Certified Emergency Professionals __________________________________________________________________ To Luke Laughlin From: Joshua Barkley, ICEP President RE: your questions and your answers Your Question: How about the part time employees making more than full time? Even if full time employees opt out of all benefits our pay does not change? 1) The ICEP has no control over mandating any content in any contract 2) The financial proposal that was proposed to you, you voted down and it included financial elements 3) The part-time Firefighters caused our membership great damage and the ICEP did what we could. To that end, we brought in almost $2 million dollars to the members of ICEP and it was paid in July of 2012. You apparently have not been employed here long enough to get the pay-out on that. However, some of the people in your very own station got paid handsomely from the ICEP settlement and it amounted to over 36 grand just among the employees at 606 and their affiliates. As to your specific situation, you paid no dues and participated in no union activities yet you asked for and received representation for a hostile situation that you were encountering. I personally represented you with those problems and several others that alluded to the same situation. As your workplace continued uninhibited and repaired, mine was not and I personally paid a steep price for representing those cases. That case now sits at the Arizona Attorney Generals office. So lets compareThe ICEP has represented the employees for 8 years, 7 at no charge or dues. They got free representation for hundreds of discipline investigations, eight court cases at no cost, that came back favorably for the PMT employees, $2 million dollars in cash and insurance benefits (posted and deleted off of PMTs Coolest) and kept subcontracting from taking over an ambulance company formerly owned by the Phoenix Fire Union President Pat Cantelme.

Cantelmes alliances are clearly not with us and his bias is documented over a decade of reporting in the New Times Weekly, the NLRB and civil suits he filed against his own employees. What could have the IAEP done to stop them? What would they have done? So you can clearly tack on job protection for our employees for 8 years, and again, at no cost to you. So lets step back a minute. Your ICEP stewards are on the trucks here at PMT, yet your station mates are spearheading a drive for an outside Union from California that has no one in Arizona and knows nothing of our situation? Former ICEP Business Manager, Greg Empeys record (Station 606) appointed by Tony Lopez) 1) turned over employee documents to the CEO of PMT (John Wilson), 2) received over $8500.00 bucks in an ICEP settlement, 3) negotiated the discipline for union officers without notification to those officers. Outcomes were poor, 4) now is on a committee to bring in another foreign union with absolutely no record at PMT or Arizona. 5) ICEP represented Greg multiple times over the years and maintained his employment through grievances and representation.

Why are they attempting to install a less effective union? A union that is failing in northwestern Arizona in several places, with a union organizer that doesnt stay with any union long enough to see the job through?

Ask these questions to the IAEP.. 1) Why are you here? 2) Who brought you here and why? 3) What will you do for us when our jobs go to the Firefighters? 4) What will our pay be if we opt out of benefits? 5) Please show us any settlement that can match the record of the ICEP. We have to move forward until we are told not to anymore. The situation at hand was implemented by employee vote, demand and court order on their behalf. Why would they bring in a Union to remove all of that work? What if they are wrong?

While the employees fight in multiple different clicks and subsectors, the employer relishes in our disarray. This is not new strategy; it is as old as the labor movement itself. The ICEP is legally recognized and the IAEP is not. When the IAEP wins the vote, you will have an unrecognized union with no authority, what then? What court order or law do you have that the new union is allowed to deal with management on your behalfit doesnt exist. On a side notewe have learned to enjoy the moment, because the next hammer always comes and we have dealt with every one of them. Nothing lasts forever and the opportunity to destroy everything that has been accomplished is at your door. Its your door, do with it as you may. We dont get paid, so what do we lose? Why do we do this?
