ORDER SECTION 35, THE MINING ACT, R.S.O. 1990 ORDER NO. W-SO-54/09 For those lands in Southern Ontario, Southern Ontario as being defined below, where there is a surface rights owner, being an owner in fee simple of the land as shown in the appropriate land registry office, who does not own the mining rights for the land, and where the Crown owns the mining rights for the lands, the MINING RIGHTS are hereby WITHDRAWN from prospecting, staking, sale and lease For the purposes of this Order, Southern Ontario means that part of the province of Ontario lying south of the south shores of the French River, Lake Nipissing and Mattawa River. Saving, excepting and reserving from the effects of this Order any Mining Rights that have been patented, sold or leased, or on which there is a mining claim, or that have otherwise been alienated by the Crown before the time and date when this Order becomes effective. Provided that any alienated lands or mining rights saved, excepted and reserved as above, that revert to the Crown subsequent to the effective date and time of this Order, shall automatically be considered to be withdrawn by this Order.
