Sub;ect to this &greement and its terms and conditions6 +icensor hereby grants you the none<clusive6 non9transferable6 limited right and license to use one copy of the Software for your personal non9commercial use for gameplay on a single computer or gaming unit6 unless otherwise specified in the Software documentation. Your ac2uired rights are sub;ect to your compliance with this &greement. The term of your license under this &greement shall commence on the date that you install or otherwise use the Software and ends on the earlier date of either your disposal of the Software or +icensor=s termination of this &greement. Your license terminates immediately if you attempt to circumvent any technical protection measures used in connection with the Software. The Software is being licensed to you and you hereby acknowledge that no title or ownership in the Software is being transferred or assigned and this &greement should not be construed as a sale of any rights in the Software. &ll rights not specifically granted under this &greement are reserved by +icensor and6 as applicable6 its licensors. O%."!S$'7. +icensor retains all right6 title and interest to the Software6 including6 but not limited to6 all copyrights6 trademarks6 trade secrets6 trade names6 proprietary rights6 patents6 titles6 computer codes6 audiovisual effects6 themes6 characters6 character names6 stories6 dialog6 settings6 artwork6 sounds effects6 musical works6 and moral rights. The Software is protected by nited States copyright and trademark law and applicable laws and treaties throughout the world. The Software may not be copied6 reproduced or distributed in any manner or medium6 in whole or in part6 without prior written consent from +icensor. &ny persons copying6 reproducing or distributing all or any portion of the Software in any manner or medium6 will be willfully violating the copyright laws and may be sub;ect to civil and criminal penalties in the S or their local country. You agree not toA a. *ommercially e<ploit the Software3 b. -istribute6 lease6 license6 sell6 rent or otherwise transfer or assign the Software6 or any copies of the Software6 without the e<press prior written consent of +icensor or as set forth in this &greement3 c. ,ake a copy of the Software or any part thereof 0other than as set forth herein53 d. ,aking a copy of this Software available on a network for use or download by multiple users3 e. Only Software sub;ect to a valid license can be used to access online services6 and download updates and patches. You may not interfere with such access control measures or attempt to disable or circumvent such security features. 'n e<change for use of the Software6 and to the e<tent that your contributions through use of the Software give rise to any copyright interest6 you hereby grant +icensor an e<clusive6 perpetual6 irrevocable6 fully transferable and sub9licensable worldwide right and license to use your contributions in any way and for any purpose in connection with the Software and related goods and services6 including the rights to reproduce6 copy6 adapt6 modify6 perform6 display6 publish6 broadcast6 transmit6 or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of protection granted to intellectual property rights by applicable laws and international conventions. You hereby waive any moral rights of paternity6 publication6 reputation6 or attribution with respect to +icensor=s and other players= use and en;oyment of such assets in connection with the Software and related goods and services under applicable law. This information may include6 but is not limited to6 user '-s 0such as gamer tags and screen names56 game scores6 game achievements6 game performance6 locations visited6 buddylists6 hardware ,&* address6 internet protocol address6 and your usage of various game features. &ll information collected by +icensor is intended to be anonymous information that does not disclose your identity or constitute personal information6 however6 if you include personal information 0such as your real name5 in your user '-6

then such personal information will automatically be transmitted to +icensor and used as described herein. The information collected by +icensor may be posted by +icensor on publicly9accessible web sites6 shared with hardware manufacturers6 shared with platform hosts6 shared with +icensor=s marketing partners or used by +icensor for any other lawful purpose. (y using this Software you consent to the +icensor=s use of related data6 including public display of your data such as identification of your user created content or displaying your scores6 ranking6 achievements and other gameplay data. 'f you do not want your information shared in this manner6 then you should not use the Software.

+','T"- %&!!&.TYA +icensor warrants to you 0if you are the initial and original purchaser of the Software5 that the original storage medium holding the Software is free from defects in material and workmanship under normal use and service for D0 days from the date of purchase. +icensor warrants to you that this Software is compatible with a personal computer meeting the minimum system re2uirements listed in the Software documentation or that it has been certified by the gaming unit producer as compatible with the gaming unit for which it has been published6 however6 due to variations in hardware6 software6 internet connections and individual usage6 +icensor does not warrant the performance of this Software on your specific computer or gaming unit. +icensor does not warrant against interference with your en;oyment of the Software3 that the Software will meet your re2uirements3 that operation of the Software will be uninterrupted or error9free6 or that the Software will be compatible with third party software or hardware or that any errors in the Software will be corrected. .o oral or written advice provided by +icensor or any authoriBed representative shall create a warranty. This warranty is limited to the storage medium and the Software as originally provided by +icensor and is not applicable to normal wear and tear. This warranty shall not be applicable and shall be void if the defect has arisen through abuse6 mistreatment6 or neglect. &ny implied warranties prescribed by statute are e<pressly limited to the D09day period described above.
