should nevertheless be made lo defend. indemnity and hold barmiess, the

6. CARRIER'S RESPONSIBILlTY
(1) CLAUSE PARAMOUNT
(A) Subjecl lo dause 13 below, lhis Bill of lading insofar as il relales lo sea
carriage by any vessel whether named herein or nol shaJl have effect subject to Ihe
Hague Rules or any legislation making such Rules or Ihe Hague-Visby Rules
compulsorily applicable (such as CONGSA OR COGWA to this Bill of Lading and
lhe provisions of the Hague Rules or applicable JegisJalion shall be deemed
incorporaled herein The Hague Rules (or CONGSA OR COGWA) if this 8ill of
Lading is subject lo U.S. or Canadian law respectively) shall apply lo the Carriage of
Goods by inland waterways. if arKIlo the extenl!hal!he provisions of lhe Harter
Act lhe United Stale of America 1893 would olhelWise be compulsorily applicable lo
regulate the Camers responsibility far!he Goods during any period prior to Ioading
on or after discharge form !he vessel the Camers responsibility shall instead be

(B) The Carrier Shall be entitled (and nothing in this Bill of Lading Shall

any applicable faw, slalule or regulalion of any country (inc!uding, but nol
limited lo. where applicable any provision of the laws of Ihe Uniled Slale of

slalute or regulal ion available to Ihe Owner of Ihe vessel(s) on which Ihe
Goods are carried.
(2) PORTTO PORT SHIPMENT
The responsibilily of the Carrier is limited lo Ihat part if the Camer from
and during loading onlo Ihe vessel up lo and during discharge from Ihe vessel
and the Carrier Shall not be liable for any 1055 or damage whalsoever in
respecl of Ihe GoOOs orfor any olher malter arising during any olher part of Ihe
Carried even Ihough Charges for Ihe whole Carrier have been charge by Ihe
Carrier. The Merchanl conslitules Ihe Camer as agent to enler iolo conlracts,
on behalf of Ihe Merchanl wilh other for Iransport, storage, handling or any
elher services 10 respeel of Ihe Goods prior lo loading and subsequenl l o
discharge of Ihe GoOOs from the vessel without responsibilily for any acl or
omission whalsoever on Ihe part oflhe Carrier of olhers and the Carrier mayas
such agenl enler inlo conlraels wilh olhers on any lenns whalsoever including
lerms less favorable Ihan Ihe terms in Ihis Bill of Lading.
(3) COMBINED TRANSPORT
Save as In olherwise provided 10 Ihis BiII of Lading, the Carrier shal! be
liable for 1055 of or damage to the Goods occurring from Ihe time Ihal the
Goods are laken inlo this charge unlil the lime of delivery to the exlenl sel oul
below:
(A) Where Ihe stage of camer where Ihe 1055, or damage occurred
cannol be proved:
(1) The Carrier Shall be entitled lo rely upon all exclusions of liabili ty
under Ihe Rules or Jegislation Ihe would have applied under 6 (1) (A) aboye
had the 1055 or damage occurred al sea oro f there was no carriage by sea,
under the Hague Rules (or COGSA or COGWA in this Bill of Lading is subject
lo U.S. orCanadian law respectively).
(ii) Where under (1) above, the Carrier is nolliable in respecl of some of
Ihe faclors causing the loss or damage, he shall only be liable lo the extent Ihal

reasan of any incorrect or insufficienl marking, numbering or addressing of!he

(2) Notwwilhslanding (1) above. the Merchant shall defend. indemnity
and hold harmless the Carrier in respect of any claim (and any expense arising
Iherefrom) of the General Average nalure which may be made on the Carrier
and shall provide such securily as may be required by Ihe Carrier in this
conneclion .
(3) The Carrier shall be under no obligalion lo lake any sleps whalsoever
lo calleel securily for General Average conlribul ions due lo Ihe Merchanl .
17. CHARGES

and shan be paid and rlOrl-fetumablein anyeven!.
