Robert Raburn BART shared information about the MacArthur Transit Oriented Development (TOD) project. A ceremony will take place on October 25 as a ground breaking for ninety of the affordable units at MacArthur TOD Village. Bridge Housing is the partner. Over 500 units will be offered at market rate rentals. 450 parking spaces will be made available which is 84% of the current parking load. There will be retail in a further phase of the project. Robert would like to see a transit element included in BARTs participation in the BID renewal, with the objective of increasing ridership. Could the free shuttle be extended to the district? That should be under consideration, according to Robert. How do we connect MacArthur to Temescal? Robert confirmed that BART parcels are on a long-term lease to Bridge Housing. They still belong to BART. Thus Jeff Ordway

in Real Estate, who answers to Robert Powers, would be responsible to authorize participation in the BID, during the petition and ballot phase, just as Jeff as done in other BIDs, such as Richmond and Jack London, both enthusiastically endorsed by BART. Meana Sandhu, guest from the City Attorneys office discussed the graffiti ordinance passed this year. The new graffiti ordinance provides more options to go after offenders. Oakland BIDs can file a civil action against an offender directly through the District Attorneys office under the new law. Photos can be utilized. But the stopgap is the DA hasnt been prosecuting graffiti/vandalism cases. Ms. Sandhu recognizes that the graffiti ordinance requires more follow up to ensure evidence such as video, is reviewed for prosecution. Illegal dumping is in a separate ordinance from that of the graffiti ordinance. Greg Minor is finalizing the illegal dumping ordinance. If dumping more than 3 cu ft, its a felony. Action: Randy will contact Ms Sandu regarding the video of the woman who vandalized his store and that has been all but ignored by OPD for prosecution.

ORGANIZATION BID Renewal Replies from the expansion area indicate about a 20% weighted support versus 3% opposing and 78% non-response. Well review the final figures at our 10/3 meeting to decide whether to proceed forward to include the expansion area. DESIGN & ECONOMIC DEVELOPMENT Obelisk at 5225 Shattuck Structural engineering drawings have been finalized. We will start getting bids for actual construction. Mosaic Trash Cans Most recent bicycle can is located at Spoke Cyclery at 6124 Tele. 26 cans have now been completed. Darlene will send out one last email for interest to sponsor last 12 cans. Requesting paint donation from Kelly Moore to begin painting can doors and adding logo. Talking to Keep Oakland Beautiful so this round we receive due consideration for $1,000 grant. In addition to bike corral at Pizzaiolo, another has been requested by Juhu Beach Club. Temescal Plaza will install two security cameras 9/9. Plans include interfacing other merchants with cameras through Google Plus. Looking at a similar pilot program for the Frazee building. Contacted Bevmo and they are not interested in considering the Frazee building as an option for one of their stores.

Taste of Temescal sold out, raised about $10,000; at October meeting well distribute checks! Temescal Trick or Treat coming up Thursday, Oct. 31.

SECURITY & CLEANLINESS


Merchant Meeting on Wed. 9/11 at Marc 49 was well attended by over 20 merchants. Cptn Toribio responded to concerns about the most recent increase in crime. Even though police academy cadets are graduating at a higher rate than in the past, OPD remains understaffed. Cameras are highly encouraged and touted by OPD. Private security is being considered by both residents and merchants. Held Security Task Force meeting 9/4 and reviewed existing conditions. Interfacing with NCPC and reigniting neighborhood watches were offered as one of many strategies. Task Force will reconvene 10/2 to review BID budget and offer recommendations to Board for October meeting. Eddie Simlin, Merchant Watch Coordinator, will attend next Merchant meeting

b. Bevmo, do we want to endorse? Darlene reported that she spoke to BevMos senior VP for real estate. They are not planning to pursue the Frazee property at this time or in the future. Therefore our endorsement is irrelevant. c. Planters, what are we going to do about dying plants? DE/ED committee met with Peralta Corporation. Planter maintenance will be handled by Peralta Services to include watering. We hope this consolidation will provide more consistency in planters livelihood. 3. New Business a. Proposed pilot project for cameras at Frazee. Roy pointed out there is the problem of robberies, muggings, burglaries, etc. OPD isnt helping so were on our own. Since BID was formed, weve considered security patrols but recoiled due to the prohibitive cost. It would wipe out our annual budget within months. We received advice from a security consultant and determined adding lighting and other streetscape improvements for target hardening purposes to be a better use of our funds. Roy talked to Frazee owner, Mark Borsuk, about installing cameras to catch the graffiti culprits. Temescal Plaza installed cameras two weeks ago. We can at least see the culprit to provide evidence if the City of Oakland can do its job to prosecute. Security patrol costs $27 an hour. Esqueleto, Mixing Bowl, Dona Tomas, and Temescal Alley merchants will pay for a week $1,500. 18 merchants for $100, 11 pm to 6 am. The merchants feel like theyre being cased and theres one group of culprits. Doughnut Dolly and Esqueleto are installing cameras. Under consideration, to provide more security includes cutting back sidewalk sweeping from 5 days to 3 days. Other considerations include focusing on immediate patrols versus cameras which are deterrent, but you cant prosecute! We need to go to Councilmember to advocate for prosecution of criminals by district attorneys. Motion: Give Executive Committee authority to identify $5,000 from the current year budget to provide matching funds for short term patrols, cameras, or a combination thereof. Total of

matching grants will not exceed $5,000.Motion was seconded and approved unanimously. Discussion: John Dobrovich will attend EC meeting and bring camera proposal to request matching funds for two cameras. Submitted respectfully,
