Cancellation of reservation should be done one month before the affair & should be put into writing w/ a letter that would state that reservation has been cancelled & be done personally in the office of Queensland only. You have to receive a signed cancellation validation from us. All down payments will be forfeited in favor of Queensland catering. Failure to do so will give us the right to collect 100% of the total contract price. 2). Increase of reservation is only possible if the services & equipment is still available, if service is no longer available a week before the event, the client has the option to withdraw all its deposits & transfer to another catering service. Queensland catering will be advised of any changes a month before the actual services. It is necessary that the caterer be given a copy of a party program, venue location sketch and 3 permits a week before the function or upon signing the contract to assure smooth flow of service. TRANSFER OF SET - UP & SERVICES OF THE WAITER: * Addtl. P 50.00/per waiter per floor if there's no service elevator in a building or function area. * There are function areas wherein ocular inspections had not been made and there is failure to inform the Office that stairs will be used instead of elevators, the waiters will still have the right to collect fees on a per floor basis even if this was not agreed upon During Contract Signing. * If the client will request for a transfer of the whole set - up, after the waiters have already finished with the set - up, addtl. Payment of P 150.00 / per waiter as transfer fee and should be well discussed and agreed upon by the client & caterer and with the acknowledgement of the headwaiter of the said function/party, Queensland policy for set - up time is four (4) hrs. For ordinary parties, & six (6) hrs for more for wedding. Client should shoulder all surcharges for excess hours, catering fee imposed by areas of reception gate entrances of function areas, villages & subdivisions. WEDDING OR ORDINARY FUNCTIONS FOR GARDEN SET-UP: * If the client has not Reserved Tents, Queensland will charge the client P 15/head for wet-linens which will be taken from the bond of the same amount. In case it will not rain, the bond shall be Refundable and will be deposited in the First Banking Day after the function. * In the event that it will rain, Queensland will not transfer the set-up if the time is limited. We will only transfer the set-up if we are given at least four hrs. w/ a charge of 50.00/head. Wet linens will not be replaced. Replaced lines will be charged at 40.00/head additional. * Services of waiter are limited up to 4 hours only, in excess addtl. P 50.00/ waiter per hrs. as overtime fee. * Chopping of lechon is FREE OF CHARGE & should be done before the function. Client should provide chopping board & knife, whether lechon is ordered from Queensland or not. NO WAITER IS ALLOWED TO CHOP LECHON ON THE SPOT, because it can disrupt service. Frances Marion A. The clients shall pay the agreed contract price for the services rendered. 2. The client agrees to pay a P5,000.00 reservation fee for the first 50 guests to Queensland Catering Services upon confirmation of transaction. Reservation fee is non refundable and non transferable. 3. Two (2) weeks after the reservation initial contract will be served to the customer with the initial details. (Food lists, number of principal sponsors, etc.) 4.120 days before the function date, 50% of the contract price is already required. FULLPAYMENT is required 15 working days before the event. Delay or failure of the Client to pay the balance of the contract price before the function date shall give the caterer the option to rescind the contract without incurring any liabilities from the client or impose penalty charges commensurate to the damage caused by the virtue of delay. 5. The client agrees that if this contract is cancelled at his/her instance or for any reasons whatsoever, the downoayment shall not forfeit as penalty in accordance with this schedule: a) If the contract is cancelled 2 mos. Before the function or party date, the whole 50% deposit of the client shall be forfeited. 6. If the number of actual guests attending the function exceeds the guaranteed number of guests, caterer shall not be required to provide additional place setting or food and beverage. However, should the customer request for additional set-up, food and service and should it be possible for the caterer, upon the latter's sole discretion and option, to provide said additional setting and food. The client shall pay the caterer a premium rate of ____?_____ per person. 7. The CLIENT fully understands that the number of guests reserved in the contract is final, not subject to reduction. The Client further agrees to pay for all guests in attendance but not less than the number guaranteed number of guests as stated in this contract. 8. The client shall be responsible for the safety and security of all the guests and their personal property. The Caterer shall not be responsible for any damages or loss of any merchandize, equipments, clothing, cell phones , gifts, other valuables left in the venue prior to during or after the function. The caterer is not liable for any damages to the venue caused by his/her guests, and the Caterer is likewise free from any and all liabilities resulting to any loss or damage or injury that may be suffered by any guests, third persons or property prior to, during and after the function. 9.The Client shall pay for the cost of broken, damaged or lost equipment, furniture, fixtures, glassware, utensils whether damaged by the guests or the Client themselves based on the current market price. 10. The Client shall be solely responsible for securing all the necessary permits, gate passes, authorizations and clearances necessary for the caterer to effectively set up its equipments and paraphernalia at the venue. The caterer shall not be responsible for any delay in the set up due to the failure of the customer to secure any f the required documentation and authorizations prior to the function dates. 11. The food should be consumed at the agreed serving time in the contract to avoid spoilage. The Client shall be liable for any spoilage of food due to delay in serving time upon clients instructions. Some food may begin to spoil within 3-4 hours after time stated in the contract. 12. The caterer further reserves the right to substitute items that are unavailable in the open market or that exceed reasonable market costs. The caterer will notify the client of any such changes if time allows. 13. The client shall appoint a representative who shall inspect, receive and certify that all equipment and food brought to the venue are complete and in good condition. Said representative may likewise inspect the belongings of the caterer's staff before they leave the venue. It shall be understood that everything is in order insofar as these matters if the caterer does not receive any written complaint from the client within 24 hours from the end of the function. 14. The performance of this agreement by is subject to acts of God such as typhoons, earthquakes, fires, floods or other disasters and acts of man, such as war, government regulations, strikes, civil disorders, curtailment of transportation facilities, or other emergencies making it inadvisable, illegal, or impossible to uphold previous contractual agreement. Caterer shall no responsibility or liability for failure to supply any service when prevented from doing so by the occurrence of strikes, accidents, extra ordinary vehicular traffic or any cause beyond Caterer's control, or by orders of any governmental authority which may affect normal catering operations. 15. Caterer reserves the right to cancel a function if it has reason to believe that the exact nature of the event varies from the originally agreed upon, whether in writing or given verbally and/or that the holding of such function may be against the law, public morals or public policy. In such case ,The Caterer shall have the right to forfeit any and all deposit or down payment already received as and by law of penalty and liquidated damages. 16. It is hereby understood that the attached Clients guidelines shall entitle the caterer to damages without prejudice to any other legal remedy it may bring. In the event that the caterer must seek legal remedies to complete execution of this agreement, the client agrees to pay all reasonable attorneys fees and cause of suit. Both parties, hereby agree so submit themselves to the jurisdiction of the court in "Quezon City ". 17. This agreement including the clients guidelines and the details indicated in page 1 constitutes the entire agreement between the parties. No modification and cancellation thereof shall be valid more if any force and effect unless in writing signed by the Caterer. The customer acknowledges that (s) he has read and accepted all the terms of this catering services agreement and has executed this agreement on " 5th day of November, 2012 at_____________. CLIENTS GUIDELINES 1. It is important that the caterer be given a copy of the event's program, venue location sketch as well as necessary entrance permits to ensure a smooth flow of equipments and food. Venue miscellaneous paper works such as getting of permits is not the responsibility of the caterer. Likewise, miscellaneous charges such as venue percentages, guaranteed bonds and other extra charges, such as overtime and damages, are chargeable to the client, who rented the venue. 2. Set-up time is an hour after delivery. The catering staff will set-up all the equipment following the final layout agreed upon by the Client and Caterer. A standard of 4 to 6 hours set-up time is vital for every function. The ordered food will arrive at the venue based on the function or booked time with the venue. The food will be served according to the start time indicated in the contract. 3. Clients should be prepared to rent tents if the reception venue is outdoors. 4. Table numbers and place cards are provided by client as well as placing it. Service staffs are not allowed to do it to avoid confusion with Clients seat plan. 5. The final layout is done during the ocular or site inspection of the venue. Ocular or site inspection is to be scheduled by both parties. The layout should be approved by the client. The client should not revise the approved lay out during the actual day of setup that will cause delay. The caterer is otherwise authorized to revise the layout if needed due to the venues restrictions such as power source, water source posts and the like that will affect the layout. 6. The client shall pay for the number of persons ordered ahead. The client shall not pay for additional food if guests exceed the number of guests. A minimal charge of P1, 000.00 to P2, 000.00, depending on the assessment of the Headwaiter on hand, will be charged to Client for the extra work of the caterer. 7. Clients representative should be assigned to watch over and control the Client's cocktail drinks to avoid losses. The Caterer will not be responsible to any lost Cocktail drinks or liquors. 8. The client shall not be allowed to add any type of food and drinks not prepared by Queensland Catering Services for food safety reasons. If the client wishes to add lechon or bring food not prepared by the Caterer, The Caterer is automatically relieved from all liabilities due to the food poisoning or spoilage. 9. The client will be given a feedback/evaluation form that should be filled up at the end of the function for review by the caterer. 10. If the reception venue of the client inside building, the use of an elevator by the Caterer to bring all equipment and food up the venue is necessary to avoid delay of equipment set-up. The client must coordinate with the building administrator should any permits, bonds, guidelines and scheduling be needed. NOTE: REFILL FOODS IS PLACED UNDER THE BUFFET TABLE. QUEENSLAND WILL NOT ENTERTAIN COMPLAINTS W/ REGARDS TO LEFT OVER FOODS. FOODS ARE PREPARED 24 HOURS BEFORE HE EVENT.FOODS ARE HIGHLY PERISHABLE AND MUST BE CONSUMED WITHIN THE TIME FRAME OF THE RESERVATION. NATURAL CALAMITIES SUCH AS TYPHOON, EARTHQUAKES OTHER WEATHER CONDITIONS AND ACTS OF GODS CANNOT BE A REASON FOR THE CLIENT TO CANCEL OR POSTPONE THE RESERVATION SO THE CLIENT HAS TO PAY 100% OF THE TOTAL CONTRACT PRICE REGARDLESS OF THE SITUATION. QUEENSLAND reserves the right to cancel the event if it will pose danger/damage to personnel and properties. In the event that Queensland/MAY FIRST BESTFOODS CATERING SERVICES DECIDES TO CANCEL ON THE DAY OF THE RESERVATION DUE TO FORTUITOUS EVENT,THE CLIENT HAS THE OPTION TO PICK-UP THE FOODS PREPARED FROM THE OFFICE.QUEENSLAND IS RELIEVED FROM ANY RESPONSIBILITY OF THE CONDITION/STATE OF THE FOOD DURING THE TIME IT WAS PICKED-UP. HOWEVER, IN CONSIDERATION OF THE CLIENT, 30% OF THE TOTAL CONTRACT PRICE WILL BE REFUNDED. QUEENSLAND/MAY FIRST BESTFOODS CATERING SERVICES WILL NOT BE HELD LIABLE, RESPONSIBLE, ANSWERABLE AND ACCOUNTABLE TO ANY DAMAGES AND INCONVENIENCES THAT ACTS OF GOD LIKE NATURAL CALAMITIES AND/OR ANY FORTUITOUS EVENTS HAVE CAUSED THE CLIENT BECAUSE QUEENSLAND/MAY FIRST BESTFOOD WAS NOT ABLE TO PERFORM ITS OBLIGATION. I agree with the above-mentioned terms and conditions set forth by Queensland Catering. In witness thereof, the parties have hereunto signed this contract this November 5, 2012. Note: Clients are allowed to bring additional food and drinks to the event, but it is not the responsibility of our waiters and food attendants to attend to your food. The client needs to provide extra charge waiters and extra chafing dish for their extra food. QUEENSLAND CATERING reserves the right, not to serve the food when the food arrives at the function area if BALANCE is not fully paid. Note: Clients are allowed to bring additional food and drinks to the event, but it is not the responsibility of our waiters and food attendants to attend to your food. The client needs to provide extra charge waiters and extra chafing dish for their extra food.
