The respondent, an alien who was admitted to the United States as a lawfl peranent resident
on April 14, 1960, appeals te decision of the Immigation Judge, dated October 31, 2011, ordering
his removal to Aruba and, alteratively, to the Netherlands.1 We will dismiss the respondent's
appeal.
We review Immigation Judges' fndings of fct fr clear error, but questions oflaw, discretion,
and judgent, and all other issues in appeals, de novo. 8 C.F.R. 1003. l(d)(3)(i), (ii).
To the extent that the respondent challenges his current detention on appeal, we note that
removal proceedings are sepaate and apart fom bond proceedings. See 8 C.F .R. 1003 .19( d).
Thus, we lack jurisdiction to consider the respondent's claims regarding his detention in the course
of considering the appeal of a decision in removal proceedings.
We afrm the Immigration Judge's decision to order the respondent removed. On appeal, the
respondent raises no argument which disputes the Immigration Judge's deterination that, in light
of the respondent's 2002 conviction fr robbery in the third degree in violation of N. Y. ENALLA
160.05 (2002), which resulted in an I-year term of imprisonment being imposed, he is subject to
removal fom the United States as an alien who, at any time afer admission, has been convicted of
an aggravated flony (1.J. at 1-7; Exh. 1; Exh. 2). See sections 101(a)(43)(G), 237(a)(2)(A)(iii) of
the Immigation and Nationality Act, 8 U.S.C. 1101(a)(43)(G), 1227(a)(2)(A)(iii). While we
recognize that the respondent has fled a motion fr post-conviction relief with te New York state
courts, the pendency of a motion fr post-conviction relief does not afect the fnality of the

(BIA 1992); Hill V Holder, No. 10-1791-ag, 2012 L 29208 (2d Cir. Jan. 6, 2012) (recognizing
that, even if an alien has an arguable basis upon which to attack his guilt plea, such argument does
not alter the fnality of his criminal conviction insofa as it may afect his immigration status);
Arriaga V. Muksey, 521 F.3d 219, 224 (2d Cir. 2008). As the respondent is subject to removal fom
the United States as a result of his criminal conviction, it is his burden to establish eligibilit fr
relief fom removal. See section 240(c)(4)(A) of the Act, 8 U.S.C. 1229a(c)(4)(A); 8 C.F.R.
1240.8( d).
We recognize that the respondent has held lawfl peranent residence fr more than 50 years
and apparently has family ties to the United States. However, this Board and Immigation Judges
do not have the discretionar authority to gant relief fom removal to the respondent solely on
humanitarian grounds or provide the relief under the Universal Declaration of Human Rights or the
European Convention on Human Rights. See generally Matter of H-M-V-, 22 l&N Dec. 256
(BIA 1998); Matter of Medina, 19 I&N Dec. 734, 742 (BIA 1988). Given the respondent's criminal
histor, he does not appear eligible fr any frm of relief that can be granted by an Immigration
Judge or this Board (l.J. at 7). To the extent that the respondent refrs to relief under frer
section 212(c) of the Act, 8 U.S.C. 1182(c), the respondent is not eligible fr that fr of relief
as he was convicted of his ofense afer April 1, 1997. 8 C.F.R. 1212.3(h)(3). If te respondent
seeks humanitarian relief, he must request such relief directly fom the Department of Homeland
Security. However, as the respondent is subject to removal fom the United States and does not
appear eligible fr any fr of relief fom removal that can be granted in these proceedings, the
Immigration Judge properly entered an order of removal in this case. Accordingly, the fllowing
order is entered.
ORDER: The respondent's appeal is dismissed.
