AUTHORIZING THE AMENDMENT OF CHAPTER 5,
'^ AFTf ICLE 27, SECTION 2, OF THE OAK LAND MUNICIPAL
CODE PROVIDING FOR AN INCREASE OF THE REAL
^ ESTATE TRANSFER TAX
WH EREAS, the City Council of Oakland adopted Chapter 5, Article 2 7 , of the
Oakland Municipal Code ("CMC") providing f or the taxation of transf ers of real property
within the boundaries of the City of Oakland; and
WH EREAS, the City wishes to increase the rate charged f or such transf ers; and

WH EREAS, Chapter 5, Article 2 7 , Section 5-2 7 .02 requires amendment in order
tcf clarif y the application of this tax to all transf ers, not specif ically exempted, whether or
not? made in exchange f or money;
The Council of the City of Oakland does ordain as f ollows:
Section 1, Section 5-2 7 ,02 is hereby amended as f ollows:
Sec. 5 -2 7 .02 IMPOSITION OF TAX . There is hereby imposed a tax on all
transf ers by deeds, instruments, writings, or any other document by which any lands,
tenements or other interests in real property located in the City of Oakland, are or is
granted, assigned, transf erred or otherwise conveyed to or vested in a transf eree, or
transf erees thereof , which shall be levied at the rate of (1%) ono and ono-quartor
porcont (1 .25%) one and one-half percent (1.50%) of the value of consideration.
Section 2 . This amendment becomes ef f ective upon passage.
