WAIVER AND INDEMNITY

AGREEMENT

THIS IS A LEGALLY BINDING DOCUMENT. PLEASE READ IT
CAREFULLY. If you do not understand any part of this Waiver and Indemnity
Agreement you should contact your lawyer prior to signing this.

Paintballing is a strenuous activity. The Undersigned is solely responsible to
consult their physician prior to engaging in such an activity. Emergency medical
help will not be immediately available due to the remote location of the obstacle
course.

WHEREAS the Undersigned is hereby requesting to engage in paintball activities
involving the use of paintball guns and ammunition, and in most cases the use of an
obstacle course located at SE 6-41-23 W2;

AND WHEREAS the Undersigned acknowledges and is aware that the Released
Party has no insurance coverage, and that liability is not assumed by the
Released Party for any injuries or death that may be sustained by the
Undersigned while being involved in any activity related to the use of the
paintball guns and ammunition, and /or obstacle course.

PAINTBALLING IS INHERENTLY DANGEROUS AND CAN RESULT IN
DEATH OR SERIOUS INJURY. THE UNDERSIGNED IS FREELY
AGREEING TO ENGAGE IN THIS DANGEROUS ACTIVITY AT THEIR
OWN RISK.

THERE ARE DANGERS FROM THE OBSTACLE COURSE AND LAND
UPON WHICH THAT COURSE IS LOCATED. AMONG SUCH DANGERS
ARE SLOUGHS, BUSHES, POISONOUS PLANTS AND INSECTS, AND
PILES OF SCRAP METAL/ OLD MACHINERY. THESE DANGERS MAY

CAUSE DROWNING, WATER BORNE ILLNESSES, ALLERGIC
REACTIONS, HEALTH PROBLEMS, DISCOMFORT, AND DEATH.

NOW THEREFORE in consideration of the Released Party allowing the
Undersigned to participate in the use of paintball guns and ammunition, and if
applicable, the use of the obstacle course, the Undersigned agrees as follows:

1. To forever release and discharge the Released Party, his employees,
agents/and assigns, and the owner of SE 6-41-23 W2 from any liabilities,
claims, demands, causes of action, proceedings, damages, or costs that may
arise from: the use of paintball guns and ammunition; the use of the obstacle
course; any latent or other defects in any equipment used; and, negligence by
the Released Party. This Indemnification Waiver of liability extends to any
liability whatsoever, in regard to participation in paintballing or any
equipment or apparatus used for this purpose;

2. To be responsible for any damage caused from participation. Including but not
limited to financial responsibility for the equipment rented to me;

3. To have this Waiver and Indemnity Agreement binding upon the Undersigneds,
heirs, executors, administrators, assigns, and estate;

4. To not enter into any slough or body of water, leave the boundary of the obstacle
course, or climb on or under any scrap metal or old machinery;

5. To not fire a paintball at a person who is not properly wearing their facemask or is
not prepared for a potential hit by a paintball. To not continually fire at a player
who has clearly indicated a desire to surrender. To not physically contact other
users of the obstacle course, aside from hitting them with paintballs at permitted
times;

6. To only put paintballs into the paintball gun;

7. To not disassemble or modify the gun in any way. To not adjust the setting of the
paintball gun for the speed or distance it is set to shoot;

8. To not shoot at any vehicle or living animal;

9. To not bring alcohol or illicit drugs to SE 6-41-23 W2, and further, to not
participate in this activity if the Undersigned has consumed alcohol or illicit drugs
within the 8 hours proceeding such participation. To not smoke any substance or
use lighters/ matches on the obstacle course;

10. To use any supplied equipment, such as masks and guns, according to the manual
and instructions regarding use that are supplied by the manufacturers of the same.
To this extent, the Undersigned acknowledges being given the opportunity to

read such manuals and instructions, namely the FT-12 Owners Manual
and Vent Lens Manual. The Undersigned agrees to keep their masks on properly
whenever in an area that they could be hit by a paintball, and engage the safety on
the gun at all times that the Undersigned is not on the obstacle course; and,

11. To not engage in paintballing or the use of the obstacle course if in poor health or
have a pre-existing condition or ailment that would be worsened by engaging in
such activity.

As parent/ guardian for the Undersigned who is under the age of 18, I acknowledge I have
read the above Waiver and Release of Indemnity, and that I voluntarily agree on behalf of
myself and the Undersigned to the above Waiver and Release of Indemnity in its entirety,
which includes the surrender of valuable rights.
