Dear Sir: As you know, we are counsel for Activision Publishing, Inc. (Activision), the owner of all rights, title, and interest in and to the Call of Duty series of video games, including the games Call of Duty: Modern Warfare 2, Call of Duty: Modern Warfare 3, Call of Duty: Black Ops, and Call of Duty: Black Ops 2. This is our second letter to you, the first having been personally served on you on May 31, 2013. A copy of this first letter is attached hereto. Due to your increasingly fraudulent actions, we are required to again notify you of the illegitimacy and unlawfulness of your conduct, much of which was set forth in our aforementioned previous letter. While we see no reason to reiterate all of your willful and infringing conduct, certain of your actions bear restatement and elaboration. Specifically, it has come to our attention that you have continued to falsely claim, including through your Twitter feed, that an Activision representative has informed you that Activision did not submit the numerous takedown notices to Google regarding your infringing videos. This is, as you know, untrue. Further, and more egregiously, you have apparently continued to submit fraudulent Counter Notifications to Google claiming that Activision has informed you that its take down notices were submitted by some unauthorized third party. Moreover, you have continued to advertise and sell unauthorized and infringing modifications for Activisions Call of Duty games, despite Activisions repeated demands that you cease such conduct. As you clearly know, including because you were hand served and personally notified by Activision on May 31, 2013, Activision did indeed submit the take down notifications at issue. Therefore, any further fraudulent statements or Counter Notifications, including those made or submitted since you were originally served with the aforementioned letter, can only be construed

as willful, deliberate, and malicious attempts to harm Activision and to cause it to expend resources remediating your abuse. Accordingly, we hereby restate our demands that you: (1) notify Google of the falsity or inaccuracy of the content of your Counter Notifications, (2) cease and desist any further efforts to obstruct Activision pertaining to the removal of your infringing videos, (3) cease and desist any further creation or distribution, in any form, of any unauthorized modification software that infringes Activisions intellectual property in any manner, and (4) remove and permanently disable all access to the infringing videos, or any other content you may possess or control that, in any way, infringes Activisions intellectual property. Be advised that our clients patience is running out. As you remember, by submitting the aforementioned Counter Notifications to Google, you have consented to the jurisdiction of the District Court for the Northern District of California. Let us remind you that, should you choose to disregard the demands of this letter or otherwise continue to obstruct Activisions efforts to remove your infringing content, Activision is prepared to take action against you in the Northern District of California to protect its rights and the integrity of its products. Please inform us immediately, in writing, that you will comply with these demands. Nothing contained in this letter is intended to, nor shall it constitute, a waiver or relinquishment of any rights, claims, defenses, or causes of action possessed by Activision, all of which expressly are reserved.
