Panessos Constitution October 20th, 2013 Preamble To ensure high standards of public welfare, the preservation of justice, and

the promotion of democracy and regional tranquility, whilst maintaining regional integrity in creating a conduit for networking and training a community of nations interested in roleplaying on NationStates, we hereby establish a common Panessosian government for governance of the Member Nations of Panessos. Article I. Name of Affiliation Section 1.01 - This region shall be known as Panessos. Article II. Membership Requirements Section 2.01 - Any nation may join Panessos as long as they meet the requirements set by law. Section 2.02 - Member Nations of Panessos shall not be required to pass any test or pay dues as a means of acceptance of membership, nor any mandatory conditions imposed upon them thereafter to retain that membership. Article III. Regional Government Section 3.01 - The regional government of Panessos shall consist of the following: (a) Founder (i) Presides as the non-elected office, which shall be held by The Empire of Austra Regalia in perpetuity. (ii) Responsible for satisfying the administrative needs of the region. (iii) Has diplomatic immunity and cannot be tried, convicted, or impeached of any crime concerning the misconduct of this office. (iv) May only vote in regional government votes in case of tied votes among the other officers. (v) When called upon, shall serve as Chief Justice on the Supreme Court of Panessos. (b) Prime Minister (i) Acts as the Head of the Executive, Leader of the Ministries, Commander-in-Chief of the Panessian Armed Forces, and the voice of the Region. (ii) Has the power to approve laws passed by the Legislature, and to veto those deemed unfit. (iii) Should a law sent to them for final approval not be approved nor vetoed in five days, the law is considered Passed. (vi) Provides the State of the Region address to the region every new term. (c) WA Delegate (i) Determined by the Member Nation with the largest number of endorsements. (ii) Shall satisfy the terms and duties of WA Delegate as determined by NationStates.

(iii) Tasked with handling WFB and RMB management, approving allotted tasks, and keeping debates and arguments from over escalating. (iv) Tasked with making sure all candidates for government positions are eligible. (v) May also hold the office of Senator, as as long as they dont abuse this power; has no vote in Legislative Decisions under the title of WA Delegate. (vi) Shall fulfill other administrative duties when necessary. (vii) When called upon, shall serve as Justice on the Supreme Court of Panessos. (d) The Senate (i) Refer to Article VI. The Legislature. (e) The Ministries (i) Refer to Article V. The Ministries. (f) The Supreme Court (i) Refer to Article VI. The Regional Courts. (g) Member Nation (i) A nation in Panessos who has met the requirements set by law for attaining membership, and has a nation or puppet in Panessos. (ii) Eligible for all regional government positions, save the Founder. (iii) Encouraged to join in regional government affairs and apply to the offsite forum and Panessian Post. (h) Forum Administration (i) The offsite forum shall be regulated and maintenanced by the Forum Administrative. (ii) Shall aid the Legislature, Member Nations, the Regional Court, and Ministries with forum technicalities, coding, and forum management. (iii) Allowed to hold other governmental offices as long as they dont abuse this power; have no vote under the title of Forum Admin. (iv) Will be a closed group whose duties may be determined by law. Section 3.02 - No Member Nation may occupy two or more regional government positions at any time, unless stated otherwise in the offices description. Section 3.03 - Before a Member Nation enters on the execution of their regional government office, they shall take the following oath or affirmation:--"I (nation name) do solemnly swear (or affirm) that I will perform the office of (Regional Government Title) of Panessos, and will to the best of my ability, preserve, protect, enforce, and defend the constitution of our region. Section 3.04 - All regional government officers of the region may be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanours. Article IV. The Legislature Section 4.01 - All legislative powers herein granted shall be vested in a legislative body of Panessos, which shall be named the Senate. Section 4.02 - The Senate of Panessos shall be comprised of Member Nations who have applied and been approved for Senate membership. (a) Once a Member Nation joins the Senate, they are categorized as a Senator. (b) Each Senator shall have one vote in any and all senatorial decisions.

(c) Only one nation per user may join the Senate; puppets and alternate nations cannot join. Section 4.03 - The Senate shall assemble in its designated forum. The Senates forum shall be open for all to see, but closed for Member Nations to comment. All drafts, whether passed, defeated, or abandoned, shall be displayed in the Senates subforum, labelled Legislative Library. Section 4.04 - The Senate may establish its Rules of Proceeding and Meeting Conduct. Section 4.05 - The Senate shall have the following powers: (a) To legislate on the activities of the regional government enumerated herein and organizations of optional participation formed under it to supplement, complement and coordinate the activities of Member Nations; in accordance with the Constitution and Nationstates rules and regulations, (b) Override executive vetoes with 2/3 majority For. (c) To regulate policies with foreign regions. (d) To oversee and regulate the admission of new nations to Panessos. (e) To regulate the shared nation, if one is established for Panessos. (f) To define and punish Raiders and Felonies committed against Panessos, and offenses against the Law of the Region. (g) To declare a Regional War or State-of-Emergency. (h) To raise, support, and maintain a Military of Panessos. (i) To also legislate on the activities of the regional government enumerated herein and organizations of optional participation formed under it to ensure the necessary and proper maintenance of law and order for carrying into execution the foregoing powers; in accordance with t he Constitution and Nationstates rules and regulations. Article V. The Ministries Section 5.01 - Ministers are elected officials who function as the executive power of Panessos, under the Prime Minister. (a) Ministers shall be elected by all Member Nations of the region by majority vote; candidates are allowed to declare a regional political party. (b) A candidate may run for as many ministerial positions as they see fit. If a candidate wins multiple elections, they must choose one office in which to ascend to. Runner-ups then win renounced positions by default. (c) Votes are to be submitted to the WA Delegate. A Member Nation may change their vote up until the last day of the month. (d) Ministries shall hold office during the term one month before another election takes place. New officers are sworn in on the first day of the subsequent month. (e) If, by the beginning of the term, a ministry position remains vacant for any reason, the vacant office will be filled by appointment by the Prime Minister, and approved by the Legislature. (f) The WA Delegate may set other rules and requirements for elections proceedings in accordance with this Constitution, unless the Legislature has set other rules.

Section 5.02 - Each minister will have the power to override certain legislative decisions and the Prime Minister approval, on the basis it corresponds with their field of duty. These vetoes must come within a week of the Prime Ministers approval, and work in the same way as a Prime Ministers veto. Section 5.03 - In case of the removal of a Minister from office, or of his death by inactivity, resignation, or inability to discharge the powers and duties of their Ministries office, appointment will be held for the new Minister. The Prime Minister will appoint the new Minister, and shall undergo approval by the Legislature. This Minister will be in office until the next elections where they may choose to leave or run for the position again. If the new temporary Minister is subject to the same cases mentioned above, the Prime Minister will decide a successor and appoint them as a new temporary Minister, who shall once again undergo confirmation in the Legislature.

Section 5.04 - Each Ministry will have control over necessities of Panessos. The Ministries shall be: (a) Minister of Defense (MoD) (i) Trusted with the responsibility of rallying support for missions of defense, protecting the region and its allies from foreign and domestic threats, and assist in maintaining a regional army and intelligence for Panessos. (ii) If Panessos or an allied region is invaded, the MoD will be trusted with working with the MoFA and the Legislative to end the conflict. (iii) May not provoke any region, or engage in direct offense against any region; Such actions will result in recall, or ejection at the discretion of the Regional Courts. (iv) May form a Security Council to discuss and advise on military strategy and administration. (b) Minister of Economics and Trade (MoET) (i) Tasked with maintaining and supervising the regions e conomic affairs. (ii) Trusted with working with the MoFA to discuss and submit inter-regional trade agreements. (iii) Tasked with observing regional exchange rates and nations currency and aid in efforts of preventing inflation and recession, with approval of the subjected nation. (iv) May form an Economics Council to discuss and advise on the regional economy and market trends. (c) Minister of Foreign Affairs (MoFA) (i) Trusted with the responsibilities of establishing and maintaining the establishment of embassies. (ii) International diplomacy will be the responsibility of the MoFA. (iii) Tasked to defuse and prevent inter-regional conflicts. (iv) May appoint Ambassadors to allied regions to promote the interest of Panessos; these Ambassadors may hold another position of office. (v) The MoFA may form a committee on Foreign Affairs to discuss and advise on topics related to the Ministers duties. (d) Minister of Internal Affairs (MoIA) (i) Responsibilities of the MoIA are to collaborate between all Member Nations, increase collaboration between members, maintain the regions offsite forum, and regulate its Forum Admin, and recruit for the region. (ii) Responsible for protecting the national heritage of all nations in Panessos. (iii) Also tasked with the duty to promoting cultural expression through subjects such as Music, Theatre, Arts, Athletics, Language, and Genealogy. (iv) Shall be tasked with organizing and maintaining regional sports competitions and finding a host nation. (v) When called upon, shall serve as Justice on the Supreme Court of Panessos. (vi) May form a committee of Internal Affairs to discuss and advise the Ministers duties. Article VI. The Regional Courts Section 6.01 - The judicial powers of the Panessos shall be vested in one Supreme Court. (a) The Supreme Court shall consist of the Founder, WA Delegate, and Minister of Internal Affairs, and such other Judges as the Legislative may appoint for varied term lengths. (b) A majority of those Justices are required in order to charge, convict, and sentence a Member Nation. (c) The Founder shall serve as the Chief Justice, responsible for communicating and delivering charges, convictions, and sentences.

(d) In the course of running the Judiciary, The Supreme Court may establish lesser courts, law offices, and employ lawyers and Judges as appropriate for the speedy administration of Justice, and to represent Panessos in cases where the regional government is party. Section 6.02 - The Judiciary shall exercise Supreme Jurisdiction over the following cases: (a) All cases affecting the position of Ambassadors, Ministers, or other regional government officials. (b) Treason against Panessos, consisting of levying war against regions or giving aid to the enemy. (c) Attempts by a user to add multiple nations to the Legislative. (d) Posting other Member Nation's personal information without their consent. (e) Godmodding, trolling, or misconduct. (f) Interpretation of this Constitution. Section 6.03 - The Judiciary may rule on the following cases: (a) Controversies to which Panessos shall be a party. (b) Civil and Criminal cases between two Member Nations. (c) Cases concerning an Inter-national Criminal case, in which both parties cannot agree on a place of trial. Section 6.04 - Judgment in Cases of Impeachment shall not extend further than to removal from Office, and the accused shall be liable and subject to indictment, trial, judgment, and punishment, according to law. Section 6.05 - No Member Nation shall be convicted of treason unless on the testimony of witnesses; Member Nations are innocent until proven guilty. Article VII. Writing Laws Section 7.01 - The format and Procedure of Drafts to Laws shall be decided upon by the Legislative. Section 7.02 - The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in cases of rebellion, invasion, or when the public safety requires it. Section 7.03 - No Bill of Attainder or Ex Post Facto Law shall be passed. Section 7.04 - No title of nobility shall be granted by the regional government.. Article VIII. Rights, Duties, and Responsibilities Section 8.01: Member Nations Rights (a) Panessos is an integral, federal, multi-national region, formed on the principle of democracy, and as a result of the free self-determination of Member Nations and the voluntary association of equal Member Nations. (b) A Member Nation is a sovereign state that has united with other Member Nations in the Panessos. (c) Each Member Nation shall retain the right freely to secede from the Panessos. (d) A Member Nation shall have its own Constitution. (e) A Member Nation shall determine its division into territories, regions, areas, and districts, and decide other matters relating to its administrative and territorial structure. (f) A Member Nation has the right to enter into relations with other nation-states, conclude treaties with them, exchange diplomatic and consular representatives, and take part in the work of international organizations. (g) Each Member Nation shall retain the right to not participate in regional government affairs, and are therefore not subject to its laws. (h) Nations identified as Guests, Foreign Diplomats, or Exterior Nations are not subject to its laws.

(i) Member Nations have the right to bring matters of concern to the Supreme Court, whether participating in regional government or not. (j) Member Nations have the right of protection from foreign invaders by Panessos Military, and may submit a recall of its forces if the Panessos Military is not wanted. (k) The territory of a Member Nation may not be altered without its consent. The boundaries between Member Nations may only be altered by mutual agreement of the Member Nations concerned, subject to ratification by the Regional Courts. (l) The sovereign rights of Member Nations shall be safeguarded by the regional government, whether participating or not. (m) Self--determination. Member Nations shall reserve the right to voluntary disassociate themselves from any or all regional government activities and agencies, excluding them from the effect of applicable provisions; except the rulings of the Regional Judiciary in matters of their Jurisdiction defined in Section Article IX. Committees Section 9.01 - Any Member Nation may create and constitute a committee. Section 9.02 - Committees may be separate from regional government and are responsible for pursuing special projects related to Panessos. Section 9.03 - Committee membership may be decided upon within the respective committee. Article X. Amendments Section 10.01 - The Legislative, whenever it is deemed necessary, shall propose and approve Amendments to this Constitution and be passed in the same way as a draft. Section 10.02 - When a proposed amendment undergoes voting, a majority For or a two -thirds majority For out of those voting is required to pass the amendment. Article XI. Ratification and Implementation Section 11.01 - This Constitution must be voted and agreed upon by at least a majority of all Senators within Panessos to be ratified. Section 11.02 - This Constitution shall go into full effect October 31, 2013. If ratified before that date, all Articles shall go in effect, though the current administration is allowed to finish its term.
