trict Institute of Education and Training of Andhra Pradesh School Education Service - Orders - Issued.

The following notification will be published in the Andhra Pradesh Gazette.
NOTIFICATION
In exercise of the powers conferred by sub-section (2) of section 5 and sub-section (1) of section 12 of
the Andhra Pradesh School Education Teachers and other employees (Abolition of existing service cadres and
Regulation of recruitment and conditions of service) Act, 2005 (Act 27 of 2005) and in supersession of Andhra
Pradesh Teachers (Regulation of Transfers) Rules, 2005 issued in G.O.Ms.No. 104, Education (Ser.II) De-
partment, dated the 5th August, 2005, the Governor of Andhra Pradesh hereby makes the following rules,
regulating the transfer of Headmasters Grade.II, Mandal Education Officers / Lecturers of DIETs., governed
by the Andhra Pradesh School Educational Service.
RULES
1. Short Title These rules may be called the Andhra Pradesh Headmasters Gr.II/Mandal Educa-
tional Officers/Lecturers of District Institute of Education and Training (Regulation
of Transfers) Rules, 2006.
2. The following Committee is competent to make transfers :-

Constitution of i) The Committees shall consist of the following namely:-


Committee
a) A Senior Officer of the Department nominated by the Director of School Educa-
tion not below the rank of a Joint Director as the Chairman.
b) One Officer not below the rank of a Joint Director from another Regional Office
nominated by the Director of School Education as a Member.
c) The Regional Joint Director of School Education concerned as the Member-Sec-
retary.
ii) The Committee shall be the authority for transfer of all Headmasters Gr.II/Mandal
Educational Officers/Lecturers of District Institute of Education and Training in
the Zone.
iii) The Member-Secretary shall be the competent authority to issue posting and
transfer orders, after the approval of the Committee.

The transfer orders shall be issued to all the teachers of one category in one proceed-
ings only enclosing the names of the Headmasters Gr.II/Mandal Educational Offic-
ers/ Lecturers of District Institute of Education and Training transferred and places of
posting on transfer in the Annexure through computer output only. No individual
transfer orders shall be issued.
3. Officers to be
transferred
compulsorily The following categories of Headmasters Gr.II/Mandal Educational Officers / Lec-
turers of District Institute of Education and Training shall be transferred compulso-
rily.

1) All the Headmasters Gr.II/ Lecturers of District Institute of Education and Train-
ing who have completed 8 years of service in a particulars school/ Office/Institution
in all categories of posts as on 1st July of the year but not the Officers retiring with in
2 years.
2) All the Mandal Educational Officers who have completed 4 years of service in an
office / Institution as on 1st July of the year.
3) Headmasters working in Girls schools. If female Headmistresses are not available,
then the headmasters who cross 50 years of age may be continued.
All the above officers shall be relieved from the schools/offices / institutions a day
before the date of counseling and this period up to issue of posting orders shall be
treated as duty.

4. Officers not to be
Transferred The Headmasters Gr.II/Mandal Educational Officers / Lecturers of District
Institute of Education and Training with less than 2 years of service as on 1st
July of the year should not be transferred.

5. Officers eligible to
apply for transfer The Headmasters Gr.II/Mandal Educational Officers / Lecturers of District
Institute of Education and Training with a service of 2 years as on 1st July of the
year only are eligible to apply for transfer.

6. Officers not be
posted in the same
Gram Panchayat /
Municipality/
Municipal Corporation. Headmasters Gr.II/Mandal Educational Officers / Lecturers of District Institute of
Education and Training transferred shall not be posted in the same Gram Panchayat/
Municipality / Municipal Corporation except Hyderabad.

7. Posting of MEOs No Mandal Educational Officers who have completed 4 years of service as Mandal
Educational Officers shall not be posted as Mandal Educational Officers. Mandal
Educational Officers who apply for transfer shall not be posted as Mandal Educa-
tional Officers.

8. Schedule of Transfers: The Director of School Education, Hyderabad may draw the schedule once in a
year and communicate the same to the Competent authority to effect the trans-
fers.

9. Entitlement of Points The points to be awarded to the Headmasters Gr.II/Mandal Educational Officers /
Lecturers of District Institute of Education and Training who apply for transfer shall
be as follows:
1. Service in the Present School or Office of Institution located in the areas as on 1st
July of the year;-
i) For service in category IV areas: Ten (10) points per every year of service.
ii) For service in category III areas : Seven (7) points per every year of service.
iii) For service in the category II areas : Four (4) points per every year of service.
iv) For service in the category I areas : One (1) point per every year of service.
2.) For Service as a Headmasters Gr.II/Mandal Educational Officers / Lectur-
ers of District Institute of Education and Training:
One point for 5 years of service in the present category as on 1st July of the year.
Note : The Habitations/Towns shall be classified into the following categories
namely:-
a) Category -I : All Habitations / Towns where 20% HRA is admissible.
b) Category -II : All Habitations / Towns where 12.5% HRA is admissible.
c) Category -III : All Habitations / Towns where 10% HRA is admissible but
having Bus / Train facilities.
d) Category -IV : All Habitations / Towns where 10% HRA is admissible, but
not having Bus / Train facilities within a radius of 3 Kms form
the school point.

10. Special categories i) Ten (10) points for the Headmasters Gr.II/Mandal Educational Officers/Lecturers
of District Institute of Education and Training who are retiring with Two years from
1st July of the academic year.
ii) Fifteen (15) points for un-married female Headmasters Gr.II/Mandal Educational
Officers/Lecturers of District Institute of Education and Training.
iii) Ten (10) points for Headmasters Gr.II/Mandal Educational Officers/Lecturers of
District Institute of Education and Training whose spouse is working in Government
or Local Body or Aided Institutions in the same zone and ofted for transfer nearer to
their spouses only.
iv) Ten (10) points to the President and the General Secretary of District units and
President and General Secretary of State units of recognized Associations.
Note : A copy of certificate issued by the competent outhority shall be enclosed to
the check list to consider their cases under special categories (iii) and (iv).

10. Preferential
Categories i) Physically handicapped i.e., those with not les than 70% handicap.
ii) Widows.
iii) Legally separated women.
iv) The Headmasters Gr.II/Mandal Educational Officers/Lecturers of District Insti-
tute of Education and Training who are suffering with the following diseases certi-
fied by Specialized Institutions for the concerned diseases as specified by the Direc-
tor of School Education in consultation with the Director of Medical Education.
a) Cancer.
b) Heart Operation.
c) Neuro - Surgery
d) Bone T.B.
e) Kidney Transplantation.
v) Headmasters Gr.II/Mandal Educational Officers / Lecturers of District Institute of
Education and Training who are willing to go over on transfer to the Schools in
Category IV area and whose spouses are employees of State Government / Local
Bodies / Aided institutions in the same zone.
Note 1: The benefit of preference shall be given once in 8 years to the above catego-
ries.
Note 2: A copy of certificate issued by a competent authority shall be enclosed appli-
cation to consider their cases under preferential category on medical grounds.
Note 3: The officers who avail the benefit of special categories and preferential cat-
egory shall not be allowed to opt for the posts of Mandal Educational Officers.

12. Applications on line i) The Headmasters Gr.II/Mandal Educational Officers/Lectureres of District


Institute of Education and Training completed 2 years and who are interested
for transfer shall apply through on line.
ii) All the the Headmasters Gr.II/Mandal Educational Officers/Lecturers of
District Institute of Education and Training covered in Rules 3 of the G.O. shall
also apply through online only.
Note 1: In the Headmasters Gr.II and Lecturers of District Institute of Educa-
tion and Training who come under rule 3 and have not submitted application
through on line or not attended for counseling or who are on leave having com-
pleted 8 years of service have not submitted the application on that date, they
will be transferred to the available left over vacancies.
Note 2: If the Mandal Educational Officers who come under rule 3 and have not
submitted application through on line or not attended for counseling or who are
on leave having completed 4 years of service have not submitted the application
on that date, they will be tranferred to the available left over vacancies.

13. Check list to be


submitted to the DEOs The Headmasters Gr.II/Mandal Educational Officers/Lecturers of District In-
stitute of Education and Training who apply for transfer shall obtain print out
from the Web site and the check list shall be submitted to the District Educa-
tional Officer with the signature of the Head of Institution and a photostat copy
shall be kept with them.

14. Transfers through


Counseling Transferes shall be effected by way of counseling through online.

15. Transfer on discip-


linary Cases The Headmasters Gr.II/Mandal Educational Officers/Lecturers of District In-
stitute of Education and Training on disciplinary cases shall be transferred to
the schools located in Category IV area only with the approval of the Director of
School Education.

16. Transfer requests


for reposting Those who requested for reposting shall be posted in the same Headmasters
Gr.II/ Mandal Educational Officers/Lecturers of District Institute of Education
and Training in the same school/Office / Institution only. For any reason the
said post is not vacant, the proposal shall be furnished to the Director of School
Education for issue of posting on administrative grounds.

17. Notification of all


vacamcies and names
of the applicants: The lists of category wise schools (category I,II,III and IV), the names of the
Headmasters Gr.II/Mandal Educational Officers/Lecturers of District Institute
of Education and Training to be transferred and the vacancy list shall be kept in
website.

The Regional Joing Director of School Education shall notify the vacancies with
the approval of the Dirctor of School Education.

18. Display of transfers


effected The transfers effected shall be displayed on website.

19. Appeal i) An appeal against any order of the Transfer Committee shall lie with the Commit-
tee consisting of Additional Director of School Education and Joint Director con-
cerned within 10 days from the date of receipt of such order.
ii) All such appeals shall be disposed off within 30 days from the date of appeal.

20. Powers of the


appellate Committee 1. The Committee may either suo-moto or on an aplication received from any person
aggrieved by the orders of the Transfer Committee may call for and examine the
records in respect any proceedings of transfer of Headmasters Gr.II/Mandal Educa-
tional Officers/Lecturers of District Institute of Education and Training to satsfy him-
self about the regularity, legality or porpriety. If, in any case, if it appears to the
committee that any such proceedings should be modified, annulled or reversed or
remitted for reconsideration, the committee may pass orders accordingly or remand
the case with any direction as to rectify any violation of reules or discrepancy. Such
orders shall be implemented by the authority concerned.
2. The Committee may stay the implementation of any such proceedings, pending
exercise of his powers under sub-rule (1) above.
3. The Committee may either suo-moto or on an application from any person inter-
ested, made within forty five days of the passing of an order under sub-rule (1) re-
view any such order, if it was passed by him under any mistake, whether of fact or of
law, or in ignorance of any material fact.

21. Punishment for


furnishing false
information The Officers who have submitted false information and certificates, and the officers
who have countersigned the information, shall be liable for disciplinory action as per
rules in addition to filing of criminal cases against them.

22. Punishment for


violating the rules The Member-Secretary who have issued orders in violation of the rules and instrutions
issued by Director of School Education from time to time in the matter shall be liable
for disciplinary action as per rules.

23. All the transfers and promotions issued under these rules shall be subject to the final out come of
SLP Nos. 9467-82 of 2004 and 13922/2005 pending in the Hon'ble Supreme Court of India and
W.P.No. 14585/2005 pending in the Honourable High Court of A.P. and any other Cases pending in
the Andhra Pradesh Administrative Tribunal, Hyderabad.

24. This order issues with the concurrence of Finance (W&M) Department vide their U.O.No. 2589/344/
A2/W&M/2006, dated: 8.5.2006.

RULES
1. Shor Title These rules may be called the Andhra Pradesh Teachers (Regulation of Transfers) Rules,
2006.
2. The following Committee is competent to order transfer of teachers:-

b) Chief Executive Officer -- Zilla Parishad - Member
c) District Educationa Officer -- Member - Secretary

ii) The Committee shall be the competent authority for transfer of all categories of Teachers
working in Primary, Upper Primary and High Schools.
iii) The Member-Secretary shall be the competent authority to issue posting and transfer
orders, after the approval of the Committee.

The transfer orders shall be issued to all the teachers of one category in one proceedings
only enclosing the names of the teachers transferred and places of posting on transfer in
the Annexure through computer output only. No individual transfer orders shall be issued.
3. Teachers to be
transferred
compulsorily The following categories of teachers shall be transferred compulsorily:-

1) All the teachers who have completed 8 years of service in a perticular school in all
categories of posts as on 1st July of the year but not the teachers retiring in 2 years.
Note : In case of upgraded and bifurcated schools, the service rendered in the school prior
to upgradation and bifurcation shall be counted for 8 years of service.
2) Surplus Teachers in the schools., which shall be taken up only on specific instructions
of the Director of School Education.
3) Male teachers working in Girls Schools. If female teachers are not available, then the
male teachers who are having more that 50 years may be continued.
4) Teachers working against the sanctioned posts of other category of posts.

All the above teachers shall be relieved from the schools a day before the date of counsel-
ing and this period up to issue of posting orders shall be treated as duty.

4. Teachers not to The teachers with less than 2 years of service as on 1st July of the year should not

on line.
ii) All the the teachers covered in Rules 3 of the G.O. shall also apply through online
only.
Note 1: If the teachers who come under rule 3 and have not submitted application through
on line or not attended for counseling or who are on leave having completed 8 years of
service have not submitted the application on that date will be transferred to the available
left over vacancies.
12. Check list to be
submitte to the MEOs: The teachers who apply for transfer shall obtain print out from the Web site and the check
list shall be submitted to the Mandal Educational Officer with the attestation of the Head
of Institution and a photostat copy shall be kept with them.

13. Transfers through


Counseling Transferes shall be effected by way of counseling through online.

14. Transfer on discip-


linary Cases The teachers on disciplinary cases shall be transferred to the schools located in Category
IV area only with the approval of the Director of School Education.
15. Transfer requests

Educaion for issue of posting on administrative grounds.

The District Educational Officer shall notify the vacancies with the approval of the Di-
rector of School Education.

The Vacancies shall be blocked in each Mandal in each category and each subject in
proportion to the sanctioned posts. Preference shall be given to notify vacancies in rural
and remote areas. The vacancies once blocked shall not be reopened during the counsel-
ing process. The list of blocked vacancies shall be submitted to the Director of School
Education in writing before the counseling.

17. Display of transfers
