ITEM 110
The following general definitions will apply when such terms are used in this tariff or in tariffs governed by this tariff. Where different definitions are provided for the same terms in connection with rates, ratings, rules, or other provisions, such definitions will take precedence: AUTOMOBILE PARTS means parts of self-propelled vehicles used on streets or highways for the transportation of persons or property including parts for freight trailers used in connection with, or in combination with, such vehicles.
BUSINESS DAY or BUSINESS HOURS means that time during which operations are generally conducted by the carrier where the service is performed, casually between the hours of 8:00 AM and 5:00 PM of every day Monday thru Friday. These terms do not include Saturdays, Sundays, or Holidays. HOLIDAYs means: New Year's Day (January 1st) Memorial or Decoration Day (Last Monday in May) Independence Day (July 4) Labor Day (First Monday in September) Thanksgiving Day Thanksgiving Friday Christmas Eve (December 24) Christmas Day (December 25)
Or any other day generally observed as a holiday by the carrier at the point where the service is performed. When the holiday falls on Sunday, the following Monday will be considered as the holiday. LOADED TO CAPACITY or CAPACITY LOAD refers to the extent to which standard truck is loaded with freight, each term meaning:
(a) that quantity of freight which when loaded in or on a standard truck equals the maximum legal load carrying capacity of the vehicle authorized by Federal, State, or Municipal laws or regulations: or (b) that quantity or freight which, in the matter loaded, so fills a standard truck that no additional article in the shipping form tendered identical in size to the largest article in the shipment can be loaded in or on the truck; or (c) that quantity of freight which because of unusual shape or dimensions or because of necessity for segregation or separation from other freight requires the entire capacity of a standard truck. (d) That quantity of freight consisting of one article loaded in or on a vehicle, when one additional article, weighing the same as or more than the article loaded, cannot be legally loaded because of the weight limitations of state or regulatory bodies. SHIPMENT is a lot of freight tendered to the carrier by one consignor at one place at one time for delivery to one consignee at one destination on one bill of lading.
STANDARD TRUCK or STANDARD VEHICLE means a straight truck, semi-trailer, flat bed, low side or any vehicle or container used to transport freight in the line haul movement, with a length of not less than 10 feet measured along the center longitudinal line of the vehicle or container floor.
ITEM 150
SCOPE OF OPERATIONS
INTERSTATE: (MC-681686) IRREGULAR ROUTES: To operate as a common carrier, by motor vehicle, in interstate or foreign commerce, over irregular routes, transporting general commodities (except Classes A and B explosives, household goods, and commodities in bulk), between points in the United States (except Alaska and Hawaii). INTRASTATE: KANSAS - (MCID NO. 168879): This certification is evidence that the carrier is authorized to transport General Commodities (except Household Goods) between all points and places in the State of Kansas.
ITEM 218
LIFT-GATE CHARGE
When the carrier is requested or required to employ mechanical loading or unloading devices, including hydraulic lifting or lowering devices, to accomplish pick up or delivery of the goods to or from the carriers vehicle an additional charge of $50.00 per shipment will apply. The charges provided in this item will be assessed against the payor of the freight charges unless payment has been guaranteed to the satisfaction of the carrier by the consignor, consignee or third party. The carrier is not obligated to perform such service when suitable vehicles, equipped with such devices, and operators are not available. Provisions of this rule shall not be construed as obligating the carrier to provide such service if, for any reason, the carrier finds it impracticable or unsafe to provide the service.
ITEM 235
Except as otherwise provided, a High Cost Delivery Fee of $72.00 will apply on shipments picked up or delivered to a specific 3 or 5 digit location listed below. These shipments will be subject to the additional pickup or delivery charges, in addition to all other charges applicable 412 418 * in Kentucky * Applies to Inbound shipments only
ITEM 241
The following charge will be added to the freight charges if the shipment is a Blind Shipment. $11.00 PER BLIND SHIPMENT (unless otherwise contracted)
ITEM 345
Actual tender of delivery at consignee's place constitutes the notice of arrival of a shipment. If the shipment is not actually tendered for delivery, notice of arrival will be given to the consignee not later than the next business day following the arrival of the shipment. (1) The notice will be given by telephone, if convenient and practicable, otherwise by mail or telegraph. The notice, however transmitted, will specify the point of origin, the consignor and the commodity and weight of shipment. (2) If the consignee's address is unknown to the carrier, the notice will be mailed to him at the post office serving the point of destination shown on the bill of lading.
(3) In the case of notification by mail, the notice will be deemed to have been given (that is, received by addressee) at 8am on the first business day after it was mailed. If the freight cannot be delivered because of consignee's refusal or inability to accept it or because carrier cannot locate the consignee or if freight cannot be transported because of an error or omission on the part of the consignor. The carrier will make a diligent effort to notify the consignor promptly in Items 500 and 501, as the case may be.
ITEM 360
Corrected bills of lading to change the freight charges collection status from prepaid to collect with not be accepted once shipment has been delivered, unless the consignee and shipper agree, and a corrected Bill of Lading is sent to us. A corrected bill of lading to change the original transpiration contracts from prepaid to collect will not be accepted if Section 7 (Non-recourse clause) of the corrected bill of lading has been signed by the consignor. A request to change the original freight charges collection status from collect to prepaid will require a corrected bill of lading from the shipper. A charge of $11.00 will apply to all corrected Bills of Lading.
ITEM 360-01
Unless otherwise agreed to in writing, contract Terms and Conditions shall be those as indicated in the carrier's Bill of Lading or in the National Motor Freight Classification 100 Item 365 Uniform Bill of Lading in effect on the date the shipment is tendered to the carrier. ONLY carrier personnel with the title of CEO, President, Vice President or Director are authorized to agree to alternate contract terms and conditions and the use of an alternate Bill of Lading referencing such terms and conditions. NO other person(s) is authorized. Where a Bill of Lading, other than the Uniform Bill of Lading or the carrier's Bill of Lading, issued by the shipper, is signed for by the carrier's driver or other person(s), that signature ONLY acknowledges receipt of the freight and identifies the entity to deliver. It is NOT a contract for the carriage of freight. Continued use of an unauthorized Bill of Lading by the shipper will NOT constitute an implied acceptance by the carrier.
Reference made to Tariffs or "Tariffs on File" means Tariffs contained in the carrier's files. Such Tariffs shall be available to shippers on request to the extent that they apply to the shipper.
ITEM 382
METHOD OF CANCELING ORIGINAL AND REVISED PAGES, EXCEPT THE TITLE PAGE
When this tariff is amended by revised pages, the cancellation of prior pages, except the title page, will be effected by means of this rule. A revised page will not show a cancellation notice except when a cancellation notice is necessary because of suspension, rejection, or other reason. Revisions of each page will be published in numerical sequence.
Except where a specific cancellation is shown on a new revised page, a revised page cancels any and all uncancelled revised or original pages, or uncancelled portions thereof, which bear the same page number. See EXCEPTIONS. For example, 1st Revised Page 10 will have the effect of canceling Original Page 10; 45th Revised Page 12 will have the effect of canceling 44th Revised Page 12; etc.
EXCEPTION: When a specific cancellation on a prior revised page excepts a previously filed page wholly or in part, this rule does not have the effect or canceling such excepted previously filed pages or portions thereof.
ITEM 430
The charges for collecting the amount of each C.O.D. shipment will be based on 3.5% of the amount to be collected, subject to a minimum charge of $25.00 and a maximum charge of $150.00. We will pick up an apparently valid check in payment; however, the shipper bears the risk of nonpayment and forgery.
ITEM 470
PART 1 CONTROL OF VEHICLE Except as provided in Part 2 of this item, no shipment is entitled to the exclusive use of the vehicle in which it is to be transported, and the carrier has control of the vehicle with the unrestricted right to: (a) Select the vehicle for the transpiration of a shipment. (b) Transfer the shipment to another vehicle. (c) Load other freight on the same vehicle. (d) Remove locks or seals applied to the vehicle. PART 2 CONTROL OF VEHICLE When the exclusive use of a vehicle is provided by the carrier at the request of consignor or consignee, the following provisions will apply: (a) Charges will apply to each vehicle used to transport the shipment. (b) The request must be given in writing or placed on the bill of lading and shipping order. (c) When bill of lading and/or shipping instructions prohibit the breaking of locks or seals or the co-loading of additional freight, such instructions will be considered as a written request for exclusive use service. (d) The vehicle will be devoted exclusively to the transportation of the shipment, without the breaking of locks or seals, except as provided in Paragraph (e). (e) In the event a lock or seal has been removed from a vehicle, the carrier will immediately re-lock or re-seal the vehicle and will notate the accompanying papers with a new lock or seal number and the reason for removal of the original lock or seal. No freight will be added to the vehicle except at the instruction of the consignor or consignee. (f) When the request for exclusive use of vehicle is made by the consignor or consignee after shipment has been receipted for and is in the possession of the carrier, the carrier will, if possible, intercept the shipment and convert it to exclusive use of vehicle service over as much of the route as possible. The party making the request must confirm in writing and guarantee charges. Such written verification will be preserved by the carrier and be considered as part of the bill of lading contract. (g) Stop-off for partial loading or partial unloading will not be permitted on shipments transported under provisions of Part 2.
PART 3 EXPEDITED SERVICE When the consignor or consignee requests expedited service, the carrier will furnish appropriate equipment, if available for such service. The term 'expedited service' as used herein means that the immediate dispatch of the appropriate equipment, vehicle, or trailer will be made and pickup and delivery will be accelerated and that the shipment will be handled with other than normal dispatch. When expedited service is requested, the Bill of Lading and Shipping Order must be endorsed with the term 'Expedited Service Requested' prior to acceptance of the shipment.
PART 4 CHARGES When the consignor or consignee requests the exclusive use of a vehicle or expedited service, the following provisions will apply: (a) Exclusive Use of Vehicle: Charges will be $80.00 per hour on weekdays (with a 3 hour minimum plus fuel surcharge) from the time they are dispatched until the time they are done. Charges will be $100.00 per hour on weekends (with a 3 hour minimum plus fuel surcharge) from the time they are dispatched until the time they are done. Expedited Service: Charges will be $100.00 per Tractor Trailer (with a 3 hour minimum plus fuel surcharge) and $80.00 per P/ U Truck (with a 3 hour minimum plus fuel surcharge). (b) Charges are to be paid or guaranteed by the party requesting the services and the non-recourse stipulation of the bill of lading may not be executed. (This paragraph not applicable on shipments moving on government bills of lading.)
ITEM 500
1. 2 hours free time will be allowed per vehicle to load or unload. 2. Time will be computed from time of arrival or appointment time, whichever is later, until vehicle is released along with appropriate bill of lading and signed delivery receipt. 3. Time beyond free time will be charged $20.00 for each 15 minutes or fraction thereof until vehicle is released, subject to an $80.00 minimum charge.
ITEM 502
When Carriers' vehicles are delayed by consignor or consignee on less-than-truckload shipments the following will apply. 1. The 1st thirty minutes will be considered as free time. 2. For every 10 minutes thereafter, a fee of $15.00 for each 10 minute period will apply unless contracted otherwise. Time will be computed from the time when constructive or actual placement is accomplished, whichever occurs first, until vehicle is loaded or unloaded. In connection with vehicles with power units attached when loading or unloading extends through a normal meal period, meal time not to exceed 1 hour will be excluded from computation of time. A record of the following information must be maintained by the carrier and kept available at all times: (a) Name and address of consignor or consignee at whose place of business freight is loaded or unloaded. (b) Identification of vehicles tendered for loading or unloading, information as to power unit being attached or not. (c) Date and time of actual or constructive placement, whichever occurs first, of the vehicle for loading or unloading and name of driver making placement. (d) Date and time vehicle is released for departure by consignor or consignee after loading or unloading is completed and name of party authorizing release of equipment. (e) Total actual weight of shipment loaded or unloaded. NOTE 1 When 2 or more shipments are tendered for pickup from one consignor for delivery to one consignee at 1 site the aggregate weight of such shipments will be used in determining the free time allowed and the resultant detention charges.
ITEM 540
A flat charge of $15.00 per shipment (unless otherwise contracted) will be added to the freight charges if the shipment contains Hazardous Material.
ITEM 545

ITEM 566
If we have to deliver the freight inside (upstairs, downstairs, and/or beyond reasonable distances) then the following Inside Delivery Fee will apply: $45.00 PER BILL OF LADING (unless contracted otherwise)
ITEM 570
IMPRACTICABLE OPERATIONS
Pick-up or delivery service will not be performed by the carrier at any site from or to which it is impracticable to operate vehicles because: (1) the condition of roads, streets, driveways, alleys or approaches thereto; (2) inadequate loading or unloading facilities; (3) riots, acts of God, the public enemy, the authority of law, the existence of violence or such possible disturbance as tending to create reasonable apprehension of danger to persons or property.
ITEM 647
A flat charge of $10.00 per shipment will be added to the freight charges if we have to call for an Appointment unless otherwise contracted.
ITEM 670
The following charge will be added to the freight charges if the shipment exceeds 16 ft. in length $22.00 PER BILL OF LADING This charge will not apply on exclusive use of the trailer
ITEM 726
PAYMENT OF CHARGES
We reserve the right to cancel all discounts/reductions if a customer has not paid within 60 days from the date of freight bill.
ITEM 750
When the carrier is requested to perform same day pickup and delivery service on a shipment and this is actually performed, a charge of $80.00 per hour will be assessed to the party requesting this service.
ITEM 753
The following charge will be added to the freight charges if the shipment delivers to a Private Residence: $45.00 PER BILL OF LADING (unless otherwise contracted)
ITEM 754
(1) When consignor or consignee requests carrier to pick up and/or deliver freight on Saturdays, Sundays or Holidays, such service will be subject to a charge of $100.00 per hour with a 2 hour minimum on LTL or TL shipments per man, per hour, or fraction thereof. Such charges shall be in addition to all other applicable rates and charges. (2) Time shall be computed upon notification of the driver to the responsible representative of the consignor or consignee that the vehicle or vehicles are available for loading or unloading at premises of consignor or consignee, and shall end upon completion of loading or unloading and receipt by driver of signed bill of lading or receipt for delivery. (3) Consignor or consignee may request carrier to place or pick up empty trailer(s) (vehicles without power units) on Saturdays, Sundays or Holidays, even though the actual pickup and/or delivery of freight may occur on a day other than Saturday, Sunday or Holidays. The charges for this service will be $100.00 per hour (2 hour minimum), for dropping the trailer if requested. (4) Carrier is not obligated to furnish pickup or delivery service on Saturdays, Sundays or Holidays. (5) Charges must be either paid by the party requesting the service or guaranteed to the satisfaction of the carrier before pickup or delivery will be made.
NOTE The term 'Holiday' means: New Years Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day or any other day generally observed as a holiday by the carrier at the point where the service is performed. When the holiday falls on a Saturday, the previous day will be considered as a holiday and when the Holiday falls on a Sunday, the following Monday will be considered as a holiday. If a delivery date is specified on the Bill of Lading or the Shipping Order and it is a Saturday, Sunday or a Holiday, such document must also indicate that the date is in fact a Saturday, Sunday or a Holiday.
ITEM 766
Where a rule is published in this tariff covering the same service as a rule published in National Motor Freight Classification ICC NMF 100 Series, such rule published herein, to the extent of its application, will apply in lieu of the rule published in National Motor Freight Classification ICC NMF 100 Series.
ITEM 770
PREPAYMENT OF CHARGES
(a) No shipment will be accepted when the line-haul transportation charge is partially prepaid, partially collect. (b) Freight charges must be prepaid on all shipments consigned to or in care of Trade Shows, Traveling Shows, Chautauquas, Fairs or Exhibitions.

If we have to protect the freight from Freezing, the following charges will apply: $10.00 PER BILL OF LADING (unless otherwise contracted)
ITEM 820
RE-CONSIGNMENT
The fee for re-consignment to another city will be the tariff rate from and to the point of re-consignment.
ITEM 830
REDELIVERY
Additional tenders and final delivery will be subject to the following charge: $60.00 PER BILL OF LADING This charge is in addition to all other lawful charges applicable to the shipment, including any accrued storage charges.
ITEM 848
RELEASED VALUE
When the rates provided in this tariff or tariffs governed by this tariff are applied on commodities as listed in the NMFC subject to released or actual value conditions, the lowest released or actual value provided in the NMFC for that commodity shall be used for the purpose of settling loss and damage claims, however, in no event will the value exceed $1.00 per pound. When the rates provided in this tariff or tariffs governed by this tariff are applied on commodities as listed in the NMFC which are NOT subject to any released or actual value conditions, then the value used for the purpose of settling loss and damage claims will be $1.00 per pound.
ITEM 880
SEALING OF TRUCKS
Except as otherwise provided in Item 470 (Control and Exclusive Use of Vehicles), of this tariff, or in individual rate items in tariffs governed by this tariff, any seals or locks applied to vehicles may be removed at the option of the carrier, via which such vehicle is moving, for the purpose of adding or transferring freight for better utilization of equipment or for the purpose of inspection of the lading or equipment.
ITEM 900
STOP-OFF CHARGES
Shipments stopped for partial loading will be subject to a stop-off charge exclusive of the initial pickup and final delivery stop.
STOP-OFF CHARGES: (1) $100 for first stop (2) $200 for second stop (3) $300 for third stop and an additional $100 per each stop in excess of three stops All such charges shall be in addition to the accrued freight, storage, redelivery and all other lawful charges applicable to the shipment.
ITEM 905
ITEM 910
STORAGE FEE
Carriers named herein will provide storage for undeliverable shipments at $5.00 per day at the delivering terminal after 3 days from receipt. Storage fee will commence at 7 a.m. the next work day after notification.
ITEM 980
Any shipment undelivered when returned to the shipper shall be returned at the same charge tariff rates from the point of return as origin to the original origin of the shipment (the destination of the returned shipments).
NOTE The applicable rates in effect on the date of the returned shipment will be applied on such returned movement and shall be in addition to all other applicable charges.
ITEM 985
When carrier, upon receipt of a request to pick up a LTL, Truckload or Volume Shipment, or to furnish a vehicle for the exclusive use of a consignor, has dispatched a vehicle for such purpose and due to no disability, fault or negligence on the part of the carrier, vehicle is not used, a charge of $25.00 per stop will apply on LTL shipments, and a charge of $80.00 per hour will apply on Truckload or Volume shipments, from the time vehicle leaves until it gets back, subject to a minimum charge of $200.00. Accrual of these charges will terminate when carrier is notified that vehicle will not be used.
ITEM 995
An Illinois Toll Charge of $2.00 per Bill of Lading will apply on shipments delivering to or shipping from the following Zip Codes: 600 - 608, with the exception of 604
