knowedge and belief: On or about May 4, 2010, at Markham, Ills, in the Northern District of Ilinois, Eastern Division

did forcibly assault, resist, oppose, impede and interfere with Special Agent Ryan Petry, an officer of the
United States as designated in Title 18, United States Code, Section 1114, who was then engaged in the
performance of his official duties, and defendant's act constituted more than simple assault;
inviolation of Tite 18, United States Code, Section 111(a)(1). | further state that | am a Special Agent wit the Postal Service,

I, MICHAEL R. MCALEER, being duly sworn, state as follows:
1 Tam a Special Agent with the Postal Service, Office of Inspector
General, and have been so employed for approximately 1 and’ years. Prior to that, [served
as a United States Postal Inspector for approximately 13 and % years, My current
responsibilities include the investigation of mail theft and other fraud, waste, and abuse in
the Postal Service.
2 This affidavit is submitted in support ofa criminal complaintalleging
that TYRANNE MITCHELL has violated Title 18, United States Code, Section 111(a}(1).
Because this affidavit is being submitted for the limited purpose of establishing probable
cause in support of a criminal complaint charging MITCHELL with assault of Special Agent
Ryan J. Petry, I have not included each and every fact known to me concerning this
investigation. Thave set forth only the facts that [believe are necessary to establish probable
cause to believe that the defendant committed the offense alleged in the complaint.
3. This affidavit is based on my personal knowledge, information
provided to me by other law enforcement agents, my interview of Special Agent Petry, my
review of reports of witness interviews, and my training and experience as a law enforcement
officer.Investigation of Tyranne Mitchell
4. On March 31, 2010, Special Agent Ryan J. Petry, Special Agent,
United States Postal Service, Office of the Inspector General, was instructed to serve a target
letter on TYRANNE MITCHELL relating to allegations that MITCHELL, a former letter
carrier, had stolen mail
5. On March 31, 2010, Special Agent Petry called MITCHELL to
inform him of the target letter and obtain his current address. MITCHELL informed Special
‘Agent Petry that he was “not at liberty” to disclose his whereabouts to Special Agent Petry.
Special Agent Petry attempted to call MITCHELL again on April 1, 2010, at the same
number and the phone had been disconnected.
6. Over the course of approximately one month, Special Agent Petry
attempted to serve in person and by certified mail the target letter on MITCHELL at several
last known addresses. Special Agent Petry was unable to effect service of the target letter.
Tyranne Mitchell’s Assault of Special Agent Petry on May 4, 2010
1. ‘On May 4, 2010, Special Agent Petry drove to 15641 South Turner
Street, located in the city of Markham, Illinois (the “Turner Street residence”), a residence
at which Special Agent Petry learned was tied to MITCHELL’s girlfriend. Special Agent
Petry arrived in the vicinity of the Turner Street residence at approximately 11:30 a.m. and
observed MITCHELL getting into his car that was parked on the driveway of the residence.
