We want to make it harder for private companies to prot from the occupation. To do this we need you on our team! Private companies have become an integrated part of Israels occupation of Palestinian territories. In 2012 the Norwegian Union of Municipal and General Workers (NUMGE) and Norwegian Peoples Aid jointly published a report called Dangerous Liaisons: Norwegian Ties to the Israeli Occupation. The report demonstrates that Norwegian authorities and companies, through nancial investments and trade, are involved in activities that contribute to Israels violations of international law and human rights in relation to the occupation of the West Bank and Gaza Strip. Several multinational companies complicit in gross violations of International Law and Human Rights in occupied Palestinian territories have a presence in Norway. Through the provision of security services to Israeli prisons and the illegal settlements, the world-leading security company G4S contributes to Israels breaches of human rights and international laws. While the situation for Palestinians steadily deteriorates as a result of Israeli occupation, G4S chooses to participate in activities that help maintain illegal settlements and military oppression. Companies have a responsibility to respect human rights and international humanitarian law. NUMGE and Norwegian Peoples Aid are therefore demanding that G4S immediately withdraw from all activities in occupied Palestinian territories and cease all delivery to Israeli prisons, where Palestinian prisoners are incarcerated in contravention of the Geneva Convention. We hope this manual will be a useful resource in the G4S Campaign.

The petition against G4S


In November 2012 a petition signed by 21 Norwegian organisations demanded that G4S immediately withdraw from all activities in occupied Palestinian territories and cease all delivery to Israeli prisons, where Palestinian prisoners are incarcerated in contravention of the Geneva Convention. How to use the handbook


The aim of this handbook is to be a resource for activists involved in the G4S campaign. The rst chapter summarises G4S complicity to Israeli violations of human rights and international law. Chapter 2 covers the companys various activities in Norway. In chapter 3 you will nd concrete ideas on how you can contribute to the campaign, chapter 4 provides help with responding to counter-arguments, and chapter 5 includes a resource bank in order to access more information. We have created a sample letter that can be sent to stores/institutions that buy services from G4S, a letter to the editor that can be sent to the local newspaper, and an interpellation proposal that can be presented to your local municipal council. These can be found in chapters 5 - 7. Chapter 8 provides examples of campaign successes from Norway and other parts of the world.

1. G4S and the Israeli occupation


G4S is an international company that provides private security services. This company today is the result of a merger in 2004 between the British company, British Securior, and Danish Group 4 Falck. With operations in 125 countries and 657,000 employees, G4S is the worlds largest security company, and the biggest employer on the London Stock Exchange.2 In Norway the company has around 2,500 employees and a turnover of NOK 1.2 billion.3 In 2002 Group 4 Falck acquired Hashmira, Israels biggest supplier of security services. Currently, G4S owns 91 percent of the shares in Hashmira (called G4S Israel).4 G4S has positioned itself as a player in the private security industry in Israel, which is the fastest growing economic sector in the country. According to Who Prots from the Occupation (Who Prots),5 a project run by the Israeli Coalition of Women for Peace, private security companies are increasingly taking over tasks traditionally performed by the Israeli military. As a subsidiary of G4S, Hashmira joined the UNs Global Compact in September 2010. Global Compact is an initiative for businesses that are committed to aligning their operations and strategies with universally accepted principles in the areas of human rights, working standards, the environment and anti-corruption.7 The companys supply of security services to Israeli prisons or stores and banks in the settlements of the occupied territories contradicts G4S Israels participation in Global Compact.

2015: By no means an end to G4S ties to Israeli occupation


G4S write on their website: G4S has stated that all remaining disputed contracts will be immediately exited in terms of legal obligations to Israel. This commences now and through to 2015, when the last contract expires.8 This statement is misleading. In an interview with the Norwegian paper Dagsavisen on 16 January 2013, Debbie McGrath, Group Communications Director of G4S in London explained which specic contracts are scheduled for termination:

Were talking about a police station, a prison and a few checkpoints. But we dont physically have any people down there, what we are supplying is security systems, meaning equipment for access control, pin codes and TV surveillance.9

So 2015 does not essentially mean an end to G4Ss activities in occupied Palestinian territories or contributions to Israels human rights and international law violations. Even if G4S goes through with the stated objective of exiting certain contracts by 2015, the company will continue to aid in Israels violation of international law and human rights. In the following paragraphs you can read more about how G4S will continue to aid the Israeli occupation and Israeli human rights and international law violations.

Security services for Israeli prisons


In July 2007 G4S Israel signed a contract with the Israel Prison Service (IPS) to supply security systems to the prisons main facility. Among the prisons that G4S Israel delivers security systems to are Ketziot, Megiddo and Damon in Israel. G4S has supplied Ketziot Prisons entire security system and a central control room for Megiddo prison. It has also supplied security systems to Ofer prison in the West Bank, and detention camps Kishon (Jalameh) and Jerusalem (Russian Compound).10 Human rights and prisoner rights organisations have gathered information showing that there are many cases of torture and abuse of prisoners in these camps.11

Ketziot, Megiddo and Damon: Security prisons inside Israel


Ketziot, Megiddo and Damon are prisons located inside Israel, and all are holding Palestinian political prisoners.12 The placement of prisons for Palestinian prisoners inside Israel and the transfer of prisoners to the occupying powers territory is a war crime according to the Fourth Geneva Convention. The Conventions Article 76 states: Protected persons accused of offences shall be detained in the occupied country, and if convicted they shall serve their sentences therein. 13 When Palestinian prisoners are moved from Palestinian territories over to prisons in Israel, it becomes almost impossible for their families to visit them due to highly restricted freedom of movement of Palestinians in occupied areas. Prisoners with families on the Gaza Strip have not been able to have visits from family members since 2007.14 UNICEF, the UNs childrens fund and the worlds biggest childrens aid organisation, issued a report in March 2013 about children in military detention in Israel. The report shows that Palestinian children are being held in prison in Israel, which is a violation of Article 37 c of the Convention on the Rights of the Child, which states that children have the right to maintain contact with their family through letters and visits, except under special circumstances.15

Systematic abuse of Palestinian prisoners


The prisons G4S provides services to are detaining a number of prisoners illegally and without trial. Systematic abuse of Palestinian prisoners has been reported in these prisons.16 According to the Israeli human rights organisation BTselem, 4,593 Palestinians were detained in Israeli prisons in January 2013. BTselem and Hamoked have documented that interrogations by Israeli security services regularly involve mental and physical assaults.17 According to Defence for Children International (DCI) in Palestine, around 7,500 children, some as young as twelve years old, have in the last eleven years been arrested, interrogated and imprisoned in Israeli military and security prisons. In the report about Palestinian children in Israeli custody, UNICEF states that abuse of Palestinian children held in Israeli custody appears to be widespread, systematic and institutionalised. The report states further that UNICEF found examples of practices that are considered cruel, inhumane or degrading treatment or punishment in violation of the UNs Convention on the Rights of the Child and the Convention against Torture.18 In February 2013 the death of Palestinian prisoner Arafat Jaradat triggered major protests on Gaza and the West Bank. Jaradat died in Megiddo prison, and according to the Palestinian Interim Self-government Authority, the autopsy showed the cause of death to be torture.19 According to Who Prots, G4S installed and operates the central control room at Megiddo prison.20 G4S has conrmed that it will exit a contract with only one of the prisons they currently deliver security services to.21 This means that G4S will continue to provide services to Israeli prisons holding Palestinian prisoners, including children. For more information about the conditions of Palestinian prisoners in Israeli prisons read Chapters 10 and 11.

Security equipment and maintenance for checkpoints


According to Who Prots, G4S supplies equipment to scan luggage and people for several Israeli checkpoints on the West Banks, including Qalandia, Bethlehem and Irtah. G4S has delivered security equipment to a number of checkpoints that are located along the separation walls route into the Palestinian territories.22 This has been conrmed by Israels Minister of Defence in response to an enquiry from Who Prots: G4S is one of the companies that provides inspection [services] and scanning equipment to all the Israeli checkpoints along the separation wall [in the West Bank].23 According to BTselem there are around 35 checkpoints that function as part of the internationally denounced separation barrier.24 This separation barrier is often called the Wall, because in some places it takes the form of an eight-metre high concrete wall, while in other places it is a barbed wire fence with camera surveillance and military security zones on both sides. 85% of the barriers route goes into Palestinian territories.25 In sum total, the wall and checkpoints amount to a system that severely hinders the movement of Palestinians on the West Bank. Investigators from Corporate Watch took pictures in February 2013 of a G4S sign on a building located on a road leading up to the military checkpoint Gilo.26 G4S has also supplied security equipment to the Israeli polices headquarters on the West Bank, close to the settlement of Maale Adumim.27

Security services for illegal settlements


The organisation Danwatch has discovered that G4S provides security services to the settlements of Modiin Illit, Maale Admumim and Har Adar on the West Bank.28 In 2002 it was revealed that Hashmira had around 100 armed guards in the settlement of Kedumim. Shortly after this G4S announced that they wanted to withdraw from the West Bank.29 Even after 2015, G4S will continue to provide security and alarm services to banks and supermarkets in Israeli settlements that violate international law. International Law professor Hjalte Rasmussen states the following about the information he received from G4S management:

 G4S has contracts with a number of major commercial interests, such as banks, supermarkets and clothing chains, for the delivery of security guards for branches and stores of these customers as per the customers wishes. The branches and stores in question are mainly located in Israel, but G4S is also under contractual obligation to provide guards for the branches and stores that are on exception located east of the Green Line, more specically in East Jerusalem or on the West Bank. 30

By providing security services to the settlements on the West Bank, G4S aids Israel in violating international law and human rights. According to a report from a fact-nding committee from the UNs Human Rights

Commission from February 2013, Israels expansion of illegal settlements on the West Bank amounts to infringement of the Palestinian right to autonomy and International Humanitarian Law. A number of services provided by G4S, such as the supply of surveillance equipment for settlements and checkpoints, and the provision of services that help sustain and maintain the settlements, are mentioned as examples of business activities in occupied territories that raise specic human rights concerns.31 In July 2010 G4S acquired the private Israeli security company, Aminut Moked Artzi, which is responsible for security in the Barkan industrial zone connected to the Ariel settlement. There is no indication that G4S is planning to cease providing security services in Barkan.32

2. G4S in Norway
The Norwegian headquarters of G4S is located in Tsen, Oslo. The company supplies a number of security services to customers in the public and private sector in and around Norway. The rst step in working with the G4S campaign is to map G4S activities in your local area. We have selected a few examples of different contracts and assignments G4S has in Norway.33  G4S is responsible for security control at Oslo Airport, Gardermoen  The company was responsible for security during the Ski Championships in Oslo in 2011  G4S is responsible for security on Color Lines vessels and terminals.  The company provides security services for the trains and trams in Oslo  G4S sees to security at Bergen harbour  G4S has been responsible for security at the Oil and Energy trade fair in Stavanger.34 These are just a few examples of major contracts G4S has in Norway. The company is present in towns all around the country and provides security services to a great number of local customers. It is therefore important to check around in your local area to nd out which customers use G4S.

Ethics in public procurement


According to Statistics Norway total procurement of goods and services for the public sector amounted to NOK 398 billion in 2011, making up 14.5 per cent of GDP. A report published by the Future in our Hands movement shows that around 95 of 100 procurements made by the largest municipal councils in each of Norways 19 counties do not have any ethical requirements to the supplier. In November 2013 Oslo was the rst municipality to join Global Compact, the UNs code of ethics for business. One of Global Compacts principles is that companies shall support and respect the protection of internationally accepted human rights, and make sure that they are not complicit in violating human rights. Oslo municipality makes purchases for more than NOK 18 billion per year.

3. What can you do?


Dialog with companies/institutions that buy services from G4S
Once you have mapped where G4S operates in your local area (hotels, government institutions, airports, schools, etc.), the next step could be to speak to companies and institutions that buy services from G4S. Most likely there are many G4S customers that are concerned about following good ethical practices, who will appreciate receiving information about G4S complicity in violations of human rights and international law. It might be useful to initiate this type of dialog by sending a letter or email summarising the most important arguments, explain the case and asking for a meeting (kindly refer to the sample letter in Chapter 6). If you succeed in setting up a meeting with a G4S customer, it may be useful to keep the following points in mind:  Be professional and to-the-point in your meeting. Remember that the campaign is against G4S support of the Israeli occupation, not the company or institution that buys services from G4S. It is important to be clear about this. Make sure the case you present is based on reliable information.  Even if the rst meeting gives no immediate results, keep in mind that often achieving results takes time condence-building and trust. Give them time to think about the case. Maybe they need to check with their head ofce or check the facts themselves. Say that they are welcome to contact you, or that you can contact them in a few weeks to set up a new meeting.

Write a letter to the editor in your local newspaper


Spreading awareness in your local area about G4S complicity to the Israeli occupation is important. In chapter 7 you will nd a sample of a letter to the editor you can send to your local newspaper. It could be a good idea to contact other local organisations that might be interested in co-signing the letter.

Organise actions
Actions could take the form of posters and banners or the distribution of leaets. If you decide to organise this type of action, contact your local newspaper you might even get some press coverage.

Contact local politicians to present an interpellation in the municipal council


Does your local council use G4S services? Try to contact a local politician, preferably someone who has shown interest in ethical procurements previously. This might be an opportunity to present an interpellation in the local municipal council, where they can challenge the municipality on their use of services from G4S, and the need of ethical requirements in public procurements. Refer to Chapter 7 for a sample of an interpellation of this type.

4. Respond to counter-arguments
Being involved in the G4S campaign you may end up in discussions on the activities of G4S. This chapter is designed to help you respond to some of the most common counter-arguments.

G4S is the worlds third largest employer. Think of everyone that will lose their job if G4S loses contracts because of the campaign against them.
 G4S is complicit in human rights and international law violations. In order to have a company change its course, it is necessary to exert pressure in order to demonstrate that certain activities are unacceptable. The campaign against G4S cannot be held responsible for the fact that G4S may lose contracts due to their complicity in violations of international law. G4S has chosen to sign contracts that entail complicity in Israels human rights and international law violation. G4S must be held accountable for the security services it provides to Israeli prisons that are detaining Palestinian prisoners in contravention of international law, and the provision of safety services to Israeli settlements on the West Bank.

G4S in Norway has no inuence on their activities in Israel. This is handled by an independent company within the G4S Group; it has nothing to do with Norway.
 This is an argument G4S Norway uses on its website.35 The claim that G4S in Norway has nothing to do with G4S in Israel is wrong. G4S Norway and G4S are part of the same multinational corporation. When G4S in Norway is criticised for contributions to the Israeli occupation, G4S Group Communications Director in London speaks on the companys behalf in the Norwegian media. On its website, G4S refers to itself as an international company with business activities around the world.

G4S has said that they are withdrawing from the West Bank in 2015. Why continue this campaign against them?
 G4S is not withdrawing from the West Bank, or ending its ties with the Israeli occupation. This was conrmed by Debbie McGrath, Group Communications Director of G4S in London, in an interview with Dagsavisen on 16 January 2013: Were talking about a police station, a prison and a few check points. But we dont physically have any people down there, what we are supplying is security systems, meaning equipment for access control, pin codes and TV surveillance.36 G4S will carry on delivering services to banks and stores in illegal settlements on the West Bank, and will continue delivering security equipment to Israeli prisons that are detaining political prisoners, including children - many of them without trial. Isnt it better to enter into dialog with G4S instead of encouraging sanctions against the company?
 There has been extensive dialog with G4S. The executive leadership of G4S is aware that the Israeli occupation violates international law, and is aware of the demands of the campaign: that G4S should cease their activities in Israeli prisons and in the occupied Palestinian territories. G4S has engaged a Danish Professor of International Law to ensure that the company is not held liable for its contribution to war crimes. G4S is aware of the campaign against the company, but chooses to keep providing services that help maintain the occupation of Palestinian territories. G4S is making prots from the contracts with the Israeli Prisons Service (IPS) and companies in illegal settlements. This is why it is important to spread awareness about G4S complicity to Israeli violations of human rights and international law. This can help individuals, companies and institutions make an informed choice when choosing a security provider. This in turn may result in G4S deciding that their activities in occupied territories bear too high a cost.

The occupation is not G4Ss fault. How does it help to boycott G4S when it is Israel that is the occupying power?
 is correct that Israel is the occupying power, and that states, not businesses violate international law It and human rights. However, companies with activities in the occupied territories and Israeli prisons have their share of responsibility. According to the United Nations Guiding Principles on Business and Human Rights, businesses have a responsibility to support and respect the protection of internationally proclaimed human rights and to make sure they are not complicit in human rights abuses.  G4S imposes a code of ethics on itself by joining the UNs Global Compact, an initiative for businesses that are committed to aligning their operations and strategies with universally accepted principles in the areas of human rights, working standards, the environment and anti-corruption. Demanding that G4S end their contracts with the Israeli Prison Service and with businesses in illegal settlements is merely challenging the company to follow their own code of ethics.

Is it not illegal to exclude companies from tender processes in this way?


 There is room to exclude from government tenders companies that do not respect human rights. For example, Oslo municipality recently changed its standard contract by adding: The supplier shall respect internally recognised human rights in their activities and those in its supplier chain. 37 The University of Oslo has also adopted a code of ethics for procurement, which requires the supplier to respect internationally recognised human rights.

5. Sample letter to G4S customer


This is a sample of a letter you can send to a local company/institution buying services from G4S G4S secures the occupation of Palestine G4S provides security equipment to Israeli prisons where a number of Palestinian political prisoners, including children are detained. Many Palestinian prisoners are held without indictment or trial. Palestinians in Israeli custody are routinely subjected to torture and ill-treatment. Israels transfer of thousands of Palestinian prisoners, including children, from occupied territories to prisons located in Israel is a war crime according to the Fourth Geneva Conventions Article 76. Half the Palestinian children in Israeli prisons are held in prisons that G4S supplies with security equipment.38 Through deliveries of services to banks and stores located in settlements on the West Bank, G4S is complicit in Israels illegal settlement policies. Israels expansion of settlements is one of the greatest obstacles to a peaceful solution of the conict. The international community has consistently denounced Israels settlement building in occupied Palestinian territories. G4S has repeatedly expressed plans to cease activities on the West Bank due to ethical considerations. In April 2012 G4S decided to withdraw from contracts with military checkpoints, one Israeli prison and one police station on the West Bank on expiry of these contracts in 2015. However, G4S will continue to deliver security equipment to Israeli prisons, where Palestinians routinely are subjected to torture, and security and alarm services to banks and supermarkets in the illegal Israeli settlements. Many who have previously used G4S services choose not to buy services from the company after becoming aware of the companys complicity in human rights violations. Due to ethical considerations the University of Oslo decided in December 2012 that it will not continue its contract with G4S. The Swedish church in Ume, the Danish bank Merkur, Amnesty International Denmark and the British energy company Good Energy have decided not to continue contracts with G4S due to the companys role in the occupation and the Israeli prisons. On the basis of this information we therefor encourage [name of company/institution] to terminate the contract with G4S. If you have the time and opportunity we would be happy to meet with you to discuss this subject in more detail.

G4S secures Israels occupation


G4S is the worlds largest security company. [Here it could be an idea to include a few sentences about what services G4S provides in your local community]. Many G4S customers are not aware of the fact that their security provider contributes to Israels violations of international law and human rights. By providing security services to Israeli prisons and illegal settlements on the West Bank, G4S is complicit in Israels illegal occupation. Israels occupation of Gaza and the West Bank since 1967 has had a heavy toll on the Palestinians. Israels settlement policy has repeatedly been condemned by the international community, as one of the greatest obstacles to peace. G4S provides security systems to Israeli prisons holding Palestinian political prisoners, including children many imprisoned without trial. Palestinian prisoners in Israeli detention are routinely subjected to torture and ill-treatment. Furthermore, G4S provides security services to illegal settlements and industrial zones in the occupied West Bank. The company has stated that it will be pulling out of all remaining controversial contracts in the area by 2015. This is not true. In an interview with the Norwegian newspaper Dagsavisen on 16 January 2013, the Group Communications Director of G4S, Debbie McGrath in London said: Were talking about a police station, a prison and a few check points. But we dont physically have any people down there, what we are supplying is security systems, meaning equipment for access control, pin codes and TV surveillance. 2015 is by no means the end of G4Ss contribution to Israels violations of human rights and international law. G4S will continue servicing Israeli prisons that are detaining Palestinian prisoners. Half of all Palestinian children detained by Israel are in prisons that G4S provides security services to.39 These children have been removed from their homes in the Palestinian territories to prisons inside Israel. This violates Article 76 of the Fourth Geneva Convention that forbids the transfer of prisoners to Israel from occupied territories. Palestinian children in Israeli detention are subject to systematic mistreatment and torture. In February 2013 UNICEF issued a report that concludes: Ill-treatment of Palestinian children in the Israeli military detention system appears to be widespread, systematic and institutionalized.40 In addition, G4S will continue providing security and alarm services to banks and supermarkets in the illegal Israeli settlements, even after 2015. G4S has committed itself to the UNs Global Compact program, an initiative for businesses that are committed to aligning their operations and strategies with universally accepted principles in the areas of human rights, working standards, the environment and anti-corruption. G4S contracts in Israeli prisons and illegal settlements are not compatible with respect for human rights. We encourage everyone who buys security services from G4S to terminate their contracts with the company.

The transfer of prisoners to the occupying powers territories is illegal and a war crime. Yet, most prisons holding Palestinian prisoners are located inside Israel. Businesses have a responsibility to respect international human rights and to ensure they are not complicit in human rights abuses. G4S has committed itself to the UNs Global Compact, an initiative for businesses that are committed to aligning their operations and strategies with universally accepted principles in the areas of human rights, working standards, the environment and anti-corruption. G4Ss provision of security systems and services to Israeli prisons and settlements in occupied territories is not compatible with respect for human rights. While the situation of Palestinians gets steadily more desperate as a result of Israeli occupation, G4S chooses to participate in activities that help maintain illegal settlements and military oppression. In the last few years there has been increased focus on the need for ethical guidelines in public procurement. We want [your municipality] to be a pioneering municipality in the eld of ethical procurement. We do not want [your municipality] to support violations of human rights and international law through the purchase of services from G4S.

Swedish church in Ume gives G4S the cold shoulder


 am not saying no to Israel as a democracy, but I say no, and scream it loud when Israel violates I human rights on the West Bank, in the same way as I say no and scream it loud to what is happening in Syria, or what happened in China or what happened in South Africa. G4S out of University of Oslo


The University of Oslo (UiO) negotiated a withdrawal from its contract with G4S in December 2012. The reason was that it was not in agreement with UiOs code of ethics.42

G4S wrecked by British energy company


After complaints from customers about collaborations with G4S, the British company Good Energy chose to end its business associations with the company in August 2012.43

Trouble for G4S in Denmark


In September 2012 the Danish Bank Merkur announced it would be pulling out of collaborations with G4S. Merkurs Director, Lars Pehrson, said to the Danish newspaper Arbejderen:  G4S and its work for the settlements in Palestine settlements that are illegal according to international law, this has been part of our assessment in considering our collaboration with the alarm company. Therefore, some months back we decided to terminate our collaboration with G4S and use another company instead. 44 Several Danish humanitarian organisations have decided to pull out of their contracts with G4S. General Secretary of Amnesty in Denmark, Lars Normann Jrgensen, said to Berlingske Business: We do not want to collaborate with G4S because of the companys activities, which from the global perspective do not live up to Amnesty Internationals requirements in terms of the efforts of companies for human rights.45 The Danish organisation DanChurchAid also chose to terminate their contracts with the company. General Secretary Henrik Stubkjre stated, We have decided to put it out on tender after constructive dialog with G4S about their work on the West Bank. They have made some efforts, but we dont think its enough. Among other things, we are not happy that they are still active in the settlements.46

Major Norwegian trade union ends ties with G4S


Industri Energi, a major Norwegian trade union for workers in the energy and heavy industry sectors, terminated its contract with security company G4S in October 2013 in protest of the rms role in providing equipment and services to Israeli prisons and settlements.Announcing that the contract will now be terminated, union leaderLeif Sande told Norwegian newspaper Klassekampen thatthe move was taken as an act of solidarity with the struggle of the Palestinian people.

University of Bergen drops G4S due to reputational damage


In November 2013, the University of Bergen chose not to use G4S as its security contractor due to the rms role in the Israeli prison system and illegal Israeli settlements. G4S had initially offered a price that was around 2 million Norwegian krone ($340,000) cheaper than any of its competitors. The university ruled that hiring G4S would cause damage to the universitys reputation worth2.5 million Norwegian krone ($420,000).

10.  Palestinian prisoners in Israeli prisons


Since 1967 around 730,000 Palestinian men, women and children have been imprisoned by Israeli military courts. The majority of these prisoners have been held in custody inside Israel. This violates Article 76 of the Fourth Geneva Convention that forbids the transfer of prisoners from the occupied territories to Israel.47

Discriminatory legislation
Israel operates with discriminatory legal systems. Two different sets of laws apply for Israeli settlers and for Palestinians in the occupied territories. If an Israeli citizen living on the West Bank in an illegal settlement is arrested, the person has the right to appear before a court within 24 hours (or 48 hours in exceptional cases). Palestinians on the other hand can be held for 8 days before appearing before a military court.48 In its conclusions from March 2012, the UN Committee on the Elimination of Racial Discrimination expressed major concerns about the existence of two sets of laws and legal systems on the West Bank and East Jerusalem.49

Palestinian political prisoners


According to the Palestinian Human Rights and Prisoner Support organisation Addameer there were 5,935 Palestinian political prisoners in Israeli prisons in 2010.50 Palestinians are dened as security prisoners, regardless if they are charged for militant actions or political crimes, such as being a member of a banned political organisation or participating in non-violent demonstrations. 50

Administrative detention: Imprisonment without trial


The legal protection for Palestinians facing the Israeli authorities and military courts is very weak, and Palestinians that are taken into custody by Israeli authorities are subjected to systematic human rights violations. One example is Israels extensive use of administrative detention, meaning imprisonment without trial for up to six months at a time. Administrative detention allows the Israeli military to hold prisoners indenitely on secret evidence without charging them or allowing them to stand trial. According to the Association for Civil Rights in Israel (ACRI), a person can be placed in administrative detention for years without knowing what they are charged for, and without the opportunity to defend themselves. In August 2011 Israel was holding 270 Palestinians under administrative detention.  A person who doesnt know the details of the charges against him and who hasnt seen the evidence on which these charges rest, can only grope in the darkness he has no real opportunity to defend himself. The Association for Civil Rights in Israel (ACRI), The State of Human Rights in Israel and the OPT 2011  The UN Commission on Human Rights and the International Committee of the Red Cross have determined that administrative detention should only be used under exceptional circumstances. This is not the case in Israels treatment of Palestinian prisoners. The UNs General Secretary Ban Ki-moon said the following in May 2012 about Israels use of administrative detention: The prisoners must be charged and brought before the court with legal guarantees, or be released immediately..51

11. P  alestinian children in Israeli prisons


Palestinian children are subjected to human rights violations in Israeli prisons that G4S provides security systems to. In a report launched in March 2013 from UNICEF, the UNs childrens fund and worlds largest childrens aid organisation, abuse of detained Palestinian children is described as widespread, systematic and institutionalized. The report states further that UNICEF found examples of practices that are considered cruel, inhumane or degrading treatment or punishment in violation of the UNs Convention on the Rights of the Child and the Convention against Torture.52 According to Defence for Children International (DCI) in Palestine, around 7,500 children, some as young as twelve years old, have in the last eleven years been arrested, interrogated and imprisoned in Israeli. This amounts to 500 700 children per year, averaging 2 children per day.53 BTselem says that only one of the 853 cases between the years 2005 and 2010 involving Palestinian minors charged for stoning ended with no prison sentence.54 Even though the age of criminal responsibility in Israel and the Palestinian territories is 12, there are cases of children below this age that have been arrested and detained. In Mai 2011 Haaretz reported on the detention of a 7 year old boy from Silwan.55 According to DCI children in Israeli prisons are often interrogated without a lawyer or the family present, and threatened or forced physically to confess and sign documents in Hebrew they do not understand.56 According to testimonies gathered from 311 children that have been held in military detention, 75% of the Palestinian children that had been arrested reported that they experienced physical violence during detention.57 The Israeli human rights organisation BTselem interviewed 50 Palestinian children that had been arrested by Israeli authorities. 30 of the 50 had been arrested in the middle of the night, and were not allowed to be accompanied by their parents. 19 of the children said they experienced violence and intimidation during interrogations, and 23 said they were deprived basic physical needs such as food, water and access to the toilet.  During my whole interrogation, the interrogator did not let me go to the bathroom, even though I really had to go. They didnt bring me food, or even water. I was really tired from the interrogation and from being beaten. So I preferred to tell the interrogator that I did throw stones in 2007. Then he ordered me to sign my confession. I signed a paper that was written in Hebrew. I didnt know what it said. At the time, I just wanted to put an end to the interrogation and the beatings, especially since it was the rst time Id been arrested.

12. Professor Hjalte Rasmussens report


G4S engaged Hjalte Rasmussen, Professor of International Law at Copenhagen University, to provide a legal opinion about the companys activities on the West Bank.58 In January 2011 Rasmussen submitted a report on G4S contribution to the illegal Israeli occupation and settlement policies. He concluded that there were no grounds to regard G4S or its employees as criminally liable in aiding the maintenance of settlements, and that the mere presence of the company is not enough to justify war crime charges. Rasmussens report was widely criticised in Denmark.59 General Secretary of Amnesty Denmark had the following to say on the matter to the newspaper Kommunen;  A serious case like this requires more thorough on the ground observations than what Hjalte has made here. Were talking major errors. General Secretary of Amnesty Denmark, Lars Normann Jrgensen.60

Rasmussen writes that the maintenance of settlements in occupied territories does not result in nancial losses to the local population and the occupied state. A fact-nding mission for the UNs Commission on Human Rights recently published a report that concluded that the settlements are directly responsible for a long list of human rights violations against Palestinians, and that the settlements directly contribute to undermining the Palestinian economy.61 Rasmussen also writes that he nds no information to support the claim that systematic abuse of some prisoners in Israeli prisons takes place, or that abuse in certain prisons exists.62 As shown in previous chapters, numerous Human Rights organisations have documented systematic torture and abuse of Palestinian prisoners in Israeli detention.63 The Danish paper Berlingske Tidende wrote on the 8th of March 2011 that Rasmussen exclusively used information accessed from G4S and Hashmira. Rasmussen did not visit any Israeli prisons, nor contacted any human rights organisations with knowledge of the conditions of Palestinian prisons in Israel prisons64 Rasmussen states that Israeli control posts at the border crossings have the sole purpose of controlling the outer borders of the occupied territories.65 This is not true. 85% of the so-called separation barriers route is built on Palestinian territory. In an advisory statement in 2004, the International Court of Justice expressed great concern that the building of the wall leads to the annexation of larges areas on the Palestinian side, and conscation and destruction of Palestinian land and resources.66 According to BTselem there were 35 checkpoints in February 2012 that functioned as part of the wall.67 Many of the checkpoints located on Palestinian territory along the route of the wall, are supplied with security equipment from G4S68

Rasmussen writes G4S activities on the West Bank do not contribute to the maintenance of the Israeli settlements in occupied territories. He maintains that the contribution or inuence from G4S on the Israeli settlement policies is minor, as the company provides services to post ofces, educational institutions, schools and kindergartens. We disagree, and argue that Rasmussen underestimates the signicance of G4S activities on the West Bank. By offering these services to central social institutions in the settlements, G4S contributes to the infrastructure required for Israel to succeed in its expansive settlement policies. The UNs investigation committee mentions the supply of services and materials that contribute to the maintenance and existence of the settlements, as examples of the companys activities in the occupied areas that are the cause of specic human rights concerns.69
