Module 6 Disscussions

1.Identify the First Amendment clause upon which the United States Supreme Court based its decision. In Engel v. itale the Freedom and e!pression of religion clause of the constitution was what the Supreme Court used to base its decision. ".E!plain the Supreme Court#s decision in the case of Engel v. itale. In this court case the courts ruled that school sanctioned prayer in public schools were unconstitutional. $hey did this because not everyone shared the same religion and school% sanctioned prayer seemed to try and force religion on others. &ublic schools are also government financed and you need a separation of church and state.

Reply 1: Simple to the point answers. 'ou might need a little more e!planation of number

" though... (hy did they ma)e this decision*

Reply 2: I completely agree with you. ery well e!plained with +uotes from the

constitution.

1.Identify the First Amendment clause upon which the United States Supreme Court based its decision. $he First Amendment clause used by the Supreme Court in this decision as the freedom of e!pression, speech of the First amendment of the Constitution. ".E!plain the Supreme Court#s decision in the case of $in)er v. -es .oines. $he decision was for $in)er /%" saying that the armbands were a way of protest. $he armbands were also not distracting which made it way freedom of speech and protest.

Reply 1: 0icely e!plained. For some reason in a lot schools today you see the rebel flag

debate. Is it the same instance as this case*

Reply 2: I agree that the wearing of the wrist bands were a peaceful way to protest. I don1t

thin) it cause violence and is a good e!ample of your first amendment right.

1. 0ame the case and the doc)et number. 2I3E' v. CA3IF420IA -oc)et 0o. 15%15" ". Summari6e the issues in the case. $he issue of this case was whether or not the search and sei6ure of 2iley1s cell phone was

a violation of the Fourth amendment. $he court ruled that it was not a violation of the Fourth amendment because he was already being arrested for an e!pired licensed and they had to search to ma)e sure they had to search the car he was driving to ma)e sure everything was in there or for illegal contraband. 5. (hy does this case interest you* I debate with myself a lot on when is it right to search someone1s possessions. I find that there is a lot of illegal searches going on7 and I wanted to see the facts in this one. 8. If you were on the court7 how would you decide this case* I would decide that it is not a violation of the Fourth amendment. I thin) this because he was already under arrest. $he biggest reason I thin) that it was not a violation was the 9:ood Faith 3aw9. $he officers were acting under good faith and not ;ust searching for trouble.

Reply 1: <a I was gonna pic) this case at first till I saw a different one I li)ed. Anyways I

only disagree on the capital punishment. It1s not because of what he did7 but because I am against the death penalty.
Reply 2: (ell this one is a tough one. I thin) that logically it was only one day late7 but

technically it was 9late9. $he +uestion that comes to my mind is why they were still using the :&S after the 1= days. (ould they have )ept using it past those ne!t few days.

I believe that 3>? was a good civil rights president. $he biggest reason being that he actually signed the Civil 2ights Act of 1@A8 instead of ;ust throwing it away. <e might have been the final piece of the pu66le7 but he was one of the most important. $he Civil rights Act ended segregation in public areas which was the biggest goal for the civil rights movement.

Reply 1: &resident 4bama was going to be my second choice. I see that he has indeed

done a lot for the civil rights community. It1s good to see his stance on some of these issues7 even if it1s not popular.
Reply 2: I )now that 3>? ended up signing the Civil 2ights Act of 1@A87 but he was only

the final piece of that pu66le. It1s good to see that when he became president that he didn1t ;ust throw it away.
