NANCI L. MEEK’S RESPONSE TO ELIZABETH A MEEK’S SUPPLEMENTAL


RESPONSE TO PETITION FOR INSTRUCTIONS (FILED ON AUGUST 30, 2007

Nanci L Meek, acting in Pro se, and in her capacity as beneficiary and

previous named trustee of the decedent’s original 1996 Elvin R Meek Family

Trust do hereby respond as follows:

1) Nanci Meek hereby objects to the 1st Amendment, and the disregard with

which the Trustee and her attorneys have never produced the original.

Contrary to Elizabeth A Meek’s Response, the validity of the original first

amendment has always been challenged by Nanci Meek. Medical

evaluations of the record of Elvin Meek and affidavits have challenged the

1st Amendment. The document itself cannot be tested until the original is

produced. Elizabeth Meek still refuses to produce the original 1st

Amendment dated September 16 1997. The 1st Amendment as produced

by Robert Jones, Elizabeth A Meek’s previous attorney does not support

the 1996 Elvin R Meek Trust which made Nanci Meek the Trustee, it in

effect re-writes the entire trust and supports the 2nd Amendment which we

feel was fabricated and produced in a fraudulent manner by Robert Jones

and Elizabeth A Meek in an effort to dominate the trust and not adhere to

Mr. Meek, an attorney himself, and his last requests. Previously filed

affidavits by his long time friend Wes Stewart will support this.

2) Attorney's fees relate to a four year delay in producing an accounting,

and are due to trustee negligence. Depositing a million dollars with a

separate trustee five years later, after pressure from Nanci Meek, does

not relieve Elizabeth Meek of responsibility for the preceding five years,

including the Arkansas fraud. In addition, the trustee continues to refuse

to provide bank account information so that the accounting can be

tested. Elizabeth Meek should bear all costs and attorneys' fees for the

litigation, including reimbursement of those of Nanci Meek, since litigation

was required to obtain an accounting.

3) That all remaining funds (cash, real estate, bonds, insurance policies,

including all three Allianz annunities included in Mr Meek’s estate which

Mrs Meek in March of 2004 elected to change the beneficiary of 100% to

her daughter Lola Reklai (Meek) and her Granddaughter Merkll any and

all monies currently collected by Mrs Meek from the decedent’s three

rental properties (Waipuna, Island Colony, Hawaii Kai) and all monies

relative to the Elvin R Meek Family Trust 1996 be held in a freeze position

until such time the court will render a decision with respect to the validity

of the 1st Amendment in question.

4) Grant our original Petition for Instructions removing Elizabeth as Trustee

and appoint as substitute trustee, Nanci Meek, the original successor

Trustee of the 1996 Elvin R Meek Trust.

5) CONCLUSION

Based upon the foregoing, Nanci Meek respectfully requests that this

court grant her request to 1) Produce an original of the 1st Amendment

in question for Reed Hayes, forensics expert in Hawaii to evaluate as

well as agree the 2nd Amendment is invalid and grant our request for

any and all documents as per the First Request for Production of

Documents dated July 11, 2008 2) Reimburse Nanci Meek, beneficiary

and former Trustee for any and all attorneys fees and costs accrued

during the last 4 years as well as reimburse any and all travel

expenses and 3) In the interim and until such time as the validity of

the 1st Amendment can be established, place a hold on any and all

assets relative to the Elvin R Meek 1996 trust assets (including but not

limited to real estate, properties being held in escrow (Waipuna

#3405), rental monies from properties, stocks (including monies from

Union Bank Cal stock included in the 1996 Trust cashed in April of

2004 by Mrs Meek while representing herself as trustee of the 1992

trust, annuities, vehicles purchased after Mr. Meek passed away, and

all CD’s, bank accounts relative to the trust estate, as well as any

subsequent purchases of properties by Mrs. Meek with money from the

estate.
