THE JUDICIAL STANDARD AND ACCOUNTABILITY ABSTARCT The judiciary in this country has enjoyed so much respect in the past. It is considered to be the strongest pillar of democracy, but in the recent years have witnessed a vigorous debate about the working of our judiciary, including the higher judiciary. The non accountability of judiciary to any one has lead to the malfunctioning of judiciary and misusing its discretion. At one level, serious charges of corruption, nepotism and acquisition of assets disproportionate to known sources of income have been levelled against some members of the judiciary, raising concerns about the integrity and impartiality of our judicial system and processes. While these have undoubtedly damaged the high regard in which the judiciary is usually held, there is simultaneous appreciation that the judiciary is not only the last bastion for the citizen against state excess, arbitrary behaviour and apathy but also the ultimate guarantor and upholder of the Constitution and democracy. It is increasingly realized that the fearlessness of these judicial pronouncements is predicated on the constitutionally mandated judicial independence from the executive, which should in no instance be undermined. The collegium system of appointment of judges has also been criticized by the eminent jurist and ex judges on the ground of favoritism and biasness. The judicial standards and accountability is very important for the standard of behaviour by declaration of assets held by them and by providing a mechanism for making complaints against erring judges and for their investigation, and establishing the confidence and faith of the people in the judicial system without exposing them to unnecessary risk. The author in this paper will focus upon the working, freedom and accountability of judiciary. The author will also highlight that how the corruption in the judiciary hampers the working of the judiciary. The paper will also discuss the various aspects of the proposed judicial standard and accountability bill and its effect on the working pattern of the judicial system. The author in the paper will go through the comparative status of the judicial accountability in the various other nations. At last the author will sum up the paper by highlighting the pros and cons of the proposed bill and with some suggestion to counter the problem arising due to the bill in working of judiciary.
