Cailing, SK Provincial Board Member ORDINANCE NO. 911-2006 Series of 2006 AN ORDINANCE ORDAINING THE ENVIRONMENT CODE OF THE PROVINCE OF MISAMIS ORIENTAL. Be it ordained by the Sangguniang Panlalawigan of Misamis Oriental, in session assembled, that: CHAPTER 1. GENERAL PROVISIONS ARTICLE |. TITLE OF THE ORDINANCE SECTION 1. Title of the Ordinance. - This Ordinance shall be known as the MISAMIS ORIENTAL ENVIRONMENTAL CODE 2006 and shall hereinafter be referred to as the Code. w | ARTICLE 2. AUTHORITY AND PURPOSE SECTION 2. Authority. - This Code is enacted pursuant to the provisions of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, which: A, Mandates the Provincial Governor to adopt adequate measures to safeguard and conserve land, mineral, marine, forest and other resources; and B. Provides authority for the Sangguniang Panlalawigan, to protect the environment and impose appropriate penalties for acts which endanger the environment, such as dynamite fishing and other forms of destructive fishing, illegal logging and smuggling of logs, smuggling of natural resources products and endangered species of flora and fauna, slash and burn farming, and such other activities which result in pollution, acceleration of euthrophication of rivers and lakes, or of ecological balance. SECTION 3. Objectives and Purposes. - This Code is enacted for the following objectives and purposes: Objectives: . A To promote the principles of sustainable development: 1. That the use, development and protection of the environment should be Managed by LGUs per devolved functions, in a way, and at a rate, that will enable people and communities to provide for their economic, social and physical well being and for their health and safety; 2. Sustaining the potential of natural and physical resources to meet the reasonably foreseeable needs of future generations; 3. Safeguarding the life supporting capacity of air, water, land and ecosystems; 4. Avoiding, remedying or mitigating any adverse effects of human « “activities on the environment; 5. That proper weight should be given to both long and short terms economic, environmental, social and equity considerations in deciding all matters relating to environmental resources, use, protection, restoration and enhancement. B) To ensure that all reasonable and practicable measures are taken by LGUs per devolved functions to protect, restore and enhance the quality of the environment having regard to the principles of ecologically sustainable development, and & 1. To prevent, reduce, minimize and, where practicable, eliminate harm to the environment. 2. To encourage and assist by program and by industry, government authorities and the community aimed at pollution prevention and generation of technologies on reduction, reuse and recycling of materials and natural resources and waste minimization. on 3. To coordinate activities, policies and programs necessary to prevent, reduce, minimize or eliminate environmental harm to ensure effective environmental protection, restoration and enhancement. 4, To facilitate the adoption and implementation of environment protection measures agreed on by the national government and local government units in the province under inter LGU arrangements for greater uniformity and effectiveness in environmental protection. 5. To apply a precautionary approach to the assessment of risk of environmental harm and ensure that all aspects of environmental quality affected by pollution and waste, including ecosystem sustainability and valued environmental attributes are considered in decisions relating to the environment. 6. To require persons engaged in polluting activities to progressively make environmental improvements including reduction of pollution and waste at source as much improvements become practicable through technological and economic developments. 7. To allocate the costs of environmental protection and restoration equitably and in a manner that encourages responsible use of and reduce harm to the environment with polluters bearing an appropriate share of the costs that arise from their activities, products, substances and services. 8. To provide for monitoring and reporting on environmental quality on a regular basis to ensure compliance with environmental laws, rules and regulations and the maintenance of a records of trends in environmental quality 9. To provide for reporting of the state of the environment on a periodic . _ basis, and promote: i. industry and community education and involvement in decisions about the protection, restoration and enhancement of the environment, and ji, disclosure of and public access to information about significant environmental incidents and hazards aa
