January 18,2012 Lisa Madigan IL Attorney General 500 South Second Street Springfield, IL 62706 Dear Attorney General Madigan, I'm writing you in regard to your office's investigation of the Save-A-Life Foundation (SALF), an investigation which reportedly has been underway for about 18 months. When I recently phoned your office to inquire about the status of the case, your legislative aide Kareem Kenyatta told me the investigation was open but only because they couldn't locate Carol J. Spizzirri, SALF's founder and president Frankly, I was stunned. Having served over three decades in law enforcement, I couldn't imagine anyone working for me making such a feeble excuse. To prove the point, shortly after that conversation, I located the following information on the Internet in about 30 seconds: Carol Spizzirri 1930 W. San Marcos Blvd #285 San Marcos, CA 92078 Less than an hour later, the San Diego County Assessor confirmed that the property was purchased on August 7,2006 by Spizzirri and Scott Anderson, a former SALF Treasurer and Corporate Director. Mr. Kenyatta didn't indicate whether your investigators had attempted to contact these other members of SALF's most recent Corporate Board, but here's their contact information as well, all of which was quickly obtained by searching Google:

Browne, Treasurer 2851 Evans Woods Dr. Doraville, GA 30340 John Donleavy, Director 325 3rd Street South Naples, FL 34102 Incidentally, according to her Facebook page, Spizzirri spent this Christmas with Mullins, who served as mayor of Palatine for 20 years. Reportedly SALF received almost $9 million taxpayer dollars to providefirstaid training to children, "many of them from the Chicago Public Schools," according to Spizzirri. But in response to a federal court subpoena and FOIAs, the Chicago Schools and other school districts where SALF claimed to have trained many thousands of students have been unable to locate any training records. Spizzirri and her organization have a history of other serious misrepresentations. For example, SALF's fund raising materials represented Spizzirri as a Registered Nurse with a specialty in renal transplants who possessed a four-year degree from a college in Ladysmith, Wisconsin. SALF also claimed Spizzirri's motivation for founding the organization was triggered by the death of her teenage daughter who supposedly bled to death following a hit and run accident, a story repeated ad infinitum over the 16 -year existence of the corporation. Since 2006 a growing body of media reports in Illinois and around the country has proved all those claims to be false. Further, last year a San Diego newspaper reported that Spizzirri is a twice-convicted adult shoplifter whose daughter took out a protection order against her based on allegations of extreme physical abuse. Last month Illinois State Board of Education Chairman Gery Chico told the Executive Appointments Committee (on which I serve) that SALF falsely claimed he and his wife were members of the organization's board. According to a recent New York newspaper article, the Health Commissioner of Westchester County, NY, says SALF also falsely claimed she was a board member. Given such overwhelming evidence, it's questionable whether the Save-A-Life Foundation ever told the truth about anything. Undoubtedly you agree that we have a duty to assure the public that the millions in public and private dollars SALF obtained weren't misappropriated. I realize that by law you're

not permitted to discuss the details of an ongoing investigation, however, based on my conversation with Mr. Kenyatta, I'd appreciate some indication from you how seriously your office is pursuing these matter. Dear Senator Bivins; I am writing in response to your letter regarding the Save-A-Life Foundation (SALF). First, allow me to correct what may have been a miscommunication or misunderstanding regarding this Office's investigation of Ms. Spizzirri's current whereabouts. Without trying to reconstruct your conversation with Mr. Kenyatta of this Office, let me assure you that we have been aware of Ms. Spizzirri's whereabouts since she moved to California. Her current address, which we certainly have, does not explain why our investigation of SALF is ongoing. As you acknowledge, we do not discuss the details of an ongoing investigation, so we will not be able to provide you with more information about the status of our investigation. But, let me emphasize that, as with all such allegations against charitable organizations, we took these allegations very seriously and immediately initiated an investigation of SALF regarding the financial and other reporting issues raised by the complainants. Second, as background, please understand that this Office's Charitable Trust Bureau has as its primary mission the protection of charitable assets held by charitable organizations registered in Illinois. The Bureau does not have jurisdiction to investigate or prosecute criminal conduct, which would fall under the jurisdiction of local State's Attorneys, but rather enforces the Charitable Trust Act through civil court actions. Additionally, where grants from state agencies are involved, the Office typically becomes involved through referrals from the granting agencies. We have never received a referral from a state agency raising any concerns regarding a grant made to SALF. Third, as further background information, SALF was registered as an Illinois charitable organization with this Office from 1994 through 2009, during which period it filed complete annual reports accompanied by audits when required by law. In September 2009, SALF filed articles of dissolution with the Secretary of State. It then filed a final report with this Office in April 2010. When we first received complaints in June, 2010, SALF was no longer an active

I appreciated your offer to answer any further questions I might have. In fact, I do have one. As you maybe aware, in FY2003 your office awarded a $25,000 grant to SALF. An application for the funding was submitted to your agency by Bennett Krause, SALF's National Director of Legislative Affairs. According to the grant application submitted by Mr. Krause, the $25,000 your office awarded to SALF was designated to provide first aid training classes to students in the following eight IL school districts: Salem School District #111 (Marion County) South Central Community Unit School District #401 (Kinmundy, Marion County) Camp Point CU School District #3 Beardstown CU School District #15 Rantoul City School District #137 (Champaign County) Cass County School Districts (Cass County) Edwardsville CU School District #7 Greenview CU School District #200

However, in response to recent FOIA requests, representatives of all eight districts promptly and unequivocally replied that they have no records of any training records. Most responded that they've never had any association with SALF. Further, in the grant application, Mr. Krause stated: The Save A Life Foundation (SALF) instructors have successfully trained more than e00,005 school children iinllinois since 1998. Based on the reasons explained in my previous letter, in my opinion this 500,000 figure is not only unsupportable, it's completely fabricated. In any event, presumably Mr. Krause can shed some light on these questions. According to his Linkedln resume, he's now employed as Statewide Manager of the IL State Employment Services Division. The Save A Life Foundation believes if every American could be trained in Basic Bystander Life Supporting Skills, they would be empowered not only in their everyday lives, but they would also become America's greatest asset in any emergency or crisis. Section l(l)(f) Section 7(1 )(f) of FOIA protects against disclosure of "[preliminary drafts, notes, recommendations, memoranda, and other records in which opinions are expressed, or policies or actions are formulatedf.]" We withheld two records pursuant to this section of FOIA. Specifically, we withheld an internal e-mail communication between Brent Stratton, Chief Deputy Attorney General, and Therese Harris, Chief, Charitable Trusts Bureau, pertaining to the Save-A-Life Foundation. This e-mail was written for the purpose of understanding certain legal requirements placed on the Save-A-Life Foundation in order to formulate a course of action with regard to Mr. Heimlich's inquiry pertaining to the grant. Further, the e-mail contains an opinion regarding the matter involved. We also withheld a draft letter to Senator Bivins from Mr. Stratton pertaining to the issue of the grant to Save-A-Life Foundation. This letter was preliminary in nature and had not been sent at the time of our response to Mr. Heimlich's FOIA request. The draft letter explains certain policies of the Attorney General's office and discusses possible courses of action by this office based on the policies. These records are exempt under the rationale that public bodies must be able to evaluate information internally and explore possible courses of action confidentially before making final determinations that should be shared with the public. See Harwood v. McDonough, 344 111. App. 3d 242, 247 (2003) ("as a matter of public policy, section 7(1 )(f) exempts from disclosure predecisional materials used by a public body in its deliberative process"). Accordingly, the internal e-mail and draft letter are exempt from disclosure under section 7(l)(f) of FOIA. I have enclosed copies of the withheld internal e-mail and draft letter for your review. Also enclosed is an e-mail communication received from Mr. Stratton pertaining to Mr. Heimlich's FOIA request that will assist you in your review of this matter. Heimlich. We have considered OAG's response to the allegations in the Request for Review; Mr. Heimlich did not reply. On June 6, 2012, Mr. Heimlich requested copies of all records related to a specific letter from State Senator Tim Bivins to OAG Chief Deputy Attorney General Brent D. Stratton, "including but not limited to internal correspondence and any response(s) to Sen. Bivins."1 OAG provided responsive records with a signature redacted pursuant to section 7(1 )(b) of FOIA (5 ILCS 140/7(l)(b) (West 2011 Supp.)). DETERMINATION All public records in the possession or custody of a public body are "presumed to be open to inspection or copying." 5 ILCS 140/1.2 (West 2010); see also Southern Illinoisan v. Illinois Dept. of Public Health, 218 111. 2d 390, 415 (2006). A public body "has the burden of proving by clear and convincing evidence" that a record is exempt from disclosure. 5 ILCS 140/1.2 (West 2010). Section 7(1 )(f) exempts from inspection and copying "[preliminary drafts, notes, recommendations, memoranda and other records in which opinions are expressed, or policies or actions are formulated, except that a specific record or relevant portion of a record shall not be exempt when the record is publicly cited and identified by the head of the public body." The section 7(1 )(f) exemption is intended to encourage government officials to openly and frankly discuss matters of governmental concern in order to make informed policy decisions. Harwood v. McDonough, 344 111. App. 3d 242, 248 (1st Dist. 2003). We have reviewed the records withheld pursuant to section 7(1 )(f), which consist of a draft version of a letter to State Senator Tim Bivins and e-mails containing opinions which were exchanged by the Chief Deputy Attorney General and the Chief of OAG's Charitable Trusts Bureau "for the purpose of understanding certain legal requirements placed on the Save-A-Life Foundation in order to formulate a course of action[.]"2 Such records are pre-decisional in nature, and there is no indication that the draft letter and e-mails have been publicly cited or identified by the Attorney General. Accordingly, we conclude that OAG has sustained its burden of demonstrating by clear and convincing evidence that the records in question are exempt from disclosure under section 7(1 )(f) of FOIA. OAG also properly redacted Senator Bivin's signature from a responsive record pursuant to section 7(1 )(b) of FOIA, which exempts from disclosure private information. Section 2(c-5) of FOIA (5 ILCS 140/2(c-5) (West 2011 Supp.)) defines "private information" as "unique identifiers[.]" The Public Access Bureau has previously determined that signatures are unique identifiers and, therefore, constitute private information which may be withheld under section 7(l)(b). 111.
