MINISTRY OF ENVIRONMENT AND FORESTS NOTIFICATION New Delhi, the 14th September, 1999 S.O. 7 !"E#$% Whereas a draft notification containing rule (3) of rule 5 of the Environment (Protection) Rules, 198 under the notification of the !overnment of "ndia in the #inistr$ of Environment and %orests num&er '()( *53(E) dated ++nd #a$, 1998 inviting o&,ections and suggestions from all -ersons li.el$ to &e affected there&$, &efore the e/-ir$ of the -eriod of si/t$ da$s from the date on 0hich the co-ies of the !a1ette of "ndia containing the said notification are made availa&le to the -u&lic2 3nd, 0hereas, co-ies of the said !a1ette 0ere made availa&le to the -u&lic on the same date2 3nd, 0hereas, the o&,ections and suggestions received from the -u&lic in res-ect of the said draft notification have &een dul$ considered &$ the 4entral !overnment2 Whereas it is necessar$ to -rotect the environment, conserve to- soil and -revent the dum-ing and dis-osal of fl$ ash discharged from coal or lignite &ased thermal -o0er -lants on land2 3nd, 0hereas, there is a need for restricting the e/cavation of to- soil for manufacture of &ric.s and -romoting the utili1ation of fl$ ash in the manufacture of &uilding materials and in construction activit$ 0ithin a s-ecified radius of 155 6ilometers from coal or lignite &ased thermal -o0er -lants2 3nd, 0hereas, the 7on8&le 7igh 4ourt of 9udicature, )elhi vide its order dated +5th 3ugust, 1999 in 4WP :o( +1*5;99 < 4entre for Pu&lic "nterest =itigation, )elhi v;s >nion of "ndia directed that the 4entral !overnment to -u&lish the final notification in res-ect of fl$ ash on or &efore + th ?cto&er, 19992 :o0, therefore, in e/ercise of the -o0ers conferred &$ su&-section (1), read 0ith clause (v) of su&section (+) of section 3 and section 5 of the Environment (Protection) 3ct, 198 (+9 of 198 )2 and in -ursuance of the orders of the 7on8&le 7igh 4ourt, )elhi stated a&ove, the 4entral !overnment here&$ issues the follo0ing directions 0hich shall come into force on the date of the -u&lication of this notification, namel$<1 &'e () )l* +'h, b(tt(m +'h (r p(,- +'h i, the m+,.)+/t.re () bri/0' +,- (ther /(,'tr./ti(, +/ti1itie'$% (1) :o -erson shall 0ithin a radius of 155 6ilometers from coal or lignite &ased thermal -o0er -lants, manufacture cla$ &ric.s or &loc.s or tiles for use in construction activities 0ithout mi/ing at least +5 -ercent of ash (fl$ ash, &ottom ash, or -ond ash) 0ith soil on 0eight to 0eight &asis( ("3) Ever$ construction agenc$ engaged in the construction of &uildings 0ithin a radius of 55 to 155 6ms from a coal or lignite &ased thermal -o0er -lant shall use fl$ ash &ric.s or &loc.s or tiles or cla$ fl$ ash &ric.s or cement fl$ ash &ric.s or &loc.s or similar -roducts or a com&ination or aggregate of them in such construction as -er the follo0ing minimum -ercentage (&$ volume) of the total &ric.s, &loc.s and tiles, as the case ma$ &e, used in each construction -ro,ect, namel$<@ i( +5 -ercent &$ 31st 3ugust +55*2 ii( 55 -ercent &$ 31st 3ugust +5552 iii( A5 -ercent &$ 31st 3ugust +55 2 and iv(155 -ercent &$ 31st 3ugust +55A(

"n res-ect of construction of &uildings 0ithin a radius of 55 6ms, from a coal of lignite &ased thermal -o0er -lant the follo0ing minimum -ercentage (&$ volume) of use of &ric.s, &loc.s and tiles shall a--l$<i( 55 -ercent &$ 31 st 3ugust +55*2 ii( 155 -ercent &$ 31 st 3ugust +555( ("B)Che -rovisions of su& - -aragra-h ("3) shall &e a--lica&le to all construction agencies such as 7ousing Boards and those in the -rivate sector &uilders of a-artments, hotels, resorts and cottages and the li.e( "t shall &e the res-onsi&ilit$ of the construction agencies either underta.ing the construction or a--roving the design or &oth to ensure com-liance of the -rovisions of su& - -aragra-h (" 3) and to su&mit such returns as ma$ &e called for and com-liance re-orts to the 'tate !overnment or >nion territor$ 3dministration( (+) Che authorit$ for ensuring the use of s-ecified Duantit$ of ash as -er su&- -aragra-h (") shall &e the concerned Regional officer of the 'tate Pollution 4ontrol Board or the Pollution 4ontrol 4ommittee as the case ma$ &e( (+3) Che 4oncerned 'tate !overnment shall &e the enforcing and monitoring authorit$ for ensuring com-liance of the -rovisions of su& - -aragra-h ("3) (3) "n case of non availa&ilit$ of ash from thermal -o0er -lant in sufficient Duantities as certified &$ the said -o0er -lant the sti-ulation under su&--aragra-h (") shall &e suita&l$ modified (0aived ; rela/ed) &$ the concerned 'tate ; >nion Cerritor$ !overnment( (33) 3 decision on the a--lication for manufacture of fl$ ash &ric.s, &loc.s and tiles and similar other fl$ ash &ased -roducts shall &e ta.en 0ithin thirt$ da$s from the date of recei-t of the a--lication &$ the com-etent authorit$( 3 decision on consent to esta&lish the &ric. .iln shall &e ta.en &$ the Pollution 4ontrol Board or the Pollution 4ontrol 4ommittee as the case ma$ &e 0ithin a -eriod of thirt$ da$s from the date of recei-t of a--lication &$ it( (3B) "n case of non - com-liance of the -rovisions of su&--aragra-h (1) of -aragra-h 1, the com-etent authorit$, in addition to cancellation of consent order issued to esta&lish the &ric. .iln, shall move the district( administration for cancellation of the mining lease( (34) 3ll authorities sanctioning or rene0ing an$ land, soil or cla$ mining lease shall not grant such lease or e/tension of lease or rene0al to cla$ &ric., &loc. or tile manufacturing unit 0ithin a radius of 155 6ilometers of the coal or lignite &ased thermal -o0er -lant in cases 0here the manufacture does not mi/ a minimum of +5 -ercent &$ 0eight of fl$ ash or -ond ash in the manufacture of &ric.s or &loc.s or tiles( Che cancellation of mining lease shall &e decided &$ the district( administration after giving the holder of such lease an o--ortunit$ of &eing heard( Co ena&le the com-etent authorit$ to verif$ the actual use of ash, the thermal -o0er -lant shall maintain month-0ise records of ash made availa&le to each &ric. .iln( (3)) "t shall &e sufficient com-liance of this notification if 0ithin t0elve months from the date of issue of this notification, manufacturers of cla$ &ric.s, &loc.s and tiles located 0ithin a radius of 55 - 155 6ilometers of a coal or lignite &ased thermal -o0er -lant com-l$ 0ith the -rovisions of su& -aragra-hs (1) E (+) (*) Each coal or lignite &ased thermal -o0er -lant shall constitute a dis-ute settlement committee 0hich shall include the !eneral #anager of the thermal -o0er -lant and a re-resentative of 3ll "ndia Bric. and Cile #anufacturer8s %ederation (3"BC#%) for a re-resentative of &ric. .iln o0ner association federation grou-( 'uch a committee shall ensure unhindered loading and trans-ort of ash 0ithout an$ undue loss of time( 3n$ unresolved dis-ute shall &e dealt 0ith &$ a 'tate ; >nion Cerritor$ =evel committee to &e set u- &$ 'tate ; >nion Cerritor$ !overnment com-rising #em&er 'ecretar$ of the 'tate Pollution 4ontrol Board ; Pollution 4ontrol 4ommittee, re-resentatives of #inistr$ of Po0er in the 'tate ; >nion Cerritor$ !overnment and a re-resentative of 3"BC#% or a re-resentative of local &ric. .iln o0ners association, federation grou-(

(5) :o agenc$, -erson or organi1ation shall, 0ithin a radius of 155 6ilometers of a thermal -o0er -lant underta.e construction or a--rove design for construction of road or fl$ over em&an.ments in contravention of the guidelines ; s-ecification issued &$ the "ndian Road 4ongress ("R4) as contained in "R4 s-ecification :o 'P < 58 of +551( 3n$ deviation from this direction can onl$ &e agreed to on technical reasons if the same is a--roved &$ 4hief Engineer ()esign) or Engineer-in-4hief of the concerned agenc$ or organi1ation or on -roduction of a certificate of FPond ash not availa&leF from the thermal -o0er -lant(s) (CPPs) located 0ithin 155 6ilometers of the site of construction( Chis certificate shall &e -rovided &$ the CPP 0ithin t0o 0or.ing da$s from the date of ma.ing a reDuest for ash( ( ) 'oil reDuired for to- or side covers of em&an.ments of roads or fl$overs shall &e e/cavated from the em&an.ment site and if it is not -ossi&le to do so, onl$ the minimum Duantit$ of soil reDuired for the -ur-ose shall &e e/cavated from soil &orro0 area( "n either case, the to- soil should &e .e-t or stored se-aratel$( Goids created due to soil &orro0 area shall &e filled u- 0ith ash 0ith -ro-er com-action and covered 0ith to- soil .e-t se-aratel$ as a&ove( Chis 0ould &e done as an integral -art of em&an.ment -ro,ect 0ithin the time schedule of the -ro,ect( (A) :o agenc$, -erson or organi1ation shall 0ithin a radius of 155 6ilometers of a coal or lignite &ased thermal -o0er -lant allo0 reclamation and com-action of lo0 l$ing areas 0ith soil( ?nl$ -ond ash shall &e used for com-action( Che$ shall also ensure that such reclamation and com-action is done in accordance 0ith the &$e- la0s, regulations and s-ecifications laid do0n &$ the authorities mentioned in the su&--aragra-h (3) of -aragra-h 3( 2. Re'p(,'ibilitie' () Therm+l 3(wer 3l+,t' HEver$ coal or lignite &ased thermal -o0er -lant shall ta.e the follo0ing ste-s to ensure the utili1ation of ash generated &$ it namel$< -I (1) Ever$ coal or lignite &ased thermal -o0er -lant shall ma.e availa&le ash, for at least ten $ears from the date of -u&lication of this notification, 0ithout an$ -a$ment or an$ other consideration, for the -ur-ose of manufacturing ash-&ased -roducts such as cement, concrete &loc.s, &ric.s, -anels or an$ other material or a com&ination thereof for construction of roads, em&an.ments, dams, d$.es or for an$ other construction activit$( Hthe thermal -o0er -lants have to ensure availa&ilit$ of fair Duantit$ of ash to each user including &ric. .ilnsI( (+) Ever$ coal of lignite &ased thermal -o0er -lant commissioned su&,ect to environmental clearance conditions sti-ulating the su&mission of an action -lan for full utili1ation of fl$ ash shall, 0ithin a -eriod of nine $ears from the -u&lication of this notification, -hase out the dum-ing and dis-osal of fl$ ash on land in accordance 0ith the -lan( 'uch an action -lan shall -rovide for 35 -ercent of fl$ ash utili1ation, 0ithin three $ears from the -u&lication of this notification 0ith further increase in utili1ation &$ at least 15 -ercent -oints ever$ $ear -rogressivel$ for the ne/t si/ $ears to ena&le utili1ation of entire fl$ ash generated in the -o0er -lant at least &$ the end of the ninth $ear( Progress in this regard shall &e revie0ed after five $ears( (3) Ever$ coal or lignite &ased thermal -o0er -lant not covered &$ -ara (+) a&ove shall, 0ithin a -eriod of fifteen $ears from the date of -u&lication of this notification, -hase out the utili1ation of fl$ ash in accordance 0ith an action -lan to &e dra0n u- &$ the -o0er -lants( 'uch action -lan shall -rovide for +5 -ercent of fl$ ash utili1ation 0ithin three $ears from the date of -u&lication of this notification, 0ith further increase in utili1ation ever$ $ear -rogressivel$ for the ne/t t0elve $ears to ena&le utili1ation of the entire fl$ ash generated in the -o0er -lant( (*) 3ll action -lans -re-ared &$ coal or lignite &ased thermal -o0er -lants in accordance 0ith su&-aragra-h (+) E (3) of -ara + of this notification, shall &e su&mitted to the 4entral Pollution 4ontrol Board, concerned 'tate Pollution 4ontrol Board ; 4ommittee and concerned regional office of the #inistr$ of Environment and %orests 0ithin a -eriod of si/ months from the date of -u&lication of this notification(

(5) Che 4entral and 'tate !overnment 3gencies, the 'tate Electricit$ Boards, the :ational Chermal Po0er 4or-oration and the management of the thermal -o0er -lants shall facilitate in ma.ing availa&le land, electricit$ and 0ater for manufacturing activities and -rovide access to the ash lifting area for -romoting and setting u- of ash-&ased -roduction units in the -ro/imit$ of the area 0here ash is generated &$ the -o0er -lant( ( ) 3nnual im-lementation re-ort -roviding information a&out the com-liance of -rovisions in this notification shall &e su&mitted &$ the 30th da$ of 3-ril ever$ $ear to the 4entral Pollution 4ontrol Board, concerned 'tate Pollution 4ontrol Board ; 4ommittee and the concerned Regional ?ffice of the #inistr$ of Environment and %orests &$ the coal or lignite &ased thermal -o0er -lants( 2A. &tili4+ti(, () Fl* +'h )(r re/l+m+ti(, () 'e+ 'u&,ect to the rules made under the Environment (-rotection) 3ct, 198 , (+9 of 198 ) reclamation of sea shall &e -ermissi&le method of utili1ation of fl$ ash( ! Spe/i)i/+ti(,' )(r .'e () +'h % b+'e- pr(-./t' 1( #anufacture of ash-&ased -roducts such as cement, concrete &loc.s, &ric.s, -anels or an$ other material or the use of ash in construction activit$ such as in road la$ing, em&an.ments or use as landfill to reclaim lo0 l$ing area including &ac. filling in a&andoned mines or -itheads or for an$ other use shall &e carried out in accordance 0ith s-ecifications and guidelines laid do0n &$ the Bureau of "ndian 'tandards, "ndian Bureau of #ines, "ndian Road 4ongress, 4entral Building Research "nstitute, Roor.ee, 4entral Road Research "nstitute, :e0 )elhi, Building #aterials and Cechnolog$ Promotion 4ouncil, :e0 )elhi, 4entral Pu&lic Wor.s )e-artment, 'tate Pu&lic Wor.s )e-artments and other 4entral and 'tate !overnment agencies( +( Che 4entral Pu&ic Wor.s )e-artment, Pu&lic Wor.s )e-artments in the 'tate ; >nion Cerritor$ !overnments, )evelo-ment 3uthorities, 7ousing Boards, :ational 7igh0a$ 3uthorit$ of "ndia and other construction agencies including those in the -rivate sector shall also -rescri&e the use of ash and ash-&ased -roducts in their res-ective schedules of s-ecifications and construction a--lications, including a--ro-riate standards and codes of -ractice, 0ithin a -eriod of four months from the -u&lication of this notification( (+3) 3ll agencies including Pu&lic Wor.s )e-artment and 'tate !overnment agencies concerned 0ith utili1ation of fl$ ash for construction -ur-oses shall, 0ithin three months from the 1 st da$ of 'e-tem&er, +553 ma.e -rovisions for the use of fl$ ash and fl$ ash &ased &ric.s, &loc.s or tiles or aggregates of them in the schedule of a--roved materials and rates( (+B) 3ll agencies underta.ing construction of roads or fl$ over &ridges including #inistr$ (of Road Crans-ort and 7igh0a$s (#?RC7), :ational 7igh0a$s 3uthorit$ of "ndia (:73"), 4entral Pu&lic Wor.s )e-artments (4PW)), 'tate Pu&lic Wor.s )e-artments and other 'tate !overnment 3gencies, shall, 0ithin three months form the 1st t da$ of 'e-tem&er, +553 a( ma.e -rovisions in their tender documents, schedules of a--roved materials and rates as 0ell as technical documents, including those relating to soil &orro0 area or -its as -er su& - -aragra-h (A) of -aragra-h 12 and &( ma.e necessar$ s-ecifications ; guidelines for road or fl$ over em&an.ments that are not covered &$ the s-ecifications laid do0n &$ the "ndian Road 4ongress ("R4)( 3( 3ll local authorities shall s-ecif$ in their res-ective &uilding &$e - la0s and regulations the use of ash and ash - &ased -roducts and construction techniDues in &uilding materials, roads, em&an.ments or for an$ other use 0ithin a -eriod of four months from the date of -u&lication of this notification(
