City of Cincinnati Roxanne Qualls Couneimember’ AWCOMe72- ene December 7, 2010 MOTION \We move that the City of Cincinnati adopt the recommendations of the Historic Building Loss Task Force, hich calls upon the city administration to improve communication and caordation between its administrative boards and the city departments that execute its land use polices, correct antiquated language within the municipal code, and improve its approach to blight remediation and historic preservation through the following actions 1. Within ninety (80) days, the Department of Cty Planning and Buldings, with assistance from the Department of Community Development, should identify all antiquated references to the "Director of Buildings and Inspections” within the Cincinnati Municipal Code (CMEC) and, in each instance, determine whether the powers and duties identified should be atributed tothe Chef Building Official, the Dicector of ity Planning and Buildings, the Division Manager of Property Maintenance Code Enforcement, the Director of Community Development, or other city staff original language of the code). Similarly, identiy all ‘references to the "Department of Buldings and Inspections” within the Cincinnati Municipal {Code (CMC) and in each instance determine whether the appropriate department is ether City Panning and Buildings or Community Development. The Solicitor wil also oversee the development of updated bylaws foreach ofthese boards [Within tity (30) days, the City Solicitor and the Division of Property Maintenance Code Enforcement will ganerate a joint report describing how they wil incorporate and coordinate the enforcement of Chapters 1435 and 1451 of the CMC with housing and building code enforcement, as well as with the prosecution for violations of those sections ofthe code. In par, the report may addcess strategic use of cil actions in dalton to criminal prosecutions [within sity (6) days, the Division of Property Maintenance Code Enforcement, in conjunction interaction between code enforcement and Chapters 1435 and 1451 CMC to all city staff who make code enforcement and emergency demolition decisions. ‘within thiny (30) days, the City Solicitor wil generate a set of guidelines to assis the Office of Urban Conservator and the Historic Conservation Board in executing the standards of Chapter 1435 CMG, including but not limited to the standards for granting a Certificate of [Appropriateness and the process for referring enforcement of historic provisions to the Department of Property Maintenance Code Enforcement. \within sixty {60} dys, the Urban Conservator and the Historie Conservation Board (HCE), in consultation with the Cty Solicitor, will produce & set of explanation, standards and guidelines ‘ohelp explain the historic review process tothe general public. Thisinformation will be posted on the Cys website Within thity (20) days, the Department of Planning will generate a report on the steps it will take to Implement the Histor Building Loss Task Forces recommendations for improving the Section 106 Review process and a timeline for implementation ofthe recommendations within sc (60) days, the Historic Conservation Board will draft report detailing the basis for their recent recommendation that the Cty hire additional staff forthe Office of the Urban Conservator, including specific examples, recommendation, and any aterative approsches to addressing the board’ concerns 1, The Department of city Planing and Buildings, in coordination withthe Enterprise Technology Solutions Department, will generate a report on how an online calendar will be created and maintained forthe Zoning Board of Appeals, Board of Building Appeals, Historie Conservation Board, Section 106 review hearings, Board of Housing Appeals, Zoning Hearing Examiner and public nuisance hearings. The online calendar should contain board agendas in advance of hearings (similar tothe format cutrently used for city council commitees Rhee, 2 LE René Quai, vee Mayor ‘STATEMENT (Over several months in 2009, four presentations were given tothe Vibrant Neighborhoods, Recreation, Parks and Public Services Committees detalling the lss of historic buling stock in Overthe-Rhine, The presentations described how this destruction ofthe city’s historic fabric has been attributable to an ineffective approach to both bight remediation and histori preservation and illustrated the loss of {economic opportunity that i occurring asa result. On October 13, 2008, City Council moved to create a tas force to explore these problems and proposed solutions. The Historic Bulding Loss Task Force members have served as oluntsers, They are; Michael Morgan, attorney and chairman of the Board of Housing Appeals (BHA) (former Executive Director ofthe Over the-Rhine Foundation at the time the tsk force was rested); Bobbie MTurner, historic cancutant and ‘member of the Historic Conservation Board (HCB) (former Director of Cincinnati Preservation Association atthe time the taskforce was created); Ken Jones, architect and member of both the HCE and the Board of Building Appeals (984); Bruce Goeteman, architect and member of the BHA; Sanyog Rathed, architect and former Standards and Appeals Commissioner, City of Milwaukee; Mary Burke Rivers, Director of OTR Community Housing; Ken Kreider, attorney and member of the HCB; Margaret Wuerstle, Chie Planner, Department of Planning: Ed Cunningham, Division Manager of Property ‘Maintenance Code Enforcement; Paula Boggs Muething, Assistant Gly Solicitor; Richard Ganulin, Assistant City Solictor and Lary Haris, Urban Conservator. ‘The taskforce met on numerous occasions during 2009 and 2010 and submitted the “Historic Building ‘oss Tesk Force Conclusions and Recommendations” to the Livable Communities Committee on September 8, 2010. Task force members then presented an overview of the findings to the LWvable ‘Communities Committee during three regularly scheduled meetings of the committee in October and November 2010, This motion is made to act upon the recommendations of the Historic Building Loss Task Force.
