AN EFFECTIVE APPROACH TO PREPARE BILL OF QUANTITIES FOR

ENVIRONMENTAL PROTECTION AND ENHANCEMENT

Preface

There is an urgent need for the construction industry to address the issues of environmental problems arising from the accelerated infrastructure development. In this aspect, Jabatan Kerja Raya (JKR) Malaysia has moved forward in defining the environmental requirements by incorporating Environmental Management Plan (EMP) into tender documents. However, the success and effectiveness of this approach does not rely solely on the EMP but also on the need to enhance the commitment and awareness of all parties involved, particularly the developers/contractors, designers, consultants, academicians and decision makers. It is of utmost importance to produce tender documents which are clear and comprehensive. A revision on environmental protection and enhancements in JKR Tender Documents has been done by itemising the environmental works into the Bill of Quantities to allow contractors to tender a realistic price. This Arahan Teknik provides changes to the items in the Tender Document with regards to the Condition of Contracts, Instructions to Tenderers, Specification to Environmental Protection and Enhancements, Preamble to Bill of Quantities, Bill of Quantities and Drawings. The draft version of this Arahan Teknik had been presented during the National Engineering Conference of Awam 2001 organized by Universiti Sains Malaysia in February 2002, Seminar on Best Earthworks Management Practices in Construction Industry which was jointly organized by Construction Industry Development Board, Department of Environment and JKR Malaysia in March 2002, and during the Assistant Directors (Road) Meeting in Mac 2002. It was also presented during the Workshop on Environmental Consideration in Road Projects in April 2002 organized by the Road Engineering Association of Malaysia (REAM) and JKR Malaysia.

ENVIRONMENTAL MANAGEMENT PLAN

The idea of incorporating Environmental Management Plan(EMP) into contract documents was conceived in November 1999 through the sub-committee of environmental management which was chaired by Tn. Hj. Abu Harith bin Shamsuddin of Unit Rekabentuk Jalan, Cawangan Jalan. This sub-committee comprises thirteen (13) multi-disciplinary personnel as listed below:-

EXECUTIVE SUMMARY

Arahan Teknik (Jalan) 22/01 - A Practical Guide To Prepare Bill Of Quantities For Environmental Protection And Enhancements provides some guidelines for the preparation of Tender Documents. It comprises the Instructions to Tenderers, Condition of Contracts, Specification to Environmental Protection and Enhancements, Preamble to Bill of Quantities, Bill of Quantities and Drawings. Guidelines on the preparation of an Environmental Management Plan (EMP) and Bulk Fuel Storage Tanks and an example of Needs Statement are presented. Photographs of environmental mitigating measures such as silt traps, silt fences, sediment basins, slope protection works, green/animal crossings and by passes, salvaging of protected species and proper management of scheduled waste and skid tanks are enclosed. In addition, monitoring of water, air and noise as well as the good and bad practices of environmental management during construction locally and abroad are highlighted.

INTRODUCTION This Arahan Teknik (Jalan) 16/03 is a reference for the incorporation of environmental protection and enhancements measures in executing contracts. The designer shall choose only relevant sections in this Arahan Teknik which are applicable to his/her project.

3.0

INSTRUCTION TO TENDERERS Environmental Management Plan (EMP) As stated in the Contract Specification issued by the Jabatan Kerja Raya on behalf of the Government of Malaysia, the Contractor shall comply with all legal duties and obligations regarding the protection of the environment as laid down in the Environmental Quality Act 1974 (Act 127). Before the commencement of works Contractor shall submit to the Superintendent Officer (S.O.), Environmental Management Plan (EMP), detailing the Contractors proposed arrangement for the abatement and mitigation measures for environmental protection, environmental monitoring, testing programme and reporting, and his organisation chart.

OBJECTIVES The objectives of this Arahan Teknik (Jalan) 16/03 are as follow: (i) To assist contractors to price environmental protection measures accordingly. To provide relevant information for the amount of work to be carried out as per requirements. To instill good environmental management and monitoring practices during construction. To protect, restore and enhance quality of the environment due to project construction.

4.0

CONDITION OF CONTRACT

4.1

ENVIRONMENTAL MANAGEMENT PLAN (EMP) Tenderers are required to comply with all legal duties and obligations regarding the protection of the environment as laid down in the Environment Quality Act 1974 (Act 127). Within thirty (30) days from the Letter of Acceptance the successful tenderer shall submit for the S.O.s approval a detailed Environmental Management Plan (EMP) based on the general guidelines for the preparation of the Environmental Management Plan (EMP) as given in Appendix A. The EMP shall include the Contractors proposed arrangements of structural organisation, work program chart related to environment, abatement and mitigation measures for environmental protection, environmental monitoring programme and reporting. The cost of preparing the EMP including the cost involved obtaining the services of Environmental Consultant shall be deemed to be borne by the Contractor.

The Environmental Impact Assessment (EIA) report and the Conditions of Approval given by the Department of Environment (DOE), where applicable, will be made available by the Government to assist the Contractor in preparing the EMP.

e) 5.1 INTRODUCTION f) This section contains the specifications relating to environmental matter in the execution of this contract. Where these matters appear also at other sections of this document, this specification shall take precedence.

The Contractor shall be liable for and shall indemnify the Government against any damage, expense, liability, loss, claim, prosecution, proceeding, fine, penalty caused by non-compliance or contravention of above legislation.

SITE OFFICE AND ACCOMMODATION

5.3.2 Accommodation for Workmen a) The Contractor shall provide and maintain at the Site, suitable and sufficient accommodation and camps for his workmen and supervisory staff as required in the Contract. The locations of the workmens accommodation shall be agreed beforehand with the S.O. and shall be such as to avoid obstruction and nuisance to the Works and public and shall be laid out in an approved and orderly manner. The Construction and habitation of the accommodation shall comply with the local statutory or other Government authorities and subjected to the approval of the S.O. Sufficient toilet facilities shall be provided to the satisfaction of the S.O. and in accordance with Ministry of Health Regulations. Proper provision shall be made for the disposal of all waste and refuse and there shall be adequate supply of water for washing, cooking and drinking purposes. The

5.3.1 Site office, workshop and store a) The Contractor shall provide and maintain at the Site, suitable and sufficient offices for his own use and that of the S.O. and his representative. The Contractor shall also provide and maintain at the Site suitable workshops and stores for him to carry out his works. The Contractor is prohibited from discharging oil and grease to any watercourses. Any spilled oil and grease shall be promptly removed by the Contractor. The Contractor shall collect and store used oil and grease and dispose them according to methods approved by Department of Environment.

The supply shall be taken from sources approved by the S.O. The Contractor shall submit his plans for the water supply and reticulation system, including filtration, chlorination and other proposed treatment, to the S.O for approval, not less than thirty (30) days before commencb) a) The Contractor shall supply, construct, operate and maintain temporary toilet facilities at appropriate locations on site. Facilities shall be complete with adequate water closets, urinals and handbasins, and proper sanitary system. The location of these facilities and their construction shall be as approved by the S.O. The Contractor shall maintain the Site and toilet in a clean and sanitary condition shall comply with all requirements of the Ministry of Health.

All waste-waters must be treated such that its discharged effluent meet the requirements of all existing regulations and legislations.

5.5

SITE CLEARING, EARTHWORKS AND EXCAVATION

5.5.1 Site Clearing Should be read in conjunction to specification in Standard Specification For Road Works. a) Site clearing should be done in stages and no burning of cleared vegetation and debris shall be allowed unless approval has been obtained from the Director General of Department of Environment. Cleared vegetation and debris should be disposed off in designated spoil tips which must be approved by the S.O. The method of depositing the spoil tips must be properly engineered, designed and approved by the S.O. Unless otherwise stated, the Contractor shall be responsible for identifying these disposal areas. The dump site/disposal areas are to be finalised before any site clearing is allowed to be carried out.

5.3.3.3 Garbage disposal a) The Contractor shall undertake the collection and disposal of garbage from the area. Garbage collection shall be made at least twice each week at times approved by the S.O. and the services shall be continued until completion of the Works. Garbage or construction waste materials shall be disposed off in a locally available landfill or hauled to disposal sites approved by the S.O.

ENVIRONMENTAL MANAGEMENT PLAN When necessary as stipulated in the instructions to tenderer, the Contractor shall submit for the S.O. approval a detailed Environmental Management Plan (EMP) as described in the General Guideline for the Environmental Management Plan (EMP) by the Contractor.

On no account should cleared vegetation, debris and spoils be deposited or pushed into water-courses, streams and rivers. Trees and vegetation identified for conservation must be protected by the Contractor at all costs.

Erosion mitigating measures are to start before commencement of site clearing and earthworks. This include planning for work in stages and also plans for diverting as much as possible surface runoff from the work areas. The Contractor shall provide all necessary temporary drainage for keeping the site and other areas free of standing water. Effort must be made to channel the surface runoff as much as possible away from the work areas. If due to unforseen circumstance turfing cannot be carried out immediately to the slope exposed areas, temporary protection/cover (e.g. plastic sheet or equivalent) shall be applied to exposed surfaces by the Contractor. Should the Contractor fail to ensure all the above, the S.O. will appoint other Contractors to carry out the said work and all costs incurred will be charged to the defaulting Contractor and deducted from monies due to him.

i) e) Other clearing activities such as access road construction, site office and work-camp construction, etc shall proceed with minimal cutting of trees and site clearing. The intended area shall be marked out for the S.O.s inspection and approval prior to any site clearing works. Site clearing should be from the centre of the road outwards towards the right-of-way boundary to enable escape of wildlife into neighboring jungles. Holes and cavities resulting from the clearing, grubbing, destumping and de-rooting shall be backfilled with acceptable materials and compacted to approximate densities of adjacent areas.

5.5.2 Earthworks And Excavation a) All silt traps, sedimentation basins, erosion control measures and drainage system as shown in Drawings must be constructed in stages and maintained by the Contractor. The locations of these mitigating measures shall be detailed and shown on plan as required by the S.O. Water discharging from the silt trap/sedimentation basin should have total suspended solids level of 150 mg/l or as specified in the Condition of Approval of EIA. The monitoring schedule is as stated in the Environmental Management Plan (EMP). b) The Contractor shall provide all necessary temporary drainage for keeping the site and other areas free of standing water before and during any earthworks started. Effort must be made to channel the surface runoff as much as possible away from the work areas.

c)

All temporary drainage, mitigation measures (e.g. silt traps and silt fence) must be constructed before any earthworks is to be carried out and maintained throughout construction period to ensure their effectiveness. Unsuitable materials and surplus earth shall be disposed off in designated spoil tips. The method of depositing the spoil tips must be properly engineered designed and approved by the S.O. Unless otherwise stated, the Contractor shall be responsible for identifying these disposal areas. The dump site/ disposal areas are to be finalised and approved by the S.O. before any earthworks allowed to be carried out. In the event additional disposal areas (spoil tips) are required, the Contractor shall be responsible for identifying these disposal areas which shall be approved by the S.O. Unsuitable materials and surplus earth need to be sufficiently graded, leveled and revegetated. No tipping is to be allowed.

The Contractor shall schedule as much as possible of the earthworks to be carried out during dry weather periods. The Contractor shall also carry out earthworks in a systematic/orderly manner to minimise earth surfaces from being exposed bare for long periods. The sequence of earthworks should be in compliance with the Environmental Management Plan. Turfing or hydroseeding must be carried out immediately after earthworks and before work on other berm/lift commences. If due to unforseen circumstances turfing cannot be carried out immediately, temporary protection/cover (e.g. plastic sheets or equivalent) shall be applied to the exposed slopes by the Contractor.

ACCESS ROADS AND EXISTING ROAD a) All access roads to the site shall be paved for a distance of at least 10 metres from where these access roads join the existing roads. The Contractor shall maintain all existing roads, bridges, drains, culverts, roadside furniture, and all other appurtenances and services on such roads and shall be responsible for any damages caused by any work carried out by him or by construction period and shall repair and rein state the same to their original condition to the satisfaction of the S.O. All temporary diversion affecting public/private roads must be approved by the Government, private landowner and the S.O. All such diversions must have temporary diversion signs to the requirements of Arahan Teknik (Jalan) 2C/85 of JKR. Adequate workmen for controlling traffic diversion must be provided.

Should the Contractor fail to ensure the above, the S.O. will appoint other Contractors to carry out the said work and all costs incurred will be charged to the defaulting Contractor and deducted from monies due to him.

5.7

POLLUTION CONTROLS

5.7.1 Dust Control a) The Contractor shall provide suitable spraying equipment for regular spraying of water over the existing roads, tracks and access roads, completed as well as incomplete road and other barren areas of the site used by the contractor and as and when directed by the S.O. The Contractor shall provide for the prompt removal of all dirt and other materials spilled from his or his sub-contractors vehicles on public or private roadways over which such materials are hauled or on to which such materials are dumped, washed or otherwise deposited by reason of his work carelessness in execution of the works and avoid interfering with drainage or creating a traffic hazard to vehicles or impeding the passage of pedestrians. When the Contractors trucks or equipment utilises public or private roadways, all dirt and materials shall be

removed from the trucks/ equipments by hosing, lorry washtrough, etc. before leaving the site. d) For Contractors trucks carrying sand, aggregates, earth and other loose construction materials liable to spillage, tarpaulin must be used to cover such open trucks when passing through villages and settlements or on all roadways.

5.7.2 Noise Control a) All work shall be carried out without unreasonable noise and disturbance. The Contractor shall indemnify and keep indemnified the Government, S.O. and the S.O.s Representatives against any liability for damages on account of noise or other disturbances created while or in carrying out of the works and from and against all claims, demands, proceedings, damages, costs charges and expenses whatsoever in regard or in relation to such liability.

The Contractor shall ensure that all equipment and machinery are in proper working condition so as to minimise the amount of noise generated. The Engineer may require the Contractor to replace any machinery that to his discretion, is emitting excessive noise. The Contractor shall comply with the general recommendations set out in BS 5228: Code of Practice for Noise Control on Construction and Demolition Sites together with any specific requirements described in the Contract. The Contractor shall ensure that noise levels of Leq = 55 dBA should not be exceeded at settlements and villages.

5.7.4 Water pollution a) All silt fence, silt traps, sedimentation basins and other erosion control measures as shown in Drawings must be constructed and maintained by the Contractor. Water discharging from the silt traps/ sedimentation basin should have total suspended solids levels of 150 mg/l or specified by other approving authorities. The monitoring schedule is as stated in the Environmental Management Plan (EMP) in this document.

d)

5.7.3 Noise Barrier a) Noise barrier shall be provided in sensitive areas such as housing situated beside busy roads or highways, schools and hospitals. The type of noise barrier used shall be either absorptive, reflective, dispersive or mixed

The Contractor is prohibited from discharging oil and grease to any watercourse. Any spilled oil and grease shall be promptly removed by the Contractor. The Contractor shall collect, label and store used oil and grease and other scheduled wastes according to methods approved by the Department of Environment. All used oil and grease and other scheduled waste shall be removed from site by a licensed Contractor.

Parameters to be tested shall include:

Biochemical Oxygen Demand at 5 days (BOD5) Total Suspended Solid (TSS) Oil and Grease E-Coli pH Dissolved Oxygen (DO)

5.7.5 Air Quality c) All wastewater (sewage, sullage) must be treated such that the effluent complies with all existing regulations/legislations. Water Quality Monitoring and Testing The Contractor shall carry out water quality monitoring at positions on an existing streams as indicated in the Environment Management Plan (EMP). No open burning of cleared vegetation, debris and construction waste etc, would be allowed unless approval obtained from the Director General of the Department of Environment.

5.8

PRESERVATION OF FLORA AND FAUNA

c)

5.8.1 Flora a) Upon the possession of site, the Contractor with the assistance of the forester and/or botanist shall furnish to the S.O. a report on tree conservation plan including trees classified as rare, endemic and endangered, method of preservation, procedure, course of action to be taken and other conservation requirement deemed necessary for the preservation of the flora. Prior to site clearing, the forester and/or botanist shall assist the surveyor to identify any trees of rare, endemic or endangered species which need to be conserved or relocated. Trees which are classified as rare, endemic and endangered, or having girth of 800mm and above shall be conserved and marked (crossed) red. Trees which are rare, endemic or endangered and need to be relocated shall be marked (crossed) white. Should relocation be required, trees shall have girth of 300mm and below.

The Contractor is responsible for the transportation of trees to nearby sites, arboretum or other alternatives, as advised by the forester. The Contractor shall ensure that relocated trees are well kept. The botanist/ forester/ horticulture shall produce a status report during construction on the effectiveness of the tree conservation, preservation and action plan as proposed in the first report. The report shall also cover aspects of new findings left out during the earlier investigation and propose any rectification plan required. Reports shall be submitted from early study. The felling of trees shall be confined within the construction limit. The Contractor shall refrain all his and his sub-contractors employees from destroying, removing or clearing trees, timber, shrub and other flora to any extent greater than that is approved by the S.O. as being neces sary for the execution of the contract.

5.9

REQUIREMENTS IN RELATION TO WATERWAYS a) The Contractor shall ensure that his programme for the whole of the Works executed under the Contract is compatible with the requirements of the Jabatan Pengaliran & Saliran (JPS) so that the continued operation and safety of rivers, water-courses and related structures are not adversely affected by the works. During the execution of the Works, he shall coordinate all operations in close liaison with the JPS and shall make such adjustments to his programme as are from time to time necessary to accommodate the actual progress achieved with the temporary and permanent diversions programme.

The Contractor shall keep the S.O fully informed of this negotiations with the JPS. No works, diversions, modifications replacements and/or relocation of rivers, watercourses and related structures shall be carried out without prior approval in writing from the JPS. Adequate notice together with such design calculations and drawings as are applicable shall be given by the Contractor to the JPS to enable the Department to consider and if necessary give effect or amend any design as may be required. The Contractor shall ensure that temporary diversions of any rivers and/or water courses shall be capable of sustaining such flows throughout the year at such levels and rates as are specified by the JPS as the rivers and/or watercourses which they replace irrespective of the anticipated periods of use of the diversions by the Contractor.

The Contractor shall indemnify and keep indemnified the Government against all losses and claims for injuries or damage to any person or property whatsoever which may arise out of or in consequence or the construction and maintenance of the drainage works and against all claims, demands, proceedings, damage costs, charges and expenses whatsoever in respect thereof or in relation thereto. The Contractor shall construct all culverts crossing underneath road and their outfall and all drainage components before diversion of streams/drainage occurs.

5.11 REVEGETATION VETIVER HEDGEROW GRASS

5.11.1 General The Vetiver is used as bioengineering system to complement structural works. Therefore it shall be of good and consistent quality. 5.11.2 Plant Materials The plant shall be Vetiver Zizanioodes (Rumput Wangi) of the South Indian domesticated type. Only non-seeding types shall be used. It is critical that the North Indian wild types, which flowers regularly and set fertile seeds, shall be absolutely avoided. 5.11.3 Starting Materials Vigorously growing young tillers derived from tissue culture or micro propagation method shall be used. The plantlets to be supplied shall be at least an aggregate of 5 plantlets when they are taken out of the test tubes prior to packing. The roots at the basal end of the aggregate of plantlets shall be at least 3 cm long.

5.11.4 Container Plants i) Vetiver hedgerows shall never be planted from cut-root (bare-root) slips. Only container plants shall be used. Unless otherwise specified, site nursery is required to receive the plantlets from tissue culture laboratory. The plantlets shall be immediately planted in black polyethylene bags upon arrival and appropriate irrigation and fertilizers shall be used.

senescent (decaying) tillers must not be included in the count. At delivery to site nursery, the tops should be cut to a height of 30 cm.

5.11.4.3 Age of container plant ii) Any container plants which is bag-bounded and with aged roots shall be rejected.

5.11.5 Site nursery Unless the plant materials are produced in central supply nursery near the work site, a site nursery is mandatory. Maximum care shall be exer cised in handling and transporting of container plants to minimise transporting disturbances. The site nursery shall be irrigated. Quality container plants from the central supply nursery shall be arranged at 15 cm x 1-meter spacing. Plants shall be reconditioned in site nursery not less than 7 days prior to field planting. Only those plants, which have fully recovered from transporting disturbances, shall be used for field planting. To enhance transplanting success the use of anti-transparence and pre planting fertilizer application are encouraged.

5.11.4.1 Roots The container plants must have active root-mass regenerated in the container media during field planting. The polybag shall be 12.7 cm x 17.7 cm (5 x 7) dimension filled with good quality topsoil. The root-mass shall completely bind the soil so that the soil core does not collapse when the polybag is removed prior to field planting.

5.11.4.2 Tops (shoot system) The tops shall have 5 or more actively growing tillers that have been regenerated and produced in-situ in the container. Old tillers extracted from the ground nursery and

5.11.6 Field Planting Quality Vetiver container plants shall be planted in rows as specified in the drawings or as directed by the S.O. i) A 15 cm width x 23 cm depth (6 x 9) trench shall be exca vated to receive the container plants. In difficult soil types, borrowed topsoil may be required to refill the trench. The between-plant distance (center to center) shall be 15 cm or less.

Topping (grass cutting) to maintain 40-cm vertical height should be carried out at 2,4 and 6 months after field planting. Thereafter, the interval between toppings would be determined by needs, as directed by S.O. To ensure the good growth of Vetiver hedgerows, it shall not be shaded by other weeds especially scramblers.

5.11.8 Quality on Delivery on Hedgerows i) At 3 months after planting, the plants should be actively growing. The hedgerows should have no failures and no runts. At 6 months after planting, the hedgerows should be fully functional with uniform growth and basal tillers between clumps closed over, all to the satisfaction of S.O.

An appropriate fertilizer programme, applied at the time of field planting, to ensure good continuous nutrient supply for 2 years shall be used.

5.11.7 Establishment and Maintenance All failures and washouts shall be reinstated within the first month after field planting. i) All slow growing clumps, which do not recover, from transplanting disturbance shall be replaced. This is shown by lack of growth of the topped tillers and non-formation of new tillers.

5.12 EROSION CONTROL MEASUREMENT The vegetation cover is normally used to minimise runoff and to keep the flow velocities that can cause erosion. Detail of the protective vegetation shall be read in clause 2.2.8 Section 2 of Standard Specification for Roadwork. This section only addresses on the construction and the maintenance of control erosion measures and to be used in accordance to the size of respective catchment area. The gabion walls used shall be constructed is accordance to the drawings and clause 3.6 of Standard Specification for Roadwork. The methods of filtering the velocities of the sediment as used in this section are silt fences.

Silt fences are generally effective in locations where the flow is concentrated and are only applicable for sheet or overland flows. They shall be placed at cleared areas in construction site especially below the toe of a cleared slope, along streams and channels with disturbed adjacent slope, around temporary stockpiles and across swales. The fence should be inspected after every rain and when a sediment accumulation of approximately 2/3 of the fence height is observed. The silt should be removed and disposed properly. The geotextile should be checked for rips, tears and other types of deterioration and replaced as needed.

5.12.2 Silt Trap A silt trap is a small temporary ponding area, usually with an outlet or channel formed by excavation and/ or construction of gabion wall. Its purpose is to collect and store sediment from sites cleared and/ or graded during construction. It is intended for use on small catchment areas ( less than 2 hectares ). With no unusual drainage features, construction of silt trap shall be completed in a reasonably short period of time.

5.12.1 Silt Fences A silt fence is a temporary barrier used for trapping silt and sediment from disturbed area during construction. It is a vertical barrier of geotextile supported by poles at regular interval. The geotextile shall be made of non-woven material with minimum properties of 200 g/m or tensile strength 15 kN/m.

The trap is to be maintained regularly throughout the contract period including desilting when full or as directed by the S.O including making good of any damage portions during the course of the works. The desilted material shall be transported to disposal site approved by the S.O. Silt trap shall be placed: 1. Along the perimeter of the site at locations where sediment laden runoff is discharged offsite. At any point within the site where sediment laden runoff can enter natural areas or waterways including ponds, lakes, rivers and wetlands.

5.12.3 Sediment Basin A sediment pond or sediment basin is a structure formed by excavation and/or construction of an embankment across a waterway or other suitable location. Its purpose is to collect and trap sediment before it leaves the construction site. A sediment basin should be used for areas greater than 2 hectares and maintained when a sediment accumulation of approximately 1/3 of the basin depth exist.

5.12.2.1 Gabion Wall A gabion wall consists of layer(s) of gabions used to trap sediments in catchment area of less than 1.0 acre or place in difficult terrain. A series of gabion wall shall be required in difficult terrain. The gabion walls shall be con structed as shown on the drawing and accordance to the clause 3.6.9 Standard Specification of Roadwork.

GENERAL GUIDELINES for the PREPARATION of the ENVIRONMENTAL MANAGEMENT PLAN (EMP) - By the CONTRACTOR.

1.0

INTRODUCTION This Guideline is for the Contractor to prepare site specific Environmental Management Plan (EMP) as a proper environmental management approach during project implementation. This Guideline is in conformation and to be read in conjunction with the following documents: The EIA report for the project - approved by the Department of Environment DOE (if any). EIA Condition's of Approval from DOE (attached if any). JKR Contract Specifications: Section 1 - General Shall be as an addendum to the Condition of Contract

The Contractor shall submit the EMP prepared to the S.O. within 30 days in compliance with item (XX) in the Condition of Contract/ Special Provision.

2.0

OBJECTIVE The main objectives of the Environmental Management Plan (EMP) are to set out a comprehensive programme which will form the basis for implementing environmental mitigation measures, environmental monitoring and environmental auditing of the construction works by the Contractor as appended below: i. To set out various environmental protection/ conservation measures that conform with the environmental conditions stipulated in the Contract Specifications, EIA report and by other relevant authorities (e.g. the Department of Environment - DOE) in the EIA Conditions of Approval.

It should be clearly noted the EMP is a document for practical use on site by nominated personnel and thus should be concise, updated and site specific. This guideline has been prepared in line with Environmental Management System (EMS).

To streamline the different functions of various sections and authorities related to the environmental matters during the construction.

SUMMISSION OF ENVIRONMENTAL MANAGEMANT PLAN The preparation of the EMP shall take into consideration of the following:

Summary of Key Environmental issues. This section shall comprise a concise site specific list of key environmental issues for the awarded package. It should also include sensitive environmental receptors like downstream water intakes, orang asli settlements, etc. The purpose is to clearly highlight the main impacts and the sensitive environmental receptors.

List of Legal and Other Requirements. This section shall list all the relevant legislation that the Contractor has to comply which are applicable to the environmental aspects of the project activities. This shall include the specified environmental standards for air, water and noise quality.

Project Schedule and Sequence of Construction A detailed project schedule which integrate environmental mitigation measures within the overall project schedule and a statement of how the Contractor intends to sequence the construction works including temporary work to minimise environmental impacts i.e. minimise earth surfaces from being exposed bare for long periods, carry out turfing, construct mitigation measures, etc. This schedule shall be in line with the main overall Project Implementation Schedule.

Implementation of Mitigation Measures This section shall specify the methods and mitigation measures which the Contractor will provide/carry out to satisfy the stipulated environmental requirements. These shall be preventive where applicable. It shall include but not be limited to the following:

Soil Erosion and Silt Control Plan This will include a drainage plan showing temporary drains, silt traps and all other measures to control erosion and siltation and a description of the methods used complete with an effective maintenance regime.

Other Site Specific Mitigation Measures This section shall specify methods to address all other mitigation measures specified in Section 1 (in the Contract Specification) as well as any other environmental issues identified during project implementation.

Liquid/Solid Waste Management This shall include methods and locations for disposal of construction waste materials, excess materials, etc.

Emergency Preparedness This section shall set out emergency response procedures, plans and communications in the event of an emergency e.g. landslides, traffic accidents etc.

Schedule Waste Management This shall specify collection, storage and disposal methods of waste oil from vehicle maintenance.

4.6

Environmental Monitoring Programme The main objective of carrying out environmental monitoring is to assess the effectiveness of the mitigation measures and to provide a trigger for action should the stipulated environmental standards be breached. The Contractor shall carry out the data collection monitoring as specified in Section 5.5 below.

Turfing This section will specify the methods used and the timing of executing turfing or hydroseeding activities, i.e. immediately after earthwork and before work on other berm/lift commences.

Non-conformance Corrective and Preventive Action This section shall stipulate corrective as well as preventive actions that will be initiated if environmental non-compliances are detected from monitoring data or environmental audits.

Contractor shall appoint an independent Professional Environmental Auditor to undertake the following tasks:

Records All environmental monitoring and audit reports as well as correspondence related to environmental management shall be retained at the site throughout the duration of the project. Records shall be stored securely and protected from damage. Records shall be made available to JKR or any other regulatory agencies upon request. The records are :

The environmental auditor selected shall have the necessary expertise and experience to execute the work diligently and professionally in accordance to the requirements of ISO 14000. The environmental auditor shall be registered with DOE. Compliance audits shall be carried out quarterly.

4.10 Management Review 4.9 Environmental Audits This section shall include the auditing procedure and set out an auditing schedule. The audit will focus on implementation of the EMP and the other environmental management elements in the implementation of the project. The

ENVIRONMENTAL MONITORING The Contractor shall carry out environmental monitoring for the parameters stipulated in the Bill of Quantities. The actual sampling locations on site shall be stipulated in the EMP and will be subject to confirmation by the S.O. prior to commencement. All equipment shall be calibrated prior to use and monitoring shall be done according to the following methods:

Water Quality Water quality of streams, rivers and outlets of mitigation ponds shall be monitored for the parameters: pH, Total Suspended Solids (TSS), Oil & Grease, Dissolved Oxygen (DO), Biological Oxygen Demand (BOD), E. coli and Chemical Oxygen Demand (COD), where applicable. All field sampling shall be carried out by trained field personnel and the samples shall be analysed in an accredited laboratory. The results from the laboratory shall be signed by a registered chemist. The analytical methods used shall be in accordance to the latest edition of 'Standard Methods for the Analyses of Water and Wastewater' as required under the Environmental Quality Act (1974).

Air Quality Ambient air quality monitoring shall be carried out to monitor for Total Suspended Particulates (TSP) using a High Volume Air Sampler. The following meteorological parameters shall be recorded during the sampling period to allow interpretation of the data:

Noise Ambient noise level (8 hour average) shall be carried out by a qualified person at sensitive locations such as schools, hospitals, residential areas and orang asli settlements as stated in the EMP. These noise measurements shall be taken at the boundary of respective sensitive areas.

Analysis of samples shall be carried out by an independent accredited laboratory stated in the EMP.

GUIDELINES FOR BULK FUEL STORAGE TANKS

1.

General a) The contractor shall storage fuel (diesel, petrol) in proper bulk storage tanks/skid tanks. This tank should be placed in one location only for each work package and must be within the maintenance yard area. The tanks must be properly bunded and maintained properly. The Contractor shall store all chemicals and hazardous materials in suitable containers with appropriate labelling. A copy of the Material Safety Data Sheet (MSDS) must be kept on Site at all times. The Contractor must comply with the Classification, Labelling & packaging (CLP) Regulations under the OSHA.

Location a) In general, the storage tanks cannot be sited near the following areas i) Close to waterways (rivers/drains) or drinking water sources Close to welding workshops / naked flames Close to public areas Close to labour camps Close to overhead high tension cables

All tanks shall be above ground. Underground tanks are strictly prohibited. Tanks must be located at least 25m away from the site office and 50m away from labour camp. Where multiple tanks are present, the tanks must be spaced at least 2m apart.

Containment bund a) The Contractor must construct a perimeter bund around the storage tank to contain the contents of the tank in the event of spillage. The bund should be made of concrete or bricks and should be at least 0.5m high. The floor area within the bund wall must be constructed using impermeable material to prevent the product from seeping into the ground. Concrete flooring is recommended. The Floor must be even. The bund-wall around the storage tanks should have a capacity to contain the worst spillage condition (110% of the capacity of the largest container). The bunded area shall be graded to a sump where an oil-water separator should be installed and regularly maintained. There should not be any opening in the bund wall that may allow surface water run-off from the entering the storage site.

A safety barrier should be erected between the bund-wall and dis charge bay to prevent trucks from knocking into the bund wall.

4.

Hazard identification a) At the entrance to the storage site, a signboard should be set up with the words "BAHAYA" and "DANGER , painted with a letter size of 30cm on a bright yellow background. The words "DILARANG MEROKOK" and 'NO SMOKING" must also be clearly displayed. The Contractor must comply with the Classification, Labelling & Packaging (CLP) Regulations under the Occupational Safety and Heath Act 1994 (OSHA).

Routine maintenance a) Surface oil from the sump/oil interceptor shall be skimmed off at regular intervals. The skimmed oil must be transferred to the waste oil storage drums. The Contractor must ensure that all joints, pipes and hoses used to load and unload the fuel from the tanks are not leaking. All leaks should be repaired immediately. The tanks must be checked weekly for leakage. Any leakage so detected shall be attended to immediately. Truck movement near the tanks shall be controlled. The truck speed shall be limited to no more than 5 km/hr. All trucks parking next to the tanks shall be supervised. Lorry drivers should not be allowed to reverse or park their vehicles without supervision from the ground. If the tanks are placed on an earth mound, regular checks must be carried out to ensure that soil beneath the tanks is not eroding.

6.

Fire prevention & fire fighting a) Dry powder fire extinguishers shall be made readily available at the storage tank area for use in the event of a fire. No welding / hot works should be carried out within 50m of the storage tanks. No naked flame should for any reason be brought close to the tanks. The telephone numbers of Jabatan Bomba shall be displayed prominently at the site office and on the tanks. In the event of a fire, the Contractor shall activate Emergency Response Plan.

Oil and chemical spillage a) All spillage incidents of oil, diesel, petrol and chemicals must be reported to the DOE within 24 hours of their occurrence. If the spill involves large quantities of petrol or diesel spillage, is should be considered as an Emergency and the Emergency Response Plan should be activated. If a minor spill occurs, efforts must be made to contain the spill immediately. Sawdust or sand should be used to contain the spill from spreading. When the spill has been contained, the spilled material must be removed immediately using appropriate means and stored in storage drums. None of the spill shall be flushed into the drainage system. For the purpose of spill containment 20kg pails containing sand or sawdust must always be placed next to all bulk storage tanks.

Soil contaminated by fuel and oil must not be washed with water. The contaminated soil should be removed and stored in waste storage drums and labelled accordingly.

EXAMPLE OF NEEDS STATEMENT FOR ROAD PROJECT

1.0

PROTECTION OF THE ENVIRONMENT The Contactor shall limit and control site clearing works to construction areas only. Existing trees are to be retained as much as possible and minimum tree cutting is allowed unless they impose danger to the public and traffic after completion of the project. Topsoil from construction areas are to be transported to an area approved by the P.D. and reused for turfing, hydroseeding and landscaping purposes. Turfing / hydroseeding is to be done immediately to slopes upon reaching their formation levels. To provide growth on cut slopes, hydroseeding shall be carried out together with bio-degradable or equivalent materials. Landscaping works shall commence early as per direction of the P.D. The Contractor shall take necessary precautions to prevent the deposition of any debris, rubbish, silt, waste materials, foul water, chemicals, etc. arising from the execution of the Works into existing streams/waterways. This provision may be varied only with the written approval of the P.D.

The Contractor shall divert existing drains, waterways, etc. encountered during the progress of the Works without disrupting their flow system and if such diversion is temporary, he shall subsequently reinstate the same subject to the P.D.'s approval. The Contractor shall construct berm drains, interceptor drains and other related drainage works to slopes which have reached the required formation levels. Temporary cover, for example, polythene or plastic cover shall be provided by the Contractor to exposed cut slopes. The Contactor shall provide soil erosion control measures including silt fences, silt traps, sedimentation basins, etc. throughout the construction of the Works and restore and landscape sedimentation basins upon completion of contract. The Contractor shall take necessary precautions to ensure that tyres of all vehicles leaving the site are free of mud. The Contractor shall not carry out any open burning on the site without the written approval of the P.D.

The Contractor shall be held solely responsible for the sufficiency of precautions taken by him to protect the environment and shall entirely at his own cost comply with requirements imposed by the relevant Authority. The Contractor shall supply and lay at least to the base layer immediately to roads which have reached the required formation levels including the required drainage system. The Contractor shall take the necessary measures and actions for the conservation and protection of the environment. Should EIA be found not mandatory, an Environmental Management Plan (EMP) shall be required. In this case, the scope and coverage of all abatement and mitigating measures for environmental protection and monitoring which are deemed to be covered as in Appendix A. The Contractor shall be liable for and shall indemnify the Government in respect of any claim or proceeding arising from his neglect of his provision. All costs associated therewith shall be deemed to be included in the Contract Sum. (iv) Accommodation For Workmen In Relation To Safety and Health Requirements The Contractor shall provide and maintain at the Site, suitable and sufficient shelters, mess rooms and camps for his workmen and supervisory staff as are customary and necessary.

The locations of the workmen's accommodation shall be agreed beforehand with the P.D. and shall be such as to avoid obstruction and nuisance to the Works and public and shall be laid out in an approved and orderly manner. The construction and habitation of the accommodation shall comply with the local statutory or other Government authorities and subjected to the approval of the P.D. Sufficient toilet facilities shall be provided to the satisfaction of the P.D. and Government Health Officer. Proper provision shall be made for the disposal of all wastes and refuse and there shall be an adequate supply of water for washing, cooking and drinking purposes. The sleeping quarters shall be properly ventilated and lighted. The Contractor shall maintain the Site in a clean and sanitary condition and shall comply with all requirements of Government, Health and Sanitary Authorities.

ENVIRONMENTAL MANAGEMENT PLAN (EMP) The Contractor shall comply with all legal duties and obligations regarding the protection of the environment as laid down in the Environmental Quality Act 1974 (Act 127). Before commencement of works the Contractor shall submit to the Cawangan Alam Sekitar (in JKR HQ) an environmental management plan, detailing the Contractor's proposed arrangement for the abatement and mitigation measures for environmental protection, environmental monitoring, testing programmes and reporting, and his organisation chart. A copy of the EMP shall be submitted to Department of Environment (DOE) in the Headquarters while another copy to the State DOE. The Contractor shall also comply with all conditions laid out by all relevant authority including the Department of Environment.

All bakau areas shall be preserved because of its importance in preventing of erosion of the shoreline and also its role as and area for the growth of marine life. Cutting of bakau trees shall be limited to areas necessary for the construction of the Works only, subject to prior approval of the appropriate authorities, namely the DOE, Forestry department, Local Authority, Land Office, etc. No bakau piles are allowed to be used for this project.
