a Weapon, and DWI. 217 On 07-01-2015, Ranger BRADFORD obtained the Glock pistol, magazine containing 14 live rounds, and the two shell casings collected at the scene from WPD - Evidence. Ranger BRADFORD stored these items in a locked filing cabinet in his office until the morning of 07-02-2015. On 07-02-2015, Ranger BRADFORD transported the items and submitted them to the DPS Laboratory in Garland, Texas for ballistic analysis. Ranger BRADFORD obtained lab submission form #GAR- 1507-07248 (Exhibit #2.21) as a receipt for the items. 3.1 On 07-06-2015, Ranger BRADFORD obtained the medical records for WADDELL from Weatherford Regional Medical Center. (Exhibit #3.1) The records indicate WADDELL was brought into the Emergency Room by ambulance on 06-22-2015, at approximately 2:30 PM. (day before shooting incident) WADDELL was treated by Dr. Jonathan BERRY. WADDELL was admitted to the hospital for "syncope and collapse," and "schizoaffective disorder." The medical notes indicate WADDELL was seen in the ER a week earlier for abdominal (0370172016 10:82:50 AM TRA (Rev. 02108) DPS SENSITIVE REPORT OF INVESTIGATION Page thot 28 ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. WADDELL had symptoms on this occasion of dizziness and auditory hallucinations. WADDELL reported that he has not drank water in the past 3 days due to not liking the water at his home, and has only been drinking beer. WADDELL further reported that people have been following him. WADDELL admitted to drinking approximately 12 beers a day and that he last used methamphetamine on the previous Friday. The differential diagnosis by Dr. BERRY included the following: "dehydration drug effect, idiopathic syncope, seizure, sepsis, drug addiction, acute psychosis, schizophrenia, ETOH intoxication, drug effect, electrolyte imbalance, heat exposure." The notes also indicate upon exam that WADDELL had "no hearing loss." (this was deemed relevant by Ranger BRADFORD due to later reports from the family of WADDELL, via an article in the local newspaper, that WADDELL was deaf) On 06-22-2015, at approximately 9:20 PM, WADDELL was discharged to home, with notification made to his MHMR caseworker of his condition. For details, see Exhibit #3.1. 8.2 on 07-06-2015, Ranger BRADFORD interviewed Don COOPER, W/M, DOB NNN. COOPER is the manager of CiCi's Pizza in Weatherford, where WADDELL was employed. COOPER related that WADDELL had worked there for approximately 3 months, after being referred by a Goodwill caseworker. WADDELL worked as a bus boy, and COOPER stated he never had any issues with WADDELL at work. COOPER described WADDELL as quiet and mild mannered. COOPER stated he knew WADDELL had just been released from a halfway house, and WADDELL admitted to him he had a drinking problem. COOPER stated he believed WADDELL had a learning disability, and described him as a “little slow." COOPER related he never observed or felt like WADDELL was hearing impaired, and that he never had problems communicating with him verbally. 3.3 On 07-10-2015, Ranger BRADFORD received the ballistics (03/01/2016 10:32:60 AM TRH (Rev. 02108) DPS SENSITIVE Page 1201 28 REPORT OF INVESTIGATION ‘STATUS: CLOSED BY: ANTHONY (TONY) BRADFORD, RA. |. CHRISTOPHER BROWN, WIM, 11/12/1968 46 yoa 061292015 ( Tuesday) 3.4 35 laboratory report (Exhibit #3.2) from the DPS Laboratory in Garland, Texas, via email. The report confirmed the Glock pistol used by BROWN was in working order and functioned properly. The submitted shell casings matched the marks left by the weapon during test firing, confirming this weapon was the one used during the incident. On 07-17-2015, Ranger BRADFORD received a full copy of WPD Offense Report #1500022553, with all attachments, including witness statements, patrol unit video, crime scene photographs, chain of custody documents and reports related to previous contacts by WPD with WADDELL (Exhibit #3.3). Relevant witness statements, previous reports from contact with WADDELL, and patrol unit video are summarized in the following details. Summary of witness Sean GLASS, W/M, DOB 03-16-198 GLASS was interviewed by Detective GOFF, who recorded the interview on audio. GLASS is a nurse, and observed WADDELL fall on the ground outside of the Jiffy Lube. GLASS and other workers at Jiffy Lube provided WADDELL with water. GLASS could smell alcohol on WADDELL'S breath, and inquired how much he had drank. WADDELL first told GLASS he had drank two beers, then told him four. WADDELL also told GLASS he had taken Seroquel and Neurontin. GLASS stated WADDELL appeared lucid and able to understand him during their conversation. Upon arrival of Fire and EMS personnel, GLASS stepped back and allowed them to check on WADDELL. Shortly after, WADDELL stated "Fuck off, T am done," and pushed past the paramedics. WADDELL pulled a knife from the right side of his pants, which GLASS described as a lock blade with a black handle, approximately 4 inches long. WADDELL then headed straight for David's Western Wear. GLASS followed the Fire and EMS personnel as they went into the store. GLASS stayed at the front door, with the door open. GLASS observed BROWN give clear commands to WADDELL to put the knife down. WADDELL continued to run around the store. GLASS then observed BROWN come to the front door area and tell WADDELL more forcefully to put the weapon down. GLASS stated when WADDELL and BROWN met at the front. of the store, he feared WADDELL was going to stab BROWN with the knife and run from the store. GLASS was standing at the front door approximately 3-4 feet from BROWN at the time of the shooting. Summary of witness Mia ARCHULETA, W/F, DOB 09-26-1965 ARCHULETA was interviewed by Detective GOFF. ARCHULETA stated she is an intake specialist for Goodwill, and had assisted in locating employment for WADDELL. ARCHULETA had spoken with WADDELL at Goodwill shortly before the incident. (Goodwill is adjacent to Jiffy Lube) ARCHULETA related that WADDELL was "fidgety and tickish," and described his speech as “weird and quirky." She stated WADDELL had shown flashes of having a temper in the past, and that she knew he had slashed a manager's tires while working at Wal Mart in Hudson Oaks. WADDELL informed ARCHULETA about him being in the hospital the previous day. ARCHULETA related that she told WADDELL to stay hydrated, and to avoid alcohol. WADDELL admitted to ARCHULETA he had drank four beers this morning, and stated he was going to try to go to rehab for his alcoholism. ARCHULETA stated that aside from acting "weird," WADDELL appeared to be coherent. Summary of witness Matt FIELD, W/M, DOB 08-28-1970. FIELD is the store Manager for David's Western Wear, and was interviewed by Detective WOLFENBURGER. FIELD'S statement was audio recorded on a digital audio recorder. FIELD stated he was in the office of David's, when he heard another male employee yell "get out, get out." No one said anything to FIELD, and he believes his workers were unaware he was in his office. FIELD walked to his office door and noted EMT'S telling him to get back. FIELD then became aware of WADDELL moving to the back of the store FIELD saw Officer BROWN in the store and heard him yelling to WADDELL to "drop the knife." WADDELL was behind some racks of clothes, and FIELD stated he never saw a knife in WADDELL'S hand because his vision of him was obscured by the clothing racks. WADDELL made his way toward the front of the store, and FIELD heard Officer BROWN yell again for WADDELL to drop the knife. WADDELL did not ever acknowledge Officer BROWN and kept coming toward him. FIELD described WADDELL as being within 2-3 feet of Officer BROWN at the time the shots were fired. FILED stated it appeared to him like WADDELL was looking around for a way out of the store during the incident. Note that several other witnesses were interviewed, and gave written or audio recorded statements to WPD Investigators before Ranger BRADFORD'S arrival. After review of the witness statements, it is apparent all of the statements support the known facts that WADDELL was in distress at the Jiffy Lube, was attended to by EMS and WFD personnel, became belligerent and produced a knife, and went into David's Western Wear with the knife in plain view. The events inside of the store are captured on video surveillance cameras. For brevity in this report, all witness statements have been previously summarized by the WPD Investigators in WED Incident Report # 1500022553. For details of these witness statements, see Exhibit #3.3 Ranger BRADFORD noted in the WPD packet that on 03-10-2015, WED Incident #1500008392 occurred behind the Office Max along Interstate 20 in Weatherford. WADDELL was called in on as a suspicious person in the area of Tin Top Road and Interstate 20. WADDELL was detained behind the Office Max, where he put the knife away and voluntarily went to the hospital by ambulance for a mental health evaluation. 3.10 Review of in car dash camera footage: Officer BROWN'S patrol car was equipped with video / audio. Officer BROWN is responding initially without lights and siren to the Jiffy Lube to the intoxicated person call by EMS. Officer BROWN begins to respond with lights and siren after being advised the subject (WADDELL) is becoming combative and has a knife in his possession. Officer BROWN pulls up to David's Western Wear, and all that can be observed on the camera is the west wall of the building, just south of the doorway. Officer BROWN did not activate his audio body microphone, however the interior microphone of his patrol vehicle records the sounds of the two shots. Two paramedics can be seen moving across the front of BROWN'S patrol unit for cover, just prior to the shots being heard. 3.11 On 07-22-2015, Ranger BRADFORD reviewed the video footage from the front door camera at David's. This camera angle gives the clearest view of the shooting incident. Ranger BRADFORD noted as WADDELL approached Officer BROWN, he appears to veer to the left toward the front door, in what could be interpreted by an observer to be an attempt to flee the store, rather than an attempt to attack or injure Officer BROWN. 3.12 Ranger BRADFORD located the frame of the video tape which shows the first shell casing ejecting from Officer BROWN'S weapon. Using this frame as the reference point for the timing of the first shot, Ranger BRADFORD applied a standard average reaction time of .83 seconds to the shot. Applying this reaction time, Ranger BRADFORD noted the frames per second speed of the video tape is 15 frames per second. .83 is 83 percent of 1 second. 83 percent of 15 (the number of frames per second) is 12.45. Therefore, to find the approximate location of WADDELL on the video at the time Officer BROWN made his decision to fire, Ranger BRADFORD backed the video up 12 frames from the frame containing the first visible shell casing ejecting from Officer BROWN'S weapon. Once this frame was located, only one of WADDELL'S feet were even visible in the video. At this point WADDELL was still coming down the aisle, toward Officer BROWN, armed with a knife and not complying with his commands to stop or drop the knife. WADDELL was well within the 21 foot range of Officer BROWN, which is and has been the standard "safe" distance from a person armed with a knife or other similar weapon in law enforcement training. When reviewing the video with these facts in mind, the events corroborate Officer BROWN'S statement that he perceived WADDELL to be coming at him with a knife in his hand, that WADDELL was not following commands, and was within 21 feet of him at the time he made the decision to use deadly force. On 10-22-2015, a Parker County Grand Jury reviewed this case and returned a ruling of no criminal responsibility on the part of WPD Officer Chris BROWN in the death of Randall WADDEL. No further investigation related to this case is anticipated, and Ranger BRADFORD is in possession of no property or evidence requiring final disposition.
