ORDER OF TEMPORARY RESTRICTION
[WITH NOTICE OF HEARING]
On September 21, 2012, came to be heard before the Disciplinary Panel (the "Panel") of
the Texas Medical Board (the "Board"), composed of Melinda McMichael, M.D., Chair,
Timothy Webb, J.D., and Carlos L. Gallardo, members of the Board, duly in session, the matter
of the Application for Temporary Suspension or Restriction (With Notice of Hearing) of the
license of Wayne Soignier, M.D. ("Respondent"). Respondent appeared in person with counsel,
Brad McClellan. Scott Freshour and Barbara Jordan represented Board staff. Based on evidence
submitted, the Board, through this Panel, makes the following Findings of Fact and Conclusions
of Law and enters this Order ofTemporary Restriction (With Notice of Hearing):
FINDINGS OF FACT
1. Respondent is a Texas physician and holds Texas Medical License Texas Medical
License No. G-9665 issued by the Board on February 22, 1986, which was in full force and
effect at all times material and relevant to this Order. All jurisdictional requirements have been .
satisfied.
2. The President of the Board, Irvin E. Zeitler, Jr., D.O., appointed Melinda McMichael,
M.D., Chair, Timothy Webb, J.D., and Carlos Gallardo to sit as a Disciplinary Panel ("Panel") in
this maUer, pursuant to the Medical Practice Act, TEX. OCC. CODE ANN. Title 3, Subtitle B (the
"Act") 164.059(a) and 22 TEX. ADMIN. CODE 187.56.
3. The Panel convened With Notice, pursuant to 164.059(c) of the Act.
4. Respondent is primarily engaged in providing medical evaluations in the Workers
Compensation system. Respondent's practice address is located in Dallas, Texas. Respondent is
not board certified.

5. The Respondent was subject of a proceeding before the Division of Worker
Compensation of the Texas Department of Insurance, ("DWC"). During the DWC proceeding, a
two-member panel of physicians became increasingly concerned over Respondent's inability to
answer basic medical questions. Respondent also displayed delusional thinking during the DWC
proceeding.
6. The Panel concluded after the questioning of Respondent, and hearing testimony from
a DWC physician who was at the DWC hearing referred to in Finding of Fact No.1, that there
were serious deficiencies in Respondent's understanding and application of basic principles of
medicine, cognitive abilities, and a significant deficit in critical thinking and decision-making.
7. The Panel questioned Respondent about his claim that he had "saved Obama's life."
When asked to elaborate, Respondent explained that he had uncovered a plot to assassinate
President Obama by a patient he was assessing. He reported that he contacted the FBI who then
poisoned the patient. When asked how Respondent knew the patient was poisoned by the FBI,
he stated that the patient showed deformities of the face "like the Russian politician."
Respondent further indicated that there are multiple (30) groups of "rangers" still plotting to
assassinate the President. Respondent also gave extensive testimony about his "prior
involvement" with the FBI.
8. The Panel determined that Respondent lack of fundamental medical knowledge
combined with delusional thinking demonstrates that his practice of medicine presents a
continuing threat to the public health and welfare.
9. Based on the above Findings of Fact, the Panel, including a physician licensed to
practice medicine in this state, finds that Respondent is a continuing threat and real danger to the
health of Respondent's patients or to the public from the acts or omissions of Respondent caused
through Respondent's lack of competence, impaired status, or failure to care adequately for
Respondent's patients.
10. Based on the above Findings of Fact, the Panel finds an imminent peril to the public
health, safety, or welfare that requires immediate effect of this Order of Temporary Restriction
on the date rendered.

CONCLUSIONS OF LAW
Based on the above Findings of Fact, the Panel concludes the following:
1. Section 164.059 of the Act authorizes the Disciplinary Panel to temporarily
suspend or restrict the medical license of Respondent if the Disciplinary Panel determines from
evidence presented to it that the Respondent's continuation in the practice of medicine would
constitute a continuing threat to the public welfare.
2. Based on the evidence presented and the Findings of Fact set forth herein, the
Panel finds that under Sections 164.051(a)(4) and 164.056 of the Act the Board is authorized to
take disciplinary action against Respondent based on Respondent's inability to practice medicine
with reasonable skill and safety to patients because of illness or as a result of any mental or
physical condition.
3. Based on the evidence presented at the hearing and the above Findings of Fact
and Conclusions of Law, the Panel determines that Respondent's continuation in the practice of
medicine would constitute a continuing threat to the public welfare.
ORDER
Based on the above Findings of Fact and Conclusions of Law, the Panel ORDERS that:
Respondent's Texas Medical License is hereby TEMPORARILY RESTRICTED.
1. Probationer shall not engage in the clinical practice of medicine or in any capacity
that involves direct or indirect patient contact. For the purposes of this Order, the "clinical
practice of medicine" is defined as the diagnosis, offer of treatment, treatment of a mental or
physical disease or deformity or injury by any system or method, or attempt to effect cures of
those conditions, and includes providing medical evaluations in the DWC system.

2. Respondent shall undergo a complete neurological examination by a Board-
approved neurologist, specifically examining whether Respondent has the ability to practice
medicine with reasonable skill and safety to patients.
a. The examination shall include, at a minimum, both a complete cognitive and
motor function examination.
b. Board staff will furnish to the examining physician any Board information that it
determines, in its discretion, may be helpful or required for the examination of
Respondent.
c. Respondent shall be required to cooperate with the examining physician,
including executing any and all releases for medical records and authorizations
necessary to effectuate the provisions of this Order.
d. Respondent shall pay all fees charged by the examining psychiatrist.
e. The Compliance Division of the Board shall furnish a copy of this Order to the
evaluating psychiatrist, who shall make a full report to the Compliance Division
of the Board regarding the psychiatrist's evaluation of Respondent and
recommendations.
3. Respondent shall undergo a complete forensic psychiatric examination by a
Board-approved psychiatrist, specifically examining whether Respondent has the ability to
practice medicine with reasonable skill and safety to patients.
a. The evaluation shall include, at a minimum:
( I) Social history and background information;
(2) History of present illness;
(3) Mental status exam;
(4) Review of records and other pertinent information;
(5) Current DSM multiaxial diagnosis, and
(6) Recommendations regarding continued care and treatment.
b. Board staff will furnish to the examining psychiatrist any Board information that
it determines, in its discretion, may be helpful or required for the examination of
Respondent.

c. Respondent shall be required to cooperate with the examining psychiatrist,
inc.Juding executing any and all releases tor medical records and authorizations
necessary to effectuate the provisions of this Order.
d. Respondent shall pay all fees charged by the examining psychiatrist.
e. The Compliance Division of the Board shall furnish a copy of this Order to the
evaluating psychiatrist. who shall make a full report to the Compliance Division
of the Board regarding the psychiatrist's evaluation of Respondent and
recommendations.
4. This Order of Temporary (With Notice of Hearing) is fmal and
effective on the date rendered.
S. This Order of Temporary Restriction (With Notice of Hearing) shall remain in
effect until it is superseded by a subsequent Order ofthe Board.
