The Section 8 Housing
Act provide for the
Section 8 Rental
Assistance Program was
enacted as part of the
Housing and Community
Development Act of 1974,
which served as an
amendment to the U.S.
Housing Act of 1937.

DeKalb County Housing Authority and the Lithonia Housing Authority
have failed to achieve the major goals of the program as stated in
the manual such as:
Encourage participating families to exercise their rights under
freedom of choice housing.
Reduce areas of high minority concentration with very low-
income families.
Encourage affordable housing providers to rent decent, safe,
and sanitary housing to low-income families including housing
opportunities for elderly and disabled/handicapped persons.
Create, maintain and encourage programs that assist families
and help them become economically self-sufficient.
Provide timely monthly rental assistance payments as
incentives to private property providers to rent to participating
families in the DCHA rental assistance program.

HQS have been established to ensure minimum
acceptable levels for units such as toilets must be a
private flush toilet fastened to the floor, adequate
ventilation either from an operable window or an
exhaust fan, heating system capable of heating the
unit to a comfortable temperature in each room, unit
should not have any unvented room heaters that
burn gas, oil, or kerosene, no roaches or rodents
infestations, smoke detectors must work, exterior
doors must be reasonably weather tight and have a
permanent type of weather-stripping and threshold
that seals, etc.

emergency for a spider bite that
was infected that require the child
to receive IV antibiotic and a stay
in the hospital. Ms. Preston has
complained repeated about
infestation of roaches and spiders
and the need for professional
exterminators. She has also
complained about mold and other
problems. Please see personal

Tenant received a letter from the
Rushing Firm, LTD for termination of
lease dated June 18, 2004 for
violation of lease agreement section
(F) maintenance and services,
subsection (2). One of the
violations involves the heating
equipment. Ms. Preston asked
Atlanta Gas Light to inspect her
heating unit. The heating unit has
not operated correctly for over a
year. Atlanta Gas Light documented
that the heating unit must not be
turned on until the conditions
indicated have been corrected such
as improper vent and appliance in
bad order that need to be serviced
or replaced by a qualified
agency/person.

handle her legal affairs. When she
went to court for the eviction,
Lithonia Housing Authority had Ms.
James Judy sign the legal
document for eviction instead of
dealing with the person assigned to
handle her legal affairs. The fact
that Ms. James Judy was disabled
with a mental condition was not
stated in the court despite the
Lithonia Housing Authority having
full knowledge of such facts.

Tenant felt intimidated due to violation
of her right to privacy. She would
often complain about the severe
infestation of roaches and spiders to
the Lithonia Housing Authority. She
also complained about the mold.
When Ms. Griffie moved into the
Lithonia Housing Authority, she was
told she could leave after one year.
However, she was threaten with the
lose of her Section 8 voucher if she
left the housing authority like many
other women living in the residence of
the Lithonia Housing Authority. She
was forced to live in deplorable living
conditions with her children.

Tenant felt intimidated and
deceived by management. She
has a very extensive file from
writing complaints to the Lithonia
Housing Authority about the
deplorable living conditions. Mrs.
Martha Calloway was very angry
with her for documenting the
problems. Ms. Howard wrote
letters to Ms. Betty Davis
complaining of the living
conditions and lack of repairs to
her apartments. The Lithonia
Housing Authority would use the
inspection process to threaten Ms.
Howard with termination several
times.

there being no court order.
They made reference to a letter
dated September 11, 2006 that
Ms. Howard never received.
The manner in which the
Lithonia Housing Authority has
utilized the eviction process is in
clear violation of HUD policy
and procedure as well as state
law.

Failed inspections and Re-inspection are the
responsibility of the owner to schedule with the
inspector.
If the unit fails the inspection, the owner must
schedule a re-inspection with the inspector after
the necessary repairs have been completed.
After the residents brought attention to the
deplorable living condition, DeKalb and Lithonia
Housing Authority changed this policy.
The failed inspections were unfairly used to evict
residents especially if they were viewed as
troublemakers. (Page-33)

Tenant felt intimidated because she
repeatedly requested to relocate to an
area in Clarkston to be near other
people from her country for added
support with her family. Lithonia
Housing Authority made it clear to her
that she would lose her assistance if
she moved to another location. She
was forced to live in a one-bedroom
apartment with three children. The
heating unit in her apartment was
dangerous and she had problems with
flooding when it rained. Ms. Yusuf
appeared at the DeKalb County Board
of Commissioners meeting to voice
her problems to the public and now
worry about retaliation.

Lease Agreement states if a tenant leaves the
apartment unoccupied for a period of 30 days,
the unit will be considered vacated. Landlord
and the Public Housing Authority (PHA) must be
advised and approval given beyond the above
period of time.
