Firms are requested to quote their best price as only the lowest technically acceptable offer will be considered 6. The Quotation should be valid for a minimum period of 180 days from the date of Tender Opening 7. The Commercial Terms Statement should be duly filled and enclosed with Techno-Commercial bid (Non receipt / Incomplete Details will lead to rejection of Tender) 8. PART I GENERAL TERMS AND CONDITIONS FOR TENDER ENQUIRY


1. Quotation must be sent by Regd AD post. The original copy of the tender form is to be enclosed in two separate envelopes. The first envelope super-scribed Techno-Commercial Bid shall contain Part I and II, another envelope super scribed Price Bid shall contain only Part III. The two envelopes should be sealed and should bear address of this office, tender reference No., due date. The two envelopes should be put in another envelope and sealed, and addressed to Director, Electronics & Radar Development Establishment, DRDO Complex, CV Raman Nagar PO, Bangalore-560 093 marked with our Tender reference No. and due date. Right is reserved to ignore any bid, which does not meet/comply with the above instructions.

2. The firm may give additional commercial terms, if any, in their techno-commercial bid. Only Price bid
should contain price details. Techno-Commercial Bid and Price Bid should be identical in all respects except that the Techno-Commercial Bid should have blank space at the place where prices have been indicated in the Price Bid. 3. Unsolicited quotations/quotations received late or improperly sealed or with incomplete marking or with unattested overwriting/corrections in the quotation documents are liable to be rejected. 4. Items supplied are subject to inspection and acceptance and the supplier should collect rejected items at his cost. 5. Validity: The quote should be valid for 180 days from the date of opening. 6. Registration: Registration is mandatory. If your firm is not registered with this Lab/Estt. or any other DRDO Lab/Estt. you are required to seek registration. For details please write to Director of (Lab/Estt.). Vendors must complete registration formalities to become eligible for placing supply orders and future enquiries. Registration number allotted by this laboratory or any other DRDO Lab/Estt. or proof of registration with another Govt. Dept., if any to be mentioned on the quotation. No correspondence/discussions/visits whatsoever will be entertained on the subject unless specifically called by this office after opening the tenders for technical discussions/ price negotiations. Any violation of this will render the quotations invalid and the firm is liable to be blacklisted. Director reserves the right to call for techno-commercial/price negotiations. The company should depute competent representative for such discussion/negotiations whenever called for and he shall be competent to take on the spot decisions.

Security : Any information/material/document supplied in connection with this enquiry/likely order is classified and should not be disclosed/copied which jeopardizes the security of state and shall be returned back to LRDE. Please inform the Director in writing whether you or any of your partners/employees have/has close relations working with any DRDO Lab/Estt. This is for record only. Adhering to the format given in Part II and Part III is a pre-requisite for considering your bid

CONDITIONS FOR TECHNO-COMMERCIAL BID 1. Give brief description of item/equipment/material with accessories. Items offered should conform to BIS (ISI) specifications or as explicitly stated. Comparative technical specifications sheet shall be attached with details such as Sl. No., specifications offered, deviations if any, and remarks. Any product brief, test certificates available may be enclosed. Samples may be enclosed or dispatched. List of spares/accessories, if applicable should be attached. Any optional, if offered, be provided with their full technical details including their use and advantage.

CONDITIONS FOR PRICE BID 1. 2. No unilateral revision in price will be admissible. Rates should only be quoted in the accounting units (A/U) mentioned in the enquiry. Rates must be quoted clearly on free delivery at LRDE basis and total value is to be indicated in words also. In case any subheads are included in the total cost, the same should be specified. Optional item, indicated in techno-commercial bids must be priced separately in price bid. In case spares/accessories are applicable, their list and price should be clearly indicated separately in and price bid.

COMMERCIAL TERMS AND CONDITIONS 1. The normal payment terms are 100 % within 30 days after receipt, inspection, acceptance and satisfactory installation of stores/equipment in good condition at LRDE against a Performance bank guarantee issued by a scheduled bank for 10% of the order value valid for the duration of such warranty/guarantee, wherever applicable. Give details of installation and commissioning (if applicable). Warranty/guarantee required is for 3 Months/Years the warranty shall be effective from the date of acceptance after delivery and inspection. The price should be quoted accordingly. Delivery desired is within 2 weeks/ months at LRDE stores at no extra cost. In case of delayed supplies, liquidated damages at the rate of 0.5 percent per week subject to a maximum of 5 percent of the contract value will be levied. The successful bidder is liable to submit Security Deposit for 10% of contract value by Bank Guarantee issued by a scheduled bank valid till the final acceptance of the stores at LRDE, prior to the release of the supply order. This Organization is exempted from payment of customs duty under notification No. 39/96 and excise duty under notification No. 10/97. However, prices should be quoted indica ting clearly Customs/Excise duties. If agreed, the necessary exemption certificate may be provided. This exemption is for the final product only.

In case equipment offered requires maintenance after the expiry of the warranty, please indicate approximate cost of comprehensive and on-call basis maintenance and also availability of local support or otherwise. Tax Deduction at Source (TDS) is applicable on Installation & Commissioning, Additional Warranty, Training, Maintenance/Repair charges etc., Please note that faxed quotation is liable to be rejected.

CANCELLATION OF SUPPLY ORDER / CONTRACT FOR DEFAULT (1) The purchaser may without prejudice to any other remedy for breach of contract, by written notice of default sent to the supplier, terminate the contract in whole or in part: (a) If the supplier fails to deliver any or all of the stores within the time period(s) specified in the contract, or any extension thereof granted by the Lab/Estt. or (b) If the supplier fails to perform any other obligation under the contract within the period specified in the contract or any extension thereof granted by the Lab/Estt. (2) In the event of Lab/Estt. terminates the contract in whole or in part; the Lab/Estt. may take recourse to any one or more of the following action. (a) The purchaser may procure, upon such terms and in such manner, as it deems appropriate, stores similar to those undelivered, and the supplier shall be liable for all available actions against it in terms of the contract. (b) However, the supplier shall continue to perform the contract to the extent not terminated.
