THIS MATTER having been presented to the Court by prevailing plaintiff Eugene Martin LaVergnes request for an Order directing that the defendants shall jointly and severally be directed to pay and reimburse the costs of suit incurred by plaintiff in the within matter as plaintiff has prevailed on his legal claims against the defendants, with the named defendants Steve M. Lonegan, New Jersey Governor Chris Christie, New Jersey Lieutenant Governor / Secretary of State Kimberly Guadagno, Atlantic County Clerk Edward P. McGettigan, Bergen County Clerk John S. Hogan Burlington County Clerk Timothy D. Tyler, Camden County Clerk Joseph Ripa, Cape May County Clerk Rita Marie Fulginiti, Cumberland County Clerk Gloria Noto, Essex County Clerk Christopher J. Durkin, Gloucester County Clerk James N. Hogan, Hudson County Clerk Barbara A. Netchert, Hunterdon County Clerk Mary H. Melfi, Mercer County Clerk Paula Sollami-Covello, Middlesex County Clerk Elaine Flynn, Monmouth County Clerk M. Claire French, Morris County Clerk Joan Bramhall, Ocean County Clerk Scott M. Kolb having all been lawfully and constitutionally served with process in the within action, and with Affidavits of Service as to each defendant confirming the service of process having thereafter been filed with the Clerk of the Court on September 27, 2013 as was required by the specific terms of the September 16, 2013 Order to Show Cause, and with the Court thereafter also being directly provided with the Affidavits of Service as to each defendant, and with the Court also having ruled found on the record in open Court on October 3, 2013 based upon the Affidavits of Service that each and every named defendant was indeed served with process, and that each defendant either appeared or had sufficient notice and of the proceedings and of their right to appear, and with the Court further ruling as a matter of fact and law on October 3, 2013 and again on October 8, 2013 that -2-

the named defendants all without legal, factual or equitable excuse violated N.J.S.A. 19:5-1, and with the Court therefore ruling in plaintiffs favor finding that the State and County Election Official defendants had indeed violated New Jersey Election Laws with plaintiff thereby prevailing on his factual and legal claims, and with the Court having now considered the Certification of Costs submitted by plaintiff, and with all parties having had an opportunity to oppose his application, and for good cause shown by plaintiff; IT IS ON THIS _____ DAY OF OCTOBER 2013, ORDRED that the named defendants Steve M. Lonegan, New Jersey Governor Chris Christie, New Jersey Lieutenant Governor / Secretary of State Kimberly Guadagno, Atlantic County Clerk Edward P. McGettigan, Bergen County Clerk John S. Hogan Burlington County Clerk Timothy D. Tyler, Camden County Clerk Joseph Ripa, Cape May County Clerk Rita Marie Fulginiti, Cumberland County Clerk Gloria Noto, Essex County Clerk Christopher J. Durkin, Gloucester County Clerk James N. Hogan, Hudson County Clerk Barbara A. Netchert, Hunterdon County Clerk Mary H. Kolb shall be individually, jointly and severally liable to pay to plaintiff Eugene Martin LaVergne the sum of $6,744.80 as costs of suit awarded in this matter; and IT IS FURTHER ORDERED that if the defendants fail to pay the sum of $6,744.80 within 15 days of the entry of this Order, that plaintiff shall have the right to submit an ex parte certification of default to the Clerk of the Court who shall immediately then enter a Final Judgment against each named defendant declaring by way of Final Judgment that each defendant shall be individually, jointly and severally liable to plaintiff Eugene Martin LaVergne for the -3-

sum of 6,744.80 as costs of suit awarded in this matter, with post judgment interest to start to accrue from the date of entry of Final Judgment; and IT IS FURTHER ORDERED that a copy of this Order awarding plaintiff costs of suit against defendants be provided to each defendant within five days of entry of this Order.
