ASSENTED-TO REQUEST FOR RULING ON


MOTION TO WITHDRAW AS COUNSEL
___________________________________________________________________________

NOW COMES undersigned appointed counsel, Attorney Mark E. Howard, and

respectfully requests that this Court issue a ruling on his assented-to motion to withdraw from

representation of the defendant Daniel Riley in the above matter. Counsel says further:

1. The defendant was arrested in Albany, New York, on September 12, 2007, and

removed to this Court, where he appeared for arraignment on September 13, 2007.

Undersigned counsel was appointed by the Magistrate Judge to represent the defendant.

2. Undersigned counsel filed an Assented-to Motion to Withdraw as Counsel on

October 2, 2007, at the request and insistence of the defendant. In addition to the grounds

cited in the motion, the defendant has repeated his demand that the undersigned not serve as his

counsel in this matter.

3. The Court has scheduled a status conference in this case for October 25, 2007,

in Portland, Maine. It would likely be a waste of valuable CJA resources to require undersigned

counsel to attend under the circumstances.

4. AUSA Bob Kinsella assents to the relief sought in this motion.


WHEREFORE, undersigned counsel respectfully requests that this Court rule on his

motion to withdraw from representation of the defendant in this case.
