TENDER Having examined the Invitation To Bid (ITB) and all documents referred to therein and attached thereto, the Site, and having considered all factors affecting the Works, we offer to furnish sufficient and competent construction management, supervisor(s), qualified and experienced labor, materials, equipment, tools, facilities, services and the like, to construct, complete and maintain the whole of the said Works in conformity with the said conditions of Contract, Scope of Works and Specifications for the total amount of:

(Thai Baht), which is broken down for comparison purposes under Article 2 of this Form of Proposal. All unit and hourly rates and amounts exclude Value Added Tax (V.A.T.) and are in Thai Baht and are firm and fixed for the duration of the Contract. We have completed all items in the Form of Proposal and the Price Schedule document attached to it. We understand that planning and progress of the Works are of essential importance. We confirm, if we are awarded the Contract, we will commence and complete the Works on the dates as expressed in your ITB. 2. PRICE BREAKDOWN

We have quoted herewith prices for each element of the work as described in the Scope of Works, construction specifications, drawings etc. We have also completed the breakdown of labor and materials costs, together with man-hours for tender evaluation purposes.

By submission of this proposal, we warrant that the prices in the proposal have been arrived at independently, without consultation, communication, agreement or understanding for the purpose of restricting the competition, as to any matter relating to such prices, with any other contractor or with any competitor. We understand that you are not bound to accept the lowest proposal or any proposal that you may receive. We agree to bear all costs incurred by us in connection with the preparation and submission of this proposal whether or not successful and to bear any further costs incurred by us prior to award of any Contract irrespective of whether such Contract is awarded to ourselves or not. Unless and until a formal agreement is prepared and executed, this proposal together with your written acceptance thereof shall constitute a binding contract between us. 2.3.2 DECLARATION In submitting this proposal, we confirm that we have carefully examined and understood the ITB and all documents referred to therein and attached thereto concerning indemnification of OWNER and we agree to execute the Works. Furthermore, we agree to execute the Works for the rates and amounts, stipulated in the proposal, immediately when OWNER notifies us, that we have been awarded the Contract. 3. VALIDITY We confirm that our proposal remains valid for acceptance by OWNER for a period of ninety (30) days after the proposal submission date.

We understand that OWNERs tentative planning calls for the Works to start on 15/ December/ 2013 and will be completed on 30/ March/2014. We understand that planning and progress of the Works are of essential importance. We confirm, if we are awarded the Contract, we will commence and complete the Works on the dates as per item 1 above.
