Description of Approach, Methodology Plan and Work for Performing the Assignment A Technical Approach and Methodology 1. 1.1. General Understanding of the Project Project Background

The Government of Vietnam is seeking World Banks assistance for infra structure development investment in three medium cities including Lao C ai, Phu Ly and Vinh city for the FY2011-2015 period. The proposed Proj ect is in line with the Urban Development Policy and Strategy up to 202 0 of the Ministry of Construction (MOC), and with the Comprehensive Po verty Reduction and Growth Strategy in Vietnam (CPRGS)- the first strat egy in Asia to be accepted by the WBs Country Assistance Strategy Fu nd and to be in conformity with the WBs Country Assistance Strategy. The Phu Ly City Development Sub-project is included in the Medium Citi es Development Project in Vietnam and was considered for inclusion in WBs preferential credit programme in FY2011. The objective of th e subproject is to support the sustainable development of Phu Ly city in partic ular and of Ha Nam province in general. The sub-project aims to meet t he strategic targets of WB and relevant programmes of the Government of Vietnam (GOV). The project proposes investments in construction and upgrading of multisectoral urban infrastructure including residential areas, improved sanitati Figure 1. These are considered as critical and pragmatic issues to be addressed for improvement of ur ban standards to meet the needs for urban development and expansion as well as for future economi c development. Phu Ly City is located on the important north-south and east-west transport junction, including the Nati onal Highway No.1A, the north - south Railway through Vietnam, and National Highway No.21 to Hoa Binh and Nam Dinh province. Phu Ly City has been continuously developed in various fields: economy, politics, culture, and society. Its technical infrastructure and social infrastructure system have been strengthened, constructed and developed. However, for meeting the important roles and functions of the city of Ha Nam province an d the northern region, it needs to address shortcomings and weaknesses in the following sectors: Transportation system Water Supply Drainage system Environmental sanitation Rehabilitation for management capability

Phu Ly City has the rational and clear reasons and motivations to develop its urban infrastructures in an urgent manner. Accordingly, most project proposals are focused on constructing or improving urban infrastructures in such multi-sectoral fields as, site resettlement, environmental sanitation facilities, urb an roads and bridges and technical assistances. Meanwhile, the infrastructure management agencies s hall be equipped with enough capabilities of maintenance and control. Tech 4 - 1

1.2.

Objectives of the Consultancy Services

The objectives of the consultancy services for Contract PL4-06B under Component 4 are to provide th e supervision of construction and contract management for the entire project (except packages PL1-01 ) and to assist in the procurement process for the contracts in Phase 2. Primary Objectives are: To fulfill the responsibilities of the Engineer, as stipulated in the Civil Works Contract; and as auth orized by the Employer. To professionally supervise the construction and maintenance of the Works under the project to e nsure that the Works are constructed and maintained fully in compliance with the terms and condi tions of the Contract, Drawings and Specification. To Consultant will assist Client to inspect and supervise the implementation of the EMP. To Assisting Client in Procurement process of the packages in the phase 2.

In addition following objectives will also assist the PMUs in implementation of the Project: Skill Transfer and On-the-job training for the Employers staff Liaison with Local Authorities, Utilities, land owners and other stake holders Report on the Progress of Works Assist PMU for maintenance of consolidated project expenditure reports

1.3.

Scope of the Project

The Phu Ly City sub-project is implemented in two phases: Phase has total cost estimate of 30% of the total value of the sub-project, including two civil work packages: ( ) construction of kinder g arden and Quang Trung Elementary school and ( ) Construction of road D4-N7 from Km1 +00 to k m4 +71 and associated infrastructure while Phase includes the rest of the components and activiti es.

The objective of the consultancy services for Contract PL4-06B under Component 4 is (i) supervisio n of construction and contract management for the entire project(except packages PL1-01) and ( ) assist in the procurement process for the contracts in Phase 2. The detailed tasks are summarized i n Figure below.

1) PL1-02 : Basic infrastructure upgrading and services improvement in residential areas


a) Hoa Lac Hamlet in Lam Ha Commune It is the upgrading and construction of about 2,132m community concrete road of 2-3m wide. Constr uction of the RC D400-D800mm combined sewer along the roads to the north of Chau Giang waste water treatment plant (WWTP)- the pipelines are about 2,103m in length. The construction includes the D125mm-D320mm water supply transmission and distribution network to local households with t otal network of about 4,250m in length.

b) Me Noi Hamlet in Liem Chinh Commune Upgrading and construction of about 796m community concrete road of 2m-3m wide. Construction of the RC D400-D600mm combined sewer- the pipeline is about 1,358m in length. The construction in cludes the D125mm-D320mm water supply transmission mains and distribution network to local hous eholds with total network of about 6,120m in length.

2) PL2-01 : Construction of Lam Ha regulation lake No. 1 and Lam Ha regulation lake No.2
Improve the condition of two regulation lakes in Lam Ha hamlet with total area of 14.7ha (including lake No. 1 of 7.78ha and lake No. 2 of 6.91ha). It includes excavation, dredging, construction of lak es embankment and the road around the lake, and installation of drainage pipelines, and lighting sy stem.

3) PL2-02 : Upgrading infrastructure in Quang Trung ward, construction of regulation lake, dr


ainage collection pipe and drainage pumping station a) Upgrading Infrastructure in Quang Trung Ward It is the construction of new internal roads which is 9.5m wide (2+5.5+2), 847.2m long; construction of lighting system along the roads. Construction of drainage pipelines along the roads including D40 0mm-D600mm RC pipelines which are connected to the D1000mm-D1500mm main sewer which is 2 ,085m long, flowing to the regulation lake. It includes the construction of the D200mm-D320mm tran smission mains and distribution network to local houses. The network is 4,935m long, including insta llation of fire hydrants according to current regulations.

c) Drainage Pumping Station for Quang Trung Ward It is the construction of the drainage pumping station to drain water from Quang Trung regulation la ke to Nhue river, including installation of two drainage pumps with capacity of 4,000m3/h for each p ump.

4) PL2-03 : Waste Water Treatment Plant for Bac Chau Giang urban area and the water supp
ly and sewerage pipelines from road D4-N7 to the waste water treatment plant It is the construction of a WWTP for Bac Chau Giang urban area with the initial capacity of 3000m 3/day in Tien Hiep commune. Detail design for this package shall be updated based on the result o f Urban Sanitation Strategy (refer to the Final Report of Consulting Services for Preparation of an U rban Sanitation Strategy, PL4-03 package). The plant area is about 3.2ha.

5) PL3-02 : Chau Giang bridge, road D4-N7 from Km0+00 to Km1+00 and the technical infras
tructure along the road and some sewers installed outside the area of the road D4-N7 It is the construction of a bridge, which is one section of the road D4-N7, passing Chau Giang river with four lanes. The technical specifications of the bridge include: cross section of 20.5m wide, the main part of the bridge is about 195m long, access road and pavement for pedestrians of 2x2.5m dimensions. Construction of road D4-N7 from km 0+00 km 1+00, including: four lanes(4x3.5m), se parating strip of 30m long, tiled pavement(2x4m) and earth pavement(2x8m), attached water supply and sewerage pipelines, technical trench and tunnels and the lighting system.

2. 2.1.

Approach to the Services Approach to the Services General

2.1.1.

The Consultant intends to offer the services with the general approaching policy as follows: Selection of construction supervision methods and technologies Application of an optimal combination of the methods and the technologies Regular briefing to the Client, concerned personnel and authorities on the progress Strict adherence to the applicable outcomes

The Consultants general approach will comprise of: Clearly defined roles and responsibilities for members of the proposed Consultant Team Strict adherence to the work schedule Systematic procedures for quality control Systematic monitoring of both processes and performance

The detail plan of the mobilization and services shall be set up in accordance with the TOR. The si te offices are recommended to be established near the site to allow free access. The Consultants r epresentative offices will be equipped with telephone/fax/e-mail facilities for efficient communication w ith all concerned agencies and coordination with the field office (survey/investigation teams and supe rvision teams) of the Consultants. The personnel of national Consultant and the counterpart staff will be mobilized as per the requirement of the project and in tune with the mobilization schedule of th e key personnel. The Consultants will mobilize their Team as per the specified time frame. The Con sultants through their Nairobi office will maintain continuous liaison with the PMU officials and their s upervision teams. In the startup meeting between the PMU and the Consultants, the general approa ch and work programme will be discussed and finalized. A proprietary website may be set up for inf ormation sharing purpose among the Consultant, Client, and Contractor, if necessary. 2.1.3. Civil Work Supervision

The methodology proposed on supervision and monitoring of this project is aimed at quality control, cost control, and timely completion of the project. The Project Director will act as the chief of the supervision staff and maintain constant liaison w ith the Contractor, the PMU and the Consultant's staff. Tech 4 - 9

The Consultants team composed of international and local engineers who have domestic and o verseas project experiences will deal with field problems in the best possible way. The Consultant will check all the critical work items like material/work test, design review, materi al requirements, and work program schedule and provide timely assistances to the Contractor in interpreting contract documents, ground survey control, quality control status and other matters. There will be assistance provided to the Contractor in the planning process by advising them, fo r instance, on advanced technologies for project control, construction methods, timely procureme nt, construction management, scheduling and organization.

1) Project Monitoring
An effective monitoring of the project is critical for a successful project implementation. The Consultant will develop necessary format that incorporates Critical Pass Method (CPM), pro vide monitoring measures for all activities of the Contractor and Sub-contractor, and exercise co ntrol over the agreed milestone dates. The Contractor is required to submit a complete work programme in CPM which will be reviewe d and checked for overall completeness, detail and logical sequence of operations. Production rates will be checked to ensure that they are compatible with the Contractor's equip ments, labour, material resources and working capital inputs as well as period of construction sp ecified in the contract. The Contractor will be advised to update the schedule at regular intervals, if necessary. The Consultant will also guide the Contractor through planning related at site level in th e best manner. In reviewing and approving the Contractors work programme, construction methods and perform ance, the Consultant senior personnel shall interact closely with their PMU counterparts. Daily work progress and delay will be monitored by Resident Engineers or National Team Leade r by the end of the day. The reason for such delay will be clearly identified and addressed to k eep up the schedule. A weekly review meeting will be arranged at the resident engineer level and biweekly meeting at the Project Directors level as agreed with PMU.

2) Quality Control
Quality Control is the one of crucial tasks of the Consultant for successful project implementation an d the Consultant will concentrate on the followings. The Consultants supervising team shall be chosen based on personnel experiences in the road & Bridge sectors and other necessary consulting experiences like setting up guidelines for quali ty assurance/control, field laboratories, guidance to field staff for quality control of construction m aterial, carrying out routine tests for approval of material sources and giving approval for road c onstruction at each construction phase. The Consultant will assess the Contractors own quality control system and assist the Contractor in setting up a site equipped with quality control laboratory facilities. The Road and Structure Engineer will regularly visit the laboratory and monitor the site activities for approval. The frequency and number of tests will be determined by the Consultant within specification and the Consultant will develop a data recording format for each different type of tests in accordan ce with test formats used in other previous road projects. The PMU will be regularly informed about the day-to-day site activities through Monthly Progress Reports. Compliance to specification requirements will be meticulously ensured. Material or works not conforming to the specification shall not be accepted for measurement or billing and shall be instructed to be replaced as described in the contract document.

3) Bridge Construction

y checking the conformity of major work items to the Construction Plan and shop drawing, such as soundness of foundation pile, bearing capacity, safety of temporary facility, control of mass concrete heat hydration. The supervision service will mainly focus on the progress of bridge construction work , which is the crucial part of this project. In consideration of possible lateral movement of bridge ab utment on soft ground, there shall be sufficient pre-feasibility study to select the most economically efficient ground stability method. A senior structure engineer will be mobilized to conduct a feasibility study, as a way of ensuring that there is no structural failure during construction and operation/mai ntenance phases of the project.

4) Drainage Construction
Generally, the elevation of the existing road is lower than the surrounding ground. It has an earth/gr avel surface with a poorly defined open drainage system. The side-ditches drain surface water throu gh irregularly positioned mitre drains which leads to concentration of run-off water on the carriagewa y. Crossing culverts on the road were observed to be located at reasonably regular intervals. Recen tly, some improvement works for culverts have been executed including new culvert installation and repair of headwalls on old box culverts. The culverts including their inlets and outlets are generally i n a good condition. However the width between culvert headwalls varies according to the existing ro ad width and the terrain. 2.1.4. Procurement Support

Procurement of works, goods and services will be important activities under the Project. Such plan will be prepared on an annual basis. To prepare the procurement plan, the Consultant will assist P MU in following the relevant procedures of the Public Procurement Act of GOV and the procurement guidelines of the World Bank. The Consultant will assist in reviewing progress of implementation of Procurement Plan/Framework a nd based on the progress made and short-falls encountered, the Plan/Framework will be updated on quarterly basis.

3.

Methodology for Carrying Out the Activities

The methodology has been developed in conjunction with the proposed Work Program. The method ology is based on the Terms of Reference (TOR), incorporating the Consultant's experience and ado pting the Project Cycle Management (Logical Framework Approach) in its structure. Therefore, and i n accordance with the terminology of the Project Cycle Management, the methodology has been dev eloped by breaking down the main project objectives into a series of results and activities.

3.1.

Supervision at Pre-Construction Stage

In order to advance the commencement of construction, all preparatory measures necessary for impl ementing supervision services including organization, temporary facility installation, design document/d rawing review, and site investigation shall be provided at the pre-construction stage.

1) Consultants Mobilization
The staff of the expert group shall be mobilized as early as possible after the receipt of the Notice to Proceed (NTP) from the PMU Steps and try to establish site offices at a suitable place in consult ation with the PMU and the Contractor. After commencing the work, the Consultant and the Contrac tor shall attend the joint meeting organized by the Client to explain about the details of design docu ment and suggest general alternative measures against possible problems. The joint meeting is aime d at helping the persons and institutions concerned to share the work implementation methods and direction as well as information unexpected by both the Consultant and Contractor and implement th e work more efficiently by creating more friendly inter-relations. In particular, as the route of the A23 road passes through the urban residential areas, public complaint is expected during the constructio n period. Accordingly, explanation meetings will be opened to collect the residential opinion and com e up with measures that can minimize the residential inconveniences.

2) Data Collection and Review of Contract and Technical Document-Desk Study


The Consultant will collect all the data pertaining to the project from Phu Ly City Peoples Committe e including Detailed Design Project Reports, Design Drawings, Contract Documents Test Reports, Pa vement investigation and material reports and other support data. In addition, the Consultant will con tinuously liaise with the Coordinator, EA, to ensure that all relevant information is made available for performing the services. EA will provide the Consultant with regular notification of activities undertak en for the project related environmental and social issues and activities that require coordination with construction activities. The data collected will be reviewed, checked and verified. While there is no specific task for review of designs and documentation, this activity will assist the Consultants staff t o get well acquainted with all aspects of the project and requirements of the Consultant. Particular a ttention will be paid to the construction drawings prepared by the design consultants, Technical Spec ification and Bills of Quantities to verify their compatibility with each other. Any short comings or inc onsistencies in specifications and errors in quantities found out during construction may lead to addit ional costs when corrected. Contract Data Sheets (Similar to conditions of particular application) and Special Specifications will be thoroughly checked together with General Conditions of Contract and Standard specification to ensure their suitability to the contract and their completeness to allow adeq uate control of the project by the Consultant. If any revisions are found to be necessary, these will be discussed with the client and incorporated to the project documentation. If required necessary var iations will be issued for contracts already awarded and documents will be revised for any new cont racts to be tendered or awarded.

3) Establishment of Project Offices


Team Leaders Office will be located in premises provided by the Client. Consultant will arrange to f urnish and equip the office. As per TOR, engineers facilities for the Resident Engineers offices and Assistant Resident Engineers offices will be provided under Civil Works Contracts including the offic e premises, office equipment, furniture, accommodation and transportation.. The Consultants site staf f will be based in different areas with respect to the civil works contracts of roads and bridges. The main function of the Consultant's Project Office of the Team Leader will be to coordinate, manage and administer the overall project activities and liaise with the Client. In addition, the Consultant may require further support, advice and directions from the home office to his staff based on site. ciates will be responsible from Vietnam. The Consultant will set up a Documentation management S ystem to handle and store the significant amount of documents that will be generated. The system will be a combination of soft copies and hard copies with easily searchable indexes so that a docu ment can be traced with least delay and difficulty. The Team Leader, Resident Engineer and Assista nt Resident Engineers will hold a start-up meeting with the Client, PMU to obtain an update on the project's overall status. The Consultant's scope of services is such that an active participation at all l evels is essential to achieve the project objective. Therefore, the PMU representative and the Consu ltant have to work in tandem with a high degree of understanding and co-operation. Correspondence All incoming and outgoing correspondence including letters, Faxes and emails will be filed in hardco py as well as in an electronic database. Incoming letters and faxes in hardcopy will be scanned for electronic filing. The Project Director, Resident Engineers and Assistant Resident Engineers will hav e an identical filing system and a comprehensive collection at Team Leaders office will contain all p roject related correspondence so that they are available for any future reference in the event of Clai ms, etc. In addition to written correspondence minutes of meetings and transcripts of any important discussions will also be filed. Team Leader will keep a track of all correspondence and follow up w here any replies and responses are outstanding. A list of correspondence with details of any outstan ding matters will be attached to the Monthly Report. Filing system A simple but versatile filing system will be established to store all correspondence, Measurement Sh eets, Site Records and Quality Assurance Records. A typical list of documents and reports that will be maintained as part of contract administration is given below:

3.2.

The Consultant will perform the services during the construction supervision stage in accordance with the following general principles and relevant contractual conditions;

The Consultant will act on behalf of the PMU as the Engineer of the Project. The Consultant will perform his duties in accordance with the acceptable criteria and standard applicable to improvement works and shall exercise the powers vested in him as the Engineer with regard the construction contract. The Consultant will have full authority to direct, oversee, and revise the work as needed and as defined in the Conditions of Contract. The Consultant shall establish an organization that shall meet the PMUs approval for the proper execution of the services.

Yooshin Engineering Corporation will use their tried and tested Project Management, Performance Monitoring and Quality Assurance Systems to ensure the Project is managed in a successful manner satisfactory to the Client. The Project management System will address:

The Consultant will set up appropriate project management systems and procedures and ensure the Supervisory team understands these systems to ensure that all aspects of the construction management is covered and documented. A system of delegation and reporting will also be an integral part. Through the systems established, the Team Leader will be able to communicate with all field supervisory system and compile documentation for work approvals, certifying works, Payments and progress monitoring Consultants will also focus their attention to some of the important considerations before, during, and after civil works contracts. These considerations are very important in achieving the defined objectives and setting up of systems and standard method of construction: Under Project start up activities, the Contractors program is reviewed and approved by the Consultant. The Contractor may fall behind the programme due various reasons for which he may or may not be responsible. Periodic review and scrutiny of all components (including deployment of plant and equipment, storage of materials, staff assignment schedules) are important parts of the construction monitoring process. The Consultant will further ensure sufficient provision of standby arrangements to guard against delays due to equipment breakdown. When Contractor falls behind the work programme, he will be advised to revise the programme, including mobilization of additional resources, in order to complete the works on schedule. For this purpose the critical path and activities falling in the critical path will be monitored by tracking the progress through a project management software such as MS Project or similar as agreed with the Employer. The software used will be compatible with the software used by the Contractor for his programming of project activities. If he project falls behind the programme, in activities falling on the critical path, due to circumstances beyond Contractors control such as adverse weather, unforeseen site conditions, delays in shifting utilities, delays in clearing right of way, etc., he may be entitled to an extension of time. If the contract period is extended, the programme also will need to be revised.

2) Meetings and Coordination


Consultant will hold regular meetings with the Contractor to which the Employer Representative will be invited, so that the progress of the project and any problems and issues affecting the project can be discussed in the presence of the senior management of the Client, Contractor and the Consultant. These can preferably be held at the Assistant Resident Engineers offices for ease of Contractors and Consultants senior site staff can attend without much disturbance to their site duties. A brief site visit before each meeting by the Team Leader and Employers Representatives accompanied by the RE, ARE and Contractors Representative would also greatly assist in understanding the site conditions. Contractor may be allowed to bring in Senior Managers from their head offices to these meetings if they wish. A schedule of meetings for around three months made in advance will make it easy all participants to keep that date free for the meetings. If and when becomes it becomes necessary a meeting with utility authorities in relation to the progress of relocation of utilities along project roads can be held just before or after the site meeting. The Resident Engineer will convene the meetings, prepare agenda and keep the minutes. The items to be discussed at a site meeting will vary depending on particular circumstances of the project, but would generally include:

Acceptance of the minutes of the previous meeting Progress to date and a critical analysis of activities behind schedule Construction program for the forthcoming period Deployment of resources and their comparison with the program Safety issues, accident records Environmental and social issues, Public complaints Outstanding approvals from the Engineer regarding drawings or pending site instructions Tech 4 - 19

A monthly Coordination meeting with Phu Ly City Peoples Commit tee Officials and perhaps the Chief Secretary when available is also planned to discuss status of all projects in progress and issues regarding utility relocations, release of funds, etc. Consultant will also attend any meetings called by the client and funding agency if invited.

3) Approval of Construction Plan & Work Drawing


Approval of Construction Plan

The Consultant shall review and approve the Construction Plan by work type which will be submitted in advance by the Contractor. The Construction Plan shall meet the conditions of design drawing and specification and the approved Construction Plan shall be available at the site for technicians use and relevant education may be conducted, if necessary. The Construction Plan shall detail the following:

Site organization chart & detailed construction schedule Main work construction process and methods Construction schedule, main equipment/material/manpower injection plan Quality/safety/environment control measures Underground structure/ traffic control measures Approval of Work Drawing

The Contractor shall prepare working drawings based on the approved setting-out of the works with due reference to the design principles shown on the detail design drawings. During the process, the Consultant shall supervise the Contractors drawing format in plan, scale, etc. The working drawings shall be developed in accordance with the sequence of the work execution. They shall be thoroughly checked and approved by the Consultant prior to the start of the work on site. Any change on the drawings during construction shall be noted for as-built drawings. The Consultants shall provide the Contractor with all necessary geodetic survey data, such as the original points, lines and levels of references specified in the contract document. The Contractor shall be responsible for the correct positioning of all parts of the Works, and shall rectify any error in the positions, levels, dimensions or alignment of the Works.

4) Approval of Materials and Material Sources


Approval of Material Sources

In accordance with scheduling plan, the supervisor (the Consultant) should check if the test result conforms to the quality standard at least 10 days before submitting an application form for major procurement material. When the material sources are found to be appropriate, the Consultant shall review and approve them within 7 days from the date when the Request of Material Source Approval is submitted. The Consultant shall check any matters related with material quality control test or change in quality on a random basis even after approving the material sources. Unless otherwise specified, it is necessary to have more than 2 suppliers, prepared for possible stoppage during procurement. The following items refer to the list of materials required to be approved by suppliers:

The Consultant shall review the Material Management Plan submitted by the Contractor and inspect the material unloaded at the site to check their conformity to the quality standard and specification. If any material is found to be inappropriate, material concerned shall be taken out from the site. The Consultant shall ensure that material will be properly piled and kept.

5) Daily Supervision Activities


Site Inspection

The Consultant shall have a full understanding of shop drawing and other relevant specifications to conduct the daily supervision activities in accordance with the Supervision Work Plan to ensure a safe and quality work completion and keep photo data and supervision record diary which detail the main work progress, inspection result and inappropriate item status until the work termination. Regular Site Meetings, Interaction with the Contractor and Public Relation

The Consultant shall set up a proper schedule for site meetings with the Contractor. A formal meeting will be held at monthly intervals and, if required, informal meetings on a more frequent basis will be held with the Contractor. During these meetings, issues and problems affecting the progress of works will be discussed and the exchange of ideas and opinions will be encouraged and fully discussed to establish their relative merits. The Consultant recognizes that it is necessary to develop a close working relationship with the Contractor at all levels of the supervision process. This will range from the day-today, face-to-face direction of the Contractor on site, to the formal exchange of contract correspondence and establishment of measurement, quality testing and payment procedures. The Consultant will brief the PMU on the outcomes of the regular site meetings and will also assist the PMU in coordination work with different agencies and related Consultant engaged to provide independent monitoring of the Environmental Management Plan (EMP) and Resettlement Action Plan (RAP) activities, and hold meetings for proper and timely implementation of the Project. The Consultant will also promote cordial relations between its staff, the public and contractor's staff as well as liaison with centr al/local government authorities and utilities agencies which is essential for the successful completion of the Project works to fulfill the overall objective of the Project.

6) Inspection on construction work in each phase & Control of Inappropriate Practice


Day-to-day Inspection

The Consultant shall review and approve the inspection plan by work type which will be submitted by the Contractor and implement the inspection work in accordance with the above plan. The Inspection Plan shall detail the witness/report review points which will be designated by the Consultant for each work phase and follow-up work shall be commenced after the Consultants approval. The inspection result shall be reviewed based on the information about inspection items, its details, sta ff that are responsible for inspection, and a checklist.

The Consultant shall provide the Contractor with detailed description of work items that fail to meet the quality standard in the Consultants judgment and shall re -inspect the work items that were supplemented or re-constructed. Any inappropriate matters shall be recorded in document and relevant remedial actions shall be clearly implemented. When any inappropriate matters are found, the Consultant shall make every effort to keep such problems from being repeated by investigating the causes, closely monito ring the progress, and educating technicians, if necessary.

7) Approval & Monitoring of Quality Control Plan


The Consultant shall establish Quality Control Plan to meet the construction quality standard and to monitor the construction progress on a regular basis based on the plan. The Consultant shall select priorities in quality control process.

The Consultant shall request the Contractor to establish quality control plan in order to meet the quality control objective and the expectation of the Client and verify the appropriateness and conformity of such plans to the relevant Specifications and Quality Standard. implemented in accordance with the ISO 9001 (International Quality Management Standard). Monitoring of Quality Control

The Consultant shall confirm the check points in each phase in accordance with the Quality Control Plan and approve the follow-up measures after evaluating the conformity of site/lab test result to the quality standard. This continuous and systematic control measure is expected to help all employees of the Contractor and thus site technicians can have a better sense of quality work and improve the construction quality as well. Selection of Quality Control Priority Items

The Consultant shall prepare a list of priority works or sectors of quality control that may require more attention and expense among those works that have failed to meet the quality standards or have high potential of defects.

8) Approval & Control of Work Progress


The Consultant shall manage the construction progress and payment schedule in a parallel manner in terms of planning, operating, and evaluating the work progress in order to complete the construction by satisfying the high quality of specifications and drawings in a given construction period. The main objective of this project includes soft ground treatment, bridge and drainage construction, facility work (additional work), and pavement. Approval of Work Schedule The Consultant shall review and approve the plan for schedule management, which is made pursuant to the CPM (Critical Path Method) and PERT (Programme Evaluation Review Technique) and submitted by the Contractor within the date described in the Contract Document, and submit the result to the Client. The Consultant shall provide a comprehensive work control measure that can control work schedule, cost, and progress in a parallel manner. Control of Work Schedule The Consultant shall review and confirm the weekly and monthly work progress submitted in advance by the Contractor. The Consultant shall keep the work progress data on a weekly basis and encourage the Contractor to focus more on main work items in order to meet the work schedule. The Contractor will report the progress and performance result of work on a weekly basis to the Consultant for approval. Upon necessity, the Consultant shall hold a weekly or monthly meeting with the Project Manager and other related professionals to analyze and evaluate the construction progress, detect any problems or false construction, and set up disaster prevention plans and others that are deemed necessary for the successful construction. Cash Flow Projections After the implementation schedule is complete, the cash flow requirements of the project for each package will be analyzed to see if they can facilitate budgeting. The budget projection versus actual accumulated interim payment will be plotted on a monthly basis and presented to the PMU. Based on this graph, it is possible to take a proactive action helping with smooth cash flow. The cash flow projection will be prepared in a worksheet format. In general, the line is shaped to be an S-curve as shown below.

Control of Delayed Work In case any work progress does not meet the monthly schedule or the accumulated scheduled-work fails to meet the contract standard, the Consultant shall request the Contractor to analyze the reason and establish proper recovery measures and schedule. The Consultant shall review and confirm the recovery measures submitted by the Contractor and check and assess the progress on a weekly basis. Unless the recovery measures do not meet the schedule, the Consultant shall hold a construction implementation meeting and set up necessary measures to meet the original recovery schedule.

9) Confirmation & Approval of Quantity Paid


The quantities indicated in the Bill of Quantities are estimated quantities of the works, and will not be taken as the correct quantities. Measurements of all completed work which have to be approved will be made by the Consultant and PMU representative who will check and approve. The Consultant will make an agreement with the Contractor on systems of measurement for interim payment certificates and verify the quantities for such certificate. The Consultant will take measurements jointly with PMUs staff an d compute quantities of approved and accepted works and materials, and check, certify, and make recommendations to PMU on the Contractor monthly and final payment certificates. In the case of earth works for example, the quantities of excavation and fill at the end of each month for which measurement has been made will be clearly marked on the cross sectional drawings to ensure that the approved and accepted work is accurately paid to the Contractor by the monthly payment certificate and final payment certificate. In addition to the works completed by the Contractor during the month, usually material on site which is to be incorporated in permanent works will also be eligible for payment in accordance with the terms and conditions of the contract. The quantity of this material will be measured accurately each month and recorded properly by PMUs staff with the assistance from the Consultant.

10) Review & Approval of Design Change


In the course of construction, the need may arise for modification and alteration to a part or parts of original design and specifications. If they are inevitable due to variation of site conditions, or desirable in view of the possibility of incidental reduction in the cost of the works, we will propose to PMU that such modification or alterations be made. Before making a decision to issue a variation order of any type, we will consult with PMU in advance and make a thorough study on the supporting, including preliminary Tech 4 - 25

design plans/sketches, work quantities, labor/equipment, time needed to carry out the work and cost estimates. The Consultant will also submit procedures and time frames of approval of variation order and effect on the overall project implementation. If it is approved to issue the variation order, we will prepare the order (including all necessary plans, specifications and related data) in the most expeditious manner possible, realizing that time is of the important essence. The Consultant will always keep the costs to be a minimum. Work required by the variation order will be valued at the prices and rates set out in the contract documents. In case the contract does not have any rates in the bills of quantities applicable for extra/additional work, we will recommend what the new rates/prices should be and, if required, to assist PMU in negotiations with the contractor. We will make an analysis of the unit prices by collecting information from suppliers and by ascertaining wage rates, equipment rates, material costs and production rates. Unit prices will be updated based on the current prices with due consideration of tax. The new unit prices shall be based on methods and input in the detailed engineering design and the bid. During the implementation, some construction work may be deleted due to right -of-way difficulties or other reasons. The Consultant will evaluate the amount of work which may then be deducted from the contract amount of the contractor and affect to the unit prices and contract amount. Once the variation order is prepared and issued, we will assist the contractor to integrate the new work with the ongoing work and get it completed in the scheduled time frame. We will also keep PMU informed on the progress of the works.

11) Review & Approval of Subcontract


Before approving sub-consultant work, the Consultant shall check the qualification and appropriateness of the sub-consulting firms in order to select the best qualified firms and ensure a seamless work implementation and high construction quality. The final result shall be reported to the Client.

12) Site Dairy, Staff Reports and Site records


Site Diaries are a good tool to adequately document the progress and performance of the works. The Consultant will keep such a daily project diary and will submit it to the Project Director on a regular basis for his review to ensure that it is being properly maintained. Site diaries will eventually become documentary evidence for claims management. Therefore site diaries will be jointly signed by the Consultant and the Contractor. Information to be recorded daily includes:

Significant events at the site Weather conditions and number of hours affected by adverse weather conditions Contractor's staff, equipment and materials at the site Equipment downtime Construction sequences Results of tests and investigations Quality assurance Records, Non conformance Reports Instructions to the Contractor and his compliance with them Work approvals Any emergency affecting the safety of life or of property; and Other pertinent matters, such as visitors to the site, etc.

All of the Consultant's project team members will be required to produce reports summarizing activities over the previous period. These reports will be submitted to the Team Leader prior to the regular Consultant's Staff Meetings so that any problems raised can be addressed in the meetings.

13) Review of AS built Drawing


Preparation of As Constructed drawings is the responsibility of the Contractor. Consultant will issue

guidelines and formats for this work and check before acceptance. Contractor will be encouraged to complete these drawings simultaneously with completion of each section of road or the structure. All plans will be drawn to universal coordinates so that they can be reproduced on the ground in future without reference to any beacons used for setting out as these may be damaged. Only the establishment of a monument using Global Positioning System (GPS) will be sufficient. As built drawings for any underground utilities such as water and telecommunication cables and ducts will be very important for future construction activities. As built drawings of these will be prepared in consultation with the relevant authority and copies will be issued to all authorities concerned with the underground utilities.

14) Traffic Maintenance and Local Access


As the roads cannot be closed for construction works, it is critical that traffic flow is maintained throughout the construction period with minimum disruption. To attain this, the Contractor will be required to submit traffic control plans for the sections of the works where interaction with existing traffic will occur. These plans will be discussed with the Contractor before approval, and modified, if so required. Consultant will ensure that the Contractor maintains traffic flows during construction in an efficient, safe manner through the use of signing. Barriers, diversion signs, detours signs, etc. The related work items and specification as per contract will be implemented with suitable modifications, if necessary, to suit circumstances. The Consultant will ensure that adequate provisions will be made to allow safe traffic flows. The Consultant will further ensure that the environment of the Contractor's work areas is maintained during the course of the work. Traffic control measures will be in place during the night time as well and where required, signs must be lit at night. Most of the project section comprises widening of the existing road. As widening of the road will be on both sides, work will be undertaken only on one side. When this side is completed to at least the binder course level the traffic will be shifted and work will begin on the other side. Where new box culvert or bridge is constructed, temporary bypass shall be constructed for the traffic. Where partial road closing is required, the safety of drive rs and construction workers shall be ensured by the installation of appropriate road safety facilities under the traffic safety regulations. Permissions with relation to the road construction works shall be acquired in close consultation with the relevant authorities including local police stations. Road traffic safety facilities comprises Signs, Road marking, Channelization facility, Lightening facility, Fence, Impact absorbing system, Worker safety vehicle, portable traffic signal, etc. First functionalit y of road safety facility is to provide necessary information to driver in appropriate time so necessary requirement for this function has to be satisfied. To encourage drivers to take alternative routes, where available, information signs will be put up at appropriate locations advising them of delays that may be encountered. Where ever only one lane is available for traffic, especially during asphalt works, stop go men will be stationed at both ends. If the distance is long, or invisible due to curves, they will be provided with radio communications .

15) Clients Assistance for Litigation or Arbitration Cases


The Consultant will advise the PMU with respect to carrying out the works following any appeal to arbitration or litigation related to the works. The Consultant shall make every effort to provide all data and evidence necessary for minimizing possible damage from such arbitration or litigation against the Client. And also provide any other specialized services as may be necessary and agreed upon. 3.3. Supervision of Completion Stage

1) Preparation of Completion Drawing & Confirmation of Quantity


At the completion of each contract package, we will receive from the Contractor a complete set of as -built drawings in hard-copy and digital version in reproducible stable medium and editable files for each contract package. Therefore, we, by means of inspections and verification of the records collected along the Project, will verify the accuracy of the as-built drawings as true record of the works as constructed, and also the as-built will be checked against site orders and variations authorizing changes and extra works in order to ensure that all variations have been incorporated in the drawings. Thereafter, the complete set of the as-built drawings will be officially submitted to PMU. As-built drawings can be submitted in the following formats: hard copies, CAD file, micro-film, etc. They will be submitted based on the Clients input, appropriate to the Clients management system.

2) Final Inspection & Request of Completion Certification Issuance


Approval of the works and correction of faulty works throughout the course of the work, we will approve or reject any construction item the contractor completes. The decision to approve or reject work will be based on test reports, survey results, reports from surveyors and inspectors and direct o bservations. Any faulty work corrected by the contractor will be re-inspected by us. The function of quality control is not to reject work but to ensure that works are completed to the required standard in the first instance to avoid the need for remedial works, and satisfactory to PMU . We will make every effort to keep the contractor fully informed about the work, which is likely to be rejected. All steps in the construction process will be closely inspected so as to ensure that corrective action is tak en as construction proceeds, rather than after construction is completed. Just prior to completion of the works in each package, we, along with the representative of the contractor, will inspect the works, or any part of the works. The results of the inspection will include a typed list of observed deficiencies, which is to be submitted to the contractor for his remedial action. 3.3.1. Safeguard Issues

1) Environmental Monitoring
The Project will have an Environmental management Plan prepared by the Design consult ants. Sub Clause 4.18 of the contract required the contractor to safeguard the Environment. Contractor is required under the contract to prepare and Environment Management Plan (EMP) for his activities and to be approved by the engineer. The Consultant will ensure that the Contractor complies with the approved Environmental Management Plan during the execution of civil works contract. The Consultant will check that contractors' methods of construction do not adversely affect the neighborhood of the works, t hat proper mitigation measures have been planned and that the contractor implements efficient environmental protection measures during construction. Supervision Team will generally advise and guide the team in monitoring environmental issues during construction. Some of the key environmental Tech 4 - 28

aspects which require focus during construction include: Setting out and clearing ROW Diversion of traffic Construction Camps Haulage roads Quarries Work Sites Construction Equipment/Vehicles Water resources and drainage channels Borrow areas Air quality and noise Soil erosion and conservation Hot mix plants Loss of fertile soil, erosion and silting Loss of access Accidental risks from blasting along road way and in quarries Location of campsites, storage depots Storage of hazardous material Wayside amenities and service stations Archeological monuments/ruins/religious structures Hydro-geology

Consultant will ensure that common nuisances such as dust, noise and drainage problems during construction are minimized by adopting mitigation measures such as watering, proper maintenance of plant and machinery and proper drainage and erosion control measures. We will ensure that the contractor corrects all the deficiencies observed during the site inspection for issuing of the taking -over certificate in a suitable manner, and completes any outstanding work. After the final inspection is performed to confirm the satisfactory completion of the works, we will make a recommendation to PMU that the contractors work is acceptable, after which a taking -over certificate can be issued and the normal procedure specified in the general conditions of contract (based in FIDIC) can be followed.

Water Pollution

Water resources will be protected by mainly focusing on water quality and wetland protection. During construction, material storage and lay-down facilities will be built away from streams to protect water resources from construction sediment and toxic materials. Proper measures will be implemented to ensure that there should be no silting of water, produced from site erosion.

Wasted Oil & Material

Antipollution plan shall be set up to prevent and control any pollution caused by leakage of oil and other toxic material. This plan shall include all countermeasures for any possible pollution cases, contingencies as well as the worst cases. Waste management plan shall include treatment, recycle, and a detailed process of managing from waste generation point to dumping point. Under this plan, examples of waste material include toxic substance, waste petroleum (oil), construction waste and metal waste.

Road Traffic Interference

Traffic control shall be planned taking account of the characteristics of each work activity ensuring that traffic obstruction is minimized and traffic safety is maximized.

Construction Machinery Noise & Air Pollution

Consistent inspection and test shall be conducted on dust produced from construction and periodical test for heavy equipment and construction vehicles in order to meet vehicle emission control. In order to control fugitive dust during construction, pollutants will be minimized by necessary measures, for instance, by spraying water. Such environmental measures will meet the environmental criteria of Vietnam.

2) Resettlement Action Plan


After the preparation of the detailed design in coordination with the district and commune officials, undertake a Detailed Measurement Survey (DMS) including census and socioeconomic baseline survey to identify adverse impacts on private assists, business, household incomes and livelihood. Based on the findings of the above field investigation, the Consultant will determine the entitlements of compensation and other assistance including relocations and will update the RAP of the project. components, involuntary resettlement arises from land acquisition or temporary disruption of income generation, a resettlement plan will be prepared and implemented in accordance to the government laws and procedures, WBs policy on Involuntary Resettlement and the approved RAP. The Consultant will assist PMU and District Resettlement Committees (Darks) to finalize Resettlement Plans (RPs) for all Project components, and to implement and monitor the RPs. Activities will include: Update the RPs prepared during TA 6478-REG. Prepare new RPs for new sections of road where RPs has not yet been prepared, Assist PMU to disclose all RPs to affected communities and general public Assist PMU to implement information campaigns and stakeholder participation. Assist PMU to implement procedures for i. minimizing adverse social impacts ii. undertaking and completing census and detailed measurement survey of all losses, iii. coordinating resettlement and compensation activities on the various road sections, iv. participatory needs assessment for replacement assets v. ensuring that at all stages of resettlement planning, management and monitoring, gender concerns are incorporated, vi. tracking compliance with project policies; and vii. implementing promptly corrective actions and resolving grievances Assist PMUs to implement detailed income restoration programs Assist PMU to implement: liaison mechanisms and procedures for a management information Coordinate with the Independent Monitoring Agency 3.3.2. Economic and Financial Control

1) Financial Management
The Consultant will establish agreed methods of measurements and certifications with the Client and the Contractor. In the course of the project, the Consultant will ensure that all the Contractor's interim certificates (and payments) are fully justified on the basis of work satisfactorily completed. All work measurements will be reviewed, checked and certified and then certificates issued monthly to the Client for payment of the Contractor's invoices. The overall financial management of the project will include the following services:

Keeping a record of statements of work done and materials used. Reviewing the Contractor's monthly quantity reports and claims for payment for work executed. Reviewing the Quality Assurance Records for the works completed as an essential requirement for certification of payments Preparing interim payment certificates for forwarding to EA Verify and/or correct repayment of advance if required. To respond to the queries or discrepancies to any disputed item that shall be settled in the following interim payment certificates. Preparing Variation Orders. If appropriate, ensuring that variation of price provisions are implemented in accordance with the contract and that valid substantiating documentation is produced.

After the approval by Client, thoroughly costing any design changes and evaluating their impact on overall project budget, and preparation of its variation orders consequent to the design changes.

2) Variation/change Orders

to issuing the Taking-Over Certificate for the Works, either by an instruction or by a request for the Contractor to submit a proposal. Where additional work is involved and Contractor is entitled for additional payment, extensions of time and other matters. The Consultant shall review and obtain concurrence of the Employer's representative quickly not to retard overall work progress. In this case, the Consultant's interpretation of the contract documents, the relevant site conditions and the contractor's detailed submissions shall be carefully reviewed. The Consultants will prepare the necessary Documents for any variations to the works, negotiate these with the Contractor and issue the agreed Variation Order to the Contractor after obtaining concurrence of the Employer's Representative for Variations less than an agreed percentage of the Contract Amount except in an emergency situation. Variation Order shall include:

Design modification summary, Modified drawings, Specifications, and Structural calculations, Bill of Quantity and estimate, Modified construction cost, and Other relevant documents

The Consultant recognizes that variation order has financial implications on the overall contract Budget. Thus, the Consultant proposes, if a variation order to a Contract is required, to prepare a detailed report on the description, justification, and cost for each change will send to the Client through Clients Representative on site for their approval. Consultant will not approve any variation order but only recommend the order to the Client. When a cost increase is approved by the Client the Consultant will prepare the official Variation Order in an approved format for the Contract. Contractor will not b e allowed to start any work as stipulated in variation order, till instructions are provided in writing by Team Leader to proceed. Contractor will be warned that he will not act on instruction of any other personnel in the project or from site.

3) Claims(EOT & Cost) and Disputes


The Consultant will act as the "Engineer" on all matters related to the works and assist the Client with processing the Contractor's possible claims during the contract period. The Consultant will evaluate all Claims that the Contractor may submit as per FIDIC Guidelines. After completion of the evaluations, the Consultant will make un-biased recommendations on what action Client should take in regard to the Contractor's Claims. Additional compensation and other matters are the norm rather than the exception in the construction of civil works. Summary of information about important correspondence for a month between PMU, the Consultant and the contractors, Report on the environment preservation Photographs of work site activities.

Quarterly Progress Report The Consultant will prepare a comprehensive report summarizing all activities of the Project at the end of each quarter. Also when necessitated by either the Consultant or PMU due to delay of the construction works or the occurrence of technical or contractual difficulties, the project forecast report will be prepared and submitted to PMU, providing comprehensive and detailed information on time, cost, procurement, financial summary and payment progress of the construction including problem encountered, if any, and major findings and recommendations. The reports will include brief description of projects and the work-completed, and Detailed problems encountered or anticipated and Contractor claims, if any, and the status of current Contractor claims. Report potential obstacles and recommendations about measures to be taken that reduce adverse effects to work progress, The activities of the Consultants personnel assigned to the Project, progress reached, brief description of supervision tasks and modifications introduced to the project, Contract management, instructions, variation orders and day-work orders approved Summary of important correspondence exchanged during the period between PMU, the Consultant and the Contractor.

Annual Progress Report The Consultants will prepare and submit annual management information reports within at the end of each Financial Year, and also at other times when considered warranted by either the Consultant or PMU due to delay of the construction works or the occurrence of technical or contractual difficulties providing comprehensive and detailed information on time, cost, quantity and financial summary and payment progress of the construction including problem encountered, if any, and major findings and recommendations with these basis during the period forecasts through to the end of the project will be prepared and submitted to the PMU. In summary, the annual report will summarize the Contracts progress including contract variations, change orders, and claims; detail problems encountered or anticipated; indicate coming year activities; analyze financial progress; and provide cash flow forecast for the current financial year.

Final Completion Report The Final Completion Report, updating the Draft Report to cover the Defects Liability Period and Final Acceptance and incorporating any comments received on the Draft Report from PMU and WB, shall be submitted within one month after the end of the Defects Liability Period. Project summary, Major project events, Performance of the Contractor, History of project implementation including all defects and the satisfactory correction, Comparison of cost of civil works at stages of detailed design, tender and completion of the project, Total project cost, summary of local and foreign cost, Summary of annual costs, Summary of labor employed in man-months categorized to skilled/unskilled and foreign/local, Tables detailing costs of variation orders and supplemental agreements with justifications, Tables detailing extension of the contract time and reasons thereto, Relevant contract dates such as notice to proceed, substantial completion, full completion, etc, A summary of the Project Performance Monitoring, and Assessment of the environment impact of the construction work in the project area. Summary of technical issues of the Project in the Construction stage. Procurement Support

Consultant staffs will provide pre-award procurement services to assist the PMU in preparing bid packages, evaluating bids, and making award determinations. The Consultant staffs will provide a collaborative process to the PMU and prospective contractors that ensure a fair and competitive sourcing process. Preview Bidder Qualification A bidder list will be drawn from a qualified contractor database based on the existing GOV and PMU list of qualified contractors. It will be expanded by qualifying additional contractors. Contractors will be qualified by meeting criteria for necessary construction and service capabilities, capacity, cost control, safety and quality performance, regulatory compliance history, customer references, licenses and certifications, insurance and bonding capacity, and financial stability. Reporting obligation of Consultants for the Contract includes: Major project events - Inception Report - Short-list evaluation report - Bid/proposal evaluation report - Contract negotiation minutes 3.7. Technology Transfer on-the Job Training

promote technology transfer between the Consultant and PMU staff, and so enhance PMUs capability to undertake similar projects in the future, reduce the dependence of PMU staff and domestic Consultant staffs upon foreign technical assistance, improve the individual performance and motivation of PMU staff and domestic Consultant staffs, and develop the training program in such a way that it fits in with PMU longer term training strategies.

In addition, the Consultant consider that there are other areas or categories of training that would be of benefit to PMU staff and domestic Consultant staffs, and which could be provided by the Consultant during the course of this project, for example:

pavement design and technical specifications, construction supervision, monitoring procedures, procurement of construction contracts, and project and financial management.

The Consultant has a philosophy of training and continued professional development of its own personnel. We have substantial experience in training and technology transfer in respect of counterpart staff in our international projects. It is intended that all field or practical training be conducted at sites where contracts are being implemented. Therefore the Consultant will indicate a model section in consultation with PMU and the Contractor at the project site to instruct and show the method of quality control and other technical skills to the Vietnamese administration staff.

The Consultant shall thoroughly review the design document before the construction work starts and try to ensure a seamless work progress by pre-consulting with the Client, the Constructor or relevant institutions over any work items that may carry problems during construction and by pre-checking the status of material sources, equipment supply and other items necessary for creating work site and commencing the work. The Consultant shall check and confirm the supervision and construction work organization status to ensure a timely completion of road and bridge construction and submit the Supervision Service Plan to the Client. The Consultant shall also pre-review the overall construction plan documents (Work Progress Plan, Safety Control Plan, and Quality Control Plan) submitted by the Constructor and establish and improve diverse standards and methods necessary for supervision management.

The Consultant shall instruct the commencement of the work when the construction site is fully prepared. Also the Consultant should check site conditions, measurement reference points, and design status, based on surveying of soft ground area and bridge foundation. During the construction period, the Consultant shall:

Check the conformity of design plans and shop drawing to the actual site conditions, construction quality, safety and work progress status and review the environmental efficiency before commencing the work. Inspect the material status in accordance with the inspection check list and conduct relevant site and lab tests to ensure quality work. Provide construction guidance at the bridge and other main work sites for a seamless work implementation and check the status of site safety on a random basis. Instruct an immediate recovery or remedy of any work delayed or wrongly constructed and confirm the final result. Check the status of the work in progress on a regular basis and report the result to the Client. Review the recovery measures submitted by the Contractor and suggest proper supervision comment, if necessary. Check the design change conditions in accordance with the Contract Documents and activity support the Client to settle any Construction Claim during construction by thoroughly checking the construction record and contract documents. Upon the request of interim payment, check the conformity of the actual completed work to the design document.
