I am writing this ban appeal on behalf of Nomis1407.
Having convinced him to create a ban
appeal on the forums, I reached the obstacle of getting him logged in to the forums. For an approximate sum of one hour, I attempted to help him log on to the forums, but I finally left the Skype call out of frustration. The first struggle was in realizing that he did not at all know his forum account password. After eventually giving up on that endeavour, I asked him to create a new forum account. I painfully walked him through every step, but when it came to the email verification process, Nomis could not log in to his email since he had forgotten the password to that as well. In an attempt to find his password, he asked me what his account password was several times, to which I continually responded that I did not, obviously, know. This incredibly tedious process led to my giving up on attempts to help him that day.
I have always had suspicions that Nomis1407 suffers from a learning disability, but this event confirmed them. At times, he shows no abnormal behaviour, but there are moments that clearly suggest that he has a disability. The clues range from his diminished ability to spell and read to his inability to understand certain concepts most notably, how a password works. After some careful consideration, I believe that given his condition, it would be fair that I write this appeal for him because I genuinely feel badly for him. Realistically, I do not believe he could ever have written such an appeal with any degree of sense.
After speaking with several individuals, namely Qdpal, Immage, criptingwalk, and of course Nomis1407 himself, I believe that I have somewhat come to a conclusion regarding what had happened.
Ash, on his account, was banned for DDOS threats. Upon receiving the ban, he had asked Nomis1407 for an alternate account. Nomis had given him the password in a Skype group call which involved at least the following members: Cript, Immage, Qdpal, and Ash. Though Nomis's action was negligent, I do not believe that he could genuinely have known that Ash would get him banned; nor would he have wanted to be banned from a $100 God account. Ash was Nomis's friend, and he used this trust to exploit Nomiss naivety and take his account. Based on his perceived learning disability, I do believe that it is reasonable to believe that Nomis could not form the necessary intent to believe that Ash would exploit his trust in him.
The fact that Ash was on Nomis's account can be proven given that they had separate IP addresses, thereby allowing Nomis to play on other accounts that he had. However, after someone realized that this was Nomis on the alts (the account, not the person Nomis, though unbeknownst to this person), I believe zepop banned him, denying him access to the server on all of his alts. Even if you do not accept the idea that Nomis could not have reasonably perceived that giving away his password would result in such consequences, he should not be banned on his alternate accounts as they were not also controlled by the actual person or IP address who had committed the banned act.
Finally, I have gone over with Nomis why he should not give his password away. To prevent anyone with whom he had shared a password from gaining access again, I walked him through the process of changing his password. Therefore, I do not believe that this incident should occur again with Nomis, making a ban on his accounts pointless.
