his was the question posed by Sheikh

Juma Amir after the relentless arbitrary campaign of detentions and renditions of Muslims to Uganda. As he spoke,
a woman and her two infant children where in
detention accused of abetting terrorism as well
as three people who were pulled from their
sick beds while undergoing treatment at a Kapsabet hospital.
Speaking at Jamia Mosque on Monday, the
Sheikh condemned the campaign saying that
it is aimed at instilling fear among Muslims.
They are trying to create a sense of fear
among Muslims by sending out a message that
anyone could be next on the line, he said.
The Sheikhs comments came after Muslim
leaders last week told President Mwai Kibaki
and Prime Minister Raila Odinga to break their
silence about the raging impunity over the illegal hounding of Muslims. They reminded
the two principles of their duties to ensure that
justice prevailed and said the government had
the mandate to ensure that all Kenyans were
treated equally under the law. Our message
is that if crime are assumed to have been committed then let the law be applied equally and
in fairness to all citizens, said Ibrahim Ahmed
Yusuf, the Jamia Mosque Committee assistant
secretary general who read a statement from
the Muslim leadership.
As we experience the rebirth of the second
republic, we call upon the government and its
agencies to uphold the rule of the law at all

'Support Jamia to benet the community'

Jamia Mosque Committee needs the assistance of the Ummah to further its myriad of
activities for the benet of the community. Sending out an appeal for support, the mosque
administrator Salim Ibrahim said a helping hand was vital towards meeting the goals of
the committee to cater for the needs of Muslims.
He said Jamia mosque held an important place among Muslims and it was looked upon
by many for daawa and social welfare programmes which form the core activities of the
institution.
The administrator said while the mosque generates substantial funds, these can barely
cater for the growing needs of the Ummah and it was imperative that the community
lends it support to enable it meet its obligations. It is true that Jamia earns a considerable
amount of money but these funds are not able to sustain the needs of the community,
he said during the ifar (breaking the fast) dinner for the Jamia mosque staff members on
Tuesday.
He enumerated some of the activities of the mosque which include educational support
which has beneted close to 200 students on annual basis. Thirteen students from various parts of the country are beneting from a scheme where they are provided with full

A new dawn beckons the people of Kenya

stitution through the protection of their rights ending the years of
injustice, impunity, marginalization and discrimination.
Without effective participation, some of the ideals which many fought
for over the twenty years period many not be fully achieved.
It is sad to mention that the immediate period before the promulgation was depressing for the Muslim community. At a time when the
faithful were observing the holy month of Ramadhan a period of
achieving higher spiritual goals, a section of the security agencies
sought to dampen this spirit by choosing to disregard the law and
perpetuate a culture of oppression and injustice in the name of
ghting terrorism. Many have been hounded, unfairly detained and
some shipped off outside the country in full violation of the countrys laws. This arbitrary campaign in the holy month of Ramadhan
did not resonate well with the spirit of the new constitution.
With the joys which greeted the Yes vote for the constitution, it was
a rude shock for Muslims that security agents could at this crucial
period in the history of the country decide to violate the existing
laws.
Our call to the leaders notably the two Principals, President Mwai
Kibaki and Prime Minister Raila Odinga is that Kenyans have a lot
of expectations from the new law and it is their mandate to ensure
that the rule of the law is fully observed. Muslims supported the
new constitution on the premise that it will stop the injustices visited
upon them and this still remains their hope at the promulgation of
the constitution.
At the same time we should heed the call from our leaders to remain patient and maintain an atmosphere of calmness. This does
not signify that we will tolerate the injustice if is still visited on innocent members of the community. As the leaders have stated, the
concerns of the community have been voiced out and they will not
stop at seeing to it that justice will eventually prevail.
Mungu Ibariki Kenya

Today marks a new era for the people of Kenya. It is the culmination of the long torturous journey stretching more than two decades
when Kenyans braved threats and intimidations to call for reforms
whose underlying goals were justice and a better life for the people
of Kenya.
The promulgation of the new constitution is a historical day, a fulllment of the dreams and aspirations endeared by Kenyans to have
a set of laws which reects their desires.
This is the rst time that the mwananchi has been involved in the
creation of the new laws, bringing to an end the forty seven year
period where the constitution was virtually imposed on Kenyans by
the British colonial rulers.
What is now become the old constitution was inherited from the
colonial masters with numerous aws which served well those who
perpetrated injustice, amassed ill-gotten wealth, perpetuated corruption and subjugated Kenyans.
In this process, right from beginning to its astonishing culmination,
Muslims like other brave Kenyans did play an effective part. The
likes of Ahmed Salim Bamahriz, Khalid Balala, Prof. Rashid Mzee,
the late Salim Ndamwe who recently passed away from the pangs
of the tortures under the Moi regime-are emboldened in the minds
of many for their role in pushing for reforms to usher in a better life
for Kenyans. We salute all the gallant sons of Kenya from diverse
backgrounds who have played an instrumental role to see to it that
the dreams of a second republic are nally attained.
As we celebrate the enactment of the new constitution and the
beginning of a new era which many Kenyans look at with a promising future, it is imperative that Muslim leaders continue to play an
effective vital role in the all important process of implementing the
constitution.
Having had the unfortunate label of being the most aggrieved community, it is essential that Muslims reap the fruits of the new con-

times and ensure that the rights of citizens are protected for that
is the Kenya we aspire to live in, the statement from the National Muslim Leaders Forum (NAMLEF), Supreme Council of Kenya
Muslims (SUPKEM) and Jamia Mosque Committee added.
The leaders reacted with anger about the ongoing campaigns which
they said was being disrespectful to Muslims who were observing
the holy month of Ramadhan. They said the government was helping to turn Uganda into another African Guantanamo, a reference
to Ethiopian where dozens of Kenyans were renditioned two years
ago in a US backed exercise which was heavily condemned by local
and international human rights groups.
The illegal actions have continued and the devious anti-terrorism
police unit continues full steam in ight as it hounds, arrests, tortures and extorts Muslims communities and individual all over the
country. Of concern is that all these actions are done in an extrajudicial manner and in total disregard of the law. It is now evident
that when it comes to Muslims, the law does not apply, Ibrahim
said while addressing Muslims who turned up for Friday prayers at
the mosque.
Why should Kenyan citizens be hounded out of the country and in
total disregard of the Kenyan laws handed over to another country?
Have we lost faith in our judicial system? the leaders asked.
The statement said the new level of impunity was being carried out
in bad faith coming only days after Muslims joined millions of Kenyans to vote for the new constitution with hopes that the new law
would end such acts of impunities perpetrated for years by state security agents. Have we ushered in a new era where impunity is the
modus operandi of the state and its security agents? he queried.
He said going by the mode of operations of the terror police, it was
clear that the so-called war on terror was being used as a pretext
to ght Islam and Muslims. When a pastor was arrested ferrying
bombs, he was taken to court and also accorded bail. But for Muslims, suspicion only will land you in the new African Guantanamo at

Luzira prison in Kampala, he said.

Amidst the mounting anger, the leaders called on Muslims to remain
steadfast and at the same time maintain an atmosphere of calm.
In the face of the intimidation, harassment and exhortations, we
must remain steadfast and uphold the law at all times while at the
same time learn to secure and protect our rights as citizens of this
country, he said.

benet from this programme Zaynab Abdallah of State House Girls
School is set to sit for her Form Four examinations this year.
Other areas of support provided by Jamia Mosque Committee include salary payments to Imams, Islamic Religious Education (IRE)
and madrassa teachers, nancial support towards the sick, burial arrangements, daily iftar programme for worshippers at Jamia
mosque and a Ramadhan food distribution exercise among other
social welfare assistances towards Muslims.
This Ramadhan, Jamia will play host to the rst Quran recitation
and memorization competition scheduled to be held on September
4 and 5. The competition will showcase the talents in this area as
well as encourage the study of Quran sciences. More than 40 participants from various madrasas and other Islamic institutions are
expected to attend.
Speaking at the dinner, the committee chairman Osman Muhammad Warfa commended the staff for their role in serving the Ummah
and said the committee will endeavor to improve on their welfare as
a motivational measure.
The iftar was graced by the Saudi Arabia religious attach in the
country Anwar Abdulaziz al Souly and Nominated MP Sheikh Muhammad Dor as well as various Muslim leaders and other prominent members of the community.

DA'WA

A Ramadhan primer on the ritual retreat of Itikaaf

order) than I'tikaaf elsewhere.
The scholars differed as to whether or not a woman can make
I`tikaaf in the prayer area (musalla) of her house. The majority is
of the opinion that her I'tikaaf in the prayer area of her house is not
valid owing to what Al-Bayhaqi reported about Ibn Abbasa, may Allaah be pleased with him, in his book As-Sunnan Al-Kubra (4:316),
wherein he records him as stating: It is an innovation (Bid'ah) for a
woman to make I'tikaaf in the prayer area of her house.
The period of remaining in Itikaaf
As for staying in the Mosque for a period of time, it is the most essential integral that constitutes the worship of I`tikaaf.
The opinion of the majority is that intending to spend any amount
of time in the Mosqueeven less than an hour can be considered
I`tikaaf. They agreed, however, that it is desirable for the one who
wishes to perform this worship to spend at least a day and a night in
the Mosque because the Prophet, sallallaahu alayhi wa sallam, was
never reported to have made I`tikaaf for less than that interval.
Things that invalidate or end Itikaaf
Sexual union
The proof for this is verse 2:187 whose relevant meaning is ...
And do not have relations with them as long as you are staying for
worship in the Mosques.... The preferred opinion is intimate contact that leads to sexual union, such as kissing and touching, also
invalidates the I'tikaaf.
Leaving the Mosque
Leaving the Mosque unnecessarily also ends I`tikaaf. Basically, if
one leaves the Mosque to shower, eat, be treated for an illness, and
the like, it does not end the I`tikaaf.
Intoxication
Whether by means of alcohol, drugs, or other substances, intoxication ends the I`tikaaf.
Leaving Islam
This invalidates the I'tikaaf.
The commencement of menstruation or Post-Birth Bleeding
This ends the I'tikaaf.
Things that are undesirable while in Itikaaf
Abstaining from speech as a way to come closer to Allah
The reason for this is that abstention from speech as a form of
worship is not prescribed in Islam. However, there is no harm in
refraining from speech if there is a lack of need.
To speak needlessly or delve into argumentation and conversation for entertainment.
Busying oneself with religious lessons that involve unnecessary
debate
Wearing ostentatious clothing.

In Islam, Itikaaf refers to a form of worship in which one stays in a

Mosque as a way of getting closer to Allah.
The wisdom behind having a kind of worship like this in Islam is
that when one is in the world (especially in the hustle and bustle of
today's societies) there are many distractions that cause one to forget why one is here and where one is going. So sometimes a person needs more than just the ve daily prayers to revive the spirit.
That is why Islam provides its followers with I`tikaaf, the option of
surrendering themselves totally to Alaah and distancing themselves
as much as possible from all worldly concerns, for a time.
The goal of I`tikaaf is for one to remain in the Mosque and busy
him or herself in prayer, contemplation, reciting Quran, attending
lessons, and such.
Itikaaf is not obligatory in Islam. Rather, it is a prescribed form of
worship that is strongly recommended in Ramadhan, and especially
in its blessed last 10 days. In fact, the recommendation of I`tikaaf in
the last 10 days of Ramadhan seeking out the Night of Decreeis
so emphatic that some scholars deem it a communal sin if no one
in the community performs it during these days. There are many authentic reports of the Prophet, sallallaahu alayhi wa sallam, making
I`tikaaf for exactly this duration.
Itikaaf contains four essential elements:
The one who is performing it.
The intention to perform it.
The place in which it is performed.
The act itself (of remaining in the Mosque for a period of time).
The one performing I'tikaaf
As for the one performing I`tikaaf he must fulll three conditions:
He must be a Muslim.
He must be of sound mind.
This condition rules out the performance of I`tikaaf by the insane,
intoxicated, unconscious, or very young children who cannot sufciently discern crucial things (a child under about ve or six years
of age)). This does not mean that those who fall under these categories are not allowed to make I`tikaaf. Rather, it means that the
act of remaining in the Mosque is not considered an act of worship
from them. (Similarly, were they to do something wrong therein,
they would bear no sin).
He must not be in a state of major ritual impurity (Janabah)
(Janabah is a bodily state that requires ghusl, or ritual, whole-body
bathing, occasioned by marital relations, sexual emissions, menstruation, and postpartum bleeding).
Hence, neither a menstruating woman nor one in a state of postbirth bleeding can make I`tikaaf, since it is forbidden for them to
remain in the Mosque in that state. Also, a man or woman who
has participated in a sexual union or come to orgasm must perform
ghusl before making I`tikaaf since it is likewise forbidden for them to
remain in the Mosque in that state.
There is no disagreement that the I`tikaaf of an unmarried woman
is valid. If she is married, she must have the permission of her husband to validate it.
The intention to perform Itikaaf
As for intention, as with all worship, one must deliberately make
it. If the one performing I`tikaaf leaves the Mosque, his I`tikaaf has
ended. If he returns to make I`tikaaf again, he must renew his intention.
The place of Itikaaf
As for the place of I`tikaaf there is consensus among the scholars that if a man performs it anywhere other than the Mosque it is
invalid due to verse 2:187, which means in its related part, for so
long as you may be in ritual retreat in the Mosques, and due, as
well, to the fact that the Prophet, sallallaahu alayhi wa sallam, never
made Itikaaf anywhere other than the Mosque.
They also agreed that I`tikaaf in the three sacred Mosques (the
Haram of Makkah, then the Mosque of the Prophet in Madeenah,
then Al-Masjid Al-Aqsa in Jerusalem) is better (in that respective

WOMEN ISSUES

Womens worship during Ramadhan

A Muslim woman should utilize the seasons which Allah has endowed with great benet and made a source for accumulating rewards. A woman can increase her reward in Ramadhan by strengthening various aspects of worship and obedience to Allah, by being
keen in performing virtuous deeds and refraining from anything that
could affect the rewards of her fasting adversely.
Sincerity during Ramadhan:
One of the aspects of servitude to Allah, which a woman practices
during the month of Ramadhan is sincerity. Abu Hurayrah, may Allah be pleased with him, reported: The Messenger of Allah, sallallahu alayhi wa sallam, said: Allah the Exalted and Majestic said:
`Every act of the son of Adam is for him, except fasting which is
(exclusively and sincerely) for Me, and I will reward him for it
(The person observing fast) has abstained from food and drink and
sexual pleasures for My sake [Al-Bukhari and Muslim]. Therefore,
a woman should refrain from all that invalidates her fast, and should
guard this pledge that is between her and her Lord from dawn to
sunset. Sincerity during this month trains her to be sincere afterwards in other acts of worship.
Rulings of Ramadhan:
One of the matters, which a woman must endeavor to learn, is the
jurisprudence rulings pertaining to the month of Ramadhan, in order
for her fasting to be perfect. There are many rulings related to this
month that concern women, like the rulings regarding menstruation,
purity, postpartum bleeding in connection to fasting -- if the bleeding
stops after twenty days she must perform a ritual bath (i.e. ghusl)
and start fasting, but she must intend fasting the obligatory fast, as
the Prophet sallallahu alayhi wa sallam informed us that without
having an intention to fast prior to the break of dawn, her fast is not
valid.
Adhering to the command of Allah and His Messenger, may
Allah exalt his mention:
Adhering to the commands of Allah and His Messenger, sallallahu
alayhi wa sallam, during this blessed month is another aspect of
servitude, which a woman practices. For example, a woman is commanded to break her fast as soon as she goes into her menses, yet
she is not deprived from the reward because she broke the fast in
adherence to the command of Allah, and she is rewarded for this
adherence.
Some women become grieved when they get their menses whilst
fasting, and start saying things like: Why do I get menses, or I
wished I never got this, or I wish I was a man so that I do not get it
and thus fast the full month. One must be content with the decree of
Allah, as He is The One who created women as women and men as
men. Thus, a woman should be content with her decree, and should
not have these feelings, because Allah does everything with Ultimate Wisdom, the essence of which we can never comprehend.
Bashfulness during Ramadhaan:
Women must learn that when it comes to enlightening and educating themselves in matters of religion, they should not be too shy to
ask questions. For example, some young women are too embarrassed to inform their families that they have reached the age of
puberty and thus continue to break their fast and do not observe
fast. This is a serious mistake in Islam, as a woman is obliged to fast
whenever she is not in her menses. Another example are women
who are too shy, thus when they have their menses they continue to
fast lest those around them would nd out, which is also prohibited
in Islam and by doing so they are disobeying Allah.
Those who did not observe fast after reaching the age of puberty
-- for whatever invalid reason -- must make up all the days they
missed.
Despite the fact that some scholars have permitted the use of the
pills that delay the menses (if they have no harmful side effects),
we believe, and Allah knows best, that not taking them is more rewarding, as it reects the womans contentment with what Allah Has
decreed on her.

Attending the Qiyam prayers and study circles:

Attending the Qiyam prayers (i.e. the optional night prayers) in
the mosque is a recommended act of worship. Umar, may Allaah
be pleased with him, used to designate a prayer area especially for
women so they could attend the prayers without intermixing with
men. It is a good thing for a woman to attend the prayers with the
congregation, but it is more rewarding for her to pray at her house.
When the woman goes to the Mosque -- whilst fullling the conditions permitting her to attend -- she will expose herself to the blessings bestowed upon those who attend the Mosque. For example,
the mercy of Allah will descend on them, the angels will surround
them and ask forgiveness for them for attending lectures that teach
people matters of their religion; saying Ameen after the supplications of the Imam which makes them deserving of whatever the
Imam supplicated, increasing submissiveness to Allah that results
due to the Imams recitation during the prayer, learning the proper
way to pray and correcting any mistakes in recitation. Having said
this, it is still more rewarding for a woman to pray in her house whilst
reading from the Quran than praying with the congregation.
A woman must be keen to get to know those who attend the congregation with her as some of them could be very pious sisters,
who could be a means for steadfastness and remind her at times
of heedlessness.
When in the Mosque, a woman should be ready to receive knowledge, learn her religion and be open-minded to accept the truth
even if it goes against her desire or that which she practices. She
must adhere to the proper Hijab, not wear perfume, not adorn herself, not mix with men outside the Mosque or in the parking lot,
so as to avoid making the mosque a social club and turning the
prayers into a meeting-place to talk and laugh with other sisters,
disturbing other people.
Religious exemptions for women during Ramadhan:
Allah granted women many exemptions during this month out of
His Mercy. One of these exemptions is that a pregnant woman or
a breastfeeding woman is permitted to break her fast. Allah The
All Knowing, Knows what feelings a woman has towards her infant
and thus permitted her to break her fast to breastfeed him. All she

YOUTH AND CHILDREN

What Ramadhan isnt about

Yes, its that time of year again when
we taste the wonderful variety of our
familys home cooking. Never in such
a short space of time do we encounter
such scrumptious meals.
Every evening there will be a knock
at the door and the aunty from next
door will oblige with a sample of his
or her delicacies and vice versa. Yes
youve guessed it- its Ramadhan!
There is feverish activity during this
month that is truly unsurpassable.
Young children will eagerly get up for
suhoor (pre-dawn meal) bright eyed
and excited for they have been allowed to fast. There will be competitions amongst the youngsters as to
who can keep the most fasts, as they
never seem to tire.
Then there are those like you and
me. When our dutiful parents or elder
brother and sisters come to awake us
we turn over and give a small grunt
of Im just coming. Half an hour later there will be shouts of hurry up,
youve only got 20 minutes left!.
Well then creep down bleary eyed
and be cajoled into eating something.
Some of us will crawl back to bed
whilst others wait impatiently moaning
is it time for fajr yet?
Someone may be reciting the Quran
whilst others look and feeling guilty for
not doing so, but still pray Fajr and run
back to the warm and cozy bed.
Then its morning and the frantic questions of can I brush my teeth. If I do
will it break my fast, but if I dont wont
I have bad breath?. No, says mum
or dad. Yes you can theres a hadith
that says. replies a dutiful member of
your family.
Then on to school, college, uni or
work and the typical questions of you
mean you cant eat ANYTHING? Not
even drink a glass of water. Isnt that
bad for you?
As the day nears its end frantic preparations will be going on in the kitchen. The youngest brother will be sent
to the shops to get the dates, minutes
then seconds will be watched ticking
away whilst sweet aromas tantalise
the mouth.
As those in the dining room shriek to
the cooks in the kitchen open your
fast, its time, open your fast. Others
will be asking impatiently what duaa
do we read? Then relaxation time,
the fast is over. Some will be praying
maghrib whilst others will be eating
hungrily quenching their appetites.
Then for many its of to the mosque
for Isha and Tarawih prayers some
faces are regular whilst for others this
is their rst yearly trip to the mosque
(the other time being Eid!) You may
never see these people in a mosque

during the year but come Ramadhan the hats are donned and jeans/ trousers rolled up.
Does any of the above apply to you or your family?
If it does, is it not time for you to learn the real and purpose of fasting?

is required to do is to make up the days she missed, and if she is unable to fast then she is only
obliged to feed a needy person for every day she missed. The ruling that is applicable to her is
just like that for old people who are unable to fast.
Another exemption is that a woman who unwillingly submits to her husbands will for marital
relations during the day in Ramadhan excused and not considered a sinner, nor does she have
to expiate; rather it is the husband who has to do so. She must try to avoid him and escape the
situation as much as she possibly can, but when she becomes cornered and nds no way but to
give in to his request, then she will not be blamed.

NATIONAL NEWS

Put wrangles aside and serve the people, Coast MPs told
Coast Muslims MPs have been criticized for wasting time dwelling
on political supremacy battle of the province at the expense of community development.
Grain Bulk Handlers Limited Chairman, Muhammad Jaffar argued
that the epic political battle involving prominent MPs in the area has
negatively affected unity among Muslims in the area.
Addressing Muslims during Muslim Education and Welfare Association (MEWA)' s annual Iftar fundraising programme at Mombasa
Islamic center, Muhammad said that without formidable unity thousands of underprivileged members of the society will not be pulled
out of abject poverty they are in at the moment. We should not
boast of God given power and that is pride that Allah has warned
the ummah of Prophet Muhammad against. What is all about this
supremacy war, how many powerful ones have come and gone?
he asked.
He called on the leaders to unite for the sake of the electorate who
voted them in anticipating better services and it was inconceivable
for the leaders to engage in political battles yet the community was
languishing in poverty.
The chairman observed that a united regional MPs backed by residents support would easily unlock various thorny issues such as
under development and poor education standard.
He also advised the Muslim community in the country to remain
steadfast and vigilant to block any attempt of removing Kadhi courts
by anti-Islam crusaders in the new constitution.
Speaking at the same function, Nominated MP Sheikh Mohammed
Dor said the region is on the promising side of developing once the
new constitution will be implemented.
He however, asked residents to remain keen on electing leaders
to various political positions expressed in the new constitution to
achieve the needed development. Constitution is just a guideline.
Unless we elect educated leaders with quality of integrity and honesty we shall not achieve what we have been agitating for decades,
he noted.
He said under the new constitution, county government will enjoy

a share of revenue generated by local based state authorities such

Kenya Port Authority (KPA) and Kenya Ferry Services (KFS).
The fundraising realized Sh2.7 million and the proceeds are expected to assist in furthering the activities of MEWA which include educational support and drug rehabilitation programmes among other
social welfare programmes undertaken by the organisation.

Give Zakat to empower the needy

Muslims have been urged to full their religious obligations of paying Zakat (alms to the poor) to ensure that the rights of the underprivileged in society are observed.
The head of Islamic propagation at Ummah Foundation Sheikh
Subki Shee said the goal of Zakat was to economically empower
the less fortunate and said proper distribution of Zakat wil contribute to uplifting the lives of Muslims and also foster good relationship among the Ummah.
Paying Zakat and giving charity does not lessen your wealth but
instead adds baraka (blessings) to the existing wealth, the Sheikh
noted.
He lamented that many Muslims had neglected their duty to give
the Zakat to the rightful recipients and made reminder for fullling this obligation which form among the most important tenets of
Islam.
The Sheikh added that fullling the obligation of Zakat was a way of
expressing gratitude to Allah for His innumerable blessings. Zakat
also puries the soul, protects one from greed, boosts social justice and narrows the gap between the rich and the poor, he further
said.
The Sheikh said this during a distribution exercise by Ummah Foundation of foodstuffs to various areas which included Mama Fawzia
Childrens Home in Kasarani and the Ndalani Islamic Centre in Matuu, Ukambani. The distribution was part of the ongoing Ramadhan
activities by the Foundation to give a helping hand to less fortunate
members of the community during the holy month.

The gospel of justice according to ATPU

Due to the serious nature of her crime, she cannot be released
even on bail. This was the sentiments of the terror police Chief
Nicholas Kamwende on the detention of a mother of two, Zamzam
Zuleikha was arrested in a night raid on Friday at her Juja road
home together with her two children aged 2 years and one and half
months.
In her company were three foreign visitors whom the police claimed
were linked to terrorism activity. At the Kibera law courts where she
was produced on Monday, the serious crime which Kamwende had
referred to turned out to be an issue which astounded those present
in court.
While the expectations were that the charge sheet will be related to
terrorism, the charges read to her indicated that she was found in
possession of another persons national identity card which in itself
is not a crime under Kenyan law. The other ID turned out to be her
mothers national identity card.
Welcome to the world of the dreaded Anti-Terrorism Police Unit, a
squad well known for agrant abuse of the rights of Muslims.
Also produced in court on the same day was a man which the police claimed was working with an international terrorist syndicate
was arrested in Mombasa. After failing to gather any evidence to
incriminate the businessman, Mansour Muhammad Aman, another
absurd charge of stealing a vehicle and handling stolen property
was levied.
In 2008, a Nairobi businessman after being held for days and
subjected to rigorous interrogations by the ATPU, he was nally
charged in court with stealing a KRA document valued at Sh3, yes
three bob.
Perhaps the prominent case of the gross abuse of human rights perpetrated by the terror police was the detention for more than three
weeks of a ve year old child Hafsah Ali Saleh who was arrested
together with her mother on terrorism allegations. Even after calls
from relatives to have the child released on humanitarian grounds,
the police refused to give in.

After days of protests from Muslim leaders, human rights groups

and women groups, the pair was eventually released without being
taken to court not an apology or compensations for their unwarranted and illegal detentions.
For the last seven years since it came into being, the unit has engaged in macabre antics which are a mockery of justice. Jungle law
is what Muslim leaders recently described its modus operandi. Almost all its victims have been arrested, detained and had their rights
disregarded when it was clear that there was no shred of evidence
to implicate them on the alleged charges.
Of the thousands of people arrested since its started its campaign,
signicantly, not a single person has been successfully convicted of
the alleged crimes.

9/11 families rally in favor of NYC mosque

WASHINGTON: NEW YORK The
planned mosque and Islamic center
blocks from ground zero got a new boost
Wednesday from a coalition of supporters
that includes families of Sept. 11 victims.
New York Neighbors for American Values rallied for the rst time at a municipal
building near ground zero.
"I lost a 23-year-old son, a paramedic who
gave his life saving Americans and their
values," Talat Hamdani said, and supporting the Islamic center and mosque
"has nothing to do with religion. It has to
do with standing up for our human rights,
including freedom of religion."
Among the nearly 2,800 people killed
when the World Trade Center was attacked in 2001 were more than 30 Muslims, she noted.
Opponents of the Islamic center project
argue it's insensitive to the families and
memories of Sept. 11 victims to build a
mosque so close. Supporters cite freedom of religion.
The new coalition was started by members of 40 civic and religious organizations that "spontaneously called each
other, because we had the feeling that
something very negative was happening," said Susan Lerner, executive director of the New York ofce of the watchdog

group Common Cause.

The controversy was triggered by "irresponsible politicians" using it as an election issue, she said. Names mentioned at the rally
included former House Speaker Newt Gingrich, a Republican, and the highest-ranking
Democrat in the Senate, Majority Leader
Harry Reid.
Gingrich has suggested that building the
mosque near ground zero is akin to putting
a Nazi sign "next to the Holocaust Museum." Reid has broken ranks with President Barack Obama by saying he thinks the
mosque should be built elsewhere.
Coalition members are now contacting ofcials, asking them to support the project as
a reection of religious freedom and diversity, and the rejection of "crude stereotypes
meant to frighten and divide us."
They plan a candlelight vigil near ground
zero on Sept. 10, the eve of the ninth Sept.
11 anniversary.
"This is not just about Muslims; this is about
who we are as Americans," said Lerner,
adding that to oppose the Islamic center is
"a slippery slope. There will always be people who are offended standing next to people who are different from others."
Rabbi Arthur Waskow, director of New
York's Shalom Center, said the project will
show the world a form of Islam that espouses peace. (Iviews.com)

Turning todays dreams into

the realities of tomorrow
The season of giving and generosity is again
here with us. For Muslims, Ramadhan is a
season of reaping endless rewards as a result of the blessings which are found in this
month.
Among the ways to benet from this special
month is to make use of the innumerable
available opportunities which only comes in
this period.
Ramadhan is an honorable and blessed month,
and the rewards for good deeds accomplished
in this period are multiplied manifold. Of particular mention is generosity, a virtue which
the Prophet (sallallahu alaiyhi assallam) was
know for during this blessed month. Narrated
Ibn Abbas (may Allah be pleased with him):
Allahs Messenger (sallallahu alaiyhi assallam) was the most generous of all the people
and he used to reach the peak of generosity in
the month of Ramadhan (Bukhari). In another
hadith he said, The best charity is that given
in Ramadhan. [At-Tirmithi].
Among the areas where we can gain from the
bounties of Ramadhan is through subscribing
to the One Shilling initiative by contributing a
shilling a day towards a cause whose ultimate
objectives will be to chart a new way forward
for the growth and development of the Muslim
community in the country.
The Foundation aspires to realize the dreams
of provision of affordable health facilities, development of Islamic learning institutions and
provisions of other important social amenities
that will benet Muslims.
It is a collective effort that is all inclusive in order to realise the benets of unity of the Muslim society.
The Foundation has put in place an implementation strategy n several parts of the country
to enable more Muslims to participate in this
venture.
One shilling appears to be a very small unit,
but, with our collective participation, the shilling will grow to leaps and bounds to be able
to contribute greatly to realizing the myriads of
its objectives.
During this noble period, we encourage you to
join us by contributing your shilling on a daily
basis towards this important cause. Alternatively, you can send in your contribution on a
weekly, monthly, semi annual or even annual
basis.
Let us join hands to see to it that we ultimately
turn the dreams of today into the realities of
tomorrow.
You can send your cntributions through MPESA 0717 613333 or ZAP 0732 613333
