567/0001-21 (Public Held Company) MATERIAL FACT NOTICE Start of Commercial Operations of Pecm II Thermo Power Plant Rio de Janeiro, October 18, 2013 ENEVA S.A. (Company) (Bovespa: MPXE3, GDR I: MPXEY) announced today that Pecem II thermo power plant (Pecm II or Plant), with an installed capacity of 365 MW, received authorization from Aneel, Brazils National Electric Energy Agency, to start commercial operations. The Plant has started to supply energy to a group of distribution companies under the terms of the Regulated Market power purchase agreement (PPA) secured in the A-5 energy auction in 2008. The PPA has a term of 15 years and its annual capacity payments, indexed to the IPCA inflation index, amount to R$269.2 million (as of November, 2012). Total contractual revenues also include a variable component to cover variable costs (fuel, operation and maintenance) incurred when the plant is required to generate power by the ONS, Brazils National Power System Operator. Pecm II synchronized to Brazils National Interconnected System (SIN) on June 2, 2013, and completed all electrical tests required by the ONS on June 29. Since then, the Plant was on standby, awaiting the completion of the new Pecm II substation, under Chesf/TDG S.A. responsibility. On August, Aneel approved the postponement of the PPA start date from July 1, 2013 until the beginning of commercial operations of the substation.
