Declaration of the Conservatee's Son: Disqualification for a cause of
this Court and Magistrate Judge Esperanza Alon
The Court is asked to respond on instant Declaration within 14 days.
I, the undersigned, Joseph Zernik, ID no..., knowing that I must say the
truth, and that I may be liable for penalties stipulated by law if I do not do
so, declare as follows:
1.
My name is Joseph Zernik, and the Conservatee is my mother.
A. Disqualification for a cause of this court.
2.
The evidence points out that in this court Chief Clerk Israel Hen
occupies his office with no lawful appointment record. . [1]
3.
The evidence points out that in this court decision records are issued
unsigned by the judicial authority and served, accompanied by
unsigned authentication letters by an unnamed clerk.
4.
In this Court, Chief Clerk Israel Hen refuses to certify any of the
Court's decisions in instant cases True Copy of the Original,
including the Order Appointing a Conservator. [1]
5.
In this Court proceedings are conducted, where it is impossible to
tell, who the parties are, records are issued by the Court, which fail to
list the parties, various records issued by counsel list different parties
on different papers, and the Court denies me, Conservatee's son,

purportedly a party to this process (25607-03-13), access to court

records, including the listing of parties to this case.
B. Disqualification for a cause of Judge Esperanza Alon
6.
Repeat Declarations, which I have filed in Court, detail evidence for
obstruction of justice with impunity by Judge Esperanza Alon:
a. Declaration of the Conservatee's son: Judge Esperanza Alon
master of the mystical secrets of court procedures, or obstructionist
with impunity?, filed on May 22, 2013. [2]
b. Declaration of the Conservatee's son regarding concerns of
obstruction of justice in court files related to Conservatee RSZ, filed
on June 20, 2013. [3]
Included in such evidence:
a. Different and contradictory March 17, 2013 decisions, issued and
served on behalf of Judge Esperanza Alon in court file 25607-03-13. [4]
b. Falsification of the Index of All Cases and Calendar of the Court in
instant court files by Judge Esperanza Alon.
c. Issuing a false and deliberately misleading April 4, 2013 Protocol
record by Judge Esperanza Alon in court file 1829-06-10, where even
the names of the participants are false, and her refusal to correct the
protocol when its falsehood was brought to her attention.
d. Refusal of Judge Esperanza Alon to address the falsehood of record
filed in instant court files (1829-06-10 and 25607-03-13), filed by the
Conservator and others.
e. Denial of Conservatee's son Joseph Zernik's access to court records
in instant court files (1829-06-10 and 25607-03-13).
Judge Alon obstinately refuses to address such claims of her wrongful
conduct.
7.
Regarding inspection of court file 25607-03-13, Judge Alon issued
decisions, which say that I, Conservatee's son Joseph Zernik,
purportedly am party to court file 25607-03-13, and that I am entitled to

inspect the court file by law, for example, May 2, 2013 decision in court
file 25607-03-13. [5]

Accordingly, I filed on June 20, 2013, Notice of Inspection, as
permitted by law. [6]
9.
Even after filing the Notice of Inspection, I was denied access to
the court file records, including the listing of parties in the court file.
According to the staff of the office of the clerk my access was denied
pursuant to to explicit instructions by Judge Esperanza Alon.
Appendix A is Declaration of the Conservatee's son Joseph Zernik
regarding conduct of the court relative to filing of Notice of Inspection
in court file 25607-03-13 on June 20, 2013.
10. A reasonable person, who would inspect the entire facts regarding
conduct of the court in instant court file, would most likely conclude
that denial of my access to court records in instant court file was aimed
at preventing discovery of additional evidence of obstructionist
conduct in instant court file by Judge Esperanza Alon and others.
11.
Conduct of Judge Alon issuing decision records which state that I
am entitled to inspect the court file, while simultaneously denying my
access to the same records, should be deemed deception.
C. Response by the Responders on Repeat Request to Inspect Instant
Court File, filed on July 3, 2013, is false on is face and repeat of false and
deliberately misleading claims.
12. Concomitantly with instant Declaration, I also file Declaration of
the Conservatee's Son: Letter to State Attorneys Request for
immediate measures by the State Attorney in view of indisputable
evidence of conduct of fraud under the guise of court proceedings in
the Haifa Magistrate Court in instant court files. [7]
13.
The Court is asked to consider the above referenced Declaration as
inseparable part of instant Declaration regarding Disqualification for a
Cause of this Court and Disqualification of Judge Esperanza Alon.

Declaration of the Conservatee's Son Joseph Zernik regarding
conduct of the Court upon filing Notice of Inspection in court file
25607-03-13 on June 20, 2013
I, the undersigned, Joseph Zernik, ID no..., knowing that I must say the
truth, and that I may be liable for penalties stipulated by law if I do not do
so, declare as follows:
1.
My name is Joseph Zernik, and the Conservatee is my mother.
2.
On June 20, 2013, I filed in the office of the clerk, Haifa Magistrate
Court, Notice of Inspection, pursuant to Regulations of the Courts
(Inspection of Court files) 2003, and Decision of the Supreme Court
under Israeli Civil Rights Association v Minister of Justice (5917/97).
- Appendix A is a copy of the Notice of Inspection, pursuant to
Regulations of the Courts (Inspection of Court files) 2003, and
Decision of the Supreme Court under Israeli Civil Rights Association v
Minister of Justice (5917/97), filed by the Conservatee's son Joseph
Zernik in court file 25607-03-13 on June 20, 2013.

In response to filing the Notice of Inspection on June 20, 2013,
staff of the office of the clerk informed me that I was indeed listed as a
party under court file 25607-03-13, but denied my access to the listing
of parties in the same court file.
4.
Consequently, staff of the office of the clerk provided me with
copies of six (6) decision records only.
- Appendix B is a copy of the six (6) decision records in court file
25607-03-13, copies of which were provided to the requester following
filing of Notice of Inspection, pursuant to Regulations of the Courts
(Inspection of Court files) 2003, and Decision of the Supreme Court
under Israeli Civil Rights Association v Minister of Justice (5917/97).
5.
While providing me with copies of six (6) decision records, staff of
the office of the clerk clarified that eight (8) decision records are listed
in the court file. However, the staff informed me that I was prohibited
from inspecting the remaining two decision records. The staff refused
to disclose the legal foundation for such prohibition.
6.
My repeat requests, in writing (Appendix A) and verbally, to
inspect Requests, Responses, case calendar, electronic signatures on
the decision records, etc (all of which were listed in the Notice of
Inspection) were all denied by the staff.

The staff of the office of the clerk, explained to me at the same time
that my access to the court records in court file 25607-03-13 was
pursuant to explicit instructions by Judge Esperanza Alon. Apparently,
staff of the office of the clerk also consulted Judge Alon in this matter
on June 20, 2013, while I was waiting in the office of the clerk. Staff of
the office of the clerk refused to answer whether such instructions by
Judge Alon were in writing, or verbally only, and also refused to permit
my access to such instructions, in case they were written.
