The Section 8 Housing
Act provide for the
Section 8 Rental
Assistance Program was
enacted as part of the
Housing and Community
Development Act of 1974,
which served as an
amendment to the U.S.
Housing Act of 1937.
DeKalb County Housing Authority and the Lithonia Housing Authority
have failed to achieve the major goals of the program as stated in
the manual such as:
Encourage participating families to exercise their rights under
freedom of choice housing.
Reduce areas of high minority concentration with very low-
income families.
Encourage affordable housing providers to rent decent, safe,
and sanitary housing to low-income families including housing
opportunities for elderly and disabled/handicapped persons.
Create, maintain and encourage programs that assist families
and help them become economically self-sufficient.
Provide timely monthly rental assistance payments as
incentives to private property providers to rent to participating
families in the DCHA rental assistance program.
Housing Quality Standards
(HQS) under the Section 8
program is designed to
ensure that the owner
provides decent, safe,
sanitary and affordable
units. Basically, HQS is
established standards to
ensure the unit is in good
condition and it does not
endanger the health and
safety of the family.

HQS have been established to ensure minimum
acceptable levels for units such as toilets must be a
private flush toilet fastened to the floor, adequate
ventilation either from an operable window or an
exhaust fan, heating system capable of heating the
unit to a comfortable temperature in each room, unit
should not have any unvented room heaters that
burn gas, oil, or kerosene, no roaches or rodents
infestations, smoke detectors must work, exterior
doors must be reasonably weather tight and have a
permanent type of weather-stripping and threshold
that seals, etc.

It is illegal for anyone to threaten, coerce,
intimidate or interfere with anyone exercising a
fair housing right or assisting others who exercise
that right and advertise or make any statement
that indicates a limitation or preference based on
race, color, national origin, religion, sex, familial

Lynetrice Preston
Tenant admitted her child into the
emergency for a spider bite that
was infected that require the child
to receive IV antibiotic and a stay
in the hospital. Ms. Preston has
complained repeated about
infestation of roaches and spiders
and the need for professional
exterminators. She has also
complained about mold and other
problems. Please see personal
letters and documentation within
Ms. Prestons file. (Exhibit I

Lynetrice Preston
Tenant received a letter from the
Rushing Firm, LTD for termination of
lease dated June 18, 2004 for
violation of lease agreement section
(F) maintenance and services,
subsection (2). One of the
violations involves the heating
equipment. Ms. Preston asked
Atlanta Gas Light to inspect her
heating unit. The heating unit has
not operated correctly for over a
year. Atlanta Gas Light documented
that the heating unit must not be
turned on until the conditions
indicated have been corrected such
as improper vent and appliance in
bad order that need to be serviced
or replaced by a qualified
agency/person.

She and her four children
had no other place to go
to the bathroom. She
was later threatened with
eviction for exposing the
deplorable living
conditions at the Lithonia
Housing Authority.

handle her legal affairs. The fact
that Ms. James Judy was disabled
with a mental condition was not
stated in the court despite the
Lithonia Housing Authority having
full knowledge of such facts.

Tenant felt intimidated due to violation
of her right to privacy. She would
often complain about the severe
infestation of roaches and spiders to
the Lithonia Housing Authority. She
also complained about the mold.
When Ms. Griffie moved into the
Lithonia Housing Authority, she was
told she could leave after one year.
However, she was threaten with the
lose of her Section 8 voucher if she
left the housing authority like many
other women living in the residence of
the Lithonia Housing Authority. She
was forced to live in deplorable living
conditions with her children.

children to include a set of

apartment and her Section 8
voucher if she reports to the
health department again. Ms.
Austin felt threaten and stated she
has a right to call the health
department.

Tenant complained of the poor
heating system in the
apartment. She also
complained of the deplorable
living conditions. She reported
her daughter received first and
second degree burns from the
heating system that require
treatment at the DeKalb
Medical Center at Hillandale
Emergency Department.

Hutchins received a Danger
Slip from Atlanta Gas Light that
stated the appliance was in
bad order.
Lithonia Housing Authority sent
Ms. Hutchins an eviction notice
for having her gas utility turned
off.

evidence was presented in
court that the gas was on. It
was alleged that Lithonia
Housing Authority retaliated
against Ms. Hutchins for
bringing attention to the
deplorable living conditions.

2006. Initial pleading changed

Tenant felt intimidated and
deceived by management. She
has a very extensive file from
writing complaints to the Lithonia

deplorable living conditions. Mrs.
Martha Calloway was very angry
with her for documenting the
problems. Ms. Howard wrote
letters to Ms. Betty Davis
complaining of the living
conditions and lack of repairs to
her apartments. The Lithonia
Housing Authority would use the
inspection process to threaten Ms.
Howard with termination several
times.

The letter from the Lithonia
Housing Authority dated
September 27, 2006 stated Ms.
Howard had seven days to
vacate the premises despite
there being no court order.
They made reference to a letter
dated September 11, 2006 that
Ms. Howard never received.
The manner in which the
Lithonia Housing Authority has
utilized the eviction process is in
clear violation of HUD policy
and procedure as well as state
law.
Failed inspections and Re-inspection are the
responsibility of the owner to schedule with the
inspector.
If the unit fails the inspection, the owner must
schedule a re-inspection with the inspector after
the necessary repairs have been completed.
After the residents brought attention to the
deplorable living condition, DeKalb and Lithonia
Housing Authority changed this policy.
The failed inspections were unfairly used to evict
residents especially if they were viewed as
troublemakers. (Page-33)

Tenant felt intimidated because she
repeatedly requested to relocate to an
area in Clarkston to be near other
people from her country for added
support with her family. Lithonia
Housing Authority made it clear to her
that she would lose her assistance if
she moved to another location. She
was forced to live in a one-bedroom
apartment with three children. The
heating unit in her apartment was
dangerous and she had problems with
flooding when it rained. Ms. Yusuf
appeared at the DeKalb County Board
of Commissioners meeting to voice
her problems to the public and now
worry about retaliation.
Mrs. Yusuf and her
family escaped
death on December
18, 2006 when the
carbon monoxide
exceeded safe
levels. Atlanta Gas
Light turned off her
gas when the
temperature was
below freezing.
Atlanta Gas Light gave
Ms. Yusuf a Danger Slip
to explain the reason the
gas must be turned off.
The carbon monoxide at
the space heater
registered 11ppm.
Normal level is zero per
opinion of the local fire
department.

Authority to replace the

Yusuf was allegedly

Housing Authority staff for
calling WSB (Channel 2) and
Joyce McKibben.

resident to signed with
the Authorities gas
provider. If the residents
refused to use their
provider, they were
allegedly threatened with
eviction.
Due to the higher cost,
some residents were
allegedly evicted for
having their gas turned
off for lack of payment.
Joyce McKibben with the
Repertoire Community
Resource Center met with
Cynthia Johnson and Legal
Aid in an attempt to get the
resident access to the
regulated provider. Cynthia
Johnson was with the
Georgia Public Service
Commission.
After several meeting, Cynthia
Johnson and Joyce McKibben
were successful at bypassing
the agreement between
and the gas provider to offer
gas service to low income
residents from the regulated
provider at a cheaper price.
Research is yet complete to
assess if the Housing
Authority received monetary
compensation for the
agreement.
Voter were informed of
a HUD regulation that
mandates Housing
Authorities evict
residents if any of the
utilities are off.
As Community
Missionaries, we are
working hard to repeal
this regulation/rule.
The inspector will make sure
the number of bedrooms is
correct and that the rent is
appropriate for the unit size.
The inspector notes any safety
hazards along with defects or
deterioration such as peeling
paint.
The inspector is looking for the
unit to meet the basic level of
health and safety for all units
leased under the Housing
Choice Voucher. (Page-32)

Ethel Gibson
Mrs. Ethel Gibson was a
tenant who made every effort
to assist her next-door
neighbors that are an elderly
couple living in deplorable
conditions. Lithonia Housing
Authority would spray for
infestation in Ms. Gibsons
apartment and refuse to spray
the elderly couples apartment
next door.
Ethel Gibson
Ms. Ethel Gibson would use her own
money to buy roach spray to help with
the infestation of her elderly
neighbors. Ms. Gibson also made
verbal complaint about the two
apartments above her being empty
and going approximately a year
without being properly cleaned. She
felt this made the roach and spider
infestation worst.

Lease Agreement states if a tenant leaves the
apartment unoccupied for a period of 30 days,
the unit will be considered vacated. Landlord
and the Public Housing Authority (PHA) must be
advised and approval given beyond the above
period of time.
Lease Agreement extermination services and
repainting shall be provided by the landlord as
conditions may require.
We decided to ask the
Inspector General to research
the two apartments above

Street #1 to see if the Lithonia
Housing Authority continued to
collect federal funds while the
apartments were empty.
We requested an investigation
to verify if the actions stated
above is a constant practice of
the Lithonia Housing Authority
with the knowledge of a few at
the DeKalb County Housing
Authority.

documented
payments from HUD.

Voter Alliance in partnership with
the Repertoire Community
Resource Center have endured
verbal threats, negative
characterizations, intimidation,
retaliation, and interference to help
residents within the Section 8 and
Public Housing program receive
decent, safe, and sanitary housing.
We have had to endure verbal
insults while we attempt to
advocate for the poor and elderly
residents concerning the
deplorable living conditions at the
CEO Vernon Jones and
the DeKalb County Board
of Commissioners
appoint people to the
DeKalb County Housing
Authority Board.
DeKalb County Housing
Authority does Lithonia
Housing Authority
inspections. They also
provide funding for the
Section 8 & Public
Housing programs.
CEO Vernon Jones
Joyce McKibben and the
Unhappy Taxpayer and Voter
encouraged the residents of the
Lithonia Housing Authority to
speak at the public comment to
inform the people of the
deplorable living conditions.
DeKalb Board of Commissioners
stated they did not have any
jurisdiction over the Lithonia
Housing Authority.
After researching the money, the Unhappy Taxpayer and
Voter Alliance sent the DeKalb Board of Commissioners
a memo titled, Selective Jurisdiction: $78,750 for a for
profit business or nonprofit organization. The document
questioned the BOC contract to Jason Lary Presents in
Lithonia, Georgia; yet, DeKalb refused to get involve with
the deplorable living conditions at the Lithonia Housing
Authority. (Exhibit D Section A pages 1-7)
After the document was
given to the Board of
Commissioners, CEO
Vernon Jones allegedly sent
the memo to Jason Lary.
The Unhappy Taxpayer &
Voter was unable to get an
explanation from the Board
of Commissioners as to how
CEO Vernon Jones obtained
the document.
Jason Lary contacted Joyce
McKibben by telephone and
was screaming and cursing.
Joyce McKibben stated in her
letter that it is literally with fear
and trembling that she write
the letter.
Joyce McKibben contacted the
Unhappy Taxpayer and Voter
Founder Viola Davis to find out
why Jason Lary cursed her
out. Unfortunately, Ms.
McKibben had no knowledge
of the memorandum.
Joyce McKibben wrote a letter to document the threats
made by Jason Lary. (Exhibit D Section A-D)
Voter Alliance wrote a
memorandum to CEO
Vernon Jones and the
DeKalb County Board of
Commissioner asking
why CEO Vernon Jones
sent our document to a
private individual.

Anthony have filed a complaint against Martha Calloway and
the Lithonia Housing Authority due to constant episodes of
intimidation, harassment, and retaliation with the FHEO. They
submitted documentation to receive their Section 8 Vouchers to

The three Sisterhood of Survivor Founders received a 14
day termination letter from the Lithonia Housing Authority
despite the Housing Assistance Payment (HAP) paying the
rent on the same day of 1/9/07 for Barnes-Gibson, Preston,
and Anthony. Again, they submitted documentation to receive
their Section 8 Vouchers to relocate.
The three
women gave

Calloway a

Martha Calloway refused. Ms.
Anthony stated, Mrs. Calloway

years to bring attention
to the deplorable living
condition in an attempt
to resolve problems
with the Lithonia
Housing Authority.
Unhappy Taxpayer and Voter request
funding to the Lithonia Housing Authority be
cut completely and the residents living in the
deplorable living conditions receive their
Section 8 Vouchers to relocate to safer living
conditions and/or relocation to other public
housing units.
We request a full investigation of the DeKalb
and Lithonia Housing Authorities inspection
process and the negligent inspections that
cause the residents suffering.
The Unhappy Taxpayer and Voter Alliance
request a forensic audit of the Lithonia Housing
Authority operation budget, federal funds for the
Section 8 and Public Housing Program to verify
alleged mismanagement, fraud, etc.
HUD needs to revoke and/or terminate Lithonia
Housing Authority right to participate in the
Section 8 and Public Housing program due to a
long history and practice of non-compliance with
state and federal rules, regulations, and laws.
Reason for a forensic audit is to answer the
following questions:
How much money was allocated for repairs and
new appliances for the units at the Lithonia
Housing Authority?
Did Lithonia Housing Authority continue to
collect payments on the vacate apartments?
What happened to the large number of residents
unfairly and illegally evicted due to utilities being
turned off, lack of repairs, failure to comply with
Housing Authorities process, etc?
Under the False Claim Act, Unhappy
Taxpayer and Voter Alliance and the
Repertoire Community Resource
Center request the DeKalb and Lithonia
Housing Authority be held accountable to
the fullest extent of the law.
Inspectors who falsified reports need to be
fired from the Housing Authorities.
Federal Time for Fraud and False Claims
Unhappy Taxpayer and Voter request drastic
action for the following reasons:
Martha Calloway lied to HUD when she received
no request for the annual audit of the Lithonia
Housing Authority. We requested the annual audit
twice verbally despite having the police called on
us. We have included the request in writing on at
least two documents hand delivered to the

Unhappy Taxpayer and Voter Alliance gave DeKalb and
Lithonia an Open Records Request to view the Annual Audit
mandated by HUD and other documents/information. They
hand delivered the request to the office of the Lithonia Housing
Authority. In Mr. Bob Youngs letter, he suggested the Unhappy
Taxpayer and Voter submit an open records request.

Whos lying? Martha Calloway or Residents of
Mrs. Calloway stated one of the Board members
is a resident; however, Agnes Sanders left the
Board since 2/23/06 according to Lithonia City
Clerk and newly appointed member Charlotte
Sledge signed a document dated 1/9/2007 that
stated she was never informed nor attended a
Resident Advisory Board or Board of
Commissioners meeting. (See Exhibit G)

resident must be on the
Housing Authorities
Board.
Martha Calloway has
refused to answer our
open records request on
their budget, units, etc.
Section 8 vouchers used within Lithonia Housing
Authority were unfairly maintained through
threats, coercion, and intimidation in order to
pay the mortgage and salaries.
We have requested information on the Section 8
program for over one year, yet HUD and DeKalb
County Housing Authority are unable to provide
a written agreement between Lithonia and
DeKalb County Housing Authorities.
Housing Authority of
DeKalb County gave the
residents of the Lithonia
Housing Authority until
December 15, 2004 to
move if they did not want
there tenant based
voucher to change to a
project based voucher.
Unfortunately, the
document was dated
December 23, 2004.
The residents of the Lithonia Housing Authority endured
verbal threats, intimidation, coercion, and deplorable living
condition to hold on to their Section 8 Voucher. New
residents were told their vouchers were portable until they
lived in the apartments for one year then their vouchers
were changed to project based forcing them to stay in the
deplorable condition.
DeKalb and Lithonia Housing Authorities engaged in the
deception together to the detriment of the residents and
their families.
Mrs. Martha Calloway

decent and affordable
housing of their choice.
She changed their tenant
based vouchers to project
based vouchers without a
legal or clearly defined
rule and/or regulation
from HUD.
Housing Quality
Standards have been
circumvent through the
use of an inspection
system and inspectors
that passed housing that
clearly should have
failed. Every tax dollar
used to finance these
units needs to be repaid
back to the taxpayers and
voters due to negligence
and abuse of power.
Mrs. Martha Calloway, CEO of the Lithonia
Housing Authority, lack leadership allegedly for
the following reasons:
No viable resident on the Board of
Commissioners
No functional Resident Advisory Board
No Annual Audit report
A Board of Commissioners that was missing half
of its members
No constant scheduled public meetings
Mrs. Betty Davis, CEO of DeKalb County
Housing Authority, has leadership allegedly for
the following reason:
Successfully returned the authority to a high
performance agency by having an annual audit
Complete Board of Commissioners with
scheduled public meetings.
Resident on the Board of Commissioners
Functional Resident Advisory Board with a
Members Handbook.
Mrs. Martha Calloway
continues to be CEO
of the Lithonia
Housing Authority.
Mrs. Betty Davis was
fired from the DeKalb
County Housing
Authority.
What is wrong with

Call your elected officials and demand they change/repeal the regulation
and/or rule that mandates the Housing Authorities to evict families if their

Call your elected officials and demand they keep the Section 8 Vouchers
tenant based to prevent an increase in fraud and abuse of power.
