Dear Mr Orbach: Today, I visited the Beit HaKerem, Jerusalem, Branch of Bank HaPoalim and asked to execute banking transactions in my accounts, detailed in my March 11, 2013 advance notice (copied below): purchase Bank of America Corporation [BAC:NYSE] stock and US T-bills. Clerk Shulyatsky refused to execute the transactions, unless I produce records of renunciation of US citizenship to Bank HaPoalim's satisfaction, and then sign the attached document. ("Change of US Person Registration Form Declaration and Waiver") Ms Shulyatsky's supervisor, Ms Efrat Dahan, explained that I was denied access to such services following instructions by Mr David Zagen of the Public Relations Unit of the Bank in Tel Aviv. As detailed in the past, regardless of fabricated legal language of your documents, such conduct has no lawful basis, and it amounts to extortion and denial of a German citizen's equal access to banking services in Jerusalem. Dear Ms Amzallag: Thank you for your quick response on my request to purchase Bank of America Corporation [BAC:NYSE] stock and US T-bills, copied below. Your response failed to address my requests at all. Instead, it responded with unrelated, fabricated legal demands, pertaining to irrelevant laws of the United States. In case my intention was unclear: I will try next week to materialize my right for equal access to banking services as a German citizen in an Israeli bank in Jerusalem, by attempting to make the requested purchases. In case the Bank is denying my access to such equal services, please let me know in advance, so that I don't waste my time or yours. Thank you for forwarding to me the attached Hebrew and English, bilingual "Change of US Person Registration" form. The form is unmarked as to its author, and there is no indication when it was drafted, or whether it is a document of Bank HaPoalim, BM, Israel, or any other entity. My Customer Agreement was signed with Bank HaPoalim, BM, and Israeli bank, pursuant to the law of the State of Israel. However, there is no reference to the law of the State of Israel that is the foundation for this form, only to various US laws, which are irrelevant to this matter. Finally, implied again in Bank HaPoalim's demands is the threat of denial of access to equal banking services by and Israeli bank, operating under Israeli banking regulation, to a German citizen and a resident of Jerusalem, which is unlawful. I would be grateful if you could please clarify: 1) Who authored "Change of US Person Registration" form. and when? 2) On whose behalf was it produced, and if so, why is it unmarked? 3) What is the legal foundation for this form in the law of the State of Israel, if any? 4) What are the current restrictions placed by the Bank on my access to equal banking services for refusing to yield to the Bank's unlawful demands?
