head. In his shrine he is honoured and worshipped with all honours originally bestowed on his by Sri Ranganatha, with Vadakalai Patram, Vazhithirunamam etc. He is acknowledged, even during his life time by his contemporaries as well as by later Acharyas and Scholars and the reverans in which they all held him are evident from their utterances, works as well as Guruparamparas. On special occasions on which the idols of Alwars and other Acharyas are assembled before the Lord, the idol of Sri Vedantha Desika was one with its Vadakalai Thiruman on his face. On his birth days, the idol has been take to the Sanctum Sanctorum of Lord Sri Renganatha with all Vadakalai paraphernalia, Pathram, Vazhithirunamam etc. His unique position as the teacher of Ubaya Vedanta and his worship as such (described earlier) stood well-established for several centuries. (b) In that part of the 19th century, there were unfortunately serious disputes between / Words : 175 Cors : Nil - 3rd page the Tenkalai and Vadakalai Vaishnavaites and as the former had the larger influence in the Devasthanam at that time, they would appear to have stopped the privileges that Sri Vedantha Desika's idol has been enjoying for all the centuries. The courts of the land were powerless and could not interfere in matters of these rituals and honours, and the petitioner could not effective steps for redressing the injustice. (c) The Adhyayana Utsava is being done in honour of the Vedas and Divya Prabandas (Ubaya Vedantha-Sanskrit & Tamil Vedantha). It is in the fitness of things that the Alwars

and Acharyas who are the custodians and guarandians of the Ubayavedantha, should be honoured during the Adhyayana Utsava in the temple. (d) In fact the Alwars and Acharyas including Sri Nathamuni and Sri Vedantha Desika with their Vadakalai namams, paraphernalia, Pathram etc., were taken to the Adhyayana Utsava mantapam with all due honours, and this was in vogue on such other days as Yugadi, Dipavali, Kanu etc. Words : 175 Cors : Nil - 4th page On their birth days, these two Acharyas had the Mangalasasanam in the Sannidhi of Sri Renganadha as explained earlier in this. It is an irony that the vigrahas of Sri Nathamunigal and of Sri Vedantha Desika, who recovered and spread the Thiruvoymozhi in its musical setting and who established the supremacy of and its sanctity of its being chanted as a necessary part of the religious worship of Sri Renganatha are not allowed to adorn the Adyayana Utsavam - an Utsavam which is celebrated for honouring the Vedas and Divya Prabandas. It is only the hatred and fanaticism in recent times of some that is responsible for the Vigrahas of these two great Acharyas, not being taken to the presence of the Lord generally and during the Adhyayana Utsavam which utsavam is without significance in the absence of these two Acharyas. (e) Though the Vigrahams are not allowed into the Mantapam of the Lord, certain honours in the forms of prasadams are being given to the Archaka of Sri Vedantha Desikar during the Utsavam.

(f) As instanced by the performance and festivals for Sri Manavala Mamunigal in Sri Devarajaswami Devasthanam in Kancheepuram, the petitioner herein made applications to the Trustees of Sri Ranganathaswamy Devasthanam. The Trustees are willing to restore the usage, but only one condition that the idol bears Tenkalai Namam on their forehead. It is sacreligious that the idol who bears an embossed Vadakalai Namam on its forehead, showing that it bears the Sastric emblem, should be compelled to wear the emblem of a different persuation before worship and the Mamool previleges, hitherto enjoyed could be restored. This condition is enjoyed could be restored. (g) There is warrant for suggesting the imposition that the idol should bear the Tenkalai Namam and it cannot be protended that the one the idol now wears is unsastric. In fact

the members of the Vadakalai Vaishnavait community are all freely admitted to worship and several of them are enjoying so many special previleges of his temple. (h) The Adhyayana Utsavam that is now in progress and will be celebrated in December - January in every year could not be celebrated, but for the circumstances that Sri Nathamunigal recovered the Divya Prabanda and Vedanta Desika was the chief saviour in the contest referred to, and established the importance of the Divya Prabandas in the pujas and rituals of this temple and who was honoured as the saviour of Ubaya Vedanta by Sri Ranganatha Himself / Words : 175 Cors : Nil - 7th page (i) In spite of the several best attempts made for the restorption of the ancient and established usage and of the Vadakalai rights with reference to the shrines of Sri Nathamunigal and Sri Vedantha Desika, they have proved in vain, so far. (j) The action of the trustees is wholly arbitrary, unreasonable and opposed to the established usage of the temple. (k) After the introduction of the special machinery, the Administrative department of the Hindu Religious and Charitable Endowments Department, the petitioner loans that the established usages can be restored and the injustices perpetrated by the trustees can be set right by the higher authorities under the Act. (l) The petitioner prays for permission referred to in para I." III. The respondent filed counters. The gist of the Counters is as follows:(a) "The respondents deny the allegations that the petitioner is the hereditary trustee of the Vedantha Desikar shrine or that he is in charge solely or otherwise of the administration. The trusteeship of the shrine and its administration and management vest both under the provisions of the scheme and under the general law only in the trustees of the main Renganathaswamy temple and the petitioner cannot claim the same for himself. The petitioner is entitled only to the pooja paricharaka rights in the shrine which he is allowed to exercise by proxy. The Thengalais contend that Vedantha Desika was a Thengalai by pursuasion and not a Vadagalai at all, that this idol according to long usage bore only Thengalai Namam in his shrine at Srirangam with thengalai paraphernalia when his idol was taken out in procession or brought to the presence of Lord Renganatha. The allegations that Vedantha Desiga's idol in his shrine bears an embossed Vadagalai Namam on his forehead and that Vadagalai Patram and Vazhi Thirunamam are observed in his shrine cannot be accepted. that his idol is taken during Adyayana Uthsava or other occasions with Vadagalai Namam and brought to the presence of Renganatha with such Vadagalai Namam cannot be admitted to be correct. These contentions were all out forward in several litigations previously and have been negatived. The idol of Vedantha Desika had Thengalai Namams, Thengalai paraphernalia etc., when brought out in procession or taken to the presence of Lord Renganatha, exactly in the same way as other Alwars and Acharyas. It was because the Vadagalai trustee in 1874 started an innovation by bringing the idols with Vadagalai Namam that Criminal proceedings followed resulting in his conviction which was confirmed in Appeal. The subsequent suits were all dismissed and the idol has never been brought out since 1874. Words : 175 Cors : Nil - 10th page Even the usual honours shown to the idols on particular days have been withheld, as there was unwillingness to observe Thengalai Namams and rituals by Thengalai Adyapakas inside the shrine. The present idol of Vedantha Desika is not the original or the old one. The old namam of teh idol was an embossed Thengalai Namam. A new idol has been substituted for the old one which was in reverent Anjali posture whereas the present one is in Gnanamudra posture unlike that recognized that inside the shrine, Thengalai Namam, paraphernalia and Thengalai practices rules till disputes arose. There is no evidence or documents to show that Vadagalai Namams or practice existed inside the shrine or outside before 1874. The practice after 1874 is not to take

The Deputy Commissioner, has in his order dated 23.12.1959 held that "there is no reason to interfere in the present system followed by the Devasthanam in this regards. The reference in para 7 of the petition to some Panditharams given to Archakas of Vedantha Desika Shrine is of no significance. This is some emoluments to a servant of an attached shrine similar to numerous other cases and could not show that Vedantha Desika had Vadagalai Namam or was brought out with Vadagalai Namam or that Vadagalai rituals followed in this shrine. (b) The usage before 1874 was for Vedantha Desika to hear Thengalai Namam and carry Thengalai paraphernalia and follow Thengalai rituals both in the shrine and when being taken out exactly in the same way as other Alwars and Acharyas. The usage since 1874 is not to bring out the idol at all. The petitioner cannot ask for a third course of bringing out the idol but with Vadagalai Namams and rituals." Words : 175 Cors : Nil

IV. The following issues were framed: (1) What is the established usage in Sri Ranganatha swamy Devasthanam in the matter of taking out the idol of Sri Vedantha Desikar during the Adyayana Uthsavams and for

Mangalasasanam before the Lord Ranganatha on the occasion of the birth anniversary or Thirunakshatram of the Acharya and on other special occasions like Yugathi, Deepavali and Kanu? (2) What were the true and correct circumstances under which the practice of taking out the idol was stopped after 1874? (3) Is the petitioner entitled to the relief prayed for in para 12 of the petition? V. Both the petitioner and the respondents did not examine and witness. Both filed the documents and argued the case. VI (a). Issue No.1: What is the established usage? None of the documents filed by the petitioner proved / Words : 175 Cors : Nil - 13th page what the established usage is. But from the documents filed by the respondents, the established usage is found to be that before 1874 Vedantha Desika was bearing Thengalai Namam and carrying paraphernalia and following Thengalai rituals both in the shrine and when being taken out and that the established usage after 1874 is not to bring out the idol at all. The following are the main Exhibits which support the above usage:(i) In O.S.130 of 1808 (Exhibit R.2) of the Zillah Court of Trichinopoly, it is stated that the Thengalaiars were recog-

nized to be the dictators of the ceremonies within the Saptha Pracarum on the island of Srirangam to Srirangaswamy's Kovil. (ii) In takeed No.133 dated 1.6.1863 (Exhibit R.13) the Deputy Magistrate, Trichy directed the 2nd Class Magistrate to get the newly placed Vadagalai Thiruman in front of Nathamuni Alwar Kovil removed by the Vadagalais themselves. (iii) In O.S.103 of 1907 dated 19th December, 1873 (Exhibit R.14) the District Magistrate ordered that no Vadagalai mark is to be erected and no idol with Vadagalai marks taken in precession within the limits of Srirangam Saptha Prakaram. Words : 175 Cors : Nil - 14th page (iv) in 1874 the idols of Sri Nathamunigal and Sri Vedanta Desika were taken out from their shrines in procession with the Vadagalai Marks in connection with the Vaigunta Ekadesi festival. This has led to a Criminal case in C.C.9 of 1874 (Exhibit R.15) on the file of the District Magistrate's Court, Trichinopoly. The first accused in this case was Kodiyalam Rangaswami Aiyangar and trustee of this temple. The main charge in this case was that the trustee along with the eleven other accused, provoked a breach of the peace by carrying in procession 2 idols with the distinctive mark of the Vadagalai sect on the foreheads, contrary to immemorial custom. The case ended in conviction. The trustee of the temple referred to above was fined Rs.1000/- etc. An appeal against this order was dismissed an Appeal No.8 of 1874. (Exhibit R.16) In that order it is observed as follows:-

1875 dated 20th May, 1875 (Exhibit R.18) declined to interfere with the decision of the High Court. (vii) The District Magistrate, in his notice under section 144 C.P.C. dated 30th December, 1889 prohibited the Jeer of Ahobila Mutt from taking procession, passing along the streets of Srirangam and into the temple and back with elephants and ensign is wearing Vadagalai marks etc., (Exhibit R.27) (viii) In A.I.R. 1939 Madras 757 the High Court, dismissed the appeals filed by Vadagalais to compel the trustees to take in procession the idols of Nathamuni and Vedantha Desika within the precincts of the temple on certain occasions, etc. (Exhibit R.22) (ix) In his L.Dis.No.29548/59, dated 23.12.59 (Exhibit R.34) the Deputy Commissioner, H.R.& C.E., Thanjavur has informed the petitioner that he finds no reason to interfere into the present system followed by the Devasthanam in this regard (ie.) procession of Sri Nadamunigal and Sri Vedanta Desigar idols on the occasions of festivals in Sri Renganathaswamy temple, Srirangam. were regarded as matters of the situation down to the year 1835. There is not a Scintilla of evidence, nor a shadow or reason to believe that down to that year the Vadagalais had ever brought out their idols at any great festival with the Vadagalai marks on their foreheads. The whole current of orders and decisions points distinctly the other way" "judging the case by the light of the documents filed, the very strongest evidence to show that no only has the right of the Vadagalais to bring out their idols with Vadagalai marks never been acknowledged, but that in 1835 when such an attempt was made it met with the strongest opposition on the part of the Tengalai". (v) This judgment was taken up in Appeal before the High Court, Madras in Criminal petition No.421/1874 (Exhibit R.17), and it was dismissed. that the established usage is that before 1874 Vedanta Desika was bearing Thengalai Namam and carrying Thengalai paraphernalia and following Thengalai rituals both in the shrine and when being taken out and that the established usage after 1874 is not to bring out the idol at all. VII Issue No.2: What are the true and correct circumstances under which the taking of idols was stopped after 1874:When the Vadagalai trusted in 1874 started an innovation by bringing the idols with Vadagalai Namam he was fined Rs.1,000/- With this the taking out of the idol was stopped and later whenever they attempted to take the idol with the Vadagalai marks, prohibitory orders were issued. VII. Issue No.3 : Is the petitioner entitled to the relief prayed for in para 12 of the petition.
